The Unintended Consequences of Affordable Housing Quotas METRO COUNCIL recently passed an ordinance that will make Nashville’s current

affordable housing situation worse. The ordinance – #BL2015-1139 – sets the goal of setting aside 14 percent of the units in all new or renovated residential real estate in Nashville/Davidson County as “Affordable Housing” or “Workforce Housing,” which means they must be rented or sold at below-market rates. While it may sound like an attractive idea to simply make Nashville’s affordable housing issues disappear by councilmatic decree, the reality is anything but attractive. Proven, well-established economic principles show that establishing “affordable housing” quotas – a practice also known as “inclusionary zoning” – results in less affordable housing and higher housing costs for everyone. Let’s examine why these unintended consequences are inevitable: Call To Action For Members! Decades of experience with rent control, which is another name for inclusionary zoning, have shown that it leads to underproduction of the units that are regulated and inflated prices for the units that aren’t. As an example, a study by economists Tom Means and Edward Stringham found that “between 1980 and 1990, cities imposing below market housing mandates end up with 9 percent higher prices and 8 percent fewer homes overall. Between 1990 and 2000, cities imposing below market housing mandates end up with 20 percent higher prices and 7 percent fewer homes overall.” The Mayor’s Office of Economic and Community Development projects that 1 million people will move to Middle Tennessee in the next 20 years. Don’t Let an Online Payment Sabotage Your Eviction IT’S HARD TO IMAGINE an invention in our lifetimes that has

had a greater impact on the world and on business than the internet. Now with the almost total penetration of smartphones in our population, anyone can do almost anything from almost anywhere: Shopping, watching TV and movies, sending emails, banking, and paying rent. While the ability to pay rent from anywhere at any time certainly increases resident satisfaction and reduces non-payment issues, it does have at least one very important side effect that needs to be kept in mind. As we all know, the Tennessee Landlord Tenant Act indicates that if the landlord accepts “rent” without reservation and with knowledge of a tenant default, the landlord is prohibited from terminating the rental agreement as to that breach. “Rents” are defined in the Landlord Tenant Act as “all payments to be made to the landlord under the rental agreement.” Therefore, if you are aware of a tenant’s unauthorized boa constrictor pet and you accept and deposit a $35 payment for that tenant’s water bill, Tennessee law no longer recognizes your right to terminate tenancy due to the unauthorized pet. The rule we should all follow is this: If you are aware of a breach of the lease for which you expect to terminate tenancy and evict the tenant (including a non-monetary breach), any payments received must be accepted with reservations. When payment of rent was limited only to a tenant’s delivery of a check or money order to the office, it was simple enough. The landlord just had to be sure that any payments that were delivered were not receipted, endorsed, or deposited, but instead were either refused, returned to the tenant, or held with reservations until the tenant had either paid in full or vacated. With online and electronic payments, the tenant now has another way to sneak in a payment to prevent eviction proceedings. The clearest way to maintain your right to terminate tenancy as to any given breach is to prevent any payments or transfer of funds at all, and because online payment systems are not all the same, this may have to be done in a few different ways. If you have the ability to approve or deny any attempted online payments before the funds are transferred, be sure to deny any payments by the tenant who is in breach. If payments are automatically transferred without the ability to deny them, then the tenant’s ability to pay online at all must be disabled. Keep in mind, that if the tenant cures the breach of the lease, you may resume collecting rent and you should undo and/or reactivate the tenant’s ability to pay online. Whatever the case, an accidental acceptance of rent would spoil your right to terminate tenancy and must be avoided to preserve your right to evict. As we mentioned above, the online world has permeated our society. If tenants don’t already know, the internet can quickly tell them the easiest ways to avoid eviction. Don’t let your tenant sabotage your eviction by accepting rent.

Wish List for the Maintenance Budget IT’S BUDGET SEASON! As we look forward to 2016, here are

some wish list items for maintenance professionals.

Maintenance training should be a priority. Let’s give our staff the knowledge to properly maintain the value of the community. Golf carts for the maintenance team saves time on work orders and punches. Enclosures for golf carts protect the maintenance staff and their tools from the elements. Salt spreaders for winter months. The kind to pull behind carts and the ones that are manually pushed would both be helpful and would save time in clearing the pathways for the residents quicker. Don’t make us throw salt by hand! Gator for pulling 2-yard dumpsters and moving them for trash pickup (for those of us who work on mid- and high-rise properties). These dumpsters weigh over a thousand pounds when full. Having a gator would prevent possible work injuries. Pet stations for properties. Please give responsible pet owners somewhere to put their debris. And most importantly, all maintenance professionals would love to see management initiate a policy to DNA all pets on their properties. We all have to pick up the undesirable pet droppings and dispose of it. We wouldn’t mind it so bad if we knew that irresponsible pet owners were going to be caught and fined for not properly disposing of their pets’ waste. These programs, if run properly, can also be an income producer for the owners.
