Education Conference Preview Brain Dominance DOES YOUR BRAIN get you into trouble? I’m not talking about your thoughts or when you’re

super-focused, but rather your brain dominant nature. Are you right-brain or left-brain? And can being right-brain or left-brain interfere with your relationships? In a word—ABSOLUTELY! But before I get into the “why,” answer this: Do you think, “people first/task second” or “task first/people second’? There’s no right or wrong answer, it’s simply your natural way of relating. Left-brain people think “task first.” They’re linear, logical, and need the details before they can see the end result. Rightbrain people process holistically and through their feelings, so they think “people first.” Their creative nature allows them to see the end result clearly without all the details. While both are valid, the difference can be a major fault line that can cause anything from mild tremors to a full-blown earthquake. Using the Richter Earthquake Magnitude Scale, let’s take a look at how our natural way of processing can unintentionally get us into trouble.

2.5 or less Tremor:

Right-Brain Ron and Left-Brain Lois arrive at work but Lois doesn’t say hi, let alone ask how he’s doing. Ron wonders if he has made her mad, or if she simply doesn’t like him.

2.5 to 6 Tremor:

Then Ron realizes Lois didn’t even inquire about his son who took a nasty fall off his bike yesterday. That’s it—he decides he will just give her the cold shoulder.

6.1 to 6.9 Tremor:

During the project meeting Ron gives Lois the cold shoulder—but she doesn’t even notice! The more she acts like nothing’s wrong, the angrier he gets.

6.1 to 8 Earthquake:

Left-Brain Lois asks Ron why he doesn’t have all the details of the project written up. How dare her, when she’s been treating him so badly! He loses it! Later, Lois acts surprised when he can give her the end results clearly even though he hasn’t written out all the details. Ron wonders, “What does she think? I don’t know how to do my job?” There are two ways to have avoided this earthquake: 1. Lois can simply acknowledge Ron. 2. Ron can let Lois know it’s important to be acknowledged. Now if you’re thinking, “Why should Lois have to go out of her way to acknowledge Ron?” or “Shouldn’t Lois realize that’s just common courtesy?” then that not only identifies how you process but it’s also the ego getting in the way of your successful interaction. Understanding how another person processes information makes for a much more productive and harmonious environment. Of course, there’s Seismic Susie and Richter Ralph, but that’s a story for another day! I will go into greater detail during my talk on March 12, when I talk about Zoo-ology: How to play nicely with all the animals in your Workplace Zoo. GN AA N E WS & EVEN TS

Professional Development: What’s Your Plan? WHAT ARE YOUR CAREER GOALS? I am sure many of you

can answer that question, so here’s a question that may be a little more difficult to answer. What is your plan to achieve those career goals? Hard work will only get you so far. If you want to advance to a position of higher authority or higher responsiBY SUSAN SHERFIELD, bility, you should have a professional CPM, MERCY HOUSING, development plan to prepare you for NATIONAL DIRECTOR that opportunity. Many companies OF EDUCATION have implemented some type of individual development plan as part of their talent management program. If you work for a company that has this, embrace the opportunity to actively work the plan. If your employer does not have this program, this is something that you can do for yourself! The first step is to determine what knowledge, skills, and attitudes are needed in the position you want to advance to. Speak with somebody who currently holds a position similar to the one you aspire to hold and ask them questions about their career path. How did they get to where they are? What skills do they find most valuable in their position? What advice can they give you? You then need to take a critical look at yourself. You may be very successful in your current role, but the position you want may require a very different skill set. Discuss your career goals with your supervisor or a trusted colleague and ask for their input to determine your most important opportunities for development. Once you identify the skills that you need to develop, you can then create your development plan. The Greater Nashville Apartment Association Education Conference offers you a great opportunity to attend several sessions in one day! The National Apartment Association Education Conference coming up in Las Vegas in June offers three days of speakers plus the industry’s largest trade show! You may want to consider obtaining an industry designation through NAAEI or IREM. Maybe a bachelor’s degree or a master’s degree needs to be part of your plan. Professional development can also be as simple as reading articles, industry journals, or a great book on leadership. You may also seek an opportunity in your current company to take on additional responsibility or job shadow. This might

involve working on a special project or temporarily stepping into a role if somebody is out on an extended leave. You need to make sure your supervisor knows what your career interests are and speak to them about potential opportunities within your company. I often hear people say that they are not attending an educational event or pursuing an industry designation or advanced degree because their employer will not support it. It is certainly a benefit to work for a company that will allow you time away from work and will pay the costs for you to attend an educational event, but the absence of this privilege should not be an obstacle. Every employee, even those who do have company support for professional development, should also be committed to self-directed learning. Self-directed learning is any educational effort you pursue on your own. This means making the investment of your own time and money. There are many free resources available online including articles, courses, and professional networks. Remember, this is your career, so don’t hesitate to make the investment in yourself. The last step of your individual development plan is to implement it! This should include setting specific goals with deadlines, enlisting a support system, and regularly monitoring your progress. You should also assemble a dossier to include classes you attend, professional books you read, articles you have published in industry journals, or any other activities that contribute to your professional development. When you have the opportunity to take the next step in your career, it will be beneficial for you to provide examples of what you have done to prepare for it. Oprah Winfrey once said, “Luck is when preparation meets opportunity.” One day, you may be lucky enough to find your dream job, but it will be the preparation, your development plan, that will help you to get that job.

often determine the quality of your results in almost any area of business or life. The office and Service Team share many of the same goals, but they also have very different roles and functions on site. Have you ever thought, “That should just be common sense? Why don’t they get it?” The truth is that many teams on site don’t communicate or interact in a way that is mutually beneficial. When you experience and understand what everyone on the team goes through on a daily basis and ask “What can I do to help you?” and do it, everyone will benefit. Now more than ever the industry needs leadership and management that understands the importance of “speaking the same language” and the profound impact it can have on everyone at every level. Asking better questions, knowing why someone wants things done a certain way, what is the most challenging, and if we could change one thing, what it would be.

EVERYONE Has a Personal Brand… EVERYONE “But I am…” EVERYONE, and I mean everyone,

has a Personal Brand. I provided an individual client one of our “Personal Brand” questionnaires, and she gave it back to me and told me she did not need to complete it as she did not work in the business community. She has a message that she sends, no matter what she does. She replied that she was “just a mom,” and those BY MILA GRIGG, MODA IMAGE AND words stung me as I desperately want BRAND CONSULTING men and women to understand that they are so much more than a position. You are more than your work and you are not defined by your position! I often hear the words, “I am…just a mother, single mom, divorced, old, alone, unemployed, retired” or even the worst term, “I just feel ugly or unworthy.” You see, a Personal Brand is not based on an occupation or income, it is not based on what you DO, but rather who you are and what you want to be recognized for. What are your unique gifts that differentiate you from all those around you? We must understand that the most amazing dress, the ultimate designer outfit or the latest style cannot really have true meaning if the mind underneath the clothing is screaming, if it hurts, if it is filled with cynicism, anger, hatred, false pride, fear or indifference. Truly, anyone can hire a stylist to make you look good on the outside, to cover up what is really happening on the inside. The problem is that when you get home and take off the covering, the inside is still there and the outside may not begin to communicate who you really are. We want to help our individual clients rediscover themselves, the beauty of life and to turn trials, tribulations and disappointments into a new VISUAL STATEMENT that says, joy, opportunity, and hope. If you are already secure in your own skin, then I applaud you and we can work together to bring added value to your Image, to build on the solid foundation you have and make your Personal Brand stand out in order to be an encouragement to those around you who have not yet reached your level. I must be honest with you, I have found very few women who did not battle particular insecurities that their past or the world around them has planted deep within the depths of their hearts. No one should start their description of themselves with the words, “But I am”…but rather with “here I am.” There are times when all we need is some help with the right outfit, and you can get a personal shopper for that, or a stylist who can help with the latest trend. I never want for anyone, especially someone whom I serve, to feel confident with COVERING UP. I want to go deeper, to help every client illuminate who they are, and paint a picture of who they are striving to become. We can all grow, no matter what are role or position is in life. Your style, fashion, and image should magnify the amazing person who you were created to be. It all begins with the inside, and eventually, that same amazing spirit will show on the outside. When the inside is broken, perhaps dirty and muddy, or even bruised and beaten, well, that too will eventually come to the surface. You see, we all have a Personal Brand, and the questions, while they may seem tedious, are meant to help you understand that WHO YOU ARE is most important and

worthy of putting together that PERFECT STYLE, FAMOUS FASHION and IMPECCABLE IMAGE. MODA helps you to do more than look good in an outfit; we want to help bring added value to your life. Brand is the heart and soul of an individual. It is always changing, it either improves or it declines. Life is an adventure, and you can accomplish so much more than you think. Personal Brand is all about creating a legacy. Is Newer Always Better? THI N K ABOU T THE L AST T IM E you bought a new car…you LOVED that new car

smell. And when you go shopping, typically, you buy new, not used. But the vast majority of our apartment inventory is USED, not NEW. So how do you combat all those shiny appliances, those fancy amenities, all that NEWNESS in that product that’s under construction? The good news is that you can, but you need to know how to do it. Thank goodness today’s renters go online the vast majority of the time before they contact us. That means they’ve seen our models, our amenities, our pricing…and they are interested in hearing back from us! One of the most important things in competing with new construction is “Speed to Lead”; that is, the speed with which we connect with the customer. It’s important—no doubt about it. But did you know that if you respond within two minutes of receiving the lead, you can increase your chances of leasing to that renter by almost 400%? BY LISA TROSIEN, APARTMENT ALL STARS Yes, I said FOUR HUNDRED PERCENT. And all you need to do is be fast. It’s also essential that your product be perfect. Not good, but great. And that’s totally doable. Curb appeal is one of the most important aspects in creating desire on the part of the prospect. Over the years, I’ve found that sometimes we get a little stale in viewing our property. We lose the ability to spot problems. So here’s a trick I’ve used with great success. Go out on your property or outside your building and take black and white—not color—photographs. For some reason, curb appeal issues really jump out in a black and white photograph. Items you may never have noticed before will pop out, and you’ll know where you need to put your focus. Try it…it works! One last tip: Your outreach marketing has to be taken to a whole new level. If you’re not conducting outreach marketing, you have no choice. It’s time to bring your A game to the market. I’ll cover this and a wide variety of tips and techniques in my session! Sexual Orientation Discrimination is Unlawful – Even Without a Law A BILL HAS BEEN INTRODUCED in the Tennessee House of

Representatives that would amend the Tennessee Human Rights Act. House Bill 296 seeks to amend the THRA by prohibiting discrimination based on sexual orientation and gender identity or express. Regardless of whether the bill becomes law, Tennessee landlords should know that discriminating against applicants and tenants because of their sexual orientation, gender identity or expression may still be unlawful. Fair housing laws prohibit discrimination based on an individual’s gender or sex. In other words, you cannot treat someone differently because they are male or female. The U.S. Department of Housing and Urban Development (HUD) has taken the position that the sex or gender protected class also prohibits discrimination against an applicant or resident because he/she does not meet the male or female stereotype. For example, it would be unlawful to refuse to rent to a male applicant because he dresses as a woman. Additionally, in February 2012, HUD announced new regulations intended to ensure that its core housing programs are open to all eligible persons, regardless of sexual orientation or gender identity. This includes lesbians, gays, bisexuals and transgender (LGBT). The regulations are titled Equal Access to Housing in HUD Programs – Regardless of Sexual Orientation or Gender Identity and include the following provisions: • Owners and operators of HUD-assisted housing, or housing whose financing is insured by HUD, must make housing available without regard to the sexual orientation or gender identity of an applicant for, or occupant of, the dwelling, whether renter- or owner-occupied. HUD has instituted this policy in its rental assistance and homeownership programs, which include the Federal Housing Administration (FHA) mortgage insurance programs, community development programs, and public and assisted housing programs. • Provides clarification that all otherwise eligible families, regardless of marital status, sexual orientation, or gender identity, will have the opportunity to participate in HUD programs. HUD’s rule clarifies that otherwise eligible families may not be excluded because one or more members of the family may be an LGBT individual, have an LGBT relationship, or be perceived to be such an individual or in such relationship. • Owners and operators of HUD-assisted housing or housing insured by HUD are prohibited from asking about an applicant’s or occupant’s sexual orientation and gender identity for the purpose of determining eligibility or otherwise making housing available. HUD has clarified that this provision does not prohibit voluntary and anonymous reporting of sexual orientation or gender identity pursuant to state, local, or federal data collection requirements.

What does all this mean for you? Regardless of what type of housing you own or manage, making housing decisions based on how someone looks as opposed to whether they meet the criteria is never a good idea. Additionally, enforcing policies against individuals because you do not agree with the way an individual dresses or presents themselves may violate fair housing laws. The bottom line is to avoid using sexual orientation or gender expression to make a housing decision.

2015 Legislation SINCE THE BILL FILING DEADLINE, TAA has identified 15 bills of interest

or concern to monitor during this legislative session. TAA will continue to study this list to determine which bills should actively be lobbied and which bills should only be monitored to ensure they are not amended to change the original intent. While this list is not exhaustive and is subject to change as session progresses, below is a summary of the bills that have been identified as priority. TAA will continue to work with each of the bill sponsors, and will provide an update as it is available.

SB 548/HB 501

As introduced, this bill enacts the “Secure Home Act.” At the direction of the TAA Board of Directors, the TAA lobbyist has worked with the lobbyist for the City of Chattanooga to address an issue of concern initiated by Chattanooga’s Mayor and Chief of Police. In essence, this bill will require a landlord to change the locks of a unit occupied by a victim of domestic assault upon receipt of an authenticated order of protection. An amendment will be filed that will make the bill. The language of this amendment will address the concerns of TAA, limiting this obligation to a single occurrence, allowing the landlord to seek reimbursement from the offender, and providing the landlord with immunity from all civil liability for damages arising out of acts by the offender.

SB 1036/HB 917

As introduced, this bill makes various changes to the use of smoke alarms in one-family and twofamily rental units, one-family and two-family dwellings, apartment buildings, and hotels. Since the summer, TAA representatives have worked with the Tennessee Fire Services Coalition to compose language that would allow the law to coordinate with the adoption of the rules by the Department of Commerce and Insurance without having to pass legislation each time a new building or safety code is adopted. Additionally, the bill updates the smoke alarm terminology used throughout the code.

SB 1129/HB 1144

As introduced, this bill declares that water companies shall not be prevented from providing water and wastewater treatment authorities with information about water customers to locate such persons or to collect delinquent debts. Additionally, this bill increases authority of municipalities to collect delinquent or past due sewer charges, and expands the ability of water and wastewater authorities to discontinue water service to sewer users who are delinquent in paying sewer service charges, penalties, or fees. In particular, section two of the bill authorizes wastewater authorities to collect delinquent or past due sewer charges from the current owner for debts incurred by a former tenant.

SB 1141/HB 1258

As introduced, this bill requires landlords to make certain certifications and disclosure in writing to prospective and current tenants with regard to mold in dwelling units or buildings. Additionally, the bill requires landlords to repair, remediate, and remove mold from dwelling units or buildings, and requires tenants to notify landlords of any suspected mold in the tenant’s dwelling unit or building.
