Individuals May Be Liable for Fair Housing Violations UNDER THE FAIR HOUSING ACT, an individual employee,
owner, or manager may be liable for their own acts of wrongdoing. This means they may be sued right along with the apartment complex for violations of fair housing laws. More importantly, they may be found individually liable for monetary damages…and the apartment complex has no legal requirement to defend them or pay a judgment against the employee. This issue was recently discussed in an Ohio case where a neighbor was sued for harassing a resident because of her disability. The disabled resident was hearing impaired. She had two Labradors that were assistance animals who helped alert the resident to common noises within the home like doorbells, alarm clocks and smoke detectors. The disabled resident’s not-so-nice neighbor mocked her use of sign language and tormented her dogs. He would repeatedly whistle from his porch and hit a stick on his porch which caused the dogs to alert the disabled resident to the noises. After the manager told the not-so-nice neighbor that the dogs were assistance dogs, the neighbor falsely complained that the disabled resident intentionally used her dogs to frighten him. About a month later, the not-so-nice neighbor called the police to falsely allege that the disabled resident brought her dogs outside the house to intimidate him. He also alleged the disabled resident’s dogs knocked over and broke a flower pot on his property when he was actually the one who broke the pot. Eventually, the disabled resident was forced to move because of her neighbor’s conduct. The disabled resident sued her neighbor for harassment in violation of Ohio’s Fair Housing Act, which is analogous to the federal Fair Housing Act. The disabled resident asked the court for an injunction against the not-so-nice neighbor prohibiting him from ever engaging in unlawful discrimination in violation of fair housing laws. She also requested actual and punitive damages along with attorney fees, court costs, expert witness fees and all other litigation expenses. The lower court dismissed the claims holding that the Ohio Fair Housing Act is limited to conduct related to housing transactions. The disabled resident appealed. The Ohio Court of Appeals saw things differently from the lower court. The Court of Appeals reinstated some of the resident’s claims against her neighbor. The Court of Appeals held that the not-so-nice neighbor may have violated the state law provision prohibiting coercion, intimidation, threats, or interference with any person in the exercise or enjoyment of, or on account of that person’s having exercised or enjoyed a right granted by the fair housing law. The Appeals Court analogized the Ohio law to the federal fair housing law and cited numerous federal courts which have found that a neighbor’s intimidating, threatening, and/or harassing conduct is actionable. The case now goes back to the lower court for discovery and possibly a trial. The lesson to be learned from this case is that anyone can be liable under fair housing laws. 2014 Capitol Conference Overview RECENTLY, MEMBERS of the Tennessee Apartment Association and its
local affiliates traveled to Washington, D.C. for the National Apartment Association’s Capitol Conference. Attendees from the Tennessee Apartment Association included Brad Cather, TAA President; Cara Mober, TAA Secretary/ Treasurer; Diane Carter, TAA and GNAA Executive Director; and Catie Lane Bailey, TAA Director of Government Affairs. Local affiliate attendees included Crystal Dollahite, AAGM President; Callie Jones, AAGM President-Elect; Pattie Woods, AAGM Past President; Linda Page, GNAA Past President and NAA Regional RVP; Wes Hall, GNAA Legal Advisor; Henry Carter, GNAA Member; Kirk Kent, TAA Past President and CAA Board Member; Donna Kent, CAA Member; Cara Mefford, CAA Secretary; and David Tonahill, CAA Board Member. The Capitol Conference is the apartment industry’s only national event focused on educating NAA members on critical federal legislative and regulatory issues impacting the multi-family housing industry. The theme for this year’s conference was “Invest in Your Political Capital.” For the National Apartment Association, having political capital is the most effective way to influence decision-making on policies that impact members of the apartment industry. There are nearly 63,000 NAA members, representing more than 170 affiliated associations and more than 7.1 million units. NAA members are businessmen and women who know firsthand how policymakers affect their lives and livelihoods. On the Tennessee Lobby Day, conference attendees were able to visit with both Senator Alexander and Senator Corker at the annual Tennessee Tuesday Breakfast. Conference attendees were also able to meet with Congressmen Black, Cooper, and Fincer. In the six remaining Tennessee Congressional offices, meetings were held with Legislative Aides who specialize in housing legislation. At these meetings, discussions were held regarding three key issues currently being debated in Congress that would significantly affect the multi-family housing industry: Immigration reform, housing finance reform, and the recent HUD rule change regarding disparate impact. Additionally, each Congressional office received a “leave-behind packet” containing economic impact data. This information highlights how the apartment industry has remained a positive economic force despite the recession, and how its size and broad scope build vibrant communities throughout the United States. The 2014 Capitol Conference was a huge success for the Tennessee Apartment Association and its attendees! While some relationships with the Tennessee Congressional delegation were built, most were strengthened and reinforced by TAA’s presence on Capitol Hill. It is great to see such strong support for the multi-family industry from Tennessee’s representation at the federal level. Today’s proposals are tomorrow’s law, and it’s always important to bridge the policy gap and educate elected officials on how those proposals will impact our industry.
