Lord Allan Jay Q. Velasco as the duly elected congressman for the lone district of Marinduque. Reacting to the claim of Velasco‟s disqualified rival, Regina Reyes, that she had already taken her oath before House Speaker Feliciano Belmonte, Barzaga said Section 6, Rule II on membership of the House has been consistently practiced and implemented by the chamber. Barzaga said the rule provides that “members shall take their oath or affirmation either collectively or individually before the Speaker in open session. And the Speaker shall be elected only on Monday morning, July 22, Barzaga said. Apart from this, Barzaga said the term of office of a representative begins at noon of June 30. But Reyes was proclaimed on May l8. Therefore, any oath taken before June 30 may not be considered as official since the term of office of a representative starts only on that day, Barzaga pointed out. On the question as to who has jurisdiction over the dispute, Barzaga said the Supreme Court is the last bulwark of democracy and the only branch of government entrusted by the Constitution to decide cases. Barzaga noted that the High Court clearly ruled that three things must concur before the House of Representatives Electoral Tribunal can assume jurisdiction over the case. “These are proclamation, oath of office and assumption of office,” Barzaga added.

The House of Representatives will not recognize Lord Allan Jay Velasco, who Reyes beat and who the Comelec wants to belatedly proclaim as the new winner. Velasco is the son of Supreme Court (SC) Justice Presbitero Velasco Jr. “As far as the House is concerned, the duly elected representative of the lone district of Marinduque is Regina Reyes,” Majority Leader Neptali Gonzales II said yesterday. “She was the one who has been proclaimed by the provincial board of canvassers, and she has taken her oath before Speaker (Feliciano) Belmonte and has assumed office,” he said. On Reyes‟ part, she said she would raise her disqualification in the appeal she would file with the SC asking the tribunal to reconsider its ruling last June 25 that the Comelec still had jurisdiction over the issue. Gonzales said the Comelec lost its jurisdiction over Reyes‟ case the moment the provincial canvassing board proclaimed her winner, and any question after that about her election and qualification should be resolved by the House of Representatives Electoral Tribunal (HRET). “We have to be consistent with the Constitution, which says that the HRET shall be the „sole judge‟ of all questions about the „election, returns and qualification‟ of a House member. We also have to be consistent with our assertion that the HRET‟s jurisdiction begins with the proclamation of a congressional winner,” he said. In line with this stand of the House, Gonzales said the chamber is also recognizing Angelina Tan as the winning candidate in the fourth district of Quezon. Reyes belongs to the ruling Liberal Party (LP), to which Belmonte and Gonzales also belong, while Tan is a Nationalist People‟s Coalition member. The Comelec has annulled the proclamation of both Reyes and Tan. In Tan‟s case, the Comelec wanted her opponent, Wigberto Tañada Jr., who she beat by more than 4,000 votes, as the winning candidate. The Tañadas are LP members. Gonzales said Velasco should now pursue the election protest he has filed against Reyes shortly after the latter was proclaimed winner. “He should pursue that in the HRET, which is the proper forum and whose jurisdiction over his case he has already recognized,” he said. Like Velasco, Tañada has filed an election protest against Tan with the HRET.

(A must share information). Chikungunya is a mosquito-borne viral disease first described during an outbreak in southern Tanzania in 1952. It is an alphavirus of the family Togaviridae. The name „chikungunya‟ derives from a root verb in the Kimakonde language, meaning "to become contorted" and describes the stooped appearance of sufferers with joint pain. Signs and symptoms Chikungunya is characterized by an abrupt onset of fever frequently accompanied by joint pain. Other common signs and symptoms include muscle pain, headache, nausea, fatigue and rash. The joint pain is often very debilitating, but usually ends within a few days or weeks. Most patients recover fully, but in some cases joint pain may persist for several months, or even years. Occasional cases of eye, neurological and heart complications have been reported, as well as gastrointestinal complaints. Serious complications are not common, but in older people, the disease can contribute to the cause of death. Often symptoms in infected individuals are mild and the infection may go unrecognized, or be misdiagnosed in areas where dengue occurs. Transmission The virus is transmitted from human to human by the bites of infected female mosquitoes. Most commonly, the mosquitoes involved are Aedes aegypti and Aedes albopictus, two species which can also transmit other mosquito-borne viruses, including dengue. These mosquitoes can be found biting throughout daylight hours, although there may be peaks of activity in the early morning and late afternoon. Both species are found biting outdoors, but Ae. aegypti will also readily feed indoors. After the bite of an infected mosquito, onset of illness occurs usually between four and eight days but can range from two to 12 days. Diagnosis Several methods can be used for diagnosis. Serological tests, such as enzyme-linked immunosorbent assays (ELISA), may confirm the presence of IgM and IgG anti-chikungunya antibodies. IgM antibody levels are highest three to five weeks after the onset of illness and persist for about two months. The virus may be isolated from the blood during the first few days of infection. Various reverse transcriptase–polymerase chain reaction (RT–PCR) methods are available but are of variable sensitivity. Some are suited to clinical diagnosis. RT–PCR products from clinical samples may also be used for genotyping of the virus, allowing comparisons with virus samples from various geographical sources. Treatment There are no specific drugs to cure the disease. Treatment is directed primarily at relieving the symptoms, including the joint pain. There is no commercial chikungunya vaccine. Prevention and control The proximity of mosquito vector breeding sites to human habitation is a significant risk factor for chikungunya as well as for other diseases that these species transmit. Prevention and control relies heavily on reducing the number of natural and artificial water-filled container habitats that support breeding of the mosquitoes. ...More on page 8

This requires mobilization of affected communities. During outbreaks, insecticides may be sprayed to kill flying mosquitoes, applied to surfaces in and around containers where the mosquitoes land, and used to treat water in containers to kill the immature larvae. For protection during outbreaks of chikungunya, clothing which minimizes skin exposure to the daybiting vectors is advised. Repellents can be applied to exposed skin or to clothing in strict accordance with product label instructions. Repellents should contain DEET (N, N-diethyl-3-methylbenzamide), IR3535 (3-[Nacetyl-N-butyl]-aminopropionic acid ethyl ester) or icaridin (1-piperidinecarboxylic acid, 2-(2-hydroxyethyl)-1 -methylpropylester). For those who sleep during the daytime, particularly young children, or sick or older people, insecticide treated mosquito nets afford good protection. Mosquito coils or other insecticide vaporizers may also reduce indoor biting. Disease outbreaks Chikungunya occurs in Africa, Asia and the Indian subcontinent. Human infections in Africa have been at relatively low levels for a number of years, but in 1999-2000 there was a large outbreak in the Democratic Republic of the Congo, and in 2007 there was an outbreak in Gabon. Starting in February 2005, a major outbreak of chikungunya occurred in islands of the Indian Ocean. A large number of imported cases in Europe were associated with this outbreak, mostly in 2006 when the Indian Ocean epidemic was at its peak. A large outbreak of chikungunya in India occurred in 2006 and 2007. Several other countries in South-East Asia were also affected. In 2007 transmission was reported for the first time in Europe, in a localized outbreak in north-eastern Italy. More about disease vectors Both Ae. aegypti and Ae. Albopictus have been implicated in large outbreaks of chikungunya. Whereas Ae. aegypti is confined within the tropics and sub-tropics, Ae. albopictus also occurs in temperate and even cold temperate regions. In recent decades Ae. albopictus has spread from Asia to become established in areas of Africa, Europe and the Americas. The species Ae. albopictus thrives in a wider range of water-filled breeding sites than Ae. aegypti, including coconut husks, cocoa pods, bamboo stumps, tree holes and rock pools, in addition to artificial containers such as vehicle tyres and saucers beneath plant pots. This diversity of habitats explains the abundance of Ae. albopictus in rural as well as peri-urban areas and shady city parks. Ae. aegypti is more closely associated with human habitation and uses indoor breeding sites, including flower vases, water storage vessels and concrete water tanks in bathrooms, as well as the same artificial outdoor habitats as Ae. albopictus. In Africa several other mosquito vectors have been implicated in disease transmission, including species of the A. furcifer-taylori group and A. luteocephalus. There is evidence that some animals, including nonprimates, may act as reservoirs. NHTSPR is DSWD‟s targeting mechanism of identifying who and where the poor are which started in 2009. The result from the assessment will be the basis of targeting beneficiaries for government‟s DSWD-MIMAROPA social protection programs. The central database for the NHTSPR is being updated every four years making this the second round of household enumeration. Activities lined-up for the celebration include: launching of priority lane for PWDs and launching of Sensitivity Training for QC Prosecutors at the Quezon City Hall on July 17, Product Conference and Trade Fair, exhibit of artworks and products made by PWDs at QC Memorial Circle, and Forum on 10 Goals to Make the Rights Real for PWDs on July 18. Other events are: “Paligsahan ng May Kapansanan sa Kasaysayan at Kultura ng Pilipinas;” Wheelchair Art Parade, Sculpture and Poster-Making Contest; Forum on Access to Justice for PWDs on July 20; MOVE Manila Run 2013 and Fun Day for Children with Disabilities on July 21; Forum on Training and Employment Programs/Projects of TESDA, DOLE, DTI and ECC; and commemoration of the birthday of the national hero and sublime paralytics Apolinario Mabini in PUP Sta. Mesa and Tanauan, Batangas on July 22. Closing ceremonies of the NDPR Week celebration will be held at SM Mall of Asia, Pasay City with a thanksgiving mass and Sensitivity Disability Campaign on July 23.

Velasco wielded influence? In a press briefing the other day, Reyes hinted that Associate Justice Velasco allegedly wielded his influence in the tribunal‟s recent decision annulling her proclamation. But Velasco yesterday denied Reyes‟ insinuation that he used his influence in the disqualification case against her. “The allegation that he wielded his influence in the case is baseless and malicious. Being a lawyer and an officer of the court, Atty. Reyes should have been circumspect in her statements,” Velasco‟s office said in a statement. Reyes said she is convinced that the SC allegedly sped up the resolution of her case since it failed to ask the comments of those involved in the case before issuing a ruling. She also alleged that she was not given fair treatment by the Comelec and the SC because she was not given a chance to prove that she is indeed a Filipino citizen. Reyes presented to the media proof that she is a natural-born Filipino, and that she was able to comply with the requirements under Republic Act 9225 in renouncing his foreign citizenship, which she acquired when she married an American citizen in the United States. Reyes also lamented that the Comelec and SC supposedly gave credence to a published article of an unknown blogger who claimed that she is an American citizen, when the truth is, she was born in the Philippines, her parents are both Filipinos, and she also has an affidavit of renunciation of foreign citizenship. – With Edu Punay, Paolo Romero
I suppose when you talk about "proclamation" what is meant by that is a "VALID PROCLAMATION" and not one that has been declared "NULL and VOID and without any legal force and effect", as in this case. I suppose when you talk about "oath of office" that means not an oath of office taken on June 5, 2013 during the last day of session of the 15th Congress, as in this case, where one might wonder why there was "undue haste" since the 16th Congress is yet to open on Monday, June 22, 2013. Rules of the House states thus: "Section 6, Rule II (Membership) of the Rules of the House of Representatives provides: "Section 6. Oath or Affirmation of Members. – Members shall take their oath or affirmation either collectively or individually before the Speaker in open session." As regards "assumption of office" it must be stressed that the SC decision was promulgated on June 25, 2013, where, in response to the Petitioner's claim that Comelec was already ousted of its jurisdiction, it stated in part, thus: "Here, the petitioner cannot be considered a Member of the House of Representatives because, primarily, she has not yet assumed office. To repeat what has earlier been said, the term of office of a Member of the House of Representatives begins only “at noon on the thirtieth day of June next following their election.”

Tubeza Philippine Daily Inquirer 5:48 am | Friday, July 19th, 2013 Commission on Elections Chairman (Comelec) Sixto Brillantes Jr. defended Thursday the agency‟s decision to proclaim the reelectionist son of a Supreme Court justice the winner of the Marinduque congressional race. Brillantes said it was the Comelec and not the House of Representatives that had jurisdiction over matters concerning a candidate‟s certificate of candidacy (COC). The Comelec on Tuesday proclaimed Lord Allan Jay Velasco, son of Supreme Court Associate Justice Presbitero Velasco, the representative of the lone district of Marinduque after it disqualified Regina Ongsiako Reyes for being an American citizen. No jurisdiction over COC House leaders have threatened to ignore Velasco‟s proclamation since Reyes, whom the Comelec had earlier proclaimed the winner, had already taken her oath as a representative. “They don‟t want to recognize that? The House does not have jurisdiction over certificates of candidacy. They don‟t have the authority to determine COCs. That is what they should see,” said Brillantes in an interview Thursday. He explained that the Comelec had merely resolved the disqualification case against Reyes, who was accused of falsely identifying herself as a Filipino citizen in her COC. Bringing to high court “We have done our part. We cannot force (the House) to accept or not to accept. We proclaimed Velasco based on our decision. Whether he will be accepted or not is beyond our powers already,” Brillantes said. He said that if Congress would not recognize Velasco, the matter may again be brought to the Supreme Court for resolution. “If it goes up to the Supreme Court, then good. That is the correct process because all our decisions can be brought before the high court,” Brillantes said. “If we are sustained by the Supreme Court and the House still refuses to recognize (Velasco), then let us leave them to fight each other. As for us, we have done our part,” he said. Reyes had won the vote count, with Velasco coming in second. The Comelec, however, disqualified her on the grounds that she was a US citizen. Reyes protested her disqualification in the Supreme Court. The magistrates threw her protest back to the Comelec, which dismissed it, paving the way for Velasco to take the congressional seat. Reyes charged the elder Velasco had influenced his fellow justices into throwing the protest back to the Comelec. Justice Velasco, who did not take part in the case, has denied this. DepEd prioritizes government science scholars in teacher hiring Communications Unit Office of the Secretary | Department of Education PASIG CITY -- Government science scholars will get priority in hiring when they apply for a teaching job in public secondary schools. This is contained in Department of Education (DepEd) Memorandum 114 series of 2013 which enjoins all DepEd regional directors to prioritize in hiring scholars who graduated under the Department of Science and Technology –Science Education Institute (DOST-SEI) program. Education Secretary Br. Armin Luistro FSC said DepEd needs the expertise of these graduates to address the critical need for teachers in mathematics and other science-related fields. “ This fresh infusion to our teaching force is DepEd’s contribution to nation-building as the country’s economic activities are becoming more and more science and technology-driven,” he added. The DOST- SEI scholars have signed an agreement that upon completion of their courses, they are required to teach in public high schools in their home region for a period equivalent to the number of years they benefited from the scholarship. “These scholars must pass the Licensure Exam for Teachers (LET) within the year as a pre-requisite for a permanent position,” explained Luistro.
