Developer files lawsuit against feds BY CAROL AUN Mission Record

Carhoun and Sons Enterprises Ltd. (CSE) is taking the federal government to court over a lengthy delay in plans to develop about 33 acres at the corner of Lougheed Highway and Wren Street. The civil claim, which seeks general, special, punitive, aggravated and exemplary damages, plus interest, was filed in B.C. Supreme Court last Friday. It took the company nearly three years to receive the necessary environmental approvals to proceed with the project, which has forced CSE to put the property up in a court-ordered sale. CSE says in the claim that the delays were excessive, unreasonable and unlawful, and accuses Fisheries and Oceans Canada (FOC) of exhibiting bias, bad faith, and malfeasance which adversely impacted the financial position of CSE as well as its associated companies and shareholders. CSE began acquiring property in the area in 1987 and by 2009, owned six contiguous parcels, totalling 33.48 acres. The company’s intentions to build a large commercial development in the area was supported by the municipality, but needed environmental approval because two ravines, which were created by storm water discharge from the district, are on the property. Because the ravines had to be filled, environmental assessments had to be undertaken and approvals from FOC obtained. CSE began the process in 2009 and received FOC approval in 2012. The document filed in court gives examples of delays and notes the Canadian Environmental Assessment Act screening, which on average took 88.7 days to complete in the years 2004, 2005, and 2006, took 546 days for the CSE file. Long pleads guilty An Abbotsford man accused of hacking the computer of pop superstar Carly Rae Jepsen has pleaded guilty to two of the five offences with which he has been charged. Christopher David Long, 25, pleaded guilty Monday in Abbotsford provincial court to possession of stolen property and mischief to data. Charges of fraudulently obtaining telecommunication services, identity fraud and unauthorized use of a computer will be stayed. Long is scheduled for a sentencing hearing on Sept. 6 in Abbotsford. He surrendered to police in Abbotsford in Carly Rae early December, Jepsen following an investigation by the Vancouver Police Department (VPD). The VPD was contacted in March 2012 with a complaint that Jepsen’s computer had been hacked. Police identified a suspect in July after fake images and a phony sex tape were released online. Jepsen, originally from Mission, is a former Canadian Idol finalist who was propelled to international stardom with her hit song Call Me Maybe. In April, she picked up three Juno Awards for Album of the Year, Pop Album of the Year, and Single of the Year.

Mission police searching for missing 18-year-old

Mission RCMP are searching for 18-yearold Samantha “Zoe” Wong who left her Seventh Avenue house sometime before 11 p.m. on May 28. As of The Record’s press time, she had not returned and her family is concerned for her safety. She suffers from a severe cognitive disability and functions at the level of an eight-year-old, say police. She also requires medication which she did not take with her, and suffers from depression. Pot activist Tim Felger’s charter rights were breached, but he is still going to trial for drug charges in Mission, a B.C. Supreme Court judge ruled Tuesday in Chilliwack. Justice Bill Smart ruled that police breached Felger’s rights when an undercover officer entered his Das Bhang store/office in Mission in 2011, and gathered evidence which was used among details to obtain a search warrant. The results of the search, in part, led to Felger’s arrest and subsequent charges in March 2011. Felger had posted a sign outside his store, indicating that no police or RCMP members, or other government agents, were allowed on the premises without a warrant. Smart ruled that some of the evidence police gathered during those visits — and which led partly to their reasons for obtaining a search warrant — was obtained in violation of Felger’s charter rights and should be excluded. However, Smart ruled that the search warrant had been lawfully obtained because of other information police gathered outside of Felger’s store — located at Horne Street and North Railway Avenue. This evidence was collected during police surveillance and interviews with neighbouring businesses. The ruling means that some of the

evidence is still admissible in court, resulting in Felger’s trial proceeding. Jury selection is set to begin next Monday, with the trial slated for June 17. The federal Crown lawyer indicated that he will be adapting the charges to reflect the judge’s ruling on the inadmissibility of some of the evidence. Felger was initially charged with two counts of trafficking and two counts of possession for the purpose of trafficking. Speaking outside of court, Felger said he expected the judge to agree that his rights had been breached. “It’s really basic. The police need a warrant to enter my property, period. No discussion anymore. If they don’t have a warrant, they’re entering as trespassers,” he said. However, he said he was disappointed with the second half of the decision. “I think that the judge made his decision to proceed to trial on very flimsy evidence.” Felger went to court last December on 2009 drug charges related to his former Da Kine store on Essendene Avenue in Abbotsford. He was acquitted of all seven charges, after the judge ruled that all evidence collected by police following a search warrant at that location was inadmissible. Crown lawyers are appealing that decision, but a court date has not yet been set.

Scandal has hurt the Conservative Party, says Kamp BY PHIL MELNYCHUK Black Press

The controversy regarding Conservative Sen. Mike Duffy’s expense claims is hurting morale within the party, so improvements are needed, says local MP Randy Kamp. Actually, the Senate has to change soon, or it could disappear, Kamp said, adding changes to unelected upper house are already underway. A ruling from the Supreme Court of Canada on reforming the nonelected body in the next year could make the body a little more palatable to the public. The government introduced a bill in 2011, the Senate Reform Act, proposing to limit senators’ terms to nine years and allowing for appointment of senators who’ve been elected in their own provinces. The bill reached second reading before being referred to the courts. “We think that’s constitutional but the Supreme Court is going to rule on that,” Kamp

said. The court also could comment on the option of abolishing the Senate, he added. Efforts also are now underway to reform Senate fiscal management. Kamp agreed the controversy over Duffy’s expense claims, paid by Prime Minister Stephen Harper’s chief of staff Nigel Wright, who recently resigned, has hurt the Conservatives. The only way to remove Duffy from the Senate, who’s resigned from the Conservative caucus, is if he was persuaded to resign. Kamp’s colleague in Coquitlam, Heritage Minister James Moore, has called on Duffy to step down, but Kamp wouldn’t go that far. “It think that’s a decision he’s going to have to make.”

It is disconcerting to see how divisive the current political climate is within this country. But, that is the nature of politics and some things will probably never change. What is perhaps even more disconcerting than the political divisiveness is that supposed religious issues oftentimes seem to be at the center of these debates. Some of these people who claim to be men and women of God attack their political rivals in ways that are certainly not models of Christian charity, let alone models of political civility. Perhaps what animates these well-intentioned people is the conviction that they are right and that they are waging a battle for the sake of righteousness. We would all do well to remember that the good example of quiet and humble actions speaks louder than self-righteous words or doctrine, and that when religion is used as a weapon to attack our enemies, it is no longer true religion. All true religion is about love, whose primary goal is to unite. That which seeks to divide is strife, and strife is the opposite of love.

Patience at an end?

In the blink of an eye, the Conservative government can strip away the retirement dreams of millions of Canadians. But when a loyal soldier of the government stands accused of bilking taxpayers with improper expenses, the prime minister claims to be powerless, while money is quietly funneled out of his office to repay the alleged wrongdoing. But, this time, Canadians may finally have had enough. The cloud of scandal continues to grow over the head of embattled Senator Mike Duffy. The former TV journalist is accused of fudging his expense account, eventually repaying the improperly claimed expenses with $90,000 he received from Nigel Wright, Prime Minister Stephen Harper’s chief of staff who has since resigned. Duffy has now quit the Conservative caucus in the Senate, but he is so far rejecting calls to resign as a senator. And the prime minister seems unwilling to push him out the door. Harper said he was “not happy” and “very upset” with the conduct of some parliamentarians and his own office, before hopping on a plane for a South American trade mission without answering questions from reporters. The same prime minister who has shown the powers of a majority government are almost limitless is now unable to even mention the name of his disgraced colleague. Apart from apparently filing bogus expense claims, most Canadians would be hard pressed to name a single duty that senators fulfill. Maybe Mike Duffy has done a service to his country after all. Maybe the senator’s actions will be the straw that broke the camel’s back and prompt Canadians to demand an end to the political embarrassment that is this nation’s Senate. - Penticton Western News

BCTF digs in for endless war L

ike those Japanese soldiers who didn’t hear about the end of World War II, the militant fringe that controls the BC Teachers’ Federation is digging in for endless battle against the B.C. government. Their nemesis, Premier Christy Clark, reiterated last week that seeking a 10-year agreement with the BCTF is a top priority when the legislature is recalled this summer. The current one-year truce ends June 30. The BCTF grudgingly agreed to that extension last year, then ran TV ads calling for an NDP government that promised concessions and union bosses on both sides of the negotiating table. “You know, I may be a lame duck,” outgoing BCTF president Susan Lambert crowed in March, “but I think Christy’s goose is cooked.” We’ll never know how much this sort of gloating contributed to the epic collapse of the NDP, champion of public sector union members whose pay and benefits make them the new upper class. But I can tell you the pros-

pects for sparing children from this ideological warfare are not good. Last week the B.C. Court of Appeal handed down an ivory-tower decision that upheld the “right” of teachers to bring their union demands into the classroom in the form of posters, buttons and black armbands that to some self-absorbed teachers symbolize the “death” of education. During the election campaign, The Globe and Mail carried a story on one of those mock elections held in schools around the province. An elementary-level To student was quoted as saying she voted against the BC Liberals because Clark “caused a teachers’ strike.” If this kid was talking about the most recent strike, I wonder where she got that idea. In a negotiating performance that was appalling even by BCTF standards, Lambert and her team conducted months of disruptive work-torule action before they could

even articulate a wage and benefit demand. When they finally did, it was outrageously out of touch with reality. An indication of how the union’s ruling class wants to conduct itself in the classroom can be found in the latest issue of the BCTF newsletter to its members. Joanna Larson, president of the Prince Rupert union local, contributes an article headlined: “What kind of citizen do we hope to graduate from our K-12 public schools?” Larson first quotes the education ministry’s current goals. They include m preparing citizens who are “creative, flexible, selfmotivated, and who have a positive self-image.” Another goal is citizens who are “skilled and who can contribute to society generally, including the world of work.” Larson then mocks these goals, as follows: “Essentially, the Ministry of Education has a vision of citizens who will maintain the

status quo, not rock the boat, and participate on a superficial level in aspects of political and societal change. It doesn’t challenge individuals to take direct action against exploitation, marginalization and violence.” In case you missed the political message, Larson later asserts: “The educated citizens we graduate from our schools cannot just be content to wear a pink shirt once a year…. Educated, engaged citizens must be willing to take direct action to change and shape our society for the better.” What is this ghastly “status quo” that must be challenged by “direct action?” In these campus-radical screeds, the final answer is generally the same: capitalism. This call to arms is a blend of the NDP election platform and a rant from the Occupy Vancouver squat of a couple of years ago. Reforming the Senate is not the issue at hand Editor, The Record: In the last decade the Conservative Party has behaved in the utmost disgusting manner and disregard for parliamentary process. The constant “deny and attack” tactics of John Baird and others is shameful, but the silence from other caucus members is beyond disgusting. To our MP, Randy Kamp, I have been waiting for you to speak out and take a firm stand on the scandal of Mike Duffy and the Prime

Minister’s office. Your weak response of reforming the senate is bafflegab. The issue is a secret payment of $90,000 to Mr. Duffy. Allard Contractors is getting another chance to expand its operation on Keystone Avenue. Mission council advanced the application to build a ready mix concrete plant on the property to a public hearing June 17. The family-owned company first approached the district about building such a plant on site in 1995. It combines various ingredients needed to make concrete except water. When the material is loaded into a truck, it is mixed with water and transported to the work site. According to a district staff report, the application was withdrawn two years later when information needed to move it forward was not received. Jim Allard, Allard Contractors Ltd.’s vice president, applied for a rezoning on the property again in 2001 and 2005. He faced two

The Abbotsford SPCA is trying to link up owners and pets after the May 17 fire at the Willows apartment building. So far, seven cats and one rabbit belonging to residents have been turned over to the organization’s care. “We can only imagine how devastated these families are to lose everything,” says Jodi Dunlop, manager of the Abbotsford SPCA. “We are glad that we’re able to make this time a bit easier by providing a safe, loving environment for their pets.” Some of the animals were brought in directly from the fire, while others were found over the weekend in the burned rubble. “We do have names and contact information for some of the animals, but we are still looking for the guardians of others,” says Dunlop. She urges anyone who is missing their pet to call 604-8501584 to see if the animal has been turned in. “The families have been through so much, and we’d love to be able to reunite them with their pets and to provide whatever support we can.” Dunlop says any unclaimed pets after this week will be put up for adoption simply due to a lack of space. “Three-quarters of my kennel space is filled with these animals.” A massive fire on Third Avenue May 17 destroyed the 26-unit apartment building, which is expected to be demolished.

volunteers will be stepping up enforcement and setting up at various locations around the community reminding drivers to not engage in activities that could increase their chances of being involved in a crash, such as ignoring traffic control devices or using cellphones. “Sixty per cent of all crashes happen at intersections,” said Don Miller, ICBC’s road safety coordinator. The top crash location in Mission from 20082012 is where the Cedar Valley Connector meets Lougheed Highway; 447 crashes happened there. “There are high volumes of traffic at that intersection, lots of movement and multiple lanes,” said Miller, who stressed the importance of approaching any intersection with caution. Other high crash intersections in Mission are Seventh Avenue and Cedar Street and First Avenue and Glasgow with 111 and 103 reported incidents from 2008-2012, respectively, according to ICBC statistics. To reduce your chances of being in a collision at intersections, Miller offered the following tips: • Prepare for the light to change, even if it is green. • Don’t change lanes in an intersection. • Turn your signal on well before you reach an intersection. This lets other drivers, cyclists and pedestrians know what you’re doing. • When you’re waiting to make a left hand turn, make sure your wheels are straight. • Check for pedestrians and cyclists when making a right turn. A. Hmmmm…. Salt water pool… touchy subject. The real name for these units is “Electrolysis Chlorinator”. Salt water pools use a special piece of equipment that converts salt (Sodium Chloride - NaCI) to active chlorine in your pool. That’s right, you now have a machine that allows you to make your own chlorine. There are 2 advantages to the: #1 - It allows a certain level of automation to the chlorination of your pool and #2 - Salt makes the water “feel” different. Some people like this, some don’t. The main disadvantage is the salt is very corrosive, and without full and proper balancing of the water, it’s not long before things start to break down… expensive things, like heaters and stainless railings,

and aluminum coping, and steel walls, and lights, and all other metallic components of your pool. The hidden disadvantage is the cost. PTE deadline will now be July 15 The District of Mission advises that the new deadline for applying for a 2014 permissive tax exemption is now July 15, 2013. At the May 6, 2013 council meeting, council adopted a new Permissive Tax Exemption Policy including new Application and Annual Reporting forms. The new forms are much more comprehensive then were used in the past. The new information is now

available at the Municipal Hall, 8645 Stave Lake Street, Mission, BC, and on mission.ca. Applicants can obtain an application form, copy of the Permissive Tax Exemption Policy FIN.31 and excerpts from the Community Charter. The purpose of this policy is to help organizations identify their possible eligibility for exemption. The applications are for a full or partial municipal tax exemption for property taxes

as per regulations set out in section 224 of the Community Charter. Permissive tax exemptions are a means for council to support non-profit, charitable or philanthropic organizations within the community that further Council’s objectives of enhancing quality of life and the delivery of community services economically. Exemptions are awarded strictly at the discretion of the council.

Volunteer for this year’s Canada Day Celebrations The planning for Mission’s 2013 Canada Day Celebrations is well under way. Each year the event grows, more attractions are added and the need for volunteers increases. More than 80 volunteers will be required to help with many areas such as; pony rides, set up, greeters, face painting, take down crew and more. In anticipation, the Mission Parks, Recreation and Culture Department is hosting a face-painting and balloon twisting workshop for interested volunteers. Mission’s Canada Day Celebrations will be

held at Fraser River Heritage Park on Monday, July 1. The event runs all day, starting with a pancake breakfast. Tim Hortons Main-stage Entertainment, the Canadian Tire Kids Zone, Fly-ball Dog Show and much, much more, all ending with a fireworks display that will light up the night. Volunteers receive a free lunch voucher, T-shirt and the satisfaction of helping out. Mission Secondary School’s jazz band kicks off this year’s Envision Twilight Concert Series on June 5 at Fraser River Heritage Park. Band members, students in Grades 7 to 12, draw their inspiration from diverse musical eras. The performance will feature solos from a number of students on a variety of instruments. The Twilight Concerts are put on by the Mission Heritage Association in partnership with Envision Financial. Concerts take place every Wednesday and Friday from June 5 until Aug. 30.

This year’s Mission Folk Music Festival is being held July 25 to July 28 at Fraser River Heritage Park. The event will feature artists from around the globe, including Jim Byrnes, Eliza Gilkyson, Italy’s Piccola Band Ikona, and Scottish singer Dick Gaughan. There will also be B.C. musicians taking part, including Locarno, The Bills, Oliver Swain and Big Machine, and Viper Central. Special guests and resident artists this year are folk singer David Francey and Scotland’s Mairi Campbell. Tickets to the show are now on sale at a special price until midnight May 31. MACHELL, Beatrice Emily (Betty) March 25, 1920 – May 20, 2013

After a brief stay in hospital, Mom passed away at the age of 93. She was predeceased by husband Bob in 1996 and grandson John in 2002. Survived by children; David (Pat) Mission BC, Harry (Shirley) Aldergrove BC, Linette (Gary McRae), Surrey BC, Judy (Frank Raimondo) Cobble Hill BC, Jim (Fiona) Cowichan Bay; twelve grandchildren, and twelve great-grandchildren. Born in Barrie, Ontario, she graduated as a Registered Nurse from Peterborough ON in 1943. In 1944 she married Robert James Machell. She moved to Matsqui BC to help out with the family farm after the flood of 1948. In 1968 she moved to Cobble Hill. Betty worked as a graduate Nurse at Cowichan Lodge from 1978 to 1985. After retiring, she was a member of the lodge auxiliary until moving to Langley, BC in 2006. In 2009, she returned to Cowichan Bay to live with her son, Jim and daughter-in-law Fiona where she stayed until her passing. The family wishes to thank all the staff on 2 West at the Cowichan District Hospital. Very special thanks to her primary home-caregiver, Donna; as well as Jane and Candace. A celebration of Betty’s life will take place at 1:00 pm on Saturday June 1, 2013 at HW Wallace Cremation and Burial Centre – 5285 Polkey Road Duncan, BC. We prayed for a miracle, all in vain. That God would make him well again But God knew best, we had to part. It eased your pain, but broke our hearts.

Delphine Helen Voth, aged 87 years, passed away peacefully on May 21, 2013. Delphine was predeceased by her husband Peter in 2001 and her sister, Maxine Nielsen, in 2007. She will be sadly missed by her son Grant (Valerie), her daughter, Wendy (Kim) Halonen, her grandchildren, Kacie, Jordan and Linzi, her great grand-daughter Londynn and her sister, Hazel Lehman in Rosthern, Saskatchewan. She was predeceased by her daughter Amy Lynn Frame and her sister Pauline Clark. SUNDER Anna Johanna Helena (van Oosten) Exemplifying the humble grace with which she lived, and surrounded by the family she raised and selflessly loved, it is with great sadness that we announce the passing of our beloved Mom and Oma, Anna Sunder, on Friday, May 24th, at the age of 80. Anna was predeceased in 2006 by her loving husband of 50 years, Art, whose loss she felt every day, as well as her brother, Koos van Oosten, and sistersin-law Corry van Oosten and Annie van Oosten. She will forever remain in the hearts of her six children, Peter (Patti) Sunder, Leo (Tina) Sunder, Margaret (John) Bekkers, Anita (Mike) McMahon, Theresa (Darryl) Kokoska, and John (Christine) Sunder; her 20 grandchildren and 13 greatgrandchildren as well as her loving family overseas; her sister Leny (Nico) Broch and three brothers Cor (Cisca), Leo (Annie) and Jan (Agnes) van Oosten in Holland; her brother Gerard (Mies) van Oosten in New Zealand; and their families as well as many extended family. She will also be missed by many dear friends and the family is grateful to them for their friendship, care and concern. A special thank you to Hilda Finch for her dedicated companionship, especially as Mom’s health declined. A sincere thank you is also extended to those who cared for Mom when she was in Mission Memorial Hospital and to the doctors, nurses and staff at the Christine Morrison Hospice for their kind and gentle care of Mom in her final days and for their support of the family during such a difficult time. A Prayer Service will be held on Friday, May 31, 2013 at 7:30 pm and a Funeral Mass on Saturday, June 1, 2013 at 11:00 am at St. Joseph’s Catholic Church, 32550 Seventh Ave., Mission, BC.
