What’s New in the City? THE “FOUR CAPITALS” TRAIN: KYIV – MINSK – VILNIUS – RIGA

The “four capitals” train—a route that visits Kyiv-Minsk-Vilnius-Riga in the span of 19 hours — was launched Sept. 28. The launch follows Ukrzaliznytsia’s purchase of 28 new passenger cars in April, so you can expect a very comfortable and pleasant trip. Tickets for the full trip are just €59, making the route affordable for Ukrainian travelers. Original plans for the route were to have include Tallinn, making it the “five capitals” train. Perhaps another European capital will be also on the list in the near future. Who knows?

During the first half of 2018, some 850,000 foreigners visited Kyiv, according to official data, an encouraging 24% increase over the same period a year ago. To help keep tourists safe and sound, the Kyiv City Government has launched a “tourist info” hotline. By calling 6116, visitors can get all the information they need: for example, how to get to the city center from the airport, or where to have a tasty meal. Visitors may also talk directly to an operator and ask specific questions. The service is free and available in three languages: English, Ukrainian and Russian.

FLIGHTS FOR 10 EUROS: RYANAIR BEGINS SERVICE TO UKRAINE

A red carpet, flashing cameras, women in fashionable dresses, men in elegant tailcoats — that’s what the 28th annual “Miss Ukraine 2018” contest was all about. Held on Sept. 20, this year’s show focussed on the theme of revealing the power of the elements: earth, water, air and fire. There were 25 participants in this year’s competition. A distinctive feature of the finalist part of the competition was performances by artists and musicians. The honorary jury named 23-year-old Veronika Didusenko as Ukraine’s most beautiful woman, but she was soon the center of gossip and scandal. She owned the crown for just for a couple of days before it was learned that she had hidden from organizers that she was married and had a child—both of which are forbidden under the competition rules. She was disqualified, and the issue has now been resolved. The crown of “Miss Ukraine-2018” was handed over to Leonila Guz, 19, who will represent our country at the Miss World contest in China on Dec. 6. Organizers will probably keep in mind for the future that uniting the four elements may risk creating an explosive mixture—and ensure a very careful vetting process before next year’s competition!

It’s an answer to the prayers of travel addicts: Irish lowcost airline Rynair has begun flying to and from Ukraine. The first Ryanair route began Sept. 3, flying Kyiv-Boryspil–Berlin–Schönefeld was successfully fulfilled. This autumn and winter, Ryanair will offer flights to eight countries from Boryspil International Airport, including Spain, Poland, Sweden, Slovakia, and Germany. There are 13 routes available at the moment. As of this writing, today’s cost for a flight to Warsaw starts at €19.57 (approximately UAH 650); a ticket to Barcelona for Oct. 27 can be purchased for €78.93 (slightly more than UAH 2,500), and so on. Ryanair uses dynamic pricing, so check out current fares on the airline’s official website. Note that Ryanair won’t fly only from Kyiv. Departures in several directions are also available from Lviv Danylo Halytskyi International Airport. The Ukrainian brand Ukraine Now has been named the winner in the Corporate Identity category of Red Dot 2018, a prestigious design award that has been presented annually for more than 50 years. The award honors its work in the “branding” of Ukraine. Works of the winners are exhibited at the Red Dot museum in Essen, the world’s largest collection of achievements in modern design. In 2018, within the framework of the competition, a jury of 24 experts evaluated more than 8,600 entries from 45 countries. The prize for Ukraine Now will be presented at an official ceremony on Oct. 26 in Berlin. We are proud!

he holiday, for all its fun and spooky customs, has ancient roots that may go back to the religion of the Druids.

According to legend, on the night of Halloween, spirits living in the other world come back to earth on the eve of All Saints’ Day (November 1). A legend remembers a cunning sinner, Jack, who was not accepted either in hell or in paradise. Wandering around the world with hellish fire in his hands, Jack used a pumpkin as a lantern to keep that fire, which thus became the symbol of the holiday. This festive night, the jack o’lantern replaces ordinary lights and serves to illuminate the road for souls returning to purgatory.

To understand what Halloween is all about, it’s necessary, at least once in your life, to dive into the atmosphere of the holiday on the night of October 31. We’ll suggest some mystical places and events to visit in the capital of Ukraine. So, trick or treat?

The Castle of Richard the Lionheart

Despite its romanticized name, this apartment house in Kyiv has nothing to do with the English King Richard. Writer Viktor Nekrasov came up with the nickname for this unusual building, constructed in Neo-Gothic style, noting its resemblance to medieval castles in the age of knights. And castles, as you know, are always shrouded in mystery. The Castle of Richard was built in 1902-1904 on the orders of Dmitry Orlov, who planned to profit by renting out apartments in it. However, the Kyiv industrialist was shot and killed before the substantial mortgage was paid off, and his widow sold the house to pay off his debts. Since then, the house has been sold and resold several times, but none of the owners stuck with it for long. It was said that the house was full of evil spirits; that terrible moans and howls had been heard around the

castle; and that at night people had heard ghostly footsteps and crying of children. Some even claimed to have met ghosts in the halls. Tired of hearing the howling noises, one of the tenants, historian Stepan Golubev, decided one day to put his hand up into a chimney and found an eggshell lodged there, which apparently had resonated and created spooky sounds under windy conditions. It may have been embittered workers, exercising revenge on a greedy owner, who decided to play a cruel joke on him by putting eggshells, bottles and other hollow objects into the ventilation system. So, the sounds disappeared, but the legends live on at Andriyivsky Uzviz. The Castle of Richard the Lionheart became a favorite residence for painters, poets, musicians and other bohemians during a certain period, but now it stands empty and mysterious.

Starting point of the tour: Kontraktova Square, located in the Lower Town (Podil District). This is one of the oldest squares in Kyiv, known from the times of Kievan Rus. Since ancient times, it was a trading place where numerous contracts were concluded, which gave the square its name: “Kontraktova.” As you reach this point, turn right and cycle all the way around Hostynnyi Dvir, a trade complex built in the early 19th century, which served as a marketplace containing 50 shops. (At present, it is under reconstruction.) You will pass by the fountain/sculpture of Samson (the Bible character), tearing the lion's jaw from which the water flows. Near Pyrohoshcha Church, turn right to Frolivska Street, from which turn left on Borychiv Tik Street. On the left side, you will notice the beautiful 18th century Pokrovska Orthodox Church. Borychiv Tik Street will take you to the colorful Poshtova Square, near the Dnipro River. Don’t miss the landmarks of this area: the Nativity of Christ Church and the main River Port in Kyiv, from which Kyiv citizens love to take a ride on a river cruise boat along the Dnipro in the warm months.

From Poshtova Square, head to European Square by climbing up through Volodymyrskyi Descent. Near European Square, visit one more Kyiv attraction: the Friendship of Nations Arch. It is a huge rainbow-shaped symbolic monument initially dedicated to the unification of Russia and Ukraine within the Soviet Union. Immediately near the Arch, there is an observation point with lovely views of Dnipro River and the left bank of Kyiv. There is also an outdoor performance stage. Go up the steps and ride along the parkway to the miraculous Kyiv Academic

Puppet Theatre, which resembles a castle with fabulous sculptures on the grounds around it; the Kyiv Water Museum; and Park Bridge, also known as Lovers’ Bridge and traditionally covered with many love locks. Pass by Valeriy Lobanovskyi Dynamo Stadium. Just after the openair stage called the Rakushka (Ukrainian for “shell”), turn

right. Here you can see monuments to Ukraine’ foremost female poet, Lesya Ukrainka, the talented composer Mikhail Glinka, and theatre actress Maria Zankovetska and a lovely fountain. Just in front of you, you will see the national government building devoted to the Cabinet of Ministers, the highest body of state executive power in Ukraine.

Turn to the other side of the park and go in the direction of the Verkhovna Rada of Ukraine (our Parliament), and admire the beauty of the recently renovated Mariinsky Palace, located nearby, which serves as the official ceremonial residence of the President. The square in front of the Parliament and Mariinsky Palace is called Constitution Square. On the edge of the square is an observation deck where you should definitely stop for a while to enjoy simply wonderful panoramic views of the left bank of Kyiv.

After taking in the panorama, turn into Shovkovychna Street, then Instytutska Street, and on to Bankova Street. where you’ll see one of the most famous buildings in Kyiv, the early 20th century House with Chimaeras. The building’s name relates to its many mural decorations based on fanciful creatures, including mermaids, snakes, frogs, and the heads of elephants, crocodiles and more. On the opposite side from the house is the Presidential Administration of Ukraine.

From Bankova Street, head through Lyuteranska Street and Shovkovychna Street to Pylypa Orlyka Street. Here, at the corner of Pylypa Orlyka Street and Lypska Street, you will find the monument to the Ukrainian Hetman Pylyp Orlyk, founder of the first Constitution in Europe (issued in 1710). Cycling though Lypska Street, we reach Mariinskiy Park. In the park, together with a beautiful old fountain, you will find a delicate chestnut sculpture, a reminder of the beauty of Kyiv’s best-known floral symbol: the blooming chestnut tree. From the park, move on though Mykhaila Hrushevskogo Street to Arsenalna Square. Look around the square and you will find one of the oldest and most famous factories in Kyiv, the Arsenal Factory, one

of Kyiv’s oldest manufacturing centers and still a state enterprise producing optical instruments and optico-electronic systems. Nearby is the Arsenalna metro station, the world’s deepest metro station, 105 meters below the street. Here you’ll also find the monument to the Arsenal Plant Workers. Just after the Arsenalna metro station, turn left and move on to Parkova Road and continue cycling to Andriya Pervozvannoho Square, where you will see the Church of St. Nicholas in Askold’s Grave Park, and the Church of St. Andrew. Nearby you will find the monument to the Heroes of Kruty, placed here in 2006, during the post-Soviet period, to honor cadets who died defending Kyiv at the Battle of Kruty, which delayed the advance of the Bolshevik Red Army on Jan. 29, 1918.

From the Church of the Saviour at Berestove, advance to All Saints Church (a Ukrainian Baroque church of the 17th century), which serves as one of the gates (called “Ekonomichna Brama,” located just under the church) to the 11th century Kyiv Pechersk Lavra, one of the first Orthodox Christian monasteries in Kievan Rus. This site is included in the list of the Seven Wonders of Ukraine and is also on the UNESCO World Heritage List. After passing through the gate, you will find yourself near Uspenskyy Sobor, the main cathedral church of Kyiv Pechersk Lavra. On the square where Uspenskyy Sobor is located is the Great Lavra Bell Tower, the Library of Kiev History and a large museum complex with outstanding exhibits. (Some of the most prominent are the Mykola Syadristy Microminiatures Museum and the Museum of Historical Treasures of Ukraine.) There is also a school of icon painting. From behind its building, you will find an amazing observation deck with a picture-postcard view of Kyiv. You can easily spend half a day exploring the huge Lavra complex, with its many ancient churches and catacomb caves, so we won’t concentrate on all the places of interest here but simply continue our cycling trip.

Climb the hill using Heroiv Krut Alley and walk along the Alley of Glory in the Park of Eternal Glory, which hosts an obelisk commemorating World War II (the Tomb of the Unknown Soldier) and an eternal flame. This spot also offers scenic views of Kyiv. Continue the ride to the National Museum and Memorial to Holodomor Victims, devoted to the victims of the man-made famine in Soviet Ukraine in 1932/1933. Just after the museum, there is a Spaskyi Bastion, the old fortification protecting the Church of the Saviour at Berestove (built in the 11th and 12th centuries).

From the observation deck near the museum, you will find a set of stairs leading down to the Dnipro River. We will go down by the dirt road to Ivana Mazepy Street. Cycling along Druzhby Narodiv Boulevard, ride the path to the pedestrian tunnel that will take you safely under the Naberezhne Highway to Navodnitskii Park, which provides a truly spectacular setting. Here you can pass along shady pathways, admiring the views of the Dnipro, and take pictures of famous monument in honor of the founders of Kyiv, which according to legend were Kyi, Shchek, Khoryv and their sister Lybid, shown in a bronze boat, the symbol of our capital. Navodnitskii Park is a traditional place to visit for all Kyiv newlyweds to take photos and throw bouquets for luck.

From the park, move on along Dnipro Quay in the direction of Kontraktova Ploshcha. Street artists love this spot, as the painted walls extend for kilometers and create one continuous work of art. While in the secondary housing market full payment is required, in the new-home market real estate developers usually offer a variety of payment plans, such as payment in installments, soft lending with the engagement of partner banks, and trade-ins (though not common in Ukraine).

Due to economic instability in the country, choosing a reliable developer with a perfect reputation is crucial when investing in real-estate construction in Ukraine. As a result of rising costs for real-estate construction and the devaluation of local currency, the Ukrainian real-estate market has seen numerous scandals involving developer bankruptcy. Such situations were especially widespread during the global economic crisis of 2008-2009 and even afterwards, when the real estate market took a huge hit and construction was frozen on many building projects.

Risk of fraud

Fraud by an unscrupulous developer is the main risk while buying a new apartment in Ukraine, especially given the country’s inefficient and corrupt legal and court systems. The most massive example of a scam in Ukraine’s real estate market was revealed in 2006 when more than 1,759 people were defrauded of about UAH 400 million by the large building company Elita-Center Group. It had collected money from investors for the construction of 40 housing complexes in Kyiv that were not built. As of the beginning of 2017, a list of construction violations in Kyiv encompassed 62 residential complexes. Among the main violations are discrepancies between the approved project and what was actually built; secondly, buildings that were not being used according to their intended function; and third, developers

While buying an apartment in a new building, the stated size of the flat and, thus, the number of square meters for which you are paying are estimated ones. Try to gather as much information as possible before you begin treatment, and don’t be in a rush, hoping to solve multiple problems at once.

Wherever you find a Ukrainian dentist, don’t be afraid to choose him or her when you’re in need. But don’t forget that in Ukraine itself, solutions for all your dental issues will be much cheaper. Iryna Mazur points out that, “In Ukraine tooth restoration with the use of photopolymer composites costs about UAH 2.000 ($70). In Europe you will pay several thousand euros; in the U.S. a few thousand dollars. Keep in mind that all sorts of dental treatment are available in Ukraine, including the fixing of implants. Restoration of dental aesthetics is the only procedure that will cost almost as much as abroad. But such treatment is always time-consuming and can’t be cheap in any way.”

BRINGING YOUR SMILE ABROAD — WHY NOT TO UKRAINE? All over the world, costs for major dental care keep rising, prompting many people to look for more affordable alternatives. In the U.S., dental care is often not included in health insurance plans, and it’s a similar story in other parts of the English-speaking world. People in the UK, Ireland, Australia, New Zealand and Canada also look for more affordable dental care. Many Asian and African countries could be added to the list.

But the services of dental professionals cost less in Ukraine, which is why they’re often recruited to other countries. According to official statistics, every third dentist working in Poland came from Ukraine. Britain is another market that may be conquered by Ukrainian dental specialists. At the moment, a dentist’s qualification is automatically recognized within the EU. But it’s unclear whether this recognition will stay in force in Britain after Brexit. Therefore, many non-British dentists may leave Britain after its “divorce” with the EU. That may give Ukrainians a chance to fill this niche.

Third, seeing specialists is sometimes necessary while healing dental diseases. You may have specialized needs: you may need an otolaryngologist, or prefer a female dentist, for example. Some Ukrainian dental clinics have developed a multidisciplinary approach, which means they have a network of professional links and will send you to a reliable specialist or laboratory to get additional consultations and do testing. This could take more time and money than expected. So when planning a dental vacation, add a couple of days to your itinerary in case emergency issues arise. If everything goes smoothly, you may spend them travelling around Ukraine, sightseeing, or enjoying a restful stay at a spa.

Don’t forget you may also need a translator while visiting a dentist in Ukraine, though in big cities, doctors, especially those of the younger generation, are often fluent at least in one foreign language, most often English.

Many Ukrainian cities that offer good opportunities for dental tourism are either historical centers or resorts. Among them are Kyiv, Odesa, Lviv, Uzhhorod, Kharkiv and Dnipro. In spa-resorts such as Morshyn or Myrhorod, dental treatment can be supplemented by preventive care and dental hydrotherapy. However, complicated and time-consuming procedures need to be planned beforehand. Make sure your doctor will be available in a resort clinic throughout the period you’ll need to complete all the necessary procedures.

Studying in a foreign country is a great opportunity to advance in your career, make a lot of new friends and become familiar with a new language and culture. But it’s no secret that there are many difficulties associated with the study-abroad experience. To provide foreigners who are currently considering or have just started studying in Ukraine a better idea of what it’s like and some useful tips and frank advice on how to make this step easier from the beginning, we invited six foreign students from various Ukrainian universities to tell us what you need to know about life as an international student in Ukraine, including immigration matters, tuition fees, specifics of the Ukrainian study process and student culture. SELAZE LOTSU I came to Ukraine to study for my bachelor’s degree in telecommunications at the Kyiv National Technical University of Ukraine. This I have successfully accomplished, and now I’m pursuing my master’s degree. The university has highly qualified tutors and offers great opportunities for students who are serious about learning. My experience in Ukraine has been interesting. There is always that element of culture shock when a foreigner arrives in the country for the first time, which I have experienced. On my arrival in 2012, most of the people I met didn’t speak or understand English, which made communication very frustrating. However, it played a key role in motivating me to learn the Ukrainian language. Now I can boldly speak, read, write and communicate effectively in Ukrainian. My social life has progressed significantly.

OLIWIA SCHILDT I moved to Ukraine in September 2013. I was very interested in Ukraine as a country, because it is located between the European Union and Russia. Since I really wanted to improve my Russian skills, I decided to move to the eastern part of Ukraine, to Kharkiv. However, I did not know at that time that so many drastic changes would happen in this country, and I came in the middle of a very happening time! On the one hand that was very interesting for me, but I was of course facing a lot of things that were making me very upset.

JAMES BROWN I came to Donetsk, Ukraine, in 2014. As my brother was in Ukraine already, it wasn’t a difficult thing to decide. I studied the Russian language in the preparatory faculty. However, due to the war I flew back to Ghana and returned in August 2015, this time around to Kyiv National University of Life and Environmental Sciences of Ukraine, where I studied agrobiology and completed my university education. My experience with socializing in Ukraine was amazing. Thanks to God I met good guys. Ukrainian people are very friendly but shy, so one has to make the approach.

STEFANIE KOWAL Having been born in Australia with Ukrainian heritage, I was surrounded by all things Ukrainian, and thus from an early age I felt inextricably connected with my Ukrainian roots. Ukrainian dance, Ukrainian Saturday school and scouting were an integral part of my youth, and these activities ensured I was an active member of the Ukrainian diaspora in Sydney. I was fortunate enough to travel with my family to Kyiv in 2009 and again in 2013, where I danced with the Virsky Dance Company, after which I knew I simply had to return to the glorious city. I would do everything in my power to make my dream become a reality. Such an opportunity arrived when I applied for a scholarship to study at Kyiv Mohyla Academy (KMA), offered by our diaspora. Having applied during a tumultuous time after the events of Maidan, there were few applicants, and I was successful in my application. My first impressions of Kyiv were everything I had imagined and more. The mixture of old and modern architecture, the cobblestoned streets of old Podil, along with a patriotic spirit among the people, would provide a perfect backdrop for my year of studies at the Academy. I felt very much at home. To my surprise, the people were warm, open and incredibly hospitable.

MARY BEATRICE I moved to Ukraine about three years ago. At first I came as a tourist. and for personal reasons decided to stay and pursue a degree here, which has been quite a journey so far. I study now at the National University of Technology and Design (KNUTD), pursuing a degree in fashion design and construction. Socializing in Ukraine is definitely different than in my homeland; the people here are a little more reserved, but after a while you get used to it.

HOW EASY WAS IT TO GET YOUR STUDENT VISA? Oliwia Schildt I have to admit that at the time I applied for my visa (this was almost five years ago!) it was not very easy. In the consulate in Germany they were not very informed about which documents exactly I would need for my student visa, and I had to wait a long time. Later on I had registration issues at the university (that took five months!) until got registered. This means that I did not have my passport for almost six months. So, frankly speaking, I have had very bad experience with that — but I am sure that things have changed over time...

James Brown Getting my student visa took me approximately a month or so, thanks to my ever hard-working mum, who was in Senegal to get it for me. Ghana doesn’t have a Ukrainian embassy, so we always have to travel to Nigeria or Senegal to get a visa. This is one major problem we have. Stefanie Kowal Attaining a student visa wasn’t the simplest of tasks. The process itself took a number of months, as all documents required translation into Ukrainian, including medical certificates, past university transcripts, and my birth certificate and passport.

It would be good for students if they would do a course for learning Russian/Ukrainian before they start studying. I know an amazing teacher at the University of Kharkiv who is teaching Russian and is doing wonderful work with exchange students. WHAT ARE THE BENEFITS OF CHOOSING UKRAINE FOR HIGHER STUDIES? Oliwia Schildt I really wanted to improve my Russian language skills and also see how sociology and public relations are taught in a Ukrainian university. I think one of the biggest benefits to studying in Kharkiv is that it is a very happening city, and young people especially can do so many things there! The nightlife is great and not so expensive, and generally Ukraine is a country with many traditions and tasty food, and one can travel very nicely there! People are happy to help out and, especially right now, the young generation is very active and creative. James Brown There are a lot of benefits studying in Ukraine away from home. It

made me more responsible and independent. To live without parental guidance and not mess up — it was a great life-molding process for me. Aside from that, the professors and lecturers give extra attention to students here; they kind of have a very close relationship, and I find this very beautiful. Stefanie Kowal My desire to study in Ukraine and apply for a scholarship at KMA stemmed from my strong desire to improve my level of spoken Ukrainian. In my first year, I chose a variety of different cultural and historical courses. In addition to this, I enrolled in an intensive Ukrainian language course to supplement my

Initially it was very frustrating, simply because I wasn’t conversant with the language. It made the learning pro-

cess difficult, but that was overcome as I gained mastery over the language. I took special Ukrainian language courses that were offered by the university for foreign nationals, which helped to improve my language skills. Mary Beatrice My language of study is Russian, but some teachers prefer speaking only in Ukrainian, so mostly there are both languages. One of the significant barriers I see is clearly the language. Ukrainian universities mostly provide studies in the official language, while most foreigners learn Russian, and it can be difficult to adapt.

the tuition fee was substantially cheaper than university courses in Australia. In Kyiv I was happy to and capable of renting my own small flat within close proximity to the Academy: approx. UAH 10,000 per month. This was slightly more expensive than I was hoping to pay, however I was living in a very central part of the city and it was convenient for me to get around and experience true city living.

DID YOU NOTICE ANY DIFFERENCE IN THE EDUCATIONAL PROCESS IN UKRAINE COMPARED WITH YOUR NATIVE COUNTRY? WHAT COULD BE IMPROVED TO ATTRACT MORE INTERNATIONAL STUDENTS TO UKRAINE? Stefanie Kowal A key difference in Ukrainian universities, in contrast to my own university experience, relates to the use of technology. Assignments, projects and assessments were all done manually at KMA. In Australia, many universities use computer-based operations in the submission of assignments and exams. Online resources are freely available. I felt KMA was lacking in this area. From my own experience, university courses in Ukraine more closely resembled classes at a high school, there being a smaller number of students per class for lectures and tutorials. However, with smaller numbers comes a more personalized overall experience. For example, stronger student-teacher relationships are possible in Ukrainian universities than in larger foreign universities. Enrolling in KMA was a fairly straightforward process. ­However

I did experience some delays in communication with university staff. Communication between the university and the student is incredibly important in ensuring a smooth enrollment process. James Brown There are a lot of differences. In Ghana, attendance is not checked in the university, but in Ukraine, it’s checked daily from class to class, and if you miss more than three from a subject you have to do rework—and in the medical university you pay before doing the rework. The key challenge in Ukraine is the language barrier. If non-medical universities had more English-speaking professors and lecturers it would greatly help. Oliwia Schildt Yes, of course. I would say that it is a totally different education

system, which makes it of course very interesting. In Germany you are more flexible choosing your classes, etc., and the exams contain more open questions and essays. I think that the key challenges are all the bureaucratic issues. Over the time in which I was studying there, I needed a lot of different documents, etc. Selaze Lotsu For me, the challenges of studying in Ukraine were the hash cold winter conditions and, most of all, the initial language barrier. In a nutshell, I think more studies in the medium of English should be introduced to open the way to admission of more foreign students. I also think the accommodation conditions should be improved, with modern facilities and general upgrades to make students comfortable while they study.

CAN ONE WORK WHILE STUDYING IN UKRAINE? James Brown Work and study in Ukraine is possible but very difficult and not allowed for foreign students. There are a lot of job opportunities, but the pay is minimal, and that is not encouraging. Living in Ukraine as a student is extremely comfortable, but to live there and work with family is tough, in my opinion. Selaze Lotsu Ukraine has very strict policies concerning immigration and working as a foreigner. It’s officially not permitted to work in Ukraine as a foreign student. You can only work if you have a work permit. Stefanie Kowal During my time at Mohyla Academy, I was enrolled both as a full-time and as a part-time student. Studying part time allowed me to explore what Kyiv as a city had to offer, as well as take on individual tutoring jobs and work as a teacher in different countries. Osman Abbas I have thought about working during my studies but did not find I had enough time. It’s difficult in medicine to study and work at the same time like in other specialties.

ADVICE FOR FOREIGNERS WHO WISH TO EXPLORE EDUCATIONAL OPPORTUNITIES IN UKRAINE Oliwia Schildt I think that research and checking out the universities and study programs is very important. Besides, it is very good to have a partner you can contact who can support you with different things. I am sure that in recent years a lot of new study programs have been created — so it is definitely worth trying it out! James Brown My sincerest advice to anyone seeking to explore educational opportunities in Ukraine would be to just go ahead, see it as a challenge that you can take on. The people are friendly, so choose friends wisely and you will win. Mary Beatrice Contact the university you want to apply for directly and not through agencies. The process of applying is not hard, and an intermediary is unnecessary. Also, try to learn at least the basics of the language beforehand, as English is not widespread enough here yet. Stefanie Kowal Studying in Ukraine is undoubtedly an exhilarating, rewarding opportunity. Not only can a student be enriched by the country’s history and culture, it is a financially cheaper alternative to many international universities. I firmly believe it is necessary for Ukraine’s universities to follow in the footsteps of their western counterparts by adopting online methods and simple enrolment processes for foreign students. Perhaps incorporating more courses taught in the English language would attract foreign students.

uring recent years, the Ukrainian government has made efforts to increase tourism in Ukraine. While citizens of the USA, EU countries, Canada, Turkey and some others are able to enjoy visa-free visits, 15-day tourist or business visas on arrival have been introduced for visitors holding passports from 31 other countries (including China, India, Singapore, Australia and more). It’s also possible to obtain a visa electronically for passport holders from 45 countries. The entry into Ukraine of the Irish discount airline Ryanair is another good sign that the tourist industry in Ukraine is poised to grow quickly. If you are one of those expats who love our country and would like to show it to others, and are considering opening your own tourist business in Ukraine, this article is for you. Here is a quick guide for foreign nationals on opening a tourism-related business in Ukraine.

Tour Agency VS Tour Operator

According to the Ukrainian law, there are two main types of tourism businesses in Ukraine: a tour agency and tour operator. What are the key differences? A tour operator is a company, registered in Ukraine, that holds a tour operator licence and whose activities are exclusively devoted to organizing tour product (a combination of two or more touristic services sold or offered for sale under a specific price, including transportation services, accommodation, support services such as visits to places of interest, cultural events or historical places of interest, organizing leisure and rest, etc.), realization and provision of tourist services, as well as support services to tourists as an intermediary. The tour operator is responsible to tourists for the tour and the quality of services rendered. A tour operator may also perform tour agency activities. www.kievcheckin.com

A tour agency is a company or a private entrepreneur in Ukraine, which does not require a license and which performs an intermediary activity of realization (sale) of the touristic product (a tour) created and offered by a tour operator(s), as well as the sale of other tourist services as an intermediary. According to Ukrainian law, opening a tour agency does not require a license. The key difference between a tour operator and a tour agency is that tour operator creates a tour product and sells it, either directly to the customers or through a tour agency. This involves booking accommodation, transportation and other required tourist services. The essential agreement is between the tourist and the tour operator, not the tour agency. A tour agency acts only as an intermediary when selling the tour product (the tour) and tourist services. Note that according to art. 37 of the Law of Ukraine “On Tourism,” foreign individuals and foreign legal entities can perform tour agency and tour operator activity in Ukraine through registration of a legal entity in Ukraine and by obtaining a tour operator licence. A foreign tourist-related business entity may conclude an intermediary agreement related to tourism in Ukraine only with a tour operator company that is registered in Ukraine. Intermediary agreements with other partners will be considered as void. Therefore, if a foreign national would like to bring tourists to Ukraine, s/he has to: Either partner with a local tour operator; OR Set up his/her own legal entity in Ukraine and get a tour operator licence, issued by the Ministry of Economic Development and Trade.

Key Requirements for Tour Operators in Ukraine

According to Ukrainian law, a tour operator’s activity needs to be licensed and the company needs to comply with a series requirements, such as: The tour operator must be registered as a company under Ukrainian law (in most cases, tour operators act as limited liability companies); The tour operator’s exclusive types of activity should involve organizing and selling tours, and intermediary tourist services. No other types of business activity are allowed. The tour operator is required to have its own website. The director of the tour operator company must have higher education and work experience in the field of tourism of not less than 3 years OR higher education in the area of tourism (Specialist, Master’s Degree) — in the latter case work experience is not required. Not less than 30% of the staff of the tour operator need to have work experience in the field of tourism for not less than 3 years OR higher education in the field of tourism (Specialist, Master’s Degree). All employees must be hired based on a labour contract. To obtain a tour operator license, the company must have a personal or rented non — residential premise where tour operator services will be provided (at least 10 square meters). To obtain a license, the tour operator is obliged to have a financial institution guarantee that will cover any financial damages caused to tourists by the tour operator in the amount set by legislation (equal to EUR 10 000 for an operator of internal tourism (including foreign tourists visiting Ukraine), and EUR 20 000 for a tour operator directing foreign tours). BUSINESS Opening Your Tourist Business in Ukraine The sections below provide detailed information on minimum statutory requirements and the documents that have to be filed for setting-up a tour operator company in Ukraine.

Choosing an Appropriate Business Structure

Ukrainian law offers a wide variety of possible business structures. However, the most popular business structure is a limited liability company (in Ukrainian, Товариство з обмеженою відповідальністю, or simply “ТОВ”), which strikes the best balance between complexity, flexibility, and scalability. It offers full liability protection to business owners (i. e. their personal assets are protected from business liabilities) and the flexibility to grow bigger as your business expands, yet at the same time involves simpler scrutiny and compliance requirements. Individuals as well as companies can register an LLC in Ukraine. A unique feature of the Ukrainian Limited Liability Company structure is that share capital is divided into parts and not in number of shares. Each member owns a part of the company as prescribed in the Companies Register (called State Register of Legal Entities, Private Entrepreneurs and Public Formation). Key features of an LLC include: Shareholders. An LLC must have a minimum of 1 shareholder. The shareholders can be individuals or corporate entities and either local or foreign individuals/entities. Directors. Directors can be one or more individuals (can be ei ther local or foreign individuals; the latter have to obtain a work permit and temporary residence permit). Corporate directors are not permitted. Directors are appointed by shareholders via a general meeting of shareholders. Company Secretary. Appointment of a Company Secretary is not required. Registered Address. Each company must have a local registered address in Ukraine that acts as the office where the management of the company conducts its activities. Share Capital. Share capital has to be formed, but there is no minimum share capital required, so the minimum amount is 1 UAH. Shares reflect the percentage held by each company’s owner in the total share capital as listed in the company’s charter. Transfer of Shares. Shares can be freely transferred subject to the priority rights as described in the company charter. Registration Cost and Timeline. Government registration of an LLC is free of charge, and registration can generally be completed in 1 working day once the necessary documents are ready. Governance. An LLC is governed by the following bodies: • General meeting of shareholders (“GMS”) — the main decision-making body, which has powers to resolve all issues • Director / Board of Directors as elected by the GMS • Other bodies as described in company’s charter Employment Agreements. Can be either in written or verbal form. Employment of foreign citizens can be only in written form. The general rule is that employment of foreign citizens requires a work permit and a temporary residence permit (unless the foreign individual has obtained a permanent residence permit).

How to Set Up a Company? An LLC, as with any other company in Ukraine, is considered to be created from the moment of its registration in the Companies Register. In order to apply for the registration, you will need to prepare the following documents: Company charter; Minutes of incorporation of an LLC and electing governing bodies; Application for registration Additionally, foreign nationals or companies will need to present the following documents to register an LLC in Ukraine:

OCTOBER NOVEMBER 2018 • Foreign nationals: • Passport copy • Tax registration certificate in Ukraine • Power of Attorney — if registration of the LLC will be performed by a representative • Foreign legal entities: • Extract from Company Registry (or another relevant state registry in which registration of legal entity is performed) or other documents, issued by government authorities, confirming the registration of a foreign company, its registered address, directors, shareholders and good standing • A document confirming powers of a representative authorized to register the LLC in Ukraine All documents that you bring from overseas must be either legalized or Apostilled unless prescribed otherwise by the international treaty between Ukraine and the document issuing country (for example, legalization and Apostille are not needed for documents issued in the Republic of Poland, Czech Republic, Republic of Latvia and some others). The exception is a passport, which does not require legalization and Apostille. Additionally note that if documents are compiled in a language other than Ukrainian, a certified translation has to be provided. Note that if you plan to appoint a foreign individual as a director (or another employee) of the LLC, additional documents will be required to apply for a work permit. At the stage of company registration, you have to appoint a resident director until the foreign citizen obtains a work permit. While preparing documents necessary for registration, you need to choose the type of business activity of the company under the National Classifier of Business Activities in Ukraine (КВЕД). Therefore, in the case of a tour operator, you should chose business activity КВЕД 79.12 “Tour Operator Business Activity” only (as mentioned above, according to law it has to be the only type of business activity of the company). Given Ukraine’s high level of bureaucracy, lack of clear-cut regulations, and language difficulties (most of the paperwork is done in the Ukrainian language), foreign entrepreneurs and companies are strongly advised to hire a competent and qualified corporate service provider that can assist them with all their initial setup as well as ongoing compliance needs.

Tour Operator License Once a company is registered, before starting tour operator activity the LLC has to apply to the Ministry of Economic Development and Trade for a tour operator licence. In order to apply for the licence, the company will need to provide the following documents: Application in the form approved by the Cabinet of Ministers of Ukraine. Filled-in form with information on locations of the tourist operator and its branches in Ukraine; Copies of education certificates and work experience of the director of the company (this should comply with the requirements as mentioned above for tour operators). Copy of insurance agreement with an insurance company, confirming mandatory insurance of tourists (medical insurance and accident insurance); Description (index) of documents, filed as part of the application. A company that has obtained a tour operator license has to ensure it complies with all the requirements as mentioned above for tour operators. If the tour operator fails to do so, the authorised representative of the Ministry of Economic Development and Trade can withdraw the license and impose a fine.
