Find your culinary favorite in Ukraine, and share your impressions with us at kievcheckin@contactukraine.com. If you want to taste Ukrainian dishes and learn more about Ukrainian traditions, here are some good places to try the local food in the center of Kiev:

TSARSKE SELO

Located in a magnificent part of the city just near the Kiev Pechersk Lavra, Tsarske Selo was one of the first Ukrainian national cuisine restaurants when it opened in 1998. You will be treated with great Ukrainian hospitality that, together with the cozy interior of Ukrainian village, creates a unique atmosphere of comfort and friendliness. The dishes preserve their historical names and are cooked according to the ancient recipes. It’s not a secret, the real Ukrainian feast is impossible without Salo (fat). The firm platter “Hulyay, salo!” that includes 4 types of this truly Ukrainian delicacy and is served with spring garlic and pickled cucumbers will be the perfect complement to a good meal. As a main dish, we highly recommend you to try their “Royal” borsch with pork ribs served in a bread pot and accompanied with bacon, onions and a glass of Ukrainian horilka "for good appetite." Aside from the high service quality, the personnel speaks foreign languages to guarantee you a comfortable visit. In the evening, be ready to feel the energy of live music and get closer to Ukrainian culture. Bon appetit, and have a truly tsar-like rest!

5 BRILLIANT CITIES TO VISIT

If You Want to Explore Ukraine More Ukraine is becoming an increasingly popular travel destination for tourists from all over the world. Ancient history, a variety of architectural styles, beautiful nature, cozy and tourist-friendly cities, rich cuisine and, of course, hospitable people, make the country extremely attractive for tourism. September with its great weather conditions and beautiful autumn views is a magnificent time of year to explore this beautiful country to the fullest extent. Below we provide an overview of popular travel destinations and essential tourist cities in Ukraine you will enjoy after sightseeing in Kiev.

LVIV Lviv is a city in the Western part of Ukraine founded in the 13th century and named in honor of Leo, the eldest son of Rus’ King Daniel of Galicia. There are more than four thousand lion sculptures in Lviv and therefore the city is also called the city of Lions. Each lion sculpture has its own history and symbolism. In the Middle Ages, Lviv was the capital of Kingdom of Galicia–Volhynia and a famous trading center. During the Eighteenth and Nineteenth centuries, the city was a part of the Austro-Hungarian Empire. After the Dissolution treaties in 1919-1920, it became a capital of the West Ukrainian People’s Republic. Lviv’s rich history is reflected in the rich architecture and authentic spirit of the city. Lviv is a truly European city with winding cozy streets and a lot of places to visit. Get acquainted with the most interesting places in Lviv: • Vysokyi Zamok (High Castle) is a popular place to observe the sunset, see ruins of the old castle, walk in old shady High Castle Park or just take pictures with the view of all the city. In ancient times there was the Prince Castle here situated on the highest hill of Lviv (about 400 meters above sea level). • Lviv town hall (19th century) where town administration is located. There is a great sightseeing platform on the top of the town hall where all tourists can see Lviv in full panoramic view. • Rynok Square (13th century) is the central square of the city and has been the main hub for public and cultural commercial life since ancient times. • Lviv Theatre of Opera and Ballet (19th century) was built in Renaissance and Baroque architecture style. You can see various ballet and opera shows there for the incredibly low price (ticket costs up to 12 US Dollars). Lviv Theatre of Opera and Ballet is the host venue for the recently revived Vienna Balls. • The set of religious monuments: the Dominican church, St. George’s Cathedral (8th century), The Church of Sts. Olha and Elizabeth, The Jesuit Church (17th century) dedicated to St. Peter and St. Paul. • Lychakiv Cemetery is a State History and Culture Museum-Preserve. Many outstanding Ukrainian and Polish personalities are buried here.

Due to numerous changes in regulations and borders in the Western part of Ukraine, local Ukrainian cuisine was flavored by classic Viennese, Polish and Hungarian (spices) cooking traditions. One of the most outstanding dishes is Banosh, prepared with corn flour and sour cream seasoned with bacon, mushrooms and farmer’s white cheese. It is worth trying local Borsch, Deruny, Kruchenyky, Golubtsi, Nalysnyky and many other Ukrainian dishes. There are many local breweries where you can try famous local beer. can try Ukrainian and foreign cuisine. After Ukrainian Independence, the street was significantly renovated and now looks elegant and spacious — definitely one of the best tourist spots in Kiev! The best way to explore Khreshchatyk is to take a leisurely walk from one end of the street (European Square) to the other end (Bessarabska Square) and then back again on the other side of the street. Enjoy the well-maintained historical buildings (such as the City Council, House with the Star, the Main Post Office building, TsUM — central shopping mall of the city that has just opened after 3 years of reconstruction and others), stop by various stores along the way (don’t miss the newly opened “Vsi. Svoi” shop, where you can find impressive selection of goods by Ukrainian brands), sit down and enjoy some drinks or food at numerous cafes, pubs, and restaurants (try Ukrainian classics like Borsch, Goluptsi, Varenyky and Pancakes), and of course spend some time at the main square of the city, Maidan. Maidan has always played an important role in the history of Ukraine, hosting the “Granite” student revolution (1990) for de-communization and the establishment of an independent state, Orange Revolution (2004), and Euromaidan (2013–2014) — the student movement for European integration.

Photo: @julia.zv Modern Kiev is a vibrant, bright, green, and cozy city with many historical buildings topped by golden domes, church spires and bell towers, and picturesque landscapes. The city is nestled among seven hills that are very suitable for city observations. You can enjoy the beautiful views of the banks of the Dnipro River and numerous bridges. The city is decorated with thousands of chestnut trees that are considered the city symbol. The main historical neighborhoods in Kiev are the ancient Upper Town, and the Lower Town, consisting of the commercial neighborhood called Podil. Since Kiev breathes so much history, we asked a few leading tour guides to reveal the top historical destinations. Here is what we found:

Andriyivsky Descent is of one the most beautiful and ancient streets in the city, often called Kiev’s Montmartre. It is a favorite stop for Kiev tourists, and here you can buy handmade souvenirs in the great variety of shops or visit art galleries, cafés and Ukrainian restaurants. The most popular Kiev souvenirs include vyshyvanka (embroidered shirts), painted Easter eggs (pysanka), Ukrainian Matryoshka, handmade linen, jewelry, a big variety of ceramic items and paintings of local artists. The street lies on a steep hill, so wear comfortable shoes while going there. It’s about a 15-minute pleasant walk from Maidan Square. Andriyivsky Uzviz is often associated with world-famous writer Mikhail Bulgakov, author of The Master and Margarita and the White Guards, who lived in the descent in the building No.13. Today, his home has become the Literature-Memorial Museum to Mikhail Bulgakov, where you can

documents, antique books, photographs and postcards, and allows you to feel nostalgic atmosphere of ancient Kiev, as if traveling by time machine. On the top of Andriyivsky Descent, you will find Saint Andrew’s Church, erected in the eighteenth century in royal baroque style. The church was constructed by Italian architect Bartolomeo Rastrelli under the order of the Russian Empress Elizabeth, who decided to construct a summer residence in Kiev, consisting of a palace and a church. Legends say that the place where now the Dnipro River flows was a sea in ancient times, and when Saint Andrew came to the present Kiev territories and

put a Cross on the mountain, just where Saint Andrew’s Church stands now, the sea waters went under the ground. After Saint Andrew’s Church was constructed, a deep well appeared under the altar. Therefore, Saint Andrew’s Church is the only church in Kiev which has no bells, as it is believed that the first bell stroke will make water wake up and cover Kiev in one second! Just after Saint Andrew’s Church, turn to the right and see the National Museum of the History of Ukraine, located just near the ruins of the Church of the Tithes (tenth century), in an area that has been declared a state reserve. The museum illustrates Ukrainian history since ancient

THE SAINT SOPHIA’S CATHEDRAL The Saint Sophia’s Cathedral (eleventh century) is one of the most important Christian cathedrals in Eastern Europe and

From there, you can enjoy a view of Podil and the Dnipro River and take pictures near picturesque mosaic pictures on the walls, fountains, unusual animal-shaped benches and playgrounds. This is a great place to walk, take funny pictures and enjoy the view of the Lower Town.

KONTRAKTOVA SQUARE

Kontraktova Square is located in the Lower Town (Podil District) and is one of the oldest squares in Kiev, known from the times of Kievan Rus. Ideally located on the banks of Dnipro River, it was and still remains an important economic, cultural, and transport center of the city. Since ancient times, it was a trading place where numerous contracts were concluded, which gave the name to the square: “Kontraktova.” The atmosphere here combines old, picturesque buildings with meaningful murals, churches, and tiny streets that make the square an interesting place to feel the spirit of ancient Kiev. The historical places of interest here include: - the main building of the National University of Kyiv-Mohyla Academy (KMA), one of the oldest and most authentic constructions in the Square, built in baroque style in the time of Hetman Ivan Mazepa (1632). Now it serves as the Library

The fountain is located in a beautiful pergola adorned with sundial clocks on the columns. - the bell tower of Saint Katerina Greek monastery, built in 1914 upon the design of V. Eisner in neoclassical and modern style as a part of the monastery complex. - the monument to Petro Sahaydachniy on horseback built amidst a park on the hill in 2001 and dedicated to the Hetman of the Ukrainian Zaporozhian Cossacks who transformed the Cossack Host from an erratic military formation into a regular army. - the House of Contracts is one of the important classical architectural constructions of the city, built in the years 1815–1817. Since the mid1990s, it has served as the Ukrainian Interbank Currency Exchange, therefore, visitors may see the building only from the outside.

THE GOLDEN GATE The Golden Gate (“Zoloti Vorota”) of Kiev was the main entrance to the eleventh century fortifications of the city. It was constructed by the order of Prince Yaroslav the Wise, whose monument is erected just nearby. In 1982, the Gate was completely reconstructed for the 1500th anniversary of Kiev. At present, there is a museum inside of the building, where you can see original parts of ancient Gate and learn the history of the fortifications of ancient Kiev. Also, you can go upstairs for an excellent view of Kiev’s city center. The Gate is surrounded by attractive Zolotovoritskyi Square, set up in the 19th century and now a popular walking area. One of the square’s main attractions is a statue of Prince Yaroslav the Wise, who holds a miniature of the Saint Sophia’s Cathedral and looks in the direction where it is built.

KIEV PECHERSK LAVRA

Kiev Pechersk Lavra (eleventh century) is one of the first Orthodox Christian

Close to the Cathedral, on Sophiivska square, you will find the dramatic Hetman Bohdan Khmelnytsky Monument, dedicated to the Cossack leader who fought for the independence of Ukraine in the mid-17th century. After the political events of 2013–2014, the cultural center of Kiev moved from Maidan to Sophiivska Square. Currently, it serves as a platform for almost all public festivals, shows and concerts of the city. The administration lights the main Christmas Tree of Ukraine in the square in December, and everyone can enjoy the Christmas fair, amusement park, competition games (quests) and artistic groups’ performances.

LAST BUT NOT LEAST — PARKS!

NATIONAL TARAS SHEVCHENKO UNIVERSITY

Kiev is one of the greenest capitals in Europe, with about 127 parks and an average of about 20 sq.m. of greenery per resident. Our tour guide experts recommended the following parks that are beautiful, are located conveniently in and around the city centre, have interesting history, and are very popular among locals as well as visitors to the city.

The National Taras Shevchenko University is one of the oldest (1834) and often ranked as the best university in Ukraine. It is named after author and artist Taras Shevchenko, whose monument is located in the park nearby (Taras Shevchenko Park) just in front of the “red building” of the university. The university is surrounded by an ensemble of 19th- and 20th-century buildings, such as the National Academy of Sciences of Ukraine, Teacher’s House, the Maksymovych Library in neoclassical style, and the National Library of Ukraine. The beautiful Taras Shevchenko Park is jokingly called the “green building” of the University, as students often prefer to walk here instead of attending lectures. The park is well maintained with fountains and creatively constructed benches and is one of the favorite places to walk for youth as well as celebrities and politicians.

NATIONAL OPERA HOUSE OF UKRAINE The National Opera House of Ukraine is one of the most notable ballets and opera scenes in Europe, founded in 1867. The present building was constructed from a design by German–Russian architect Victor

SEPTEMBER 2017

Schröter, who approached the project very carefully to make sure the building’s neoRenaissance style harmoniously fits into the architectural and natural landscape. The opera house will amaze you with its elegance of interior, gravity and luxury. Huge Venetian mirrors adorn the lobby, marble stairs are lit by porcelain lamps and bronze, gilding, and crystal are everywhere. The theater is not just beautiful, but also very conveniently located in the centre of the city, just a few minutes of walk from

other places of interest such as Maidan, The Golden Gate and Taras Shevchenko University. Talented artists and the wonderful architecture attract the attention not only of residents but also Kiev visitors. Every day, you can see various ballet and opera shows there for an incredibly low price: generally, ticket costs around $10–15. Because of its popularity, it is advisable to book your tickets beforehand, especially that now you can book your tickets online!

The Rodina Mat statue is 102 meters in length and is a visiting card to the city. You can take an elevator on the top of the statue, which will cost you around $8.

TOP EVENTS IN SEPTEMBER INTERVIEW

INTERVIEW WITH HUGUES MINGARELLI The Head of delegation of the European Union to Ukraine Сurrently Ukraine is moving forward to the European integration that resulted in joining the Association Agreement, the Free Trade Agreement, and Visa-Free travel regime with the European Union. In light of such recent changes, we asked the EU Ambassador to Ukraine and Head of the EU Delegation to Ukraine since August 2016, Hugues Mingarelli, about future perspectives and challenges for Ukraine on its future development and strengthening relations between Ukraine and the EU.

1. What are the current key priorities of the Delegation of the European Union to Ukraine and its achievements in strengthening business and cultural relationship between Ukraine and the EU? At the moment, our efforts are focused mostly on the proper and timely implementation of the Association Agreement. This Agreement is a sort of a roadmap for Ukrainian reforms and it can be also viewed as a kind of "toolbox" for such reforms. The Agreement, if properly and timely implemented, would simply mean that legislation in many areas is identical as it is in the EU. It will significantly improve chances for economic growth, increase of living standards, and so on. It should be also remembered that this Agreement led to the creation of the free trade area between the EU and Ukraine. It is one of our chief priorities to maximize the effects of this free trade. And we already

30 Kiev Check-In

have some positive news. In the first quarter of 2017, the exports from Ukraine to the EU grew by 24.5% when compared with the same period in 2016.

potential of Ukrainian agriculture and global demographic tendencies, this sector could be a sort of a goldmine if properly and wisely managed.

2. What will be the future of the EUUkraine relationship after the ratification of the Association Agreement between Ukraine and the EU, key challenges for Ukraine?

4. What are the top reforms required in Ukraine to boost foreign investment from the EU?

The key challenges will be linked to what I described above – the implementation of this Agreement. It can unlock a huge potential for improvements in many areas of daily life in Ukraine. For that, we need to demonstrate the political will to pass respective reform laws, then their proper practical implementation and observation. New institutions would have to be created while old ones would have to be significantly refurbished in order to meet these challenges and tasks stemming from the Association Agreement. For these sort of tasks, hundreds and thousands of well-educated professionals would be needed. They would have to be properly paid. And it brings us to another important reform, public administration reform, which the EU is helping Ukraine with. Other challenges lay in the field of how to effectively fight corruption. Corruption is blocking your country from prosperity and from attracting large foreign investments. We could also list several other sectors and reforms that are of the vital importance: energy and energy efficiency, health reform, decentralisation, judicial reform, and so on. 3. Which top sectors of Ukrainian economy will benefit from the Association agreement the most?

NEVER CHOOSE BETWEEN BUSINESS AND PLEASURE

• Fight against corruption • Fight against corruption • Fight against corruption; • Cutting red tape and all other bureaucratic barriers • Improving the work of the judicial system and state regulatory agencies • Tax reform and customs • Digitalisation of the workflow within the state administration, which would streamline formal processes linked to the economy and investors. 5. What are the best ways to change the perception of Ukraine internationally? The best means of promoting Ukraine abroad would be steep economic growth and the growth of economic prosperity of Ukrainian citizens and companies, fast development and modernization of the country, as well as success in establishing the rule of law. You do not need to run expensive promotion campaigns if you succeed with those elements described in the previous paragraph. They would be immediately spotted by international media and foreign visitors traveling to Ukraine. In short, the best way to change the perception of Ukraine internationally is successful implementation of all those difficult, painful but badly needed reforms.

THE UKRAINE - EU ASSOCIATION AGREEMENT

SEPTEMBER 2017 content has come into application provisionally since November 1, 2014 and the trade content has come into effect provisionally since January 2016. This May the last EU country (Netherlands) has ratified the AA followed by its approval by the Council of the European Union on July 11, 2017. As a result, AA provisions shall formally come into force on September 1, 2017. The AA endorses Ukraine’s ‘European Choice’; politically it sets the stage for the realisation and preservation of European values of democracy, human rights, fundamental freedom and rule of law in Ukraine while economically, it seeks to improve and modernize the trade practices and reform the economic policy and regulations and make Ukraine an investment, trade friendly destination and a competitive exporter for the EU and international market.

General Principles Political

The European Union - Ukraine Association Agreement (AA), as the first step towards integration of Ukraine into the European Union, seeks to establish political association and economic integration between the EU and Ukraine and provide for mutual free market access and includes the Deep and Comprehensive Free Trade Agreement (DCFTA). The DCFTA specifically offers an agenda for Ukraine to harmonize its regulatory and customs framework in the context of trade and pave way for economic modernization and development. Finally, on July 11, 2017, the European Council completed the ratification of the AA with Ukraine, while full implementation of the AA begins on September 1, 2017. Following is a quick guide to the background, key content and provisions of the AA.

Background Ukraine, a former member of the Soviet Union, has become an independent sovereign state since 1991. The country is endowed with rich natural resources and has a strong high-tech industrial base including electronics, arms and space engineering besides its expansive base of chemicals, metallurgy, forestry and food

industries. However, tumultuous political scenario had impeded the country’s economic development and Ukraine had to battle fierce inflation until the turn of the century. Since its independence Ukraine has sought a close economic and political relationship with the European Union and has pursued that as a key foreign policy. Russia, the single largest trading partner

of Ukraine, obstructed the country’s efforts to integrate with the EU. After a prolonged period of negotiation, which was stalled and marked by demonstrations, trade embargoes and territorial invasion, in 2014 the AA was signed in two parts: the political content was signed in March 2014 and trade and economic content was signed in June 2014. The provisions relating to political www.kievcheckin.com

Parties to the AA have committed to a strong relationship based on common values, such as value for democracy, human rights, rule of law, fundamental rights, and good governance. The AA underscores the promotion of respect for the principles of sovereignty and territorial integrity, inviolability of borders and independence; it also emphasises the need for cooperation to fight against corruption, organised crime and terrorism, as well as countering the proliferation of weapons. It calls for promotion of sustainable development and principles of a free market as central to the relationship between the EU and Ukraine.

Rule of Law and Movement of People Ukraine is required to commit itself undertaking reforms in judiciary to improve transparency and prevent corruption to enhance the rule of law. Both parties commit themselves to increasing their dialogue and cooperation on migration, asylum and border management and combat trafficking. Among others, the AA paved way for the introduction starting from the 11th of June, 2017 of visa-free travel for Ukrainians holding biometric passports to enter the Schengen area member states for short www.kievcheckin.com

term visits.

Foreign Policy The AA aims to facilitate the gradual alignment of Ukraine’s foreign, security and defence policies with those of the EU at bilateral, regional and multilateral levels. This will effectively redefine the relationship of Ukraine with Russia and the rest of the world.

Trade Related Matters Market Access The EU, as a collective, is the largest trading partner for Ukraine. The DCFTA will create more business opportunities for Ukraine by improving the standards of its products and enhancing its competitiveness in the world market. In turn, the EU will gain from the competitive exports of Ukraine. The AA completely liberalises trade in goods (subject to rules of origin) and services between Ukraine and the EU. It also removes all barriers against the flow of investment. The EU has already implemented total liberalisation for most of products, however Ukraine will do so over an extended period of seven years. Both parties shall commit to combating irregularities and customs frauds that are intended to take advantage of the preferential treatment of goods granted under the DCFTA. Failure to fulfil the commitment would result in temporary suspension of trade. With most of the custom duties and trade barriers removed it would result in a new spurt of economic growth and business opportunities for both Ukraine and the EU. It would open up alternative revenue sources for the tax authorities in the form of indirect taxes.

Trade Remedies The EU and Ukraine can take defensive measures such as antidumping, antisubsidy, and safeguard measures against imports from the other party that cause or threaten to affect the domestic industry. It must be noted that the EU has in place anti-dumping duties on imports from Ukraine involving specific products such as chemicals and metals.

Customs Services

required to improve the customs services and simplification of customs procedure at the borders to facilitate speedy movement across borders without the congestion of goods carriers.

Technical Standards Ukraine should adapt to the European technical and quality standards to comply with the health and safety requirements with regards to industrial goods. In the absence of tariffs, non-tariff barriers in the form of technical standards would pose the intense challenge for the Ukrainian exporters, however, it would help them to modernize and harmonize with international standards and make them competitive. Ukraine has already commenced the process of harmonizing its national standards with those of the EU that has two tiers, one at a broad sectoral product level directives and another at product-specific standards.

Food and Safety Regulations Similar to the standards for industrial goods, Ukraine is required to commit to aligning to the product specific safety regulations under the EU’s sanitary and phytosanitary measures. It will elevate the standards of Ukrainian agricultural and food products to the international standards and eventually enhance the market opportunities for Ukrainian exporters. Since the commitment to the European standards would be cost intensive, the AA allows Ukraine to waive comprehensive conformity for very small farms and some traditional products. The EU would also provide technical support with some major projects to improve safety standards.

Services The provisions relating to the services are organised under three heads – establishment of service entities in the jurisdiction of the parties to the AA, crossborder supply of services, temporary presence of individuals in the jurisdiction of the parties for the purpose of providing service. Subject to several reservations, both parties commit to treating the service providers of other party no less favourably than their own. However it must be noted that Ukraine has to modernise, adapt and harmonise its service standards and systems with those of the EU.

The AA urges Ukraine to undertake legislative commitment towards aligning customs codes with the EU. Both parties are

Public Procurement The AA provides for the gradual and reciprocal liberalisation of public procurement market of both parties. It also provides the regulations for award of contract and they are identical to the EU public procurement law that is based on the principles of non-discrimination, equal treatment, transparency and proportionality. Ukraine is required to set up a central authority to implement the regulations and to appoint an autonomous body to review decisions of the contracting authorities.

Intellectual Property Ukraine is required to reform its IPR system to conform with the international practices by focusing on strengthening the enforcement of industrial property rights, protecting geographical indications, mechanisms to increase the protection of rights and interests of copyright holders and a unified procedure for collecting fees due under copyrights. Strengthening the IPR regime is crucial for attracting international investments.

Competition Policy The AA required Ukraine to undertake legislative commitment to prevent and reform monopolistic behaviour and state subsidies. It is essential to curb monopolistic activities that result in suppression of competition and to restrict excessive state subsidies to ensure wider choice, lower prices and better quality for customers. It is significant for modern and thriving economy.

Economic and Sector Cooperation Economic and Financial Assistance

During most of its post independence period Ukraine was reeling under recession through its fortune turned around with the turn of the century led by the global commodity price boom which was short-lived; the 2008 global financial crisis besieged the Ukrainian economy

34 Kiev Check-In

that gradually recovered in 2010 only to be hit by the political turmoil and Russian invasion. The country’s economy is in need of a major revamp and the EU has committed to extending financial assistance. Until 2020, the EU and several of its financial institutions would provide an assistance package of over €11 billion.

Financial Market Ukraine is required to commit to the adoption of the European system of regulating banks, insurance and securities market. This is a precondition for Ukrainian banks and financial institutions to be granted license to set up branch, subsidiaries or agencies in the EU and vice versa.

Transport Modernising and standardising the sector is crucial for integrating Ukraine into the EU’s supply chain hence the AA details the standards and regulations pertaining to different modes of transport and qualifications of operators, safety standards of vehicles and vessels and directives for inspection bodies. Strengthening and standardising the sector is significant to realise the full potential of the AA, to promote cross-border trade and movement of people and to enhance cooperation and interoperability among operators in the sector.

Energy Natural gas constitutes a major share of Ukrainian imports and until recently it was majorly dependent on Russia for its supplies. Making Ukraine energy-efficient is critical for its economic progress and for geopolitical reasons. Ukraine is urged to adopt the EU energy efficiency standards and to reform the energy policy to align prices with import costs.

Digital Sector Natural gas constitutes a major share of Ukrainian imports and until recently it was majorly dependent on Russia for its supplies. Making Ukraine energy-efficient is critical for its economic progress and for geopolitical reasons. Ukraine is urged to adopt the EU energy efficiency standards and to reform the energy policy to align prices with import costs.

Consumer Protection The EU prioritises consumer protection by implementation of common safety rules and standards for products and services.

The AA also emphasises on consumer protection by urging Ukraine to align its regulations with those of the EU. Ukraine’s obligation under the AA can be grouped into categories - first, general commitments related to information exchange and the improvement of information provided to consumers; second, obligations related to product safety; and third, institutional and administrative procedures for the protection of consumers and the enforcement of consumer rights. Though Ukraine has a system in place it is not effectively implemented and does not match up to the EU regulations.

Company Law Ukraine is to harmonise its legislation with that of the EU for annual accounts of certain types of companies and consolidated accounts for group companies. It is expected that overall harmonisation of law will improve transparency and predictability of legal regime, ensure protection of investors and shareholders and enhance the overall business climate in Ukraine. It is worth mentioning that Ukraine has already allowed for companies to use international accounting and financial reporting standards, which facilitate comparability of accounts, as well as has significantly simplified procedures, related to opening of business and reporting.

SEPTEMBER 2017 hours, or 44 hours if agreed. • There will be a regulation of flexible work schedule and homework. • There is a provision against gender discrimination. • The list of reasons for fixed-term contracts is to be extended. • The redundancy payment is to be increased.

Others The EU will extend cooperation in the education sector by offering joint master degree programmes, capacity building projects, policy dialogue in education reform network, promoting teaching and research in the field of the EU studies and promote mobility of teachers and students and modernisation of higher educational institutions. Likewise, in the area of culture and creative sectors, both parties will cooperate by promoting mobility of artists and arts. The AA provides for cooperation in the area of science and space technology; recently, Ukraine has been endowed the status of ‘associated Country’ that allows it to participate at the same status of a EU member state in the Horizon 2020, a key scientific programme with substantial funding. Ukraine shares its border, tradition, and

TOP EVENTS BUSINESS IN SEPTEMBER CORNER

history with many of the EU counterparts. The AA calls for cross-border cooperation in general terms, and in specific sectors such as transport, energy, education, tourism and health, and the modernisation of crossborder emergency services.

Legal and Institutional Provisions The AA urges gradual approximation of Ukraine’s legislation to the EU norms and standards. Specific timelines, varying between 2 and 10 years, are set within which Ukraine should approximate its legislations to the relevant EU legislation. As the EU law and legislation is not static but under constant evolution, Ukraine is also required to pursue dynamic approximation to keep pace with the principal EU reforms and in accordance with Ukraine’s capacity to carry out the approximation. Two basic dispute settlement mechanisms are provided: • General - applicable to all parts of the AA and it relies on two parties finding a mutually agreed solution in the Association Council, failing which the aggrieved party

may take ‘appropriate measures’. • DCFTA specific – It is a more elaborate system that provides two alternative tracks, either binding arbitration, or softer mediation for consensual solutions. • There is also a provision for the special case of violation of the ‘essential elements’ of the Agreement (i.e. basic political principles), which can lead to suspension of the entire Agreement. The following institutional provisions are included in the AA: • The EU-Ukraine Summit - provides overall political guidance and an opportunity to discuss any bilateral or international issues at the presidential level. • The Association Council – at ministerial level, it has broad powers to amend many details of the Agreement (in its annexes), but it cannot change the main body of the Agreement. • Association Committee - at senior official level, with other specialized committees such as for trade matters, and sub-committees is responsible for the continuous updating of the AA in the light of legislative developments in the EU. • Parliamentary Association Committee, It will be a forum for Members of the European Parliament and the Parliament of Ukraine to meet and exchange views.

Agriculture The AA assures technical assistance and investment finance, though there are references to the EU legislation there is flexibility in terms of application and timeframe. A strategic action plan has been developed with the collaboration of experts from both parties to implement agrarian reforms in the next five years.

Employment Policy The AA requires Ukraine to implement reforms focusing on anti-discrimination, gender equality, health and safety and to align its labour laws with those of the European Union. Presently the employer's interest is ignored in the labour law, which is entrenched in the communist legacy. The newly proposed labour code envisages more flexibility in labour relations and more rights provided to employers, and the key points are: • Written contracts are to become compulsory. • Employers will be able to dismiss employees for well-defined reasons. • The working week is to be limited to 40 www.kievcheckin.com

DOING BUSINESS IN UKRAINE -

Tips for Foreigners Following the recent reforms and closer ties with West, Ukraine is gradually becoming an attractive, albeit still difficult, place to do business and invest for the foreign business community. Regardless of the still weak political, legal, and financial climate in the country, Ukraine has an excellent geographic location, the largest territory in Europe, rich natural resources, and a low cost but skilled workforce. Ukraine’s confusing regulatory regime, ever-changing regulations and significant red tape can cost foreign investors significant money and time. In our experience, every day we encounter front-facing government staff, bank representatives, private consultants, and notaries who are not aware of the latest changes and provide incorrect information. But these challenges are by no means insurmountable, the savvy entrepreneur can easily find his/her way past to make some great investments. Here’s a list of business tips for any foreign individual exploring doing business or investing in Ukraine. Note that law and regulations change frequently, therefore always consult for the latest updates before making any decisions!

PERSONAL BANK ACCOUNTS As a foreign national (resident or non-resident), you are allowed to open the following types of personal bank accounts in Ukraine: • Regular current and savings accounts in the local currency UAH and selected foreign currencies. • An Investment Account that allows foreigners to make investments into Ukraine and subsequently repatriate profits and capital out of the country. Keep the following points in mind when opening and operating your bank account in Ukraine: • Rules for bank accounts vary depending on the type and are strictly regulated by Ukrainian Banking law. For example, you are not allowed to withdraw cash from your investment bank account (whereas it is possible from a regular current bank account). Therefore, use the type of bank account that corresponds to your planned purpose and transactions. • While you are free to deposit money into these accounts from overseas and bonafide local payments, cash withdrawals in

foreign currency as well as overseas transfers are subject to certain limits at present (depending on types of bank account and transaction). These restrictions are a result of the currency controls imposed by the government mainly because of the political and economic crisis that started in 2013 and still lingers today. They apply both to businesses as well as individuals, although the specific rules may vary. • You can use your debit card (linked to your regular current account) when making purchases overseas as well as withdraw cash, subject to certain limits.

STARTING A COMPANY While there are a number of different business structures available in Ukraine, the most suitable limited liability structure for a small- to mid-sized business in Ukraine is a Limited Liability Company (LLC). Both resident and non-resident foreigners are free to incorporate a LLC and can be 100% shareholders of the company. Points to note when opening a LLC: • The process of incorporating a company is fairly straightforward and can be completed in 1-2 working days after all the necessary documents are ready. • Prior to registration of an LLC, foreign shareholders need to obtain a Ukrainian tax number. • The director of an LLC can be only an individual who has right to reside in Ukraine (a citizen of Ukraine, or a permanent citizen or foreign individual who has obtained a work and residence permit in Ukraine). Corporate directors are not permitted. • A Ukrainian company must have a local registered address. • Foreign entrepreneurs who wish to relocate to Ukraine to operate their company can apply for relocation visa (work permit & residence permit), which is subject to approval by authorities. It’s important to work with a knowledgeable and competent corporate services provider that knows the latest regulations to ensure the accuracy and timeliness of the work done.

WORK AND RESIDENCE PERMITS Work permits and residence permits are two different permits issued to foreigners.

Tetiana YAKOVENKO Director of ContactUkraine LLC www.contactukraine.com With the exception of few situations, both permits are required when relocating to operate or work for a company in Ukraine. Keep in mind the following: • Foreign entrepreneurs who have opened their LLC company in Ukraine will need to apply for both permits if they wish to relocate to Ukraine. The same is true when the LLC is hiring other foreign staff. • Certain categories of foreign citizens (such as permanent residents of Ukraine, employees of representative offices and permanent establishments of foreign companies, representatives of foreign mass media, professional athletes, artists and some others) do not need to apply for work permits when working in Ukraine (but they still need to obtain residence permits). However, in most other cases, a valid work permit is required before commencing work. • The processing time for a work permit application is about 1 month. • After the work permit application has been approved, the permit holder must obtain a temporary residence permit if he/she plans to relocate to Ukraine to work. Family members are also eligible to obtain the temporary residence permit. • Obtaining a residence permit takes up to 15 days upon application.

SEPTEMBER 2017 tors are increasingly interested in purchasing residential property here. However, the real-estate market in Ukraine is not very mature and therefore often fraught with significant difficulties and risks at almost every step of the transaction. It’s extremely important to work with a knowledgeable and trustworthy legal advisor when dealing with real-estate in Ukraine. Here are some basic guidelines: • It is important to perform the deal and payment strictly in accordance with Ukrainian Civil, Banking and Investment law to avoid future difficulties with repatriation of investments and investment income. • Proper due diligence as well as proper legal planning and examination of real-estate transactions are crucial while investing in real-estate in Ukraine due to risk of fraud. • The commission of real-estate agencies is typically around 3–5% from the real-estate purchase price, payable only if the deal is concluded. Real-estate agencies are not regulated and do not require a license to operate. Therefore, we highly recommend that you also use an independent real-estate legal advisor to assist you with proper advice when concluding your transaction.

TOP EVENTS BUSINESS IN SEPTEMBER CORNER

PAYING FOR INVESTMENTS Foreign nationals are allowed to pay for their investments in Ukraine (opening a business, buying real-estate or other type of investment) in two possible ways: • Directly from their account overseas (in this case, payment is made in foreign currency); -or• By opening an investment bank account in Ukraine. In this case, the foreign national must transfer money in foreign currency to the investment account, convert it to local currency hryvna (UAH), and then pay for the investment in the local currency. Note that an investment account is the only type of bank account in Ukraine for foreign individuals that allows them to make settlements for their investments.

TAXES Tax rate in Ukraine depends on the type of taxpayer and her income. The base tax rates are listed below: • Corporate tax rate: 18% • Individual income tax rate: 18% plus 1.5% military tax • Social security tax: 22% (applicable as part of payroll tax) • VAT: 20%

• Individuals registered as Private Entrepreneur (similar to Sole Proprietorship in other countries) and listed under the Simplified Tax Scheme (3rd Group): 3–5% Note that the Ukrainian tax code defines specific rates for certain types of income or transactions which can be different from the ones mentioned above. In addition, some types of income/transactions are exempt from taxation. Therefore, to define applicable tax rate for each specific case, it is important to get professional advice.

GETTING A UKRAINIAN TAX NUMBER As a foreigner, if you are planning to work, invest, or start a business in Ukraine, most likely you will need to obtain a Ukrainian tax number. Therefore, it’s usually a good idea to get this done as soon as possible. If you are overseas, the application for tax number can be filed by your representative in Ukraine under a Power of Attorney. The application processing time is about 5 working days.

• Both work permit and temporary residence permit applications are subject to review and approval by government authorities. However, under valid grounds, there should be no problem with the approval process.
