Introduction

The second phase of the project “Public Information Database - www.opendata.ge” has started in Septeber, 2011. IDFI has submitted official requests for public information to public authorituies of Georgia and has requested information on different issues and adinistrative expenses incurred for the period of the second quarter (April-June) 2011. Questions of the second and first phases were the same, but simultaneously IDFI with the standard requests has submitted questions about the creation of official web-pages, the list of employees and public registries.1 It should be noted that, during the second phase of the project, information about salaries and supplements, bonuses, business/ official/ international visit expenses, expenses for the service of vehicles (repair, wear), fuel consumption and telecommunication expenses were requested for the complete system and the staff who implements public authority separately. Within the project “Public Information Database - www.opendata.ge”, the public information has been actively requested. Answers were analyzed in terms of content and also was carried out a detailed analyze of financial data. The total amount of sent requests is 5024. Public authorities where the requests were sent are 229 and the published document on the web-site www.opendata.ge has reached 3300 units. It is noteworthy that when public authorities had no information about different questions such kind of answers and therefore requests were abolished. For example when public authority had no implemented programs or projects and the answer was the same, the request and the answer was not recorded in statistics.

d) Rejected Information – is the case when public authority refuses to provide information and the refusal is without the bases of the legal ground. For example Children and Youth Development Fund has provided the answer about public registry, but there is only explanation about the meaning of registry.2

General Problems The main problems revealed during the second phase of the project is conneted to the violation of public authority’s obligations under the legislation of Georgia. Denoted circumstance should be explained by two different reasons: a) Public Authority violates its obligations consciously; b) Public Authority doesn’t know how to observe Georgian legislation. For example, revealed the fact that, when request is about the expenses incurred by the public official, who implements public authority the answers received from the Ministries and other public institutions are the same, such kind of template.3 The issue would not be problematic, the answers were complete, but the explanation indicated in response is the following: “public authority does not

In our opinion, ebove mentioned answers is avoidance the release of public information, because it’s impossible financial department of public authority doesn’t know the amount of salaries and bonuses of the ministries, or doesn’t know the amount of fuel consumption by the deputy ministries. Also it’s unbelievably that LEPL’s financial departments4 or administrations of the state representativegovernor are be able to calculate the data and for example financial department of ministry of finance of Georgia is not able to repeat the same accounting operations. It should be noted that public authorities release the expenases incured by the complete system, they can make a differentation between the complete system and central office, but are unwilling to release public information about officials, therefore they do not want to become known actually what the money is being spent on the provision of high-ranking officials. Regrettable fact is also that, some of the public institutions has change their position with regard to accountability and transparency and if the response of the first phase of the project was comprehensive, the second one is already incomplete, because for unknown reasons they was unable to calculate financial information of high-ranking officials separately.5

The same trend is observed also in the case of the General Courts of Georgia, when they don’t release the information for the reason that such an action would lead to paralyze the work of court staff. In our opinion this is the flagrant violation of law.6 Also in the case of General Courts of Georgia, answers received from the city/district courts are identical and avoiding to release of information.7 The case belongs to the category of systematic proble, when public authorities release information about their public registries. In the most cases, the answer doesn’t contain information about the data of public registry or is indicated only requisites of public information request/releaseing.8 According to the General Administrative Code, Article 35 public registry is the formal and/or official document in which public institution is obliged to put public information in. In public registry must be indicated public information of its adoption, from the creation, processing or publication within 2 days, with the names, making, creating, processing, publication date, the natural or legal person, public official, public agency, the name of the reference from which it came and / or who sent it. Therefore, public registry must be include all public information existing in public authority and not onle the requisites of request/releasing of information. In public registry must be include financial accounting documents, administrative and legal acts issued by the officials and others. Public registry may be filled out manually (in most cases, when

public authority doesn’t have electronic public registry, received copies of registries are filled out manually).9

We consider that in any cases, public authorities have no knowledge about public registry and what kind of information shoul be filled in it. Or they may know but they don’t conduct. Therefore, public authorities violate duties assigned and the question on public registry is left unanswered. It should be noted that the number of identical answers on public registry were 22.

Speaking on the revealed problems, it should be underlined superficial approach to the consideration of the statements, in particular the situation when issued regarding to the release of public information are considered superficially. For example, IDFI has requested web-page creation expenses of public authorities and the responses were about the expenses incurred for the second quarter 2011 only.10

Should be noted answers received in response to the different requests submitted during the second phase of the projet. These requests were about specific issues related to the competence of the public authority and the largest percntage of the rejections are in such cases. For example:

Access to Public Information in Regions of Georgia In contrast to the first phase of the project, during the second phase were implemented requesting of public information from the Reions of Georgia, in particular: Self-governing cities, municipal boards, administrations of the governonrs, also from the governmnts of autonomous republic of Adjara and Abkhazia. If we compare with the information received from regions and the information received from other executive bodies we notice that approach of the regional public authorities is more serious than others

and issued information is comprehensive and complete.11 For example, answers from the administrations of governor are twice more than the responses received from the ministries and governement of Georgia. Also, it should be underlined that the number of rejected answers is no recorded.

Of course, the unanswered requests are frequent or the answers are incomplete. But we can make a conclusion that, on the basis of revealed trends, access to information in the regions is at a higher level than the situation in central government is.

Conclusion

In the framework of the project conducted by the IDFI, has revelaed the main problems regarging to the access to information and freedom of information. In the most cases, public authorities don’t make information public, that on the one hand indicates to the violation of law and the other hand indicates disdain to the work. This is absolutely contrary to the principles of a democratic state.12 In addition, access to information in the administrative bodies in the regions of Georgia is at a higher level and commitment is being implemented than the situation in central government is. Unfortunately, there is a category of persons in public institutions, who do not realize how important is the transparency of public sector and the openness of the budget expenditure. If we perform a parallel with the first phase of 2011,13 it is clear that the facts of the ignored and refused requests for public information are still actual problem in Georgia.

Within the project “Public Information Database - www.opendata.ge”, the public information were analyzed in terms of content and also was carried out a detailed analyze of financial data. Data processed in the framework of the project gave us possibility to make an overview on the budget expenditure of the public authorities. On the basis of the received public information has revealed public institutions, which have spent a large amount of money for the period of second quarter 2011, but it should be underlined that, data are presented based on the received public information only,

these information are received in response to the IDFI’s requests.
