What are the financial and legal responsibilities if you rent out a property?

Y

ou may be a professional buy-to-let landlord, or even an ‘accidental landlord’ who needs to move out of your home to upsize or relocate. Whatever your situation, make sure you’re aware of your legal and financial responsibilities. Landlords have a legal responsibility to ensure their tenant’s health and safety by keeping the property safe, free from health hazards and to provide access to working amenities. As a landlord you must take responsibility for confirming that any amenities provided are in safe working order; this is best accomplished by employing a professional to certify compliance with legal standards. Once checks have been carried out, you will be presented with certificates. The most common of these certificates include a Gas Safety Record, Energy Performance Certificate (EPC), Portable Appliances Test (PAT) and Electrical Installation Condition Report (EICR). In February 2016, the Government introduced new legislation imposing a legal responsibility on landlords to check that any prospective tenants have the ‘right to rent’ in the UK. This requires landlords to meet their tenants in person and check the tenants can provide documentation confirming they are either a British citizen, Swiss national or from an EEA country. If they do not meet this criteria, tenants must prove that they have the right to reside in the UK by providing a valid visa or residence permit for example. Landlords can be faced with fines up to £2,000 per tenant if they house a tenant without valid right to rent documentation. Becoming a landlord also has financial ramifications. Maintaining a property to ensure it continues to meet necessary standards can be expensive. Rent received must be declared as taxable income in addition to any salary or other income and this may result in landlords paying a higher rate of income tax. It is also important for landlords to notify any mortgage provider to ensure they obtain permission to rent the property, which may cause a change in monthly payments.

Has the Government got it in for the London property market? Does it want to stop people moving house, get rid of buyto-let landlords and send rents up, Jenny Knight asks?

irst there was the massive increase in stamp duty for houses priced at more than one million where the slab over £925,000 is taxed at 10 cent and the bit over £1.5 m taxed at 12 per cent, with second homes buyers hit with an extra three per cent. The result has been a slow down in sales for expensive houses in London and, some claim, an increase in prices for cheaper homes. The 2015 Summer Budget ruled that mortgage tax relief for buy-to-let landlords would be cut, meaning many new landlords would struggle to make a profit. Then came the Chancellor’s Autumn Statement in which letting agents will be banned from charging fees to tenants to cover checking references and preparing agreements. These fees average £202, according to the Association of Residential Letting Agents, who say the ban will backfire if agents shift fees to landlords resulting in higher rents. Charles Weller, of Palace Gate Lettings, says: “This ban is infuriating. We were midway through this consultation about changes in the way fees are charged and then the Government comes out with an outright ban. “There is so much expected of agents and what we have to do on behalf of tenants. So much is going on behind the scenes that our charges are justified – and they are small amounts; we don’t really make any money out of them. “As in any walk of life, there are some agents who charge outrageously, but it is ridiculous to try and ban all of us from charging fees. “Tenants need to be guided and protected through the whole system. If they want to make changes to the terms of the agreement, we have to address that. They need to be urged to get forms back to us – references and agreements, for example. Deposits have to be protected and we have to make sure moneys are paid on time. “If they want to spend an hour measuring up the property before moving in, we don’t charge for that. Inventories are there to protect the tenant and landlord and the cost of preparing and checking them should be split between them.”

017! Happy New Year everyone. I expect many of us are now thinking about what to give up in the new year, what hobbies or interests to take up, what to change or where you are going to move to? It looks set to be quite an exciting time and I’m very much looking forward to the year ahead. After celebrating the Wandsworth office’s 10th year last year, we feel we have now cemented ourselves as a successful, long standing advisor around the area. This year we are trying to deliver even more with slicker websites (our global homepage and UK websites have been given an overhaul and we think they now look even better), easier access for clients to our award-winning research and more information for buyers to help understand the market in the area of their search. Punch in your postcode and it will reveal a host of interesting facts about the area where you live from school catchment areas, the average sales prices and what types of restaurants are closest to you. We have also tried to boost our profile across the part of the market that people assume we don’t operate in. Not many know that 59 per cent of our registered buyers are looking to spend between £500,000 and £1,750,000 and 39 per cent of all that we have sold in the last 12 months has been sub £1,500,000. One of our clients, that we sold for in the Toast Rack, subsequently bought a lovely garden flat through us and is currently negotiating on a rental investment through us at £550,000, too. There have been some fun stories at the top end of the market as well and the highlight must have been the buyer who flew from Brazil to look at two houses backing onto the common, flew back the following day having secured one of them, putting down a non-refundable and closing four weeks later. It goes to show that the buying process can be straightforward if there is a focused buyer, committed vendor and some quality solicitors. It also goes to show that the market is performing so if you have something to sell, we are ready and able to help.

TESCOTOWERS Tesco hopes to bring 180,000 new flats to London by building homes on top of its stores and by turning some of the biggest supermarkets into mini-villages. Flats could also be built within stores and car park spots offered to tenants. Tesco says it could net them £1.8 billion and help the London housing crisis. Other supermarkets are believed to be discussing similar plans with property developers to build hundreds of flats on top of superstores and sprawling store car parks. According to Alan Stewart, Tesco’s chief financial officer, the sale of Tesco’s so-called “air rights” could generate around £400m. The plans have added appeal because they could provide a solution to Britain’s housing crisis. Tesco has already identified 15 sites, most of which are in London, with another in Oxford. Air rights involve selling the rights to build over retained land on long leaseholds. Typically, flats are built on top of existing buildings. Recent developments have involved flats being constructed off-site, then crane-lifted into place on a building. Compared with other cities worldwide, London is relatively low-rise. But that could change as land is scarce.

BREAKING THECHAIN Right from the beginning of January, many people’s thoughts begin to turn to moving house, either in the short or long term, says John Thorogood

W

hether they’re upsizing or downsizing, there’s nothing like the dawn of a New Year (perhaps it’s Christmas with the family) to inspire or force us to consider changing the space we live in. The spike in the numbers of people looking at online property over the Christmas period is testament to this, even if many of those are just fantasising. The timing of your sale is all important and doing your research is vital. Many people planning to move house often choose not to put their own property on the market until they’ve found a suitable property to buy – it feels more comfortable that way and they’re usually made to feel confident that their own home will sell fast anyway. But in our experience (that’s several decades’ worth), we’ve seen very few people succeed at this. Sometimes their house may not sell as fast as they/ we think it will (despite the assurances or all the estate agents) meaning they often lose out on that house of their dreams. But even if your own property does get interest quickly, the other one you are after is often snapped up by someone in a better position (already under offer for example). If you’ve already set your heart on a particular property, it’ll also be very stressful selling under pressure which goes against our efforts to maximise your selling price. Better options may be either of the following and these are particularly true if you’re moving out of London but also hold for upsizing or downsizing locally: 1 Bite the bullet – sell up and commit to renting in your new chosen area initially. Yes, it means moving twice but it negates the problems highlighted above and is something which may help you find your preferred location before committing to a purchase. Or 2 Market your house for sale first – get the buyer in position and then start looking in earnest for a house to purchase (having done groundwork/research on the web in advance). Be clear from the outset to your agent (who in turn should inform all potential buyers up front) that you will not move until you find somewhere yourself – when the local market is short of stock (which it generally is) most buyers are happy to give that a chance and wait for a reasonable time period. This makes you a strong candidate with the agents you’re looking through and they are more likely consider you seriously as a purchaser. Mortgages are more affordable than ever, according to the Council of Mortgage Lenders (CML). The CML said the average homeowner spent 17.7 per cent of their monthly income on their mortgage in September, compared with 23.7 per cent eight years ago when interest rates were much higher. It was certainly steady as she goes for September with borrowers getting on with it and securing mortgage deals at rock-bottom rates. The cut in base rate in August further pushed mortgage rates, which were already at historic lows, down further still and with lenders keen to do business before the end of the year, there was a flurry of cheap mortgage products available. However, there is a potential blot on the horizon for borrowers in the form of rising Swap rates which may feed through to higher mortgage rates in the short term. Borrowers who have their eye on a cheap rate should certainly think about securing it while they can – they are so low anyway, it is unlikely to be a move you will regret.

As a result, the Bank of England revised up its forecast for approvals from 56,000 to 65,000 after conceding that the housing market is doing better than it expected back in August. So given the weakness in approvals in August, transactions in October are likely to be at or around the same level as September, before recovering slightly in November.

WHAT’SAHEADIN2017? Are there surprises to come, asks Duncan Farmer

L

ooking back over 2016 it was a year of surprises: Britain voted to leave the EU, Donald Trump won the US presidential election and Leicester City won the premier league. The one certainty throughout the year of shocks was that property prices carried on rising and the economy – with the exception of the pound – appeared to take all the excitement in its stride. Interest rates even came down, although Theresa May did say that she felt that was unnecessary. Looking ahead to 2017, many analysts experts are predicting more of the same and a rise in interest rates still appears a distant worry. Unemployment has been falling and while inflation has risen it has not yet passed the Bank of England’s target of 2 per cent. Wages are also rising, which means that anyone with a job is seeing their income rise at a time when their mortgage payments are at worst stable and at best coming down. Some analysts suggest that the Bank of England’s Monetary Policy Committee may even drop rates again to zero, but the one fly in the ointment is Trump’s presidential election victory. Apart from his pledges to build a wall on the Mexican border (even though it already has a big fence) and to see Hillary Clinton imprisoned (he’s since rowed back on that), the one pledge he appears to be sticking to is a multibillion dollar spending plan on infrastructure. That, say some experts, could lead to much higher inflation in the US and that could easily spread to these shores. If that were happen to an increase in UK interest rates is likely to follow. One problem that neither Brexit nor Donald Trump can resolve is the shortage of UK property, which the Council of Mortgage Lenders says is the biggest driver of prices. “The problem is that demand (from buyers) is still not being met with a supply response (from sellers). New instructions to sell have fallen, or been relatively flat for more than three years now. This has led to the average number of properties per surveyor falling to its lowest level for nearly 40 years,” it said. If that trend continues prices can go only one way.

t used to be the case that first-time buyers made up a third of the mortgage market, but that figure has risen dramatically to a half. While first-time buyers have been supported by various Government schemes, the real weakness is coming from second steppers and other home movers, whose activity has continued to be subdued since the financial crisis. Factors limiting activity include uncertainty surrounding the economy, affordability pressures and mortgage rules announced in 2014, which are being reviewed. The results of the review are expected shortly, but while a change in the rules may help to a certain extent the real pressure is a lack of supply of suitable properties.

On the flip-side, low-budget flats and large, sharers’ houses have been flying off the shelves, with potential tenants offering over asking price in many cases in order to secure accommodation. Owners of these properties have seen an increase in rent this year and, for the most part, have avoided void periods altogether. A significant number of houses sell discreetly; a lot of sellers don’t want their personal affairs or their much loved house widely publicised. This is old fashioned estate agency; taking an interest, really finding out what buyers want and when they want it, and keeping in regular contact with them. It is about helping people in almost every aspect of their move; schooling, recommending local tradesmen and removal companies, dog walkers or tree surgeons – we are asked anything and everything. Louise O’Driscoll, Knight Frank Battersea & Nine Elms Describe your property career to date. From a young age, my dream was to be a TV Presenter. Realising this might not happen, I happily settled for the hard working life of being a UK holiday rep. This strangely enough lead me into the life of Lettings where I started my career back in 2003. I dipped out of lettings for a short period to try my hand at selling cars. Plus, I was curious to find out what a career in recruitment would be like. I quickly realised I had no real interest in cars (even though I sold 16 of them one month) and recruitment was certainly not as rewarding nor as enjoyable as lettings. In 2006 I crept my way back into lettings and found myself exploring the London lettings market and there I have stayed. What do you enjoy most about your job and what have been the highlights? No one day is the same. I am lucky to meet some very interesting people and even luckier to get a flavour of what their lives and properties are like. It can be stressful at times but I do enjoy the pressure and the thrill of a win, whether it be taking on a new property or the excitement on hearing my team have agreed a deal. Winning an instructions is always a highlight for me especially, when there have been some heavy negotiations involved. However, getting to meet the applicants and to take them out on viewings can be lots of fun. I got the shock of my life when Madonna got out of the car to view a property with me. Describe the biggest challenges. Setting expectations to both clients and applicants on prices of properties and what the market is doing and trying to second guess what the competition are saying. What advice would you give to anyone considering a career in estate agency? It’s not an easy ride and you need to be on the ball while ensuring you are giving the best customer service at all times. Being organised is also key, especially when you have a full diary. For me, being keen, motivated and enthusiastic with a willingness to help and be a part of a team is of paramount importance. What advice do you have for tenants in the current market? Be honest and upfront. If you have a pet then disclose it at the beginning.

What sets south London apart? We have the River Thames on our doorstep, Battersea Park is the best Park in London, you tend to get better value for your money and there appears to be a more relaxed atmosphere in South London.

What do you think lies ahead for the south London market? The market will be in favour of the tenants, certainly for the next few months especially with the regeneration of Nine Elms and Battersea Power Station. Landlords will have to take a hit on their rental income since rents will fall due to supply. The market will be busy so it will be key for landlords to ensure their properties are looking the best they can to attract the right applicant quickly and to understand that in a thriving market they will need to be price sensitive

Recent highs, recent lows? With the hard work and help of my then team, we took the St Johns Wood lettings department to over £1million in just under three years. Another high was being asked to manage the lettings department in our new Battersea and Nine Elms office. I always try to look on the bright side so can’t think of any lows right now – not sure there have been any.

What is your top location south of the river? Battersea & Nine Elms – of course! If you were not an estate agent, what career would you choose and why? My secret passion would be to host my own talk show. Guess I could start by interviewing some of the more memorable applicants I have viewed with.
