elcome to 2022, and a revamped Gaming for Africa magazine. The past two years have been a tough one globally, and for many 2022 signals the re-emergence of hope, improved business and a more positive approach to the future of the African Gambling industry. The new year also signals a departure from endless lockdowns, a departure from the naive belief that the powers-that-be have all our best interests at heart as they continue to sow fear and discord for political goals. As such, and drawing on the optimism for the future, this re-designed issue of Gaming for Africa magazine contains a number of thoughful articles like media-guru, Petro Magos’ take on the 5 trends that will have an impact on Casino Marketing in the years to come. Petro will, in future issues also share his keen industry insight with our readers. This issue also looks a the increased use of technology in streamlining business operations, like Sun International’s revamp of its MVG (Most Valued Guest) Programme - an update that has allowed Africa’s oldest casino loyalty programme to go digital. Uganda to Issue National Lotto Licence

T

he African country of Uganda has issued a call for applications to operate a National Lottery licence. The landlocked country, bordering on Kenya and Tanzania, has a population in excess of 45-million, with internet access for close to half the population and a high-percentage of smartphone and mobile use estimated at 22-million. The Ugandan National Lotteries and Gaming

Regulatory Board has issued a call for applications for the lottery licence, and is seeking an operator to run the National Lottery on behalf of the Government of Uganda, in partnership with and under the supervision of the NLGRB. South Africa’s KwaZulu-Natal to Raise Gaming Taxes The secretary for the KwaZulu-Natal Legislature has published an amendment to the South African province’s KwaZulu-Natal Gaming and Betting bill, raising gaming taxes.

T

he amendments include an increase in tax rates across the board, including items such as casino gaming tax, limited payout machine gaming tax, bingo gaming tax, and the betting tax on fixed odds bets on sporting events. For casino tax, operators are expected to pay 9.85% tax on gross gaming revenue (GGR) which doesn’t exceed ZAR12m (£560,000/€660,000). Revenue above ZAR12m but under ZAR30m is taxed at 11.3%. Revenue between ZAR30m and ZAR100m will be taxed at 12.5%, the same rate as before. The highest possible tax rate for casinos is for revenue of ZAR100m or more, which is taxed at 14.05%. Previously, revenue less than ZAR30m was taxed at 9.5% and revenue above this total at 12.5%.

Tax rates for limited payout machine gaming were set at 15.25% of GGR, paid to the Provincial Revenue Fund. The highest tax rate for bingo gaming is ZAR73.8m for revenue of ZAR1bn or more. The secretary for the KwaZulu-Natal Legislature, Letho Sibiya, said he doesn’t foresee such proposals being met with any objection, “given that the tax rates have not been revised for many years”. Regarding tax revenue from horse racing, the amendment proposes that revenue be paid to other categories of licenced operators, rather than just to the operator Gold Circle as is currently the case. The bill proposes Category 1 licensed racecourse operators – those that conduct thoroughbred horse race meetings – should

receive 1.6% horse racing tax revenue. Category 2 operators who conduct harness racing horse race meetings, and Category 3 operators who conduct standardbred horse race meetings should receive 0.2% each. Another proposal suggests that a percentage of the tax revenues which are currently being paid into a provincial revenue fund should be funneled into a Transformation Fund for “specific projects to be undertaken by the licensee in accordance with a detailed project plan”. For fixed odds betting, operators are subjected to a tax rate of 6.0%. 3.0% goes to the Provincial Revenue Fund, 1.0% to the Transformation Fund, 1.6% to Category 1 operators, and 0.2% to Category 2 and 3 operators.

before successful completion of the training. “The programme is designed to feed off the gaming companies’ requirement in P1 and P2 to ensure the students attain their degrees, while at the same time, promote and secure a pool of skilled technicians for the industry, which leads to better absorption within the casino space” says Group CEO at grok HR consulting, Mr Herman J van der Merwe. Furthermore, from Technical Manager and Mentor at umAfrika, Mr Ronnie Maisela: “The programme is designed to develop professional engineering technicians by teaching learners how to apply mathematical, scientific and engineering theory to electronic engineering systems and equipment” Nosipho Fakude, a student who was part of the

Online Gaming and Gambling in Africa: Why Greater Regulation Is Inevitable Insight from LexisNexis Risk Solutions - Jason Lane-Sellers, Director, Marketing Planning EMEA, Fraud & Identity

The online gaming and gambling market is huge and growing; it is expected to be worth more than US$127 billion by 2027. Africa is expected to claim an increasing proportion of that market in the coming years, as more governments invest in internet technology and the continent’s demographics come into play (the number of under 24 year-olds in Africa is predicted to increase by 50% by 2050).

he potential for operators to create new markets and revenue in Africa is evident – but it is equally clear that it is only a matter of time before regulation around online gaming and gambling in Africa is ramped up considerably. Regulation in Africa directed at the gaming and gambling sectors is relatively light – and online gaming and gambling is a relatively recent addition to the agenda. But this is in stark contrast to regulatory activity in other areas of the world.

Money laundering Casinos have long been identified as a target for money laundering and financial crime. The high turnover of customers and volume of transactions make gambling a high risk business and in 2003, the Financial Action Task Force added casinos to its list of non-financial businesses that are required to follow its guidelines on anti-money laundering and counter terrorism financing (AML/CFT). This means that casinos follow similar know-your-customer checks and transactions screening applied by banks and other financial institutions. More recently, though, online gambling and gaming has come under the spotlight. The FATF is taking a close interest in the sector and is currently consulting on its updated guidance on a risk-based approach to AML/CFT for virtual assets and virtual asset service providers (VASPs). The FATF has long been concerned that the online gaming and gambling sector is a magnet for financial crime and in June 2019 announced that VASPs would be subject to its AML/CFT guidance.

Responsible gambling Gambling operators are under increasing pressure to play a leading role in responsible gambling programmes. In many countries, the onus is firmly on operators to ensure that self-excluded gamblers do not re-register under a different identity. While responsible gambling programmes in Africa are still relatively immature, it’s likely that operators will face greater and greater obligations in the near future – and the lack of coordination between regulatory boards will make identifying self-excluded players particularly challenging. Around the world, regulators are increasing their activity around the gaming and gambling sector, particularly online businesses, and issuing fines to operators who breach anti -money laundering or responsible gambling rules. The UK Gambling Commission, for example, fined the online casino operator Casumo £6m in March 2021 for breaches to AML and responsible gambling rules, and fined Betway £11.6m for similar breaches in 2020. The UKGC issued almost US$33m in fines in 2020, up from $24m in 2019.

Regulation in Africa It seems inevitable that regulators across Africa will follow the lead of regulators in the US, Asia and Europe and tighten legislation and enforcement around online gaming and gambling. A major driver is international pressure on the internet gambling and gaming sector to join the fight against international financial crime. We can already see early developments, with Tanzania, Kenya and Uganda

leading the way in passing specific regulations aimed at online gambling. The Gaming Regulators Africa Forum is also working to improve coordination of gambling regulation across Africa, and to build awareness around risk. “Across Africa we are seeing a more concerted effort by gaming legislators and regulators to not only come to grips with the phenomenal growth in online gaming, but also understand new technologies, payment methods and how to effectively regulate them. As technology progresses unabated, gaming regulators are struggling to keep up. African regulators are hard-pressed to ensure that effective measures are in place to protect players, understand the everchanging playing field, while at the same time also ensuring that their tax net is cast as wide as possible,” says Roy Bannister African Gaming, AI and 4IR Consultant, who publishes Africa’s leading gaming trade publication, Gaming for Africa. “Increased continental co-operation among gaming regulators around responsible gaming and best financial practices have improved in recent years, but regulators will need to embrace technological developments and expertise from global experts like LexisNexis in order to more effectively understand the growing pace of this industry, and implement measures to effectively regulate it.”

Ghana Lottery Authority Clamps Down on Illegal Operators Ghana’s National Lottery Authority (NLA) has formed a task-force to clamp down on illegal private lotto operators, popularly known as ‘banker to banker.” The taskforce, comprising the military, police and the NLA lotto personnel, have been tasked to arrest people operating ‘banker to banker’, throughout the country.

n September this year, the authority announced its intention to clamp down on the activities of illegal private lotto operators. The NLA set out a pre-qualification phase of the licensing regime and the operators were given a one month window to register with the NLA, in view of their preparedness to operate private lottery. The authority, after the one month, disqualified 70 companies, particularly those that failed to meet the NLA set criteria. The NLA set their license fee and asked qualified companies to apply for licensing for 2021/2022 licensing year. Goodfellow Dei Ofei, Public Relations Manager of NLA, at a recent press briefing in Accra, said: “We are determined to purge

the lottery industry of illegal operators and operations activities. The NLA has been very reasonable with the process. We gave them a fair opportunity to rectify their position with us, but as I usually say, the recalcitrant elements will always rebel and we are prepared to face them squarely.” Mr Ofei said, “We have dispatched our men into the regions to arrest and prosecute anyone operating lotto without the requisite license or authorization.” Asked what happens to the disqualified companies which did not meet the criteria, he said, “the NLA did not just disqualify them without giving them options. We gave them two options. One is to consider registering as a Lotto Marketing Company (LMC) so that they can sell for the NLA,

which comes at no cost or to register under one of the registered private operators whose number of writers can still accommodate them and still meet the threshold.” Mr Ofei said, “So far the team in Accra has arrested over 35 operators and have seized thousands of Ghana cedis from these operators. Per our arrangement with the police, any money or items we seize during the operations are handed to the police for safe keeping because they will be used as exhibits during prosecution.” He expressed satisfaction about the operations so far, and thanked persons who on a daily basis gave information about illegal operators to the NLA. Mr Ofei appealed to the public to assist the NLA to win the fight against illegal lotto operators.

New Competition Commission Report Identifies Gaming Industry as Skewed Key economic sectors in South Africa – including retail pharmacy, gambling and fishing rights – have remained highly concentrated, a new study by the Competition Commission shows, further flagging the failure by certain licensing processes to spread ownership across the sectors.

he report, ’Measuring Concentration And Participation in The South African Economy: Levels and Trends’, notes that out of 144 sectors examined, about 69.5 percent were “highly concentrated” with 40.3 percent of these classified as “highly concentrated with a presumptively dominant” firm. Only about 9.7 percent of the surveyed sectors “were found to have unconcentrated” markets. Licensed industries such as gambling, retail pharmacy and others were highly characterised by merger and acquisition activity which has only served to increase concentration in the sectors. The report notes that gambling industry has effectively seen three companies (HCI/Tsogo Sun, Sun International and Goldrush ) “control vast parts

of the industry due in large part to licensing and past merger” activity. “Tsogo Sun and Sun International control over 80 percent of casino gambling and have through mergers and new licenses control of 77.5 percent of Limited Payout Machines (LPMs). Gold Rush’s purchase of Crazy Slots in 2016 helped to strengthen its position in the LPM segment,” said the report. As per Administrative Tax Data from the South African Revenue Services (Sars), 95 percent of firms in 2016 were small, medium enterprises (SMEs), but they only accounted for 24 percent of turnover. This is compared to large corporates that made up just five percent of firms on Sars books in 2016 yet comprised 76 percent of total turnover.

This has been interpreted under the Competition Commission’s report to be reflective of “how concentrated and inequitable” the South African economy is. The report thus shows that South African SMEs have “greater entry and exit rates” than larger firms. “The skewed economic structure in South Africa is evident from the fact that amongst taxpaying firms, SMEs contribute only 24 percent of total firm turnover relative to the 50-60 percent cited by a recent OECD study.” Moreover, the skewed economic structure of South Africa’s economy will “constrain employment generation and contribute to household inequality” at a time the jobs market is shrinking. f there is one thing the recent global pandemic has taught us, it’s how to shift and evolve. The world is embarking on a new phase in history and the recent change in thinking and strategizing has filled some with apprehension, while others have embraced the challenge and pioneered their own path. Peermont Resorts are renowned for their Casino and Leisure complexes throughout Southern Africa, most notably Emperors Palace. Also within the stable are three properties located in Botswana, one of them being The Grand Palm, which to locals is somewhat of a national institution and home of the Gaborone International Convention Centre (GICC). A strategic move made by Peermont in 2021 was to consolidate the management of their Botswana properties under a single leadership vision. Enter Keletso Bogatsu. The Gaborone-born General Manager was promoted to fully-fledged status in November of 2021 and boasts a pedigree of over 25 years in the tourism and gaming industry, having started at Protea Hotels all the way back in 1996. ‘ I was with Protea Hotels for 20 years and was the first Black Female Manager for the group at only 32 years of age. I then worked for a Hotel Group called Mantis that was responsible for developing a 5-Star Hotel in Abuja, Nigeria. I worked on the Project as a Development General Manager and managed the hotel for a further 6 months after they opened,’ says the 46-year-old, demonstrating her drive to climb

the management ladder, which was noticed by Peermont in 2018. ‘My journey with Peermont started as Operations Manager at the Grand Palm. Then in 2021 I took on the role of acting General Manager in the height of the pandemic which has now been made official. At Peermont Botswana I will oversee all 3 of our properties,’ says Bogatsu casually of the 4 hotels, 7 restaurants and world renowned convention centre located in Gaborone and Francistown that now fall under her guidance. The unifying of Peermont’s Botswana properties is the new direction to elevate the brand to premier status post-COVID-19 restrictions, which have impacted the hospitality, tourism and gaming industry severely in the last 18 months. ‘Number one on my list is to bring back Peermont Botswana from the hurt that was caused by the pandemic, by using the innovative solutions and technological advancements that have been developed recently. Then to bring the properties in Botswana to operate as one, under the banner of Peermont Botswana. Meaning, all the processes, operating procedures and strategies are aligned,’ says Bogatsu. And to achieve her objectives, Bogatsu will be looking to the future. ‘My new role is to lead and inspire a very young team of future leaders. It involves making sure that the team is inspired to achieve the goals and make sure that our guests are guaranteed exceptional and exciting stays at our properties.’ Bogatsu’s management

style has been motivated by being more inclusive of her team’s opinions and sharing of ideas: ‘It’ll be more democratic in order to bring Peermont back to its former glory days. Thus, I will need the team to be encouraged to work together towards a common goal and make sure that everyone is involved. Seeing other people grow in their careers and achieving more than their expectations - and having had input – that’s what gets me going daily.’ Bogatsu is currently one of only two female General Managers at Peermont and the first Motswana (person from Botswana), which only inspires her further, ‘Going up the ladder will always create opportunities or obstacles. But I don’t focus on the obstacles. More than half the time, I only realize that there was one when I have already gone past it.’ Focus has also played a big role with Bogatsu knowing that success requires not only planning, but hard work. ‘Perseverance and patience, knowing and understanding that you have a vision that you need to achieve, but most importantly focusing on achieving that goal. It will not always be easy, but if focused, will achieve anything. Focus, focus and focus,’ she laughs. And when not leading from the front Bogatsu, can be found going full throttle in a different way. ‘For the last 8 years I’ve been into motorbikes and I have a M90 Suzuki Boulevard which I ride on weekends,’ she smiles with a twinkle in her eye. NorthWest Regulators Clamp Down on Illegal Festive Season Gambling The South African Police Service in collaboration with the North West Gambling Board have intensified their efforts to combat illegal gambling in the province in the run-up to the festive period.

n 29 November 2021, the Police pounced on two taverns in Hartebeespoortdam in which unlicensed gambling machines were confiscated and the tavern owners were arrested for possession of gambling machines without a license or authorization from the North West Gambling Board.

Being in possession of gambling machine or any gambling device is an offence in terms of the North West Gambling Act which on conviction carries imprisonment of up to ten years and or a fine. “Illegal gambling continues to be an area of concern for the province and the consequences

thereof are dreadful, mainly on women and children. With South Africa commemorating 16 days of violence against women and children, the North West Gambling is hard at work with other Law enforcement agencies to curb the spread of such operations.” North West Gambling Board Acting CEO, Mr Bafana Mabale expressed his satisfaction with work done by the Entity in collaboration with key stakeholders to close down on illegal gambling operators. “We have made progress working with the South African Police Service and the South African Revenue Service in previous years as most gambling machines were confiscated and destroyed over time resulting in very few machines left in the environment to date. We will ensure that we leave no stone unturned to close illegal operations so we can protect the society from falling prey to these perpetrators. Illegal gambling is diverting the much-needed revenue for the licensed gambling operations and that is a cause of concern which we are addressing “says Mabale.

Sun International Turns to Tech to Improve Customer Experience Sun International has used the downtime during the lockdowns to look at how it can improve and enhance its customer experience.

n addition to introducing a speedy online booking platform, the company has also introduced a slick new App to streamline communication for its Most Valued Guest (MGV) programme.

Anthony Leeming, CEO of Sun International said, “The Covid-19 pandemic has catapulted the world into the digital era and has forever changed customer expectations and how we communicate with them. Our MVG’s are no longer prepared to spend hours trying to access information about the best room rates or to confirm how many points they have to redeem. They want instant access to information and they literally want it at their fingertips. The new App gives this to them.” The Group’s MVG loyalty programme, which was first launched in February 1994, was the second to be introduced in South Africa and the first to offer free membership. At the time the programme only applied to casino patrons, but in 2016 it was expanded to include hospitality and leisure offerings too.

It will be recalled that Mr Bello Maigari, acting executive secretary, National Lottery Trust Fund (NLTF) has last week raised alarm over the activities of illegal lottery operators. Maigari, said that there were many lottery operators in the country without a licence, adding that this has resulted to leakages in terms of what they were supposed to remit to the trust fund. “Nigerian government is losing more than one trillion Naira every year because of illegal operators. There are a lot of illegal operators in the industry and these are part of the reasons why there are leakages. Some are conducting this business without being regulated and there are chances that such proceeds will be channelled towards crime, fraud and money laundering,” he said.
