TWO TOWN HALL MEETINGS TO DISCUSS THE POA WILL BE HELD AT THE CLUBHOUSE ON JANUARY 25TH AND MARCH 2ND AT 7PM.

he Georgia Property Owners’ Association Act (“POA”) was adopted in 1994 to expand the powers of homeowners associations. The POA does not, however, apply automatically. Instead, the developer of a community or the members of a community’s homeowners association must “opt-in” to be governed by the POA. The “optin” process generally takes place either by the developer when the developer initially creates the declaration of covenants for the community, or by the members of the homeowners association through an amendment to the declaration. However, developers of most communities do not submit their communities’ covenants to the POA because there is a provision in the POA that assessments cannot be waived. This means a developer would need to pay assessments on each lot it owns, regardless of whether or not the lot has been developed and sold.

Nine benefits of a POA include the following: 1 Automatic Statutory Liens After submitting to the POA, the association will no longer be required to file liens at the county courthouse for unpaid assessments or other charges. Instead, the POA creates an automatic statutory lien against a delinquent owner’s lot. In other words, the association will no longer have to file individual liens against lots in order to secure unpaid assessments; rather, the POA provides that the declaration of covenants itself serves as notice that there is a lien for any unpaid assessment or other charges. If the association is not paid out of the proceeds of the sale or refinance, the lien continues against the lot and will generally have priority. The statutory lien also results in a secured claim of the association against an owner if the owner files for bankruptcy. 2 Joint and Several Liability

to Pay Assessments

The POA includes another provision that generally strengthens an association’s assessment collection powers. That is, the POA provides

that unless the declaration of covenants states otherwise, the grantee (or buyer) of a house is jointly and severally liable with the grantor (or seller) for all unpaid assessments. That means that if the automatic statutory lien is not paid at the closing, the association can proceed against the new owner who will be personally liable for all amounts owed prior to the closing. ( Note that the new owner can then seek reimbursement from the previous owner, but the association would not be involved in that dispute. ) 3 Late Fees and Interest Submission to the POA allows the association to charge a late fee of the greater of $10.00 or ten percent (10%) of the amount due, and interest at a rate of ten percent (10%) per annum on unpaid assessments and charges. These provisions must also be stated within the declaration of covenants, so as part of the amendment process, we generally will include these provisions to strengthen the community’s collection powers. 4 Attorney’s Fees and Costs of Collection The POA authorizes the recovery of the association’s costs of collection of the delinquent assessments, including reasonable attorney’s fees actually incurred. 5 Specific Assessments The POA provides that to the extent provided in the declaration of covenants, a board may specifically assess expenses to an owner if the conduct of the owner or the owner’s tenants or guests caused the expense. For example, if an owner or owner’s child damages common property that the association then pays to repair, or an owner causes the association to incur attorney’s fees in covenant enforcement against the owner, then those amounts may be specifically assessed against the owner. 6 Tenants The POA also clarifies that all owners and tenants (i.e., people who rent a house in the community from the owner) must comply with all the provisions of the declaration of covenants and the association’s rules and regulations.

7 Fines and Suspension The POA gives the association a statutory power to assess fines against violators and to suspend the common area use rights of violators, provided the ability to fine and suspend are stated in the declaration of covenants. 8 Additional Restrictions In addition to addressing covenant duration, Code Section 44-5-60 states that no change (i.e., amendment) in the covenants which imposes a greater restriction on the use or development of the land will be enforced unless agreed to in writing by the owner of the affected property at the time such change is made. For example, if your community passes an amendment to restrict the number of houses that may be leased at any one time, Code Section 44-5-60 could be asserted that the leasing restriction will not be enforceable against any homeowner who voted against the amendment because such owner did not agree to the amendment in writing. The best option is to eliminate the owner’s Code Section 445-60 assertion altogether. To that end, as stated above, one of the important benefits of the POA is that it states that Code Section 44 5 60 shall not apply to any covenants contained in any instrument submitted to the POA. That means the approved amendment to limit leases in the above example would be enforceable against the entire community, including those homeowners who voted against the amendment. 9 Foreclosures Community associations cannot fulfill their obligations related to maintenance, repair, and operations without owners paying their assessments. Many associations have had enough of delinquent owners who continue not to pay and are increasingly looking to foreclosure as a way to rid themselves of these deadbeat owners. There are two types of foreclosure in Georgia. Judicial and non-judicial. A typical non-judicial foreclosure is a mortgage which provides that if an owner does not pay the monthly payments, the mortgage company may foreclose without having to sue the homeowner. By contrast, community association foreclosures are judicial foreclosures that do require the association to sue the owner.

Community Trash Update!

he Board has been working diligently with Red Oak during this transition period. We recently communicated, via email blast, all of the trash industry struggles that are going on right now. Please make sure you are familiar with the detailed information that we have sent out from Red Oak regarding your trash service and recycling.

NEW TRASH SERVICE DATE IS THURSDAY! If you have a 2nd trash can that you would like serviced, you will need to contact Red Oak directly to set up payment for that 2nd can. The cost is $6 per month. We encourage you to call and set this up prior to January 1st. Please contact Red Oak at 678-455-7819 or dispatch@redoaksanitation.com.

See below for information on our frequently asked questions. Please have your cans curbside the evening before. All Trash must be placed in your bins. No trash outside of the can will be collected. If you need an additional trash can, this can be provided for an additional $6 per month. If you are in need of a new can please contact Red Oak dispatch at dispatch@redoaksanitation.com. Please specify your name, address, and what type of can you are in need of (Trash or Recycling). Red Oak will service one bulk item per month. Red Oak will remove up to 5 bags or bundles of yard waste per week that meet the following parameters: ▶ 5 bundles/bags of yard waste per week. Yard Waste bags cannot exceed 30 gallons per bag ▶ All yard debris must be contained in bags, or bundles. ▶ All yard waste must be cut and bundled in sections no greater than three (3) feet in length. Bundles may be no larger than twelve (12) inches in diameter. Bags or bundles cannot exceed twenty (20) pounds in weight. ▶ Larger branches & limbs cannot exceed (3) inches in diameter and 3 feet in length. ▶ IMPORTANT NOTICE: our equipment is not able to take any construction debris, rock, dirt, trees, stumps, logs, sod, rail road ties, pallets, concrete, paint or oil. Red Oak does not offer tree or brush service removal.

Cardboard Removal must meet the following parameters: ▶ All Cardboard boxes, recycling or not, must be completely empty; each box must be broken down completely flat and may need to cut down to meet parameters. Boxes must be bundled with no more than seven (7) boxes per bundle, not to exceed twenty (20) lbs. per bundle and must be tied with twine or duct taped into manageable bundles no larger than three feet by three feet (3’x3’). ▶ Up to twenty-one (21) boxes are accepted per week. ▶ Boxes must be placed curbside with carts the night before service. ▶ Please consider cutting boxes up so they can be sealed off in bags to fit in cart, or broken down to fit in cart. Stringing Is it time to restring your racket? Feel free to drop off your racket at the Tennis pro-shop to be restrung. Wilson, Babolat and Luxilon strings are all available. String types vary from very durable for chronic string breakers, to very soft strings that provide a lot of feel and touch. Turn around time is usually 24 hours. Don’t hesitate to contact Danie if you have any restringing questions.

COVENANTS CORNER

A

s reminder notices are sent out to the community about covenant compliance, we frequently receive repeat follow up questions. This month’s covenants corner is dedicated to those Frequently Asked Questions (FAQ) and Frequently Made Statements (FMS)with answers from the Board. Maybe you’ve been wondering some of the same things? I own my home; therefore the HOA cannot tell me what I can or cannot do with my property, correct? When you purchased your home, you signed documents stating that you agree to the Covenants, Conditions, and Restrictions (CC&R’s), the By-Laws and other Governing Documents set forth by the HOA. Within these documents are rules and restrictions that can have restrictions on what you can do with your own property. If I want to place a political (or any) sign in my front yard, isn't that my first amendment right? The CE CC&R’s expressly restricts the placement of any sign on your property other than the few exceptions listed in the CC&R’s. Political signs, Contractor Signs, non- approved “FOR SALE” signs are all prohibited within Creekstone and can be removed by the HOA if a resident fails to comply. Why do I need to pay the HOA a fee and gain permission from a Committee before doing certain work to my home? Due to the amount of time and complexity of some ACC requests, the Creekstone Board has chosen to outsource certain ACC modification requests to our Property Management Company (HMS) to obtain all necessary documents/signatures and to ensure that the project does not deviate from the original plans during the construction phase. This service was not part of our original contract with HMS, therefore, the cost associated is passed back to the homeowner through the fee. Why am I receiving a letter to paint my mailbox when we have other residents with much worse violations seeming to go unnoticed? Your violation has no relation to other violations in the HOA. Each resident receives notices from HMS regarding Code/Covenant violations and the Board is then notified when the violations are not corrected within a suitable time frame. I don’t use the amenities, I don’t swim or play tennis. Why do I have to pay my HOA fees?

Use or non-use of the amenities has no bearing on your quarterly dues. The dues for the association cover much more than swim/ tennis/clubhouse expenses, including landscaping, insurance, property management, legal, utilities, taxes, accounting, etc. Failure to pay HOA fees can result in collections, reporting to credit agencies, potential wage garnishment and even foreclosure.

Why does the Board seem so concerned with minor Covenant violations when we have much bigger issues such as habitual speeders and stop sign violators in the neighborhood? The Board does not prioritize Covenant violations over other issues. It is the responsibility of the Board to enforce the CC&R’s of the HOA; where it is the responsibility of the Local, State and Federal government to enforce traffic laws. The Board of Directors has no jurisdiction or authority to address vehicle moving violations. Is it against the HOA rules to use a garage as storage and therefore park all vehicles in the open/driveway? YES! The CC&R’s clearly state that all residents must use a minimum of two garages for the parking of vehicles and that utilizing all three garages for storage is strictly prohibited. It is STRONGLY encouraged for all residents to utilize all three garages to park vehicles/golf carts. Can the HOA fine me for a code violation? Yes. Each violation carries a different fine and the HOA has every right to enforce these fines. Failure to pay fines can lead to collections and even wage garnishment. Kids in the neighborhood keep ringing my doorbell late at night and waking me up. Why isn’t the HOA doing anything about this? Unfortunately the HOA cannot prevent teenagers or strangers from coming on your property. This is a trespassing incident that would need to be reported to the Forsyth County Sherriff’s Dept."

he HOA has noticed many unapproved exterior projects during the past few months. We would like to remind everyone to review the community guidelines (www.creekstoneonline. com/page/23487~493964/modifications-information) and submit an application for modification as you tackle your spring projects! If a project begins without ACC approval and the project does not meet the community guidelines, it is at the expense of the homeowner to correct/modify any unapproved issue related to the project. If you are planning a project, please keep in mind that the application requires a signature from neighbors sharing a common boundary line. Awareness of the neighboring homeowners will be considered by the ACC Committee, but will not be binding. No application will be considered unless this section is complete. We encourage the residents who sign off on their neighbors ACC application to review the complete plans and all modifications being submitted.

Please Note: ACC Approved Sign For Projects Required In Tier Levels 2, 3, or 4 Approved modifications that fall into Tier Levels 2, 3 or 4, will be required to post a temporary sign in the front yard, which provides information that the project has received proper approval from the ACC. Details on how to obtain the sign will be included in your approval letter and also require a fully refundable sign deposit of $50, remitted by check. Once the project is complete, you will notify HMS by emailing the property manager, Amber Collins at amber.collins@hms-inc.net, who will coordinate the pickup of the sign and refund of the $50 sign deposit. Sign deposits will be remitted when sign is issued, following the official approval of the modification request.

Failure to follow the items of this approval will result in an unapproved exterior modification.
