The Brickshire Bulletin is published quarterly in January, April, July, and October for the residents of the Brickshire Community Association.

About Brickshire

Brickshire, in the heart of historic Virginia, began development in 2001.  It is now home to more than 900 families, who enjoy all the beauty and serenity of the country with the added benefits of being within thirty minutes of Richmond and Williamsburg. The Brickshire Golf Club and Grille is owned by the Brickshire Community Association and is open to the public.

Southern Pine Beetles. Is That What’s Bugging You?

The Virginia Forestry Department provides information on what might be killing your pint trees. See the article within.

Southern Pine Beetles

These insects are extremely destructive bark beetles, despite being native to South Carolina. These beetles are smaller than a grain of rice and can destroy millions of dollars’ worth of timber during periods of a severe outbreak in pine forests. They are also costly pests in developed areas and can impact pine trees in urban settings. Activity normally begins in the spring after individuals overwinter in or under the bark of previously infested trees. Pairs of SPB will most successfully attack trees that have been weakened or stressed by overcrowding, drought, disease, human impacts such as soil compaction or equipment damage to stems, or have suffered other damage like a lightning strike. Areas with mature pine trees growing close together are susceptible to attack by bark beetles. Let’s keep our trees healthy by following these recommendations from the Virginia Department of Forestry: Keep trees healthy by reducing environmental stress:

» Protect trees from lawn maintenance equipment.

» Ensure soil around tree is not compacted by vehicle traffic. Mulch around the base of the tree and water during times of dry weather.

» Remove injured or diseased trees.

» If possible, thin large areas of pine to improve the health of the stand.

» Some insecticides are effective at preventing bark beetle attack, but the entire tree must be sprayed. This is usually only recommended for high-value yard trees. Contact a certified arborist. Closely monitor your woods for signs of bark beetle infestation. Look for these signs and symptoms:

» Pitch tubes: as beetles bore into the tree, the tree releases resin in small clumps on the bark.

» Sawdust: boring dust falls to the base of the tree and in crevices between bark plates.

» Galleries: bark beetles create feeding tunnels underneath the bark.

» Red needles: once trees are infested, needles turn yellow and then red, and eventually fall from the tree.

New Kent County Report

The Board Of Supervisors (BOS) adopted the 2023-24 budget on April 25th. Initially, it was proposed to raise the real estate tax rate by 2 cents/per hundred and I fought against the proposal and won. There will be no increases in real estate or personal property taxes. There is also no increase in water rates.

MARK YOUR CALENDARS: 27 race dates at Colonial Downs from July 13th -September 9th. This year’s scheduled race dates have been moved to Thursday, Friday and Saturday. On August 12th, three huge races are scheduled which include the Arlington Million, Beverly D. Stakes and Secretariat Stakes. Derby Day is scheduled for the last day of racing season on September 9th.

The request for three additional crosswalks on Kentland Trail has been denied by VDOT. The engineers state that crosswalk regulations now require them to be ADA approved, costing $30K each.

Several folks have inquired about the Poindexter acreage on Courthouse Road and the other parcel south of his property. Mr. Poindexter is preparing his land for crops and cattle; no houses or commercial buildings. Matt Star owns the property just south of Poindexter’s and plans to develop a subdivision in 3-5 years. The property is unsightly, looks like a war-zone, so he plans to cleanup the front of the property that is visible from the highway.

No updates on the proposed upscale grocer except a letter of intent (LOI) has been signed and negotiating and exchanging proposals are ongoing.

I serve on the Transportation Safety Commission and after pleading with VDOT for the past three years to repave Kentland Trail, it has come to fruition.

Finance Committee Report

Chair Brian Keena reviewed the April financials and reported the HOA receivables are at approximately 97% collected, which is excellent. Amenity Fee account is almost double the forcast, reserves are all fully funded, and the variation in the Golf Club Contribution line item is related to the spread of the budget and will resolve itself over the coming months. May financials will reflect extra principal payment of $100,000 Golf Club loan balance.

Status of Financial Statement Review/Audit Optionstwo proposals for review have been received with a third due this week. Finance will review in their June meeting and plans to have a recommendation for the Board at their next meeting.

Fire station #4 is under construction and completion is expected this fall.

The Board of Supervisors (BOS) is in negotiations to purchase property in Bottoms Bridge for fire station #6.

The developer of Oakmont Villas is meeting with County officials on June 29th to discuss creating another neighborhood behind Brickshire. The meeting is not a public meeting. This development would be in the Kentland PUD, but would be a separate subdivision consisting of 200 homes.

I have submitted petitions and paperwork to run for District Four Supervisor on November 7th. The registrar’s office has confirmed that I have qualified to seek re-election and I hope you all will continue to support me.

Architectural Review Board Report Tim Sutor, Chair

Prior to the June 6 meeting, long time Brickshire volunteer and ARB member Ken Hislop announced his resignation from the ARB to enjoy some much deserved R & R. The ARB and Brickshire is grateful to Mr. Hislop for his years of service to this community. The Board voted unanimously to fill the seat with Mr. Bill Keswick who has served as an alternate to the ARB for many years. Congratulations to Bill Keswick for his new position!

The Architectural Review Board has 7 voting members and we presently have 2 sitting alternates. Collectively they complete weekly ride-around inspections of each new construction job site, reporting any builder violations to the office. They also inspect completed home improvement projects. If you have Tuesday mornings available and have interest in joining the ARB, as an alternate member the office can send you an application for the ARB to consider. Summer is the time for home improvement projects in Brickshire and many of you are making plans for what you would like to do this year around your property. As a reminder, most projects require approval at a scheduled Architectural Review Board meeting before you can begin the work. The Brickshire Design Standards can be found on the mybrickshire.com website and those Standards outline all of the rules and regulations regarding home improvement projects as well as new construction. Should you like a copy of the Design Standards emailed to

you, the office can gladly forward to you at your request. Once you have your application complete with all supporting documents, please submit to the Brickshire office, or via email to mrice@evernest.co and it will be reviewed at the next scheduled meeting.

As a reminder, the ARB meets the first and third Tuesday of each month and applications must be received by the Monday one week prior to a scheduled meeting to be included on the agenda. Permitted work hours in Brickshire for construction activity is 7am to 7pm Monday through Friday and 8am to 5pm on Saturdays. No work is permitted in Brickshire on Sundays or the holidays noted in the Design Standards. Should you witness a construction violation or hazard, please report via email to mrice@ evernest.co so that proper notice can be sent and the issue corrected.

If you post an issue on a social media platform but fail to share with the office, nothing can be done about the problem. PLEASE follow proper channels of communication and report violations with accompanying photos so that we can issue proper letters and fines and hold the builder accountable so that the issue does not continue in Brickshire.

The ARB meets the first and third Tuesday of every month at 9am in the Owner’s Clubhouse. All homeowners are welcome to attend. There will be no meeting held on Tuesday, July 4, so the only meeting in July will be Tuesday, July 18.

The following projects are in progress. Trees - Simon Facer said the removal of trees on the walking path should be completed around the end of May beginning of June.

Tennis/Pickleball Courts - still no update as we have not received final bids from contractors.

Basketball courts and fence - Todd has the court bid and it has been approved by B&G for recommendations to the Board. We are now waiting on the fence bid for approval. The blacktop and hoops will go in ASAP with the hoops being the final step.

Pool - Swim Metro will be doing pool set up and maintaining the pool again this summer. Lifeguards are said to be hired. Benches for Tennis/Pickleball courts are ordered and will be stored until after the courts are decided on and finished.

Todd says the Kings Pond algae seems to be going away and there is no longer any smell and algae is disappearing. The company is going to continue checking and we suggested to the board to have a system put in to keep algae moving to prevent buildup. The Timmons Group will install aeration pads (4) that are bubblers to keep the movement and prevent a build up. We made a motion to approve $7,500 to have this done.

Guests were there (3 women) to ask about when Pickleball courts were to be done and were told we had no update as of yet.

David King came to ask about putting in a Volleyball court, running track and softball field in tot lot area. He was told that would have to be discussed later as we were presently working on Basketball area. Unfortunately, there have been four resignations from the B & G Committee effective immediately, citing issues with the BOD.

Covenants Enforcement Procedures

When we closed on our homes here in Brickshire, we had to wade through a mountain of paper work. Many of us probably didn’t get around to reading most of it, except, perhaps, those documents dealing with the money we had spent and the significant financial obligations we had just assumed. Among the other provisions in those documents was an agreement to comply with the rules and regulations that govern life and property ownership here. The primary purpose of those rules is to preserve the beauty, property values and quality of life that brought us here in the first place. These rules and regulations have been adopted by the Board of Directors and can be found under the Founding Documents heading on the Brickshire website at www.mybrickshire.com

The Board has charged the Covenants Committee enforcing compliance with those rules under a process that is authorized by and conducted in accordance with the Virginia Property Owners’ Association Act. Committee members make note of any violations they observe and report them to the association office staff, which sends a letter to the property owner stating the nature of the violation and setting a reasonable date by which the violation should be corrected (normally about 30 days).

If the violation remains uncorrected, a “Due Process” notice is sent by regular mail and certified return receipt mail advising the owner of a Due Process Hearing for non-compliance to be held within fourteen days. The Owner will be invited to attend the hearing, with an attorney if desired, and encouraged to resolve the issue prior to the hearing. Once the hearing is held, the decision will be mailed to the owner within seven days. Should the owner be found in continued non-compliance, assessment charges may be levied in the amount of $10 per day for violations of a continuing nature, or $50 for a single offense.

The Owner may also be notified of the association’s intent to correct the violation, should the Committee deem such action necessary and appropriate and that the cost of any corrective action will be levied against the owner. If assessments are levied and not paid, standard collection procedures take effect.

The BCA staff is ready to work with property owners to resolve all violations prior to beginning the formal enforcement procedure. Fortunately, this enforcement process is seldom required because the great majority of owners are never cited for a violation or, if cited, quickly correct the problem.

The children’s committee had a huge success with Mother’s Day Crafts and all 60 creations were claimed for! Father’s Day crafts have arrived and will be going out for pick up at the HOA office on May 29th.

Summer is just around the corner, and it just wouldn’t be summer without our annual pool party! DJ Jerry will be there along with Kona Ice and a dual lane water slide. Be sure to stop by for all the fun on July 22nd from 10-2.

Lastly, what’s summer without a little baseball! Join your Brickshire neighbors at the diamond for a Flying Squirrels game on July 30th! For $30 you can enjoy a party on the 3rd base concourse that includes a two hour all you can eat buffet featuring hamburgers, hot dogs, BBQ pulled pork, baked chicken, macaroni and cheese, coleslaw, and non-alcoholic drinks. We will also have private bartender (Beer/Wine only), field level seating tickets and a video board/PA welcome to The Diamond for our Brickshire group! Things to See and Do and Learn!

Arts Alive is back! This venue has been mentioned before, but is worth highlighting again. Just a 30 minute drive from Brickshire to West Point. Most performances start at 7:00 p.m., but you will want to get there earlier to explore the variety of artwork featuring local artists (many of whom live in Brickshire). Tickets can be purchased individually for $25 each performance. However, your best bet is a season subscription for adults $100 ($120 after July 31) or for adults age 60+ and $80 ($105 after July 31st). July and August are always difficult months for gardening, trying to cope with the heat and humidity. Many flowers thrive with this weather, as long as they are well watered, but some just wilt.

If your plants are in full sun and wilting, you might want to make a note to move them to a shadier location in the fall. Summer is not the time to plant or transplant plants and shrubs. Many work hard to survive during the heat. Wait until cooler temperatures. But…Fall is coming and the old saying “Fall is for planting” is true. It gives plants the best chance to take root and get established during the cooler seasons.

Meanwhile if you are watering a lot and your plants leaves are turning yellow, you probably need to cut back some on the watering.

Do you enjoy being outside on your patio in the summer, but are tired of fighting the bugs? Instead of using toxic pesticides that may harm bees that are fighting to survive, try natural methods like planting flowers that bugs don’t like. Surround your patio with things like Marigolds and tobacco plants that have a scent that bugs don’t like. Add in aromatic herbs like Rosemary, Basil, Thyme, Cilantro that keep bugs away and are useful in your kitchen.

There are many more plants that will help keep the bugs away, just check online for a list. Keep deadheading your flowers, and trimming long branches when they are getting leggy. I usually prune my roses back moderately once during the summer, right after a major bloom, as I don’t want to cut off a lot of buds. And remember, flowering plants, especially roses, need to be fed

The Board did t not approve the proposal to repair a section of the walking trail ($67,418). The Board discussed their observation that the condition of this section of trail does not warrant repair at this time.

New Tennis Court Benches

The Board approved the purchase of two benches for the Tennis/ Pickleball courts from Tennis Supplies and Equipment for $539.90+tax and installation, but not to install until after the work on the tennis courts is complete.

New Gym Equipment

The Board approved the purchase of two pieces of equipment from Superior Fitness for $4202.12 plus the cost of an EXIT sign.

This can be a good time to start think about what you want your garden to look like in the spring. You will need to order your daffodils, tulips, hyacinths, peonies and iris early in the fall. Have you checked out some of the beautiful new bicolor double daffodils.? They are not only gorgeous, but also deer resistant.

If you live in Brickshire, I am sure you are acquainted with the four footed thieves that munch on our flowers and shrubs. I try to plant things that deer don’t like, but I can’t resist roses, mallow, daylilies and other deer candy, so I spray at least every 2 weeks with Liquid Fence, Deer Out or Bobbex. That seems to work. I really want to try some of the new double ruffled tulips this year, but deer love tulips, so I have to commit to spraying those more often in the spring

The Board tabled further discussion about adding a 20’ by 20’ expansion and asked the B and G Committee to provide a full plan of what equipment would go in the space, cost estimate of the new equipment, and approximation of how many additional fitness center users this expansion would accommodate. Will discuss again once this information is provided.

Expansion of Basketball Court

The Board approved the proposal from ProSeal ($49,600) and MaxPlayFit ($11,802), as well as fencing, to expand the basketball courts resulting in 2 quarter courts and one half court..

Fence Extension Along

Villa Green Terrace

The Board approved the Good Neighbor Fencing proposal for $2596 to install fencing behind Villa Green Terrace at the Association’s expense, provided the contractor submits to the Association with proof of insurance, Virginia contractor’s license, verification of installation plans, and confirmation that all materials will match existing fencing.

Amend Design Standards

The Board approved five changes to the Design Standards as presented by the ARB. Changes are posted on website.

The Board approved the request to record Board meetings and post the video behind the owner wall of the Brickshire website. This is subject to selecting and installing needed equipment.

Reconsideration of Fence Extension (Bel Green Area)

One of the five owners impacted by the fence extension approved at the April 25, 2023 meeting provided a written statement and plat indicating his opinion that at least part of the fence is on private property and not within Brickshire’s right to alter. He withdrew his support of the extension. Consequently, the Board rescinded the previously approved fence extension and to deny this project.

Request to Purchase Recording and Audio Equipment

The Board reviewed the recommendations for enhanced audio and recording devices. Brown provided the details of the options, installation possibilities, and pricing for equipment. It was agreed that five table mics for Board members is appropriate and that the two existing mics with stands will be used for the Owner Forum. A sound mixer, all needed wires and cables, as well as a cover for the wires are needed. It was further agreed that Brown would get a proposal from Protection by Design to obtain and install the audio equipment. The Board tabled a decision on video camera and portable PA deferred until the proposal is available.

Request to Organize a Trip to the Ballgame

The Board approved organizing tickets for a Flying Squirrels in July game at no expense to the Association.

Aerator for Kings Pond

The Board approved the proposal from Timmons for $7500 to install aerator system at Kings Pond to keep algae at bay..

Continued Assessment Violation

The Board agreed to follow counsel advice and schedule a final hearing for an owner in violation of the covenants and delinquent in assessments before filing a lawsuit for judgment and abatement filing for injunctive relief.

Ratification of Consent Items

Approved Children’s Committee request for an ice cream and pizza truck in the pool parking lot on the last day of school, at no expense to Brickshire.

Approved proposal of $5600 from Conner Tree Service to remove dead/declining trees adjacent to homes from Golf Course property.   Approved Children’s Committee request for $111.20 for Father’s Day crafts.
