Southern summer safety As of June 21st, summer has officially begun. The state of South Carolina did not need permission from the calendar in order to start getting warmer. According to the Department of Natural Resources, the highest recorded temperature in South Carolina, 113°F, was actually on June 29, 2012 in USC Columbia. For the sake of all of our readers, hopefully temperatures will not reach such numbers this year. The hotter weather is

great for going to the beach, having cook outs, and spending time with family. Through the fun and enjoyment it is important to remember that these temperatures can, in fact, be deadly. The American Red

Cross has created a list of ways to keep you and your loved ones safe while being able to still enjoy the summer weather. The first and most important item to remember about the summer is just how dangerous cars can be. It is vital to remember not to leave children or pets in the car because cars can reach up to 120 °F. Some other ways to keep safe is by avoiding drinking too much caffeine or alcohol during hotter temperatures

because they can cause excessive dehydration. Although it might be hard to go without that morning coffee or that beer after dinner, it really is going to be very beneficial to keep yourself healthy. Another important tip for keeping safe in the summer weather is to be mindful of what you are wearing and doing during peak temperature hours. The American Red Cross recommends wearing loose-fitting, lightweight, light-colored clothing

and to avoid dark colors because they absorb the sun’s rays. It is also recommended that people avoid doing outdoor work during the hottest parts of the day and to avoid exercise during this time as well. It is also important to check on the elderly, children, and animals to make sure that they are not struggling with the heat. Often times these three groups are not able to fully understand or get to a point where they can keep safe in these

warmer temperatures. Summer is a lot of fun. The sun is great. That reflects the widespread adoption by many states of the Uniform Fiduciary Access to Digital Assets Act, which the Uniform Law Commission (ULC) created as a guideline for states to adopt or use as a model for their own legislation. UFADAA was later modified into the Revised Uniform Fiduciary Access to Digital Assets Act (RUFADAA). Your executor must contact the custodians of your digital assets. In other words, the websites hosting your accounts. In states without the above laws in place, your executor or other loved ones may have a tough time because, in theory (despite recent legal challenges), the custodians still have outright power to bar access to accounts of deceased users. Yahoo! takes this a step further by abruptly terminating email accounts when a user dies. The uniform law (UFADAA) established a hierarchy governing digital account access.

The instructions you have left online with the account custodian come first. Instructions left in your will rank second. Absent any of that, the custodian’s terms-of-service agreement applies. So, in states that have adopted the uniform law, the fate of your digital assets at a website will be governed by that website’s TOS agreement if you die without a will or fail to leave any instructions with the website. If you state your preferences in a will, but also leave instructions with the website, the instructions you leave the website overrule the will. Facebook, Snapchat, and Instagram have famously declared in their TOS agreements that all content uploaded by the user becomes their property. While claims like these have been scoffed at, the websites are not hesitant to stand by such assertions and may cite user account preferences to back them up – which, in some states, could mean a legal struggle for heirs.

ary for your digital assets through a Power of Attorney form, so that this responsible person can make decisions about them in your best interest should you lose the capacity to do so while living. What other steps should you take? Leave a digital access map for your executor – your accounts, your passwords. This need not be seen until you pass away or are unable to maintain your digital profiles and accounts. It can be a file stored on a flash drive or similar backup media – and it can also exist on paper. Check with websites to see what their policies are for transferring or maintaining digital assets when a user passes away. See how reward points and credits are transferred and how pending financial or investment transactions are handled. Is the executor of your estate plan a technophobe? If so, then think about appointing a second executor just to handle your digital assets. It may be worthwhile.

Tread lightly: Worn tires put drivers at risk Afternoon downpours could spell disaster for millions of road trippers this summer, thanks to an unlikely suspect – tires. New research from AAA reveals that driving on relatively worn tires at highway speeds in wet conditions can increase average stopping distances by a staggering 43 percent, or an additional 87 feet -more than the length of a semi-trailer truck -- when compared to new tires. With nearly 800,000 crashes occurring on wet roads each year, AAA urges drivers to check tread depth, replace tires proactively, and increase following distances significantly during rainy conditions. “Tires are what keep a car connected to the road,” Tiffany Wright, AAA Carolinas spokesperson. “Even the most advanced safety

systems rely on a tire’s basic ability to maintain traction, and AAA’s testing shows that wear has a significant impact on how quickly a vehicle can come to a stop in wet conditions to avoid a crash.” In 2017 alone, AAA Carolinas Emergency Roadside Assistance responded to 135,910 calls in North and South Carolina regarding a faulty tire – which is 13.47 percent of their total calls. In partnership with the Automobile Club of Southern California’s Automotive Research Center, AAA conducted testing to understand performance differences at highway speeds between new all-season tires and those worn to a tread depth of 4/32” on wet pavement. AAA research found that: Compared to new tires, tires worn to a tread depth of just 4/32” exhibit:

An average increased stopping distance of 87 feet for a passenger car and 86 feet for a light truck. A 33 percent reduction in handling ability, for a passenger car and 28 percent for the light truck on average. If tested side-by-side at 60 mph, vehicles with worn tires would still be traveling at an alarming 40 mph when reaching the same distance it takes for vehicles with new tires to make a complete stop. While AAA’s research found that tire performance does vary by brand, price is not necessarily an indicator of quality. In fact, worn tire performance deteriorated significantly for all tires tested, including those at a higher price point. AAA advises shoppers to research options carefully before selecting a replace-

ment tire for their vehicle, and never choose one based on price alone. Unfortunately, current industry guidelines and state laws and regulations frequently recommend that drivers wait until tread depth reaches 2/32” to replace tires. Not only does this recommendation jeopardize a driver’s safety, it minimizes manufacturer warranty costs and is often paired with environmental concerns. By prioritizing safety, AAA maintains that tires should be replaced once the tread depth reaches 4/32”, when stopping distances have already begun to deteriorate significantly. AAA’s comprehensive evaluation of tire tread laws and regulations across U.S. states found a state requirements range from inadequate to non-existent.

Gov. Henry McMaster announces emergency opioid response plan Governor Henry McMaster has announced the South Carolina Opioid Emergency Response Plan, which details strategy and guidance developed to support state and local efforts to combat the opioid epidemic. The state Opioid Emergency Response Plan was developed as part of the ongoing collaboration of more than two dozen organizations that comprise the recently formed S.C. Opioid Emergency Response Team (SCOERT), which was created by Governor McMaster in December of 2017. “This plan is a living, breathing document that we will add to and amend as we encounter new issues and achieve successes,” Governor McMaster said. “We will combat the opioid crisis the only way our state knows how: as one team collaborating and sharing talents and resources to help the people of South Carolina.” The State Law Enforcement Division and the S.C. Department of Alcohol and Other Drug Abuse Services serve as the lead agencies of the SCOERT. The team has identified four focus areas to address the opioid problem, including: education and communication, prevention and response, treatment and recovery, and coordinated law enforcement strategies. Below are the different sections of the plan, which will be used to guide the statewide response to the opioid crisis: Opioid Emergency Response Team Base Plan Annex 1 – Educate and Communicate (Annex 1 will help inform the conversations that physicians have with their patients regarding pain and pain management,

as well as continue raising the general population’s awareness of the dangers of opioid use.) Annex 2 – Prevent and Respond (Annex 2 will emphasize first-line prevention of opioid use disorder, with agencies coordinating a public health approach to addressing primary prevention, treatment, and rescue actions.) Annex 3 – Treat and Recover (Annex 3 will work to eliminate barriers to treatment access – including the shame associated with seeking help – and to develop more treatment and recovery opportunities.) Annex 4 – Coordinated Law Enforcement (Annex 4 will help expand drug takeback programs, increase resources to combat illicit opioid supply chains, reduce the number of fatal opioid overdoses, and facilitate access to care instead of incarceration.) Similar to existing emergency response plans coor-

dinated by SCEMD, the state’s opioid emergency plan begins with basic guidance for how organizations should work together to combat the opioid epidemic in South Carolina. The basic plan is followed by annexes that detail specifics for how organizations should address the four focus areas. The base plan and its annexes are designed to be evolving documents that can be modified and adapted to address the needs of local communities. The SCOERT effort is already showing tangible results of agencies working together. A new map-based data portal was recently added to the state’s opioid crisis education campaign website, justplainkillers.com/ data/, which displays opioidrelated mortality data and is searchable by county. The data displayed is provided as part of the SCOERT collaboration, including DAODAS, the S.C. Dept. of Health and Environmental Control,

Summer kicks off with opening of Neptune Island Waterpark

Surrounded by City of Hartsville City Council members, Neptune Island staff and other special guests, Seymour and Sandy, Neptune Island’s official loggerhead sea turtle mascots, cut the ribbon to officially open Neptune Island Waterpark to the public on Monday, June 18, 2018. Immediately following the ceremony, the new waterpark launched its first day of operation and began welcoming guests to the “undiscovered island” at 10 a.m. The ribbon cutting is a momentous occasion for the City of Hartsville as it symbolizes the completion of its expansion of the existing Piratesville Splash Pad, which opened in July 2013. Since its opening, the splash pad has averaged over

20,000 attendees per season. For four seasons, the pirate-themed splash pad has offered children under six years of age a place to cool off with its spray cannons, geysers, slides, and dump buckets, but does not currently feature attractions for the entire family to enjoy. Neptune Island will now include the Piratesville

Splash Pad as an added feature at its new facility. The new waterpark complex boasts a wide array of features for guests of all ages; including the Endless Abyss, a quarter-mile long lazy river, the Castaway Bay wave pool, two Twin Sirens tube slides, the Neptune’s Revenge speed body slide, and the three Trident Racers

Cabana rentals, party pavilions, snack stands, food trucks, and a beer garden will make the new water park a regional destination for visitors and residents alike. “Neptune Island is more than just a new recreational facility for our residents in Hartsville,” said City Manager Natalie Zeigler, “it has created over 130 seasonal job opportunities and is forecasted to attract over 90,000 visitors each year to Hartsville. We have seen increased tourism over the last several years with the addition of two downtown hotels as well as new restaurants and boutiques. We will

have even more growth with today’s opening of the Neptune Island Waterpark and the upcoming opening of EdVenture Children’s Museum.” Neptune Island Waterpark will celebrate its grand opening on Saturday, June 23, 2018 during its “Grand Opening Celebration” event. Visitors to Neptune Island on June 23rd will enjoy live entertainment from Pantasia Steel Drum band along with visits with pirates, mermaids and other free children’s entertainment as part of their admission to the waterpark. Red Cross shares 15 ways to be safe this summer

“A South Carolina summer is finally on the way and many of us will take advantage of the warm weather by grilling out and cooling off in the pool or at the beach,” said Louise Welch Williams, regional CEO of the Palmetto SC Region. “We want everyone to enjoy the summer while being safe at the same time, so we are offering these 15 safety tips people should follow.” WATER SAFETY Ensure that everyone in the family becomes water competent. That is, learn to swim well, know your limitations and how to recognize and avoid hazards, and understand how to help prevent and respond to emergencies around water. Adults should actively supervise children and stay within arm’s reach of young children and newer swimmers. Kids should follow the rules. Fence your pool in with

four-sided fencing that is at least four-feet in height and use self-closing, self-latching gates. Wear your U.S. Coast Guard-approved life jacket always when on a boat and if in a situation beyond your skill level. Swim as a pair near a lifeguard’s chair – everyone, including experienced swimmers, should swim with a buddy in areas protected by lifeguards. If in a location with no lifeguards, such as a residential pool, designate a “Water Watcher” to keep a close eye and constant attention on children in and around the water. BEACH SAFETY If you plan to swim in the ocean, a lake or river, be aware that swimming in these environments is different than swimming in a pool. Be sure you have the skills for these environments. Swim only at a beach with a lifeguard, within the desig-

nated swimming area. Obey all instructions and orders from lifeguards and ask them about local conditions. Make sure you swim sober and that you always swim with a buddy. Know your limitations and make sure you have enough energy to swim back to shore. Protect your neck – don’t dive headfirst. Walk carefully into open waters. Watch out for and avoid aquatic life. If you are caught in a rip current, try not to panic. Signal to those on shore that you need assistance. Swim parallel to the shore until you are out of the current. Once you are free, swim toward shore. If you can’t swim to the shore, float or tread water until you are free of the rip current and then head toward shore. GRILLING SAFETY Always supervise a barbecue grill when in use. Don’t add charcoal starter

fluid when coals have already been ignited. Never grill indoors – not in your house, camper, tent or any enclosed area. Make sure everyone, including pets, stays away from the grill. Keep the grill out in the open, away from the house, deck, tree branches, or anything that could catch fire. Use the long-handled tools especially made for cooking on the grill to keep the chef safe.
