Based at the Montefiore Hospital, Brighton Bariatrics is a multi-disciplinary team which includes experienced bariatric surgeons, anaesthetists, nurse specialists, a psychologist and dietician. Mr Goldie Khera describes the service: “Obesity is a serious disease which interferes with basic physical functions such

as breathing or walking. Rain, rain, go away ...

I

am not normally the sort of person to let the weather get me down, but I find myself drowning in a sea of monotony as the rain drums endlessly against the window. It is a Sunday, the day which tends to magnify tedium and boredom, as if watching paint dry under a microscope. It seems to have been raining for days. It HAS been raining for days. I’m reminded of those interminable Sundays of my childhood up north, where the old people would be inharmoniously and unanimously snoring away in the living room, in spite of the fact that an archaic black and white movie was crackling out of the TV at full volume. In spite of the appalling weather, I managed a five mile run in Preston Park first thing this morning. There is something to be said for not going to the pub on a Saturday night. Where normally there are fairweather runners, there was just me and an old man (who overtook me) in a professional running vest. I was intrigued to see a travelling woman brushing her teeth in her pyjamas in the pouring rain outside her caravan. I dropped in for coffee and a little respite from the rain at my friend B’s house. She answered the door in her pyjamas – albeit without a toothbrush in hand – and then forgot to put the water in the coffee pot before she put it on the stove. Pretty ironic really, given that we are currently surrounded by the stuff. By midday, I was bored and so decided to answer some letters that I was saving as a ‘Monday morning job’. The main missive was to Hastings Borough Council, who recently challenged our house for replacing a boarded-up glass front door with a UPVC one. We either have to apply for retrospective planning permission, or pay out four times more for a timber door. It is too late to slap a conservation order on something that has already been destroyed, but I will do as the council wish, with a certain degree of belligerence. With my letter writing complete, I went to the pub to bid adieu to a colleague who’s off to India and South East Asia until March. So now I’m grumpy, belligerent and jealous … nice combination.

hen Hove Civic Society was formed during the 1960s, it was a protest group. In recent years, under the chairmanship of Helmut Lusser, the society is now leading the debate by proposing rather than opposing. I have previously mentioned Hove Civic Society’s plans for a plinth for public art on Hove’s promenade which I very much support. I recently met with Helmut to discuss the society’s ongoing project to populate and, in many cases, repopulate our streets with, quite simply, trees. The project really got going in 2012, with a study of Hove’s streets to identify where planting might be helpful. Success was had in December of that year with the planting of 12 elms in the Montpelier area. In December 2013, 40 trees (hornbeam and smooth-leaved elm) were planted near Stoneham Park. Discussions are now being held regarding Bigwood Avenue and, far more ambitiously, the Church Road area. Looking back over old photographs of Hove, it is quite clear that hundreds of trees have vanished over the past century. This is sad, as they are hugely attractive and provide shade and a haven for wildlife. On boulevards such as New Church Road and The Drive, they are a delight. Trees won’t work on every street. Osborne Villas, a street that I know well, certainly wouldn’t be suitable. The pavements and road itself are narrow and trees would just seem out of proportion. Wide St Aubyns nearby has trees and, despite the generous height of its buildings, seems dominated by foliage. Perhaps its magnificent elms just need cutting back a bit. Glenn's family chose the charity for this year's Golf Day, and Barbara Mishon felt that Glenn would want the money raised to go to Martlets, as it was a charity he had worked with for many years and had always been very proud of being involved with the Martlets hospice. John Brookes of local solicitors Dean Wilson LLP answers questions on the difference between being employed and self-employed I’m interviewing to fill a senior role and one of the best candidates has asked if we will consider hiring them as a selfemployed contractor, rather than as an employee. What is the difference? The key issue in determining whether someone is employed or self-employed is whether the employer or the worker has control over where, when and how the work is done. If the worker has to do the work themselves and is performing a function that is part of regular business, it is likely that they are employed rather than self-employed. What factors are likely to mean that a person really is selfemployed? If a person is self-employed they can usually hire someone else to

do the work for them and they will provide the main items of equipment they need to do their job. If they agree to do the job for a fixed price regardless of how long the job may take, and regularly work for a number of different people, this will indicate they are self-employed as can the fact that they have to correct unsatisfactory work in their own time and at their own expense. Why is it important to determine the difference? While self-employed and employed people experience different tax treatment there are also important differences under employment law. A self-employed person doesn’t get paid annual leave, sick leave or have access to an employer’s

pension. They also aren’t protected under employment laws and therefore can’t claim unfair dismissal or redundancy and might receive very little notice that their contract is ending. It is also important that an employer is legally responsible for the actions of their employees, but a self-employed person is responsible for any errors or mistakes they make. What happens if we think we’ve hired someone as self-employed, but we get it wrong? Getting the relationship wrong, even if by accident, can prove to be costly, particularly for the employer. If a relationship of employment is found to exist, the employer can be found responsible for unpaid annual and other kinds of leave, unfair dismissal and redundancy costs as well as unpaid PAYE and NI. As such, if there is any uncertainty about what the nature of the working relationship is, it is always best to check first to avoid costly and time consuming mistakes.

CORPORATE CONUNDRUMS AND OTHER CHALLENGES FOR PROPERTY INVESTORS INTO THE UK James Wolfson of Healys LLP on corporate conundrums

F

oreigners purchasing high value properties in the UK, particularly in London, are greater exposed to inheritance tax, particularly if the properties have future growth potential. Inheritance tax is chargeable at 40% on estates which exceed the ‘nil rate band’ exemption (currently £325,000). Prior to 1 April 2013, it was common for non-domiciled persons to acquire UK residential properties through an offshore company, the shares of which were often held by an offshore trust. The tax regime introduced in March 2012 curtailed ownership of high value residential properties by offshore companies. Impending changes to the capital gains tax regime applicable to nonresidents owning UK properties used as dwellings has introduced uncertainty as to whether offshore companies is the vehicle of choice to hold investment properties, as well.

Enveloped Properties Since 21 March 2012, companies (and certain other corporate entities) holding high value residential property are now liable to 15% Stamp Duty Land Tax (SDLT) on acquisition, recurring yearly ATED charges, and also capital gains tax (CGT) at 28% on the ‘ATED-related gain’ upon disposal of the property. Previously, the gains of offshore companies disposing of UK residential properties escaped CGT. The threshold at which the tax applies is to be lowered to £500,000 over the next two years. As from 1 April 2015, the entry level for the tax is any property over £1,000,000. Reliefs apply where the property is held as part of a business (e.g. property rentals and developments). The new tax regime is a deterrent to using offshore companies, unless the company is merely acting as nominee. ‘Future Gains’ of Non-residents Additionally, in his Autumn Statement in December 2013, the Chancellor announced that, from April 2015, capital gains tax is to be extended such that ‘future gains’ on all disposals of UK properties used as a dwelling by non-residents would be

subject to the charge. It appears that non-resident individuals and partners holding such properties will be caught by the new regime, as are non-resident companies. Foreign trusts may be affected. The details regarding the applicable rates and how the tax is to operate are yet to be announced. It is anticipated that the gain may be calculated by reference to a date from which the value of the property has been ‘rebased’. A consultation was held between April and June 2014, and it is anticipated that the outcome of the consultation is to be published by the end of the year. The applicable corporate rate may be a determining factor as to whether to use companies for dwellings held for investment purposes. Alternative Solutions Should non-residents be imminently acquiring UK residential properties, advice should be sought as to possible alternative solutions to mitigate UK taxes, and the timing of completion.
