Survey says? HBTS long-range planning underway Approximately 2,400 people who registered their email addresses with FirstService Residential recently received a long-range planning survey asking residents to prioritize a list compiled by the Long Range Planning Committee. Of the 83 people who have responded so far, the top three priorities are: 1. More multi-use paths for walking, jogging and bike riding 2. More sidewalks 3. Improved code enforcement to help alleviate illegal dumping and littering A list of additional comments included several concerns already included in the current budget. The Long Range Planning Committee strongly encourages homeowners to complete the survey. A full report will be available at the annual meeting in July and will be used in future budget planning. The survey is also available at the recreation center and at HBTSNews.com.

Holley by the Sea Improvement Association, Inc. Rules and Regulations Regarding Campaigning, Canvassing and Sign Posting in Common Areas and Recreational Center WHEREAS, ArticleVI of the Articles of Incorporation of Holley by the Sea Improvement Association, Inc. (the“Association”) provides that the affairs of the Association shall be managed by the Board of Directors; and WHEREAS, Article II, Section 4 of the By-laws of the Association authorizes the Board of Directors to adopt and publish rules and regulations governing the use of the common areas and facilities including the personal conduct of the members and their guests thereon, and to establish penalties for infractions of such rules and regulations; WHEREAS, in an effort to help ensure peace and tranquility for all who use the Holley by the Sea common areas and facilities, and to promote and enhance the safety aspects of living in and visiting the Holley by the Sea common areas and facilities, the following rules regarding canvassing, campaigning, and sign posting are hereby adopted: Campaigning, canvassing, and sign positing on the Holley by the Sea common areas and facilities for any matter, including elections and other Association matters, is subject to the following conditions: 1. Canvassing, campaigning and sign posting in the lobby area and walkways is prohibited. What does Florida State Statutes say about rights of owners to assemble?

720.304 Right of owners to peaceably assemble; display of flag; SLAPP suits prohibited.— (1) All common areas and recreational facilities serving any homeowners’ association shall be available to parcel owners in the homeowners’ association served thereby and their invited guests for the use intended for such common areas and recreational facilities. The entity or entities responsible for the operation of the common areas and recreational facilities may adopt reasonable rules and regulations pertaining to the use of such common areas and recreational facilities. No entity or entities shall unreasonably restrict any parcel owner’s right to peaceably assemble or right to invite public officers or candidates for public office to appear and speak in common areas and recreational facilities.

New board-approved policy regarding usage of the common areas:

I am appalled by your blatant and very transparent decisions at the April 20 special meeting to control every available aspect of messaging concerning our association. With only five items on the agenda, three of them were aimed at silencing any opposition and controlling the flow of information to the membership. The“Campaigning Policy”was clearly intended to silence the opposing recall faction, although presented otherwise. I believe Danner that the recall effort does fit the definition of association business even though it is contrary to your wishes. The prohibition is in itself a clear violation of F.S. 720 which you frequently choose to ignore. Termination of the contract with Sandpaper Marketing for the Facebook page even though the offer was made to halve the cost was quite obviously aimed at one individual. Now the development and administration of the Facebook page is under the control of a board family member. I in no way anticipate that the page will be a free and unbiased source of information. Fortunately, there are other pages that serve as informational and discussion platforms for the membership. The most egregious decision that was made last night was to terminate the contract for the insert to the HBTS News, a publication that deals solely with our community. Again, quite transparently aimed at one individual. The insert allows the president and the GM to engage with the membership and to forward informative content concerning the future of the association. Rather than support a publication that deals directly with our community, you would choose to have that information buried in a publication that deals primarily with happenings at Pensacola Beach, Pensacola and other areas. If what you have to say is so unimportant that it could be placed in a publication adjacent to the schedule for the next pub crawl, I would submit that it is a frivolous expenditure of funds. Publishing in“Splash”is just one more case of“tried and failed”. I frankly do not buy the statement that you have an incomplete email address list by blaming it on FSR. Myself and numerous others have selectively been excluded from your email list even though we have corresponded with you via that medium on numerous occasions. It was quite laughable when the president stated that she didn’t think the email blast should be used for propaganda. The email blasts sent out to only select members are filled with positive spin for negative situations. Those of us that are excluded have to receive them from third parties.You should represent all members or none. In closing, I would like to address the comment directed towards the small number in attendance at last night’s meeting. The vice president intimated that it was due to a lack of interest. I think that most likely it has to do with members recognizing the futility of engaging in dialog with this board of directors. Comments or concerns from the floor have no effect on the outcome of votes other than the occasional tabling or postponement should the outcry be loud enough.

The Southern way is the best way “It’s a one-stop shop for a Southern girl,”said Lisa Gambill, resident of HBTS and co-owner of Navarre’s Southern Specialty Market. Since opening nearly a year ago, the popular shop has expanded and evolved.“We’re coming into our own. We want to offer more to the community. We’re going to offer all things Southern – we’re a Southern variety store.” In their first year, co-owners Lisa and her sister-in-law of 15 years, Magda Morton, built their reputation on their delicious variety of foods. At the market, shoppers have come to love Lisa’s Chocolate Addiction Cake and the weekly soups with jalapeño cheddar cornbread muffins. Cajun pork chops and chicken wheels, which are chicken breasts rolled up with smoked beef then wrapped in bacon, have been best sellers since the shop opened. Opinion/April meeting synopsis There have been no less than four public meetings since HBTS became selfmanaged on April 4. Meetings took place on the April 8, 14, 20 and 27. We encourage you to visit ourYouTube channel to watch the meetings for yourself. Some of the“highlights”of the last month include: ■ The board voted to not buy space in HBTS News for content provided by the board. ■ The board voted to not renew the Facebook contract with Sandpaper Marketing. ■ The board approved a policy on the usage of the common areas. The original draft policy was very far reaching. For instance, The original version had,“Defamatory or controversial material which will have a divisive effect on the Members, their guests, or the community cannot be displayed or handed out.” The approved policy states: “This policy states that Campaigning, canvassing, and sign positing on the Holley by the Sea common areas and facilities for any matter, including elections and other Association matters, is subject to the following conditions: 1. Canvassing, campaigning and sign posting in the lobby area and walkways is prohibited”- which still

Right, Pat Traynor speaks with Alex Crawford after she named him chairmain of the nominating committee. seems to contradict Florida State Statutes. ■ The board president admitted to having meetings regarding employee insurance with other board members without noticing the meetings. ■ Weeks earlier Crawford provided a sign-up sheet for those who wanted to serve on the nominating committee but neglected to bring the sheet to the meeting where members were named to the nominating committee. Current nominating

committee: Pat Traynor, chairman; Billy Neal; Dan Ramsey; Mark Lewis; and Teryl Deegan. (See April 27 meeting) ■ Bill Crouch said he would resign if/when presented with the correct number of recall ballots. ■ The board did not retain long-term employees who were grandfathered in before FirstService Residential started managing HBTS. These employees would not have cost the association the 30 percent liquidated damages

as stated in the contract. Board member Mary Landon stated,“My feeling is – if those employees had time to hand out recall ballots when they were supposed to be doing their job – then they didn’t have a place at HBTS.” Former employee Jackie Goebel took exception to that comment and stood up to say she never handed out ballots while on the clock. It boiled down to the perception that employees were not retained for“political”reasons. At least five full-time

employees over the age of 60 were not retained. FirstService charged Holley by the Sea $46,051 for the retained non-grandfatheredin employees. When asked by the recall board, FirstService said it would consider a refund if FirstService is reinstated. The bill has not been paid as of press time. ■ Crawford spent t i m e explaining a “medical condition”of an employee that w o u l d n ’t allow her to b e employed at HBTS. The employee stated this was a lie, and may file suit against the association. ■ Friends of board admit to“telling stories”to get the members all “riled” up on Facebook. ■ Friends of board take a lot of time to praise the“volunteers” that worked countless hours at the front desk. ■ The guest exception policy was reworked several times. The final version was not provided to HBTS

News by deadline. ■ Bill Crouch listened to a voicemail from a vendor left for FirstService and called the vendor to say he fired all of the employees including FirstService and that he needed to see all of FirstService bills. When he thought there were more, he continued to call the vendor asking for invoices that belonged to FirstService. ■ Service Master was hired to clean the facility. ■ Many members are complaining that the e n t ra n c e s , exercise equipment, and bathrooms are not kept as clean as they were when FirstService was the management company. ■ Board solicits praise for working long hours until employees could be hired to replace the employees who were not retained or elected not to be retained. Less than a third of the original staff was there the Monday after self-management began.

President’s Corner: Please welcome H.B.T.S’s new faces. The new CAM/GM is April Salazar. April has Alex Crawford arrived at a challenging time but is more than capable of leading the Association as we proceed with self-management. On the Front Desk we welcome Yvette Wirt, Christina Cameron and Carrie Shields who will also be helping Shelby Filek in the Architectural Control Department. Our new custodians are Brittany Birsette and Erica Bruski and we have added Bryce Voit as a lifeguard. Coming on board soon will be Amanda Slepica in the Youth Department and of course lifeguards and Camp counselors for the Summer programs. Simple HR have proved to be a great choice for an HR Company, they have managed the new hires and made sure all employees who wanted health care are signed up and ready for the new Florida Blue plans on May 1st. Congratulations to Shelby Filek who has been promoted to Architectural Supervisor and to Katie Johnson who has been promoted to Youth Director– both appointments well deserved. Fabre Engineering is making progress with the survey and as-builts. Frank Myers will be holding a workshop soon to discuss the next step as we work to satisfy the DEP and the County. After several rain delays the dome over the lap pool has been taken down and we are ready for the warm swimming weather. Thank you Gordon for your hard work. After a particularly heavy rain we had what appeared to be a leak from the flat roof over accounting. This proved not to be a roof issue but rather the drainage pipe backing up due to years of accumulated roots and dirt. We have now put in a French drain to move the water away from the foundation of the building. First Service Residential failed to supply importable data for our transition to T.O.P.S and this has delayed the progress of implementation. Kudos to Rae and Rhonda for their hard work and flexibility and inventive work arounds. The old website has been resurrected as a purely temporary measure until we can implement the T.O.P.S website. Andra is busy taking pictures to show everyone what a beautiful community we live in. This will be a website that prospective buyers in HBTS can access as well as staff and residents. Denise and the Social Committee have some great events planned for the Summer. She and the volunteers did a wonderful job at the Easter Egg Hunt and the families attending all had a great time. I would like to say a personal ‘Thank You’ to the staff – both the transitioned staff and HBTS’s new employees. In concert with the volunteers who helped out during the first few weeks, their ‘Can-do’ attitude and cheerfulness has been an inspiration. The Recreation Center did not close, the Childcare continues to be available as do all the programs. The pool and gym are operational and all the doom and gloom predictions did not happen. To everyone who has helped make the transitions possible I want to thank you. It has been hard work but that hard work has produced a wonderful team going forward. If we now put this contentious period behind us I believe we can make this the wonderful Community. If you would like to help, in any way at all, please contact me or a Board member. We had all ages attend for a great day with the Easter Bunny, refreshments, the Easter egg hunt, and lots of prizes. This event was a hopping success with a very large attendance. Architecture News HOA’s for Dummies….. Homeowners’associations, or HOA’s, are legal entities formed to maintain common areas and enforce the operative legal documents known as CC&R’s (Covenants, Conditions and Restrictions). They are established to help maintain order in the community. Most condominiums and single-family subdivisions have established HOA’s, which are typically formed prior to the commencement of development. Each homeowner is given the opportunity to review the CC&R’s and other important documents prior to their close of escrow on a property located within the HOA. HOA’s are comparatively recent inventions. Prior to World War II, the majority of neighborhood organizations were casual and their policies were a manifestation of cultural morals and social norms. As the population drastically grew after the war, communities inevitably augmented and became increasingly diverse. The HOA attempts to initiate the old notion of the neighborhood again, but it has to rely upon a certain set of values that have been attained by law through deed restrictions instead of common familiarity. The following are the elements of a Homeowners’ Association: • HOA’s are legal entities with operative documents – that outline requirements in order to handle maintenance and enforcement matters. Generally there is a governing board elected from members of the HOA that employs a General Manager/CAM and/or property management company to handle the administrative and day-to-day operations • HOA’s have the influence to ratify and impose maintenance and design standards in addition to those recognized by City Ordinances • Membership is most typically mandatory for all property owners within the development

Marsha Triebold, Swim Coach Extraordinaire

By Andrew Adams Since August 2005, Coach Marsha Triebold, a Level 3 certified swimming coach, has led the HBTS Stingrays, the only year-round USA Swimming Team in Santa Rosa County. Being a part of USA Swimming includes insurance coverage and ongoing background checks and training for coaches. Nearly 25 youth, ranging

in age from 6 to 18, participate in the HBTS swim team. The only qualifications are a basic knowledge of the four strokes and the ability to swim one length (25 yards) of the pool in both freestyle (front crawl) and backstroke. Triebold has been a member of HBTS since 1995. She and her husband, Howie Triebold (also a certified swimming coach), moved here

with their three daughters while Howie was stationed at Hurlburt Field. One of their daughters, Michele Whitfield, is a teacher at a Navarre area school and is also a member of HBTS. Triebold has worked at HBTS’ Recreation Center since 1996 and has served in different positions. She started out as an aerobics instructor and has also worked as a

The weather did not cooperate. To avoid mold and mildew issues next fall, the dome must be put away completely dry. The pool dome allows the heated lap pool to be used comfortably and therapeutically during the cooler months of November through April. Despite being nearly surrounded by water on our peninsula, there are only two other lap pools (The Club II in Gulf Breeze and the Navarre Family YMCA) in south Santa Rosa County. Most lap swimmers and water aerobics participants look forward to being outside in the sunshine.

lifeguard, conducted weight room orientations, worked at the front desk and even called Bingo. The team travels for all of its meets, since meets cannot take place at the rec center. They travel as far as Dothan, Ala., and Biloxi . They also go to Panama City and the University of West Florida for meets. While she is a part-time employee, of HBTS, Triebold’s travel expenses, including hotel, mileage, meals and everything else come from her own pocket. Swimming is in Triebold’s blood. As a girl in Kernsville, Pa., she and her four sisters swam competitively. She compteted on her college team for two years. Triebold’s mother was a non-swimmer but was enthusiastic in her support. At one point, her mother participated in an adult learn-to-swim and became reasonably proficient in the water. At 86, her mom still wakes up at 5 a.m. to exercise. Triebold continues the family tradition of motivating physical activity in the next generation. She has five grandchildren under the age of 4 and looks forward to coaching them in a few years.

If she could have a blank check to do what she wanted to enhance the opportunity to develop swimmers in the Navarre area, Triebold would: 1. Build a 50-meter pool that is at least 6’feet deep at the starting block and has a state-of-the-art pace clock and timing systems. 2. Increase the eligibility

to any child in the area. 3. Host large, regional swim meets which would bring in people from hundreds of miles away.
