The shoreline and land suffered extensive damage during the heavy rainfall in April. The committee was created to determine the scope of work necessary to repair the damaged areas previously worked on and modified by Roads, Inc. In August, the HBTS Board appointed Endell Stevens, Laurie Gallup and Melinda Robertson to the Erosion Control Committee. However, board and association members have questioned committee members as well as work that has already been completed. Also, according to Santa Rosa County Project Engineer Chris Phillips, the size of the onsite retention ponds were never permitted through the county, based on a Nov. 10 site visit. In an email to HBTS General Manager Alex Fambri on Nov. 12 Phillips wrote,“As mentioned in conversations with you (via email) and the HOA President, we would allow maintenance of existing ponds, but not over excavating and reshaping to provide additional volume. In fact, we can find no record of any ponds being permitted on the south end of the rec center property in any form or fashion.” Phillips was told by Erosion Control Committee members that only the berm was going to be repaired due to the damage it suffered during the heavy April rains. “… but [we] have found out later that clearly there is more work being done. Site observations also show that, in our professional opinion, the improvements being constructed will not survive a significant rainfall event due mainly to the sand being used the repair the berms,”Phillips wrote. What makes a family? Staff Reports HBTSNews Holley by the Sea Board of Directors discussed the definition of“family”as it applies to recreation center usage at its Nov. 13 meeting. Article IV, Section 4, of the HBTS Declaration restricts usage of the recreation facility to immediate family. “For the purposes of the section,‘designated owner’ shall include members of the owner’s immediate family. ‘Immediate family’ for the purposes of the section shall mean husband, wife and children under age 25 residing in the household,” Article V, Section V, states. However, under the same article, homeowners can transfer usage to tenants, “so long as the number of tenants does not exceed the number of bedrooms in the residence.” Previous Holley by the Sea boards have issued variances allowing homeowners who do not fit the covenant’s strict definition of“family”to use the HBTS recreation facility, or to allow owners the same usage privileges as tenants.

Former HBTS Board Secretary Beth Walter, who served from July 2013 to March 2014, stated the purpose of the motion was to create a policy that would account for the changes of the family structure. “Our interpretation of the covenants and legal counsel was that the covenants did not grant the board the authority to approve these variances for usage,”Walter said.“We tried to create a guest policy that covered different situations that had come up in the past and to allow those who were not covered in the new policy to present their case to the board for inclusion in the guest policy.” Although a draft policy was written, the board never approved it and according to the April 2014 Board of Directors’ meeting minutes, the issue was removed from the agenda.

One amendment asked homeowners to approve or disapprove allowing the HBTS Board to make rules about usage.There are 4,720 lots in HBTS and each homeowner receives a ballot. Out of the more than 4,000 ballots sent out, 347 voted on the amendment, with 242 voting for and 105 voting against the amendment. According to the HBTS covenants, changing any portion of the Declaration or bylaws requires two-thirds of board approval and 51 percent of the entire association membership voting in favor of the change; or 66-2/3 percent of association members voting in favor of the amendment if the board disapproves. (See sidebar for history of amendments to usage policy.) Present Board The present HBTS board sought legal counsel in an attempt to broaden Article IV, Section 4, to include extended families, foster children and unmarried couples. “This provision of the declaration has been problematic for Holley by the Sea from an operational perspective based on a number of issues,”according to legal counsel as read by Board Secretary Jan Frink. “Many boards have looked

I strongly recommend HBTS amend this provision.” Board President Alex Crawford supported the attorney’s assessment. “What the attorney is saying is that when we apply restrictions we are becoming discriminatory and possibly outside the law,”Crawford said.“I don’t mean this to offend anybody, but I’m English so I can say this, you imagine if policy was written 60 years ago, how exclusionary the policy would be and that would be illegal.” Homeowner Billy Neal told the board that he thinks they have the authority to issue variances. “You’re either elected or appointed to perform duties of this association and I believe the authority is in (the) governing document that you can make this decision,” Neal said.“Two boards ago made the decision that you didn’t have authority.” Former board member Beth Walters told the board members that the attorney “agreed with us at the time that what we were doing, issuing variances, was illegal. Now a new board is here and the attorney is changing her mind. The attorney agrees with whatever the

board wants.” Crawford shared a personal matter to highlight the differences in usage for tenants and homeowners. “I have a daughter with Down syndrome. She’d be allowed in if we were renters; on the other hand you have families of a mother, father with two children living in a three bedroom house, only three of them can come,”

History of “Easement of Enjoyment” Jan. 23, 1972: Original Declaration; Article IV, Section 1. 1: “Section 1. Member’s Easements of Enjoyment. Subject to the provisions of Section 3 of this Article, every Member shall have a right and easement of enjoyment in and to the Common Properties and such easement shall be appurtenant to and shall pass with the title of every lot.” There were no restrictions at this time. Jan. 1, 1992: Amendment 8; Article IV, Section 4 2. added: “Section 4. Restriction on Easements of Enjoyment where there are Multiple Owners of Lots. As to lots owned by two or more persons, the owners of such lot shall designate no more than two persons who may have the benefit of the easements of enjoyment provided for in Section 1, above ("Easements of Enjoyment"). Such designation shall be made in writing and filed with the Association. Provided, however, that where the owners of the lot are members of the same immediate family, all members of the immediate family shall have the rights to the Easements of Enjoyment” March 31, 1997: Amendment 9; Article IV, Section 4, 3. changed: “… shall designate no more than two …” to “… shall designate one …” (when multiple owners of a lot), and added: “In the event the property is leased, the designated owner may, in their place, designate their tenant or tenants (so long as the number of tenants does not exceed the number of bedrooms in the residence) as the party or parties having the benefit of the easement of enjoyment reference above.” And added: “For purposes of the Section, ‘designated owner’ shall include members of the owner’s immediate family. ‘Immediate family’ for purposes of the Section shall mean husband, wife and children under age 25 residing in the household.”

Easement Rescinded The board voted to rescind the vote to grant access to a client of Wetlands Sciences because after further investigation, it looked like a situation of“bait and switch.” The board was led to believe that the client of Wetlands Science owned land that was landlocked by land owned by HBTS when in fact the client did not own the parcel in question. Board of Directors approved up to three hours of time for the board to visit with Attorney John Bordelon for his advice and explanation of the greenbelts located in HBTS. Employee Health Insurance Full-time employees of HBTS have had their individual health insurance policy paid for 100 percent by Holley by the Sea for more than 10 years. In September, the board budgeted to fund the insurance at the current level, knowing that the insurance would increase at least 18 percent. The insurance increased 15 percent and the open enrollment period was in November. The board took no action to determine the level of reimbursement for 2015 until the Dec. 2 meeting. Open enrollment ended Dec. 2 without employees knowing how much of their insurance costs would be funded by the HBTS budget. Several employees opted for the lowest coverage available and some opted for no insurance because of the uncertainty. The board voted to keep the coverage at 100 percent which is $485 per month per employee. Currently 12 employees are on the insurance plan.

Merry Christmas, Happy Hanukah, Season’s Greetings, Happy New Year…no matter how you say it the Alex Fambri sentiment is to wish all the best to you and yours! It wouldn’t be December without a visit from Santa at the Social Committee Hosted Breakfast in the Beach House. There is still time to make your reservation for the 13th at the front desk. It promises to be festive and fun for children of all ages. HO HO HO! Holiday Hours…the recreation center will close at 5pm on December 24th, we’ll be closed the 25th in observance of Christmas. Also we’ll close at 5pm on December 31st and remain closed January 1st for New Year’s Day. Happy New Year also means the Annual Assessment is due. APPRECIATION: Thank you to all everyone that participated in the HBTS Social Committee November events!!! • On Tuesday, November 11, 2014, the HBTS Social Committee held the Veteran’s Pot Luck Dinner at the HBTS Beach House. Approximately 80 people attended to honor and thank our Veteran’s for their service. The event was filled with great food and tons of recognition for our Veterans, their spouses, children, and family members. The patriotic music provided by Captain Bill completed the red, white, and blue spirit that filled the room. We extend our appreciation to the three Veteran speakers, USAF TSgt Michael Marcum, USAF Col Frank Myers, and special guest Chief Master Sergeant Frank Daily (Chapter Coordinator and National Director of Therapeutic Programs for Heroes on the Water). The final tribute to our Veteran’s was given during a candle light ceremony to Lee Greenwood’s“God Bless the USA”. Thank you Veteran’s for your service & protecting our freedom!

On Saturday, November 22, 2014, the Artisan’s Alley Craft Fair was held from 10am – 3pm. Approximately 100 shoppers filled the HBTS Café area throughout the day! Small business owners provided great products for holiday shopping. We thank the business owners that worked hard to have their exhibits nicely display with great products. Exhibitors were Origami Owl, Premier Jewelry, Thirty One, Scentsy, Paparrazzi, Chef Stephanie, Diaper Cakes, No Negatives Photography, and D.Myers Gallery. December Parent’s Night Out is on the 12th. The cutoff date for sign- up is December 5th. Children must be HBTS residents and be in grades K-5. December PNO usually fills up fast, so don’t delay... Sign up TODAY! It’s a great time to do some holiday shopping while the kids are having some evening/late night fun. Stay tuned for 2015 Parent’s Night Out dates! The Before School Program still has plenty of spots available! After Care has ONE spot open. We are still anxiously awaiting the arrival of our Elf on the Shelf, Sophia Rose! Santa sent her to the Rec. Center from the North Pole last year as an extra set of eyes and ears. The kids enjoyed her company, loved finding where she was “hiding”every day, and always got a laugh out of her sneaky tricks she would some-

times play. We can’t wait for her to return this year! TheYouth Department will be closed December 25th and December 26th. Fun Factory will be closed December 12th as well as December 22nd-January 5th. Sorry for any inconvenience this may cause. Be Bear Aware-Your Trash is their Next Meal! Be a good neighbor and conceal your trash cans and recycle bins out of sight. Concealing these containers will improve the neatness and appearance of the community. Taking the trash out to the curb the night before pick up and storing in view can, and often does, attract bears. Our Covenants require that trash cans and recycle bins remain out-of-sight except on trash pick-up days. Please keep these containers in your back yard, behind a fence or barrier to conceal them from view. Leaving garbage, recycling containers, barbeque grills, pet food and bird feeders outside, leads to problems with bears.

Architecture News • Bears can smell food more than a mile away and if they are rewarded with an easy meal, they learn quickly to return to the scene. • Curious bears that are not rewarded with an easy meal such as garbage or pet foods will direct their attention to natural settings away from human habitation. • Bears that become used to getting human foods may damage property or become a threat to public safety. • Intentional feeding of bears is against Florida law. • Any food source that attracts dogs, cats or raccoons also can attract BEARS. • To deter bears you can Contact Waste Management 3 days prior to pick up for a special "pick up ticket" for items that will not fit in the trash bin. LINE THE STREETS FOR THE HOLIDAYS!

With Thanksgiving, begins the holiday season and to all our members I wish Seasons Greetings and hope everyone has the Alex Crawford chance to spend time enjoying the company of family and friends. It is also a good time to think of those who are alone and for whom the holidays are just a reminder of that fact. Do you have a neighbor who might benefit from a cheerful visit, some holiday goodies or even just the knowledge that you are thinking about them in the midst of all your holiday preparations? At the November Board Meeting, after much debate, the Board finally voted to take what will hopefully be a more humane approach to the usage/variance issue. In other words the policy of this Board will be to create ‘exceptions’so that families are no longer separated between those who can and those who can’t use the facilities. Renters have had in some cases more rights than have owners, while it is heartbreaking that a family of two children, mother and father who rent a three bedroom home must choose which child or which parent must be excluded when the family visits the gym or pool. Past Boards have battled with this issue and the solution is really to permanently change the Covenants rather than instigate policies that vary according to the Board in situ. A great suggestion from the meeting was that instead of sending out Amendments with the ballots at the time of the Annual Meeting, we send out Amendments with the Assessments since the chances of reaching the required 50% plus 1 are so much higher. What we all should realize is that Society has changed the definition of a family and who are we to say just exactly what that is now – especially as we approach the Season of Goodwill to All. In H.B.T.S. we have many members who do not have computers and consequently do not use email or FaceBook. They may not even read this newsletter. It was brought to my attention at a meeting of the Storm Water Task Force in Milton that the data from surveys they send out goes directly into a database to form the basis from which they decide which Communities get mitigation funds. Hopefully we never see another‘100 year rain’like in April but the NewYear could well bring some heavy storm water and flooding to our Community so again please look out for your neighbors who may not receive either the information or the surveys that follow through ‘electronic means’. Tiger Point is very well organized in this respect and is consequently the recipient of substantial grant money. We will keep you informed and many thanks to those members who emailed about the importance of these surveys. Let us remember at this time our Military who are away from home, serving across the globe to keep us safe, thank you and your families for your service and devotion to this Country.
