Harper HBTSnews.com So just when can an American exercise his or her First Amendment right: the freedom of speech? If you live in Holley by the Sea, it depends on who answers the question.

HBTS resident PaulVitello,“It’s my civil right.” The right in question is whether Vitello has the right to have a political sign posted on his property. The sign is 4 by 8 feet, for a total of 32 square feet and reads “Throw out the bums, vote.”

Vitello has never been politically active other than to vote in each election since he was 18, but considering the state of the economy and this being an election year,Vitello felt moved to act. Vitello continued on page 4

According to Jennie Barret, the HBTS interim general manager, when an individual makes the decision to live in a covenant-bound subdivision,“One gives up some of those rights when one moves into a covenant subdivision.” However, according to

Jean Tashlik, Patrick Traynor and Joseph Hart were selected as the top three candidates for the upcoming Holley by the Sea board of directors election. Nominating Committee Chairman Kevin Lanier presented Holley by the Sea’s board of directors their recommendations for three new board members during a May 8 board meeting. “We advised each person that we were nominating three people for the three positions and would turn the results

over to the board to act as they see fit,”said Lanier. Although three candidates were recommended, the board can elect to have all six candidates’ names on the ballot that will be mailed to all HBTS residents. The following are the candidates who applied for board membership along with a brief bio: • Jean Tashlik has been a Navarre resident since 1971 and a HBTS property owner since 2000. She is a teacher and coach in Okaloosa County. She is a Red Cross volunteer and serves on the Education Committee with the Navarre Beach Area

Chamber of Commerce. Tashlik has also served on HBTS tennis, pool dome and beach house committees. • Patrick Traynor has lived in Navarre since retiring as an occupational safety and health specialist in 2001.Traynor has approximately 31 years of military service. He stated his military service and government service required that he stay current in management objectives and milestones. Traynor has served on the HBTS Architectural Committee and was the treasurer for the HBTS board of directors. He founded the HBTS fish-

Harper HBTSnews.com A Holley by the Sea parking ordinance will be examined by legal counsel after residents couldn’t reach an agreement on RV, trailer, commercial truck and boat parking in the subdivision. About 60 HBTS members attended the April 28 HBTS special board meeting and spent more than two hours arguing over the ordinance. Pete Peterzen, board president, opened the meeting with how the covenant is now worded. The present ordinance states in Article VI, section 10, that all“… camper, self-propelled mobile home, trailer, boat, any vehicle that has commercial signs, advertising or commercial equipment visible … must be enclosed in a permanent structure.” The issue centers on the 2005 ordinance that was rescinded in 2009 by the then-HBTS board without putting in a clear policy to address how bigger vehicles must be enclosed and where they should be parked. There was also discussion about the original intent of the ordinance when HBTS was first developed. Peterzen said that permanent structure was never defined; hence different standards have been applied over the years, with some residents receiving verbal permission, others needing a special permit and still others given violation citations. “We’ve been collecting data over the last six months,”getting the history, and doing polls on this issue and“the polls show a divergence of opinions,”said Peterzen. “The first point is, what is a permanent structure?” Several board members quipped that nothing in Florida is truly permanent, but that fences that do not require a building permit or inspection are not permanent structures for HBTS covenant purposes. Additionally, fences are not subject to county code requirements for setbacks from lot lines. Therefore, fences do not meet the permanent structure guideline, Peterzen said. The definition of permanent structure led to the discussion on how and where the vehicles should be parked.

years of Navy service. • Earl Dean has lived in HBTS since 2003. He attends board meetings, committee meetings and works with the staff. He has served on the architectural, social and beach house committees in an effort to improve and make HBTS a better place to live. Dean retired with 21 years from the army and retired from the office of personnel management in Washington, D.C. with 34 years. His combined honorable federal service is 55 years. He is seeking a seat on the BOD to ensure residents are treated fairly. He said he understands that the BOD works for the mem-

The Holley by the Sea recreational center gym will be getting a new seated elliptical machine and leg press in the near future. Jackie Goebel, HBTS maintenance manager, sought approval from the board of directors to replace an old elliptical machine and leg press during the May 8 board meeting. “The leg press is about 17 years old,”said Goebel,“and the elliptical has been in the gym since before I started working here.” The elliptical has been repaired several times to include the replacement of two left-side strides said Goebel. The machine has been repaired under warranty but the warranty has expired, and it has become cost prohibitive to continue repairing the machine. Furthermore, older members that use the gym like the seated elliptical machine better than an upright because it works the legs, arms and chest without placing pressure on the legs said Goebel. The cost of both pieces of equipment is under $8,000. Goebel informed the board of directors that she has not used any of the $15,000 that is budgeted for weight room equipment. One model is an Octane seated elliptical and the other a Hoist leg press. Goebel noted an issue with the weight room is that there is no room for additional equipment. “Either we take out the old stuff that needs to be replaced,” she said,“or we just sit and want.” A couple of the smaller rooms adjacent to the main weight room were opened up to allow more space, “but that’s all there is,” said Goebel. The machines and equipment in the weight room are maintained by Fitness Master in Pensacola. Every three months a technician calibrates the machines, performs regular maintenance and any other work that needs to be done. Goebel received board approval to purchase the equipment and it has been ordered.

He served in the U.S. Air Force and after leaving the service he opened a small business. In 1997, he joined Boeing and has worked with the company in one capacity or another since, resulting in a request to join the Ares

Rocket Instrument Unit Avionics group. He currently works at the Fort Walton Beach Boeing facility. Stephens would like to serve the community and assist with the hard decisions that need to be made. He said that he believes the covenants are in place to give the neighborhood a standard to live by so that HBTS will be a more unified neighborhood. • Chris Johnson is a senior engineer and Florida real estate broker/owner. He said that HBTS success should be built by its members through participation. Johnson said he does not believe in ruling by committee. He would encour-

age the BOD study other successful subdivision associations in order to bring more knowledge on how to make HBTS the best place to live. His primary goal, if elected, would be to save HBTS money and lower assessment dues. He would also work with board members to revamp the HBTS recreational center to provide better usage of empty spaces. The board will discuss the candidates at 6 p.m. during the June 1 BOD meeting held at the HBTS recreational center.

Parking Continued from page 1 A few residents stated that when they moved to the area they were told their vehicle didn’t have to be behind a fence, only to be cited several years later for not having a fence around the boat or RV. Others stated their recreational vehicle was parked on the side of the house, but not behind a fence and that was permitted. Still, a few others expressed concern that they needed to have special permits to park their recreational vehicles. The differing standard has resulted in confusion amongst the residents; hence, the board’s attempt to clarify the ordinance. However, not all present members agreed on even allowing vehicles to be parked on one’s property. One group of members viewed the covenant as not being evenly enforced and a form of harassment against boat, RV and commercial-truck owners. Resident Robert Birke said,“I call this Holley by the Sea Harassment Association.” Those who favor having a policy that would not financially hurt recreational vehicles and allow the owners to park their vehicles on the side of the house or behind a privacy fence were vocal. “I feel for these people,”property owner Pat Traynor said.“It costs these people money every time there’s a change.” However, a small group of people favored not allowing any RVs or boats to be parked on the side of the house or in the backyard because regardless of where the vehicle is parked, it would still be visible from the street or by the adjacent neighbor. Resident Sammie Mattocks stated,“I do not want to wake up one morning … and look at my neighbor’s RV.” After more than two hours of discussion, board member Joe Sipp finally moved that the board of directors adopt an approach to develop a policy to revise the Sept. 2005 guidelines that were rescinded in 2009. The board approved the motion and will have the covenant reviewed by legal and bring the information gathered back to the board at the next meeting.

In Honor of May Military Appreciation Month

Fike promoted to staff sergeant By Jessi Stone HBTSnews.com Stephanie Fike of Holley by the Sea joined the Air Force so she could see the world. Little did she know that her first assignment as a medical technician would be near home at Eglin Air Force Base. Fike, 26, recently completed her first four years in the Air Force and re-enlisted for another four. Fike said her advice to others trying to find their way would be,“If you don’t know what you want to do, get out and try to experience something new.” On May 1, she received her second promotion and participated in the traditional pinning ceremony. She is now a staff sergeant, which is a supervisory noncommissioned officer position. In technical terms, it means a new jacket with a larger stripe. But personally, Fike said the promotion meant a great deal to her because it gives her the responsibility of“passing on knowledge and skills to those below me.” While Stephanie’s father Troy Fike had the honor of pinning her for her first promotion, her stepmother Cheryl Fike had the honor on May 1. Stephanie said the ceremony also included a tradition of“tacking”from higher ranked officers.They came by and playfully punched her shoulder, but she said they took it easy on her compared to the punches males receive when promoted. Stephanie graduated from Milton High School in 2004, but has always lived in Navarre. After graduation she was interested in the medical field but wasn’t sure which path to take. Her older brother Adam Fike was in the military at the time and

She went to visit for the summer but ended up staying for a year. Experiencing a different environment gave her the push she needed and she joined the Air Force when she returned to Navarre. “I had a lot of friends who had joined the military to be a nurse,”she said. “And I really enjoy traveling.” She completed basic training at Laughlin AFB

in Texas and was stationed at Eglin. She recently returned from her first sixmonth tour overseas. While she couldn’t disclose the location, she said she enjoyed being exposed to a completely different culture. “Getting to see the living conditions in other countries really opens your eyes to how good we have it in the U.S.,”Stephanie said. She said the best part of her job was being able to

talk to wounded warriors while treating them. “You get to talk to them and hear how they got injured,”she said.“These are the people that come home and get Purple Hearts.” She purchased her first home in Holley by the Sea while she was still overseas. Her parents surprised her by moving all of her things from storage into the new house on Sunrise Drive before she returned. She

has spent the last few months getting settled and landscaping her first yard on her time off. In July, she will be heading out on her next assignment in Virginia. She said that could be a three- or four-year assignment. She is still holding out for a tour in Italy or Germany. While at Eglin, Stephanie works at the Family Health Clinic and sees about 250 active duty, retired and dependent military patients a day.

“It’s a great feeling being able to help someone and see them get better,”she said. Her decision to join the military has not hampered her ability to get an education. She received tuition assistance and is working on her bachelor’s degree that will enable her to get into the Air Force’s physician’s assistant master’s program. After receiving her master’s degree, Stephanie will become a commissioned officer.

ber and had it delivered to his home where he filled in the knots on the pinewood, primed and painted the lumber, followed by the wording to complete the sign. “I did that myself.” He placed the sign on his property at least 30 feet back from the street. Vitello said that he never received complaints from the neighbors, but one neighbor apparently took offense and called in a complaint to the HBTS office. According to Barrett,“A neighbor complained about the sign.” A certified letter was sent

to Vitello dated April 23 indicating that“In order to uphold the neighborhood’s beauty, it is critical for residents to abide by the association’s restrictions.” The letter indicated that Vitello was in violation of HBTS Covenant Article VII, Section 13, and Section 8.08.00 of the Santa Rosa County Code. Section 13 of the HBTS covenant reads,“No signs of any kind shall be displayed on any residential lot unless the form and size of such signs be first approved by the Subdivider.” County code 8.08.00

reads that political signs shall be a maximum of 32 square feet with a maximum height of 25 feet and shall be installed on private property. When asked about the contradiction in the codes, Barrett said the covenant code takes precedence, and although the covenant reads that no signs shall be permitted unless prior board approval has been received, a policy was put in place by a previous board that allows residents to have up to five smaller signs that can be posted for 45 days.

A second letter was sent dated April 30 again citing Article VII, Section 13 of the covenant. However, for Vitello, the U.S. Constitution trumps state law or covenant statute and he is prepared to go to court to fight for his First Amendment right. “I’m prepared to file suit in federal court,”said Vitello,“I’m kind of bull-headed that way.” Vitello attended the May 8 HBTS BOD meeting but there was no action, and he was informed that the matter would go to the HBTS attorney.

Hidden Creek Architectural Committee appointees receive approval By Yvonne C. Harper HBTSnews.com The Hidden Creek Estates architectural committee candidates received approval on May 15 to serve an additional two-year term during a HBTS board of directors special meeting. The issue of not having Hidden Creek ACC members reappointed came to light during a May 8 HBTS board meeting. A special meeting was called in order to get the Hidden Creek board back on track. The three candidates nominated for the Hidden Creek

ACC were Skip Hardenburg, Tom Kurz and TomVan Hottee. Board secretary Brooke Goldberg said that the HBTS covenant gives the board discretion to appoint or not to appoint a Hidden Creek Estates ACC, but “the appointees need to be done in order for business to continue.” The three selected members are presently serving on the board and agreed to continue serving pending approval. Board member James Mitchell moved to approve the individuals to the committee.

However, he added that the board is here to appoint the members and to give direction on what the board would like the committee to do in lieu of what the HBTS covenant requires. “Can you guys ensure that when the two-year mark comes up that we are kept apprised of the selection of the new members?”asked Mitchell. HBTS board members acknowledged that they have not done this in the past and they share responsibility along with the prior Hidden Creek ACC chairman.

Hardenburg explained that there has been a lot of transitioning in their support staff and it just fell through the cracks. Goldberg said that “It’s understandable that would happen but for continuity sake, it’s important we stay on top of this.” Hardenburg addressed the need for new members but that it is difficult to find people who will do the work, although the community is very supportive of what they are doing. “Most of the members stay longer than two years and

have probably never been through a reappointment process,”he said.“But we need some fresh blood and new perspective.” It was suggested that scheduling the meetings at least quarterly and providing advance notice – more than one week – could be one way to encourage participation. “It may be more productive if people know when the meetings are,”Goldberg said,“and you may get more volunteers.” Hardenburg didn’t agree with quarterly meetings stating that if there is no business it is not feasible to have a meet-

ing just for meeting’s sake. He also stated that the Hidden Creek ACC stays apprised of what is happening at HBTS by reviewing the HBTS ACC meetings’minutes, maintaining regular contact with HBTS staff and attending the HBTS board of directors meetings. However, he did agree that “We just need to be better at being on top of our game.” Adding,“Let us go forward with this process”and review the results to ensure it is working correctly and smoothly. The board approved the three candidates who will serve a two-year term.

Harper HBTSnews.com The May 8 Holley by the Sea board of directors meeting started off with several denied usage-request variances, prompting board member James Mitchell to comment,“This has been such a negative meeting”after the third request was denied. The first request was made by a renter seeking recreational usage privileges for his livein girlfriend and her children. The property manager and renter were present and made the request; the owner was not present but was aware of the request. The covenant limits facility usage to one person per bedroom or usage for a nuclear family. The home being rented has three bedrooms, and the renter has three children. The renter, now separated from his wife, has custody of his children. It was noted in the meeting by board secretary Brooke Goldberg that despite the fact that the renter and his girlfriend are not married, both

have primary custody of their children. “The only thing that separates them (from other renters),”Goldberg said,“is they are not married.” Board president Pete Peterzen disagreed stating that the configuration of the couple does not fit under the rules for an owner, and that the family is essentially two singleparent families living together. “Where do we draw the line with multiple families having full usage of facilities?”Peterzen asked.“What if we have a married couple with three kids and an adult with a couple of kids?” The renter stated that the children only intended to use the pool during the summer and that he and his girlfriend use the gym. Peterzen addressed the point by stating that in the summer the pool is at capacity and more people will be authorized to use the pool, and extending that privilege to a non-nuclear family would be an expansion of usage policy. “We give owners variances and renters variances with

nuclear families,”he said.“I see this as a fairly big expansion of usage.” Goldberg disagreed replying that she viewed the family’s situation as a hardship. “The only thing that would stop us is they’re not married,” Goldberg said.“There’s a lot going on (with the family).” The request was denied with a 3-2 vote from the board. “Sorry,”Peterzen said,“it’s just too big a jump for me to approve access. I just don’t know where it would stop.” The next request came from a mother and adult daughter who recently moved in with her mother. The mother was not present but Jennie Barrett, HBTS interim general manager, said that she called the homeowner and the homeowner is aware of the request although she did not write the request. The daughter moved in to assist her mother and although the board members were receptive, they wanted something in writing proving a hardship exists. “If it is a medical hardship,” Peterzen said,“I would like

County to fund sidewalk project By Yvonne C. Harper HBTSnews.com A project to extend the sidewalk from where it ends on Sunrise Drive to U.S. Highway 98 has been funded by Area 3 Impact Fees. The Santa Rosa County Board of County Commissioners approved a request by District 4 Jim Melvin to

allocate $25,000 from Area 3 Impact fees, fees gathered from the south-end of the county, with work to begin in a couple of weeks. Public Works Director Avis Whitfield said there are several other big projects in the county and manpower is stretched thin. “Once it begins, it should be four to six weeks to com-

plete the project,” he said. The Holley by the Sea board of directors approved a license agreement and easement to complete the work. Once completed, the sidewalk on Sunrise Drive will run continuously to U.S. 98 with about a 140foot walk over around the east pond.

something in writing or a power of attorney; otherwise, it’s not a lot different than what we just had.” Mitchell agreed with Peterzen stating that he wants “something that says this is actually what’s going on.” The board denied the request 5-0 with the provision that the member can make the request again once a power of attorney, a letter from the mother or medical documentation is provided to the board. The next request ended on a more positive note when the board approved a request to allow a usage variance request from a homeowner who has three adults with two children living in the home. The married homeowner’s sister and her son recently moved in, and the usage would only be for six weeks for before and after school care. The sister had been a renter in HBTS and her son is already enrolled in the program. Mitchell asked if there was any way for the board to assure that it was just for the requested amount of time.

Barrett replied that“I can have them locked out the day after expiration.” However Peterzen reiterated that the policy states that guests can’t use HBTS programs. Goldberg reiterated that the request was for a specified program, for a set amount of time, and the family would not be allowed usage of the whole facility. The board approved the request 4-1, giving the family until June 7 to continue using the before and after school program. The final usage variance request was made on behalf of a renter who already has usage privileges but was requesting that his 10-yearold be allowed unsupervised usage in order to complete a Cub Scout project so the child can earn a badge. Mitchell wanted to ensure the father signed a“harmless agreement”and Barrett assured the board one would be signed. The motion was made to allow Barrett to handle the issue in a 5-0 vote.

Social Committee Report Staff Reports HBTSnews.com The Social Committee currently has $1,096.56 in its fund. Committee chairman Bob Geller reported that the April Flick and Float was a success and those who attended said that it would be a good idea for future events. Geller also reported that within the last few weeks, five committee members have indicated that they would like to step down temporarily or resign from the committee. “The loss of these key members will adversely affect out ability to staff current events,”said Geller in his report to the HBTS board of directors. After the committee was polled via email, the results were a recommendation to suspend activities for the summer months. Although several members have some new and interesting ideas that will be pursued in the future and discussed in the June 5 meeting, Geller stated that he feels the best course of action at this time is to suspend all social events until September. The Social Committee will meet on June 5.

The delicioso y fantastico fare was prepared by Vina Kramer and featured chicken and beef fajitas, Mexican cornbread salad, guacamole dip and more. Angela Allensworth garnered the Top Female win with 18 points followed by Eileen Nohava with 16. The top male player was Brad Allensworth with 17 points followed by Henry Bonar with 16. According to Angela, this was the first mixer where both she and her husband Brad have each won top honors. Yard of the Month: Natural preserve and retreat in HBTS By Yvonne C. Harper HBTSnews.com There are mornings when Linda Fusco looks into her backyard and sees her friend quietly sitting, listening to the sounds of the mini waterfall along with melodies of the morning birds, enveloped in the preserve that is Linda’s yard. “She loves the property so much,”said Linda,“It’s her quiet time out.” Linda purchased the home that sits on a half-acre in 2005 from a master gardner. “He was trying to create a natural preserve,” she said of the previous owner. Although she has cleared out some of the perimeter of her property, the trees, flowers and shrubs that surround her home remain. Every day she spends time in her yard. Recently she cleared some of the perimeter and mulched the beds around the trees and shrubs. “I bought 100 bags of mulch,”she said, “and I had to go back and buy 100 more.” She also had some sand brought in and layered to help the grass grow. Scattering sand was a job she did herself four years ago, but it was too much to wheel barrel the sand this year. She spends about 20 hours a week in her yard, which is a lot considering she is the owner of All Phase Cleaning, Inc., but she enjoys her yard time. “I always feel if I buy something, I want to take care of it,”she said. But her yard is more than just trees, shrubs and flowers. In the back sits a piece of driftwood from Navarre Beach that looks like a sculpture one might see in an

Youth Department News Before and After School Program: This program is for school age children (K-5). We currently have openings in the Before School Program and a waiting list for the After School Program. If you would like to have your child added to the waiting list please contact theYouth Department. Fun Factory: Please be sure to call the day of to reserve a slot for your child. Space is limited. New Hours: Morning Fun Factory: 8:30 a.m.-12:30 p.m. Monday-Friday for ages 6 months–5 years old. Evening Fun Factory: 6-8 p.m. Monday-Friday for ages 6 months–10 years old Saturday Fun Factory: 8 a.m.–noon for ages 6 months–10 years old. Summer Camp Information: Summer camp registration is open. Summer camp is open from June 11–Aug. 20. All forms for registration are available on the HBTS website and at the front desk. Please make sure you follow the summer camp paperwork checklist to ensure you have all required forms. Summer camp is open to children who are members of HBTS and are 5 years old (entering kindergarten for the 2012-13 school year) to 12 years old (children who have completed 6th for the 2011-12 school year). Summer camp fees are as follows: $30 registration fee – includes a summer camp T-shirt and bag. $90 per child – Full time $75 per child – Monday, Wednesday, Friday $50 per child – Tuesday, Thursday $25 per child – Daily Summer camp parent meeting: TheYouth Department will hold an open house for summer camp. Parents will be able to ask questions, pick up their child’s T-shirt and bag, meet the counselors for the summer and get an idea of what the children will be doing during the summer.

Holley by the Sea is a leash law area Santa Rosa County Animal Services Ordinance No. 2004 Section 2. Definitions (5)“Direct Control”- The term“direct control”as used in this ordinance shall mean immediate, continuous physical control of an animal at all times such as by means of a fence, leash, cord, or chain of such strength to restrain the same; §12 (8) Direct Control Fines: $30 for first violation, $60 for second violation of same within one year, $100 for third subsequent violations of the same provision. Section 12. Animal Control (8) Direct Control - It shall be a violation of this ordinance for any animal to be off the premises of its owner or person responsible for said animal, without being in direct control of its owner, person responsible therefor, or other person. Animals not under direct control shall be considered an animal nuisance and may be seized, restrained, impounded and disposed of as provided by this Ordinance for any unlicensed animal. Holley by the Sea has received several calls about dogs wandering loose in the neighborhood. HBTS is a designated direct control area. As a courtesy to neighbors, keep your pets contained to your yard or on a leash when you walk. If you see a loose animal, call Santa Rosa County Animal Control at 850-983-4680. They are open from 8 a.m.-4 p.m. Monday-Friday and 9 p.m.-2 p.m. on Saturday. For after hours, call the non-emergency number for the Santa Rosa Sherriff, 850-983-1100.
