Should the Rental Market be Regulated? If Yes... How?

Times within the real estate sector are good, yes; truly we can say they are good. Over the past few years we have seen a steady increase in the annual transaction volume but the question many of you may have is how are we able to continue to sustain this growth. An immediate response is infrastructure; roads, public transport, better traffic management, garbage collection etc. However if we look into detail at how to continue to strengthen our built environment it is also through implementation of standardised procedures. In relation to the two recent articles published on the Times of Malta; does the Maltese Rental Market need to be regulated? In both these articles discussion of price regulation is mentioned and we would like to say that we are in disagreement. Regulating the prices is something that cannot be enforced, as it is an individual’s decision and a free market. We believe that the beginning of regulation should start with all rental properties being registered with a governmental division by all landlords and if all landlords want to rent their property then tenants can only rent from registered owners which will help regulate the prices across all residential property. Recommendations for Residential Rentals from short to long term (max 5 years): Create a precise process of events that should be implemented for all rental properties and to create a Private Rental Accreditation scheme for all landlords and agents to form a part of.

A standard guide for rental agreements should be provided by government so that each agreement is fair and complies with the law Laws in place for tenants living in unsafe conditions, serious health and safety hazards The right amount of notice by law so that landlords do not abuse the rights of the tenants Obligatory for landlords to have building insurance Obligatory for landlords to have smoke detectors Each landlord is to appoint a company to prepare an inventory check in report Holding Deposit: The landlord must place the deposit in a holding deposit protection scheme to be returned once the tenancy expires Tenants must provide proof of identity, a reference and bank statement and valid employment status and a guarantee on the rent to be paid either through employment or other. Online database to be set up by the government whereby each Landlord/agency must upload his lease agreement onto database All properties for rent must be registered Final withholding TAX for landlord on rental income The recommendations and processes displayed are in very brief form for the purpose of discussion.
