Congratulations to the Newly Weds!! Now you may be wondering, what is the best way to file my taxes? When a couple gets married, there are always a lot of questions about taxes and what is the best way to file. In order to take advantage of additional deductions, the best way to file is “Married Filing Joint.” If you get married before December 31st of the year, the IRS allows you to file “Married Filing Joint” for that year and every other year you are married. Normally when a couple files an income tax for the first time as a married couple, if all the withholdings are at the correct rate, then normally there is a refund! I know there may be circumstances where the wife may have children prior to getting married and is able to get Earned Income Credit due to being in a lower tax bracket but that may no longer be the case after adding the husband’s income and filing “Married Filing Joint.” Nonetheless, in my opinion, after preparing taxes for the last 30 years, the best way for a married couple to file is “Married Filing Joint.” Now, let’s say for instance, that one of the partners has a tax issue from the past and/or child support issues. There is a form called “Injured Spouse”, which still allows you to get the portion of the refund. The law reads: The IRS can withhold a joint refund if one spouse owes past-due federal taxes, child support, spousal maintenance, federal non-tax debts (such as student loans) or a state tax judgment. A spouse is not required to pay the past-due amount (the injured spouse) may receive all or a portion of the couple’s refund by filing Form 8379, Injured Spouse Allocation.
