Whether they’re looking at newly built or previously owned houses, all buyers have lengthy wishlists. When choosing new, they have a virtually empty canvas on which to draw their dream homes, especially if money is no

object. These days, however, it is an issue, even for higher-end buyers, said Carl Becht, vice president of sales for Vaughan & Sautter Builders. “They are very costconscious these days and might not be as willing to go overboard” as they were before the economic downturn, Becht said. His

vey reported that some of the most-desired features involved saving energy. That included Energy Star-rated appliances and windows, even Energy Star-rated homes. Nine out of 10 buyers would rather buy homes with energy-efficient features and lower utility bills than homes without those features that cost 2

buyers are primarily over 55, downsizing, and seeking to reduce the operating costs required for houses 5,000 square feet or bigger, in some cases. percent to 3 percent less, the survey said. Energy efficiency first became important during the 1970s, said Medfordbased real estate consultant Gary G. Schaal, who was sales and marketing director for major area builders for more than 25 years. Oil crises in1973-74 and 1979 drove up gasoline and energy prices. Today’s buyers “are demanding more efficient insulation packages, and many are turning to geothermal units for heating and cooling,” Becht said. “Geothermal is expensive up front, but it pays for itself over time.” Main Line custom builder Mark Semerjian said that "geothermal is pretty standard" for the houses he builds –some of them 6,000 square feetplus. Solar power is used to run some units, but widespread adoption of solar “is hampered by the aesthetics” of having panels visible on the roofs, Semerjian noted. Among first-time buyers, top-of-list amenities include many of the things the trade-up crowd also desires, including “gourmet kitchens with large islands, hardwood on the first floor, stainless-steel appliances, and luxury baths with large showers,” said Anthony E. Maras, area president for Pennsylvania and New Jersey for K. Hovnanian Homes. First-timers are especially concerned with price and proximity to work, the national survey said, a finding with which area builders agreed. Whirlpool tubs – in high demand when he worked for Scarborough Homes, Schaal said – are out. “Large showers are in.” (The survey concurs.) “Jacuzzi tubs have fallen by the wayside,” said Becht, adding that “big walk-in showers and multiple showerheads“ are

what buyers want. “We still put in tubs,” just not oversized Jacuzzis. Storage remains an issue, the national builders’ survey found: Buyers want laundry rooms, linen closets in the bath, garage storage, walk-in pantries. “The need for storage is the nature of our society,” said builder Bruce Paparone, “and it is a given in our business.” The “gourmet kitchens” of first-time buyers include “granite countertops,” Schaal said. At the higher end, they include commercialgrade appliances, said Becht and Semerjian. Two other recent trends among trade-up buyers are things mentioned during survey presentations more than a decade ago: First-floor master suites are sought after by older buyers, who, Becht said, are more concerned about being able to stay in the homes as they age than about “the fact that they are more expensive to build.” The end of the living room, long predicted, has been delayed “by concerns about resale,” Becht said. In exchange, buyers “want family-size dining rooms” for the twice-a-year holiday dinners.

A group of local Realtors and renovation loan experts is getting ready to put on the Affordable & Renovation Open House Day next Saturday to promote the available homes locally and financial tools buyers have available to them. The event takes place at the offices of the Tallahassee Board of Realtors, 1029 Thomasville Road in Midtown. It includes a breakfast along with an interactive renovation seminar that will be facilitated by the Tallahassee Lenders Consortium. The speakers will cover the basics of buying houses, including distressed properties, that may be priced below market levels but require some sort of repair, how to obtain down payment assistance, the lending process, and working with a contractor on the planned renovations. Afterward, program attendees are invited to tour a group of affordably priced homes in the community that need renovation. Contractors will be on hand to answer questions and talk about the building process. In particular, speakers will be discussing the 203k loan offered by the Federal Housing Administration. This loan is designed to encourage lenders to finance homes that need rehabilitation by including the fixup funds in the mortgage proceeds at closing. The down payment requirement is low, and eligibility criteria are not as stringent as with other forms of financing. Homeowners whose houses need improvement can also refinance with these loans.

“The more we get the word out about this, the more it is going to be used and we will see a lot of benefit from it,” said Libby Lane, executive director of the Tallahassee Lenders Consortium, one of the event sponsors. So far, TLC has worked with Wells Fargo and with University Lending Group on a few of the 203k mortgages and been successful. “It’s just a great financing tool so that folks who a find a home that is below market can fix it up and make it livable,” Lane said. And, through some recent meetings with city of Tallahassee housing officials, TLC has reached agreement on buyers being able to qualify for down payment assistance. Previously, the program rules required that recipients of down payment help make sure their house met all building codes at closing – which ruled out any house that the buyers planned to renovate after they moved in. Without 203k financing, homes needing fixup were a tall order. Prospective buyers normally don’t want to pay for re-

pairing someone else’s house because they don’t own it. Sellers often don’t want to put any more money into a residence that is a distressed property, or they may not have the financial resources to do so. Nonetheless, there are many area residents with limited financial means who could take advantage of renovation loan financing. Realtors say the houses priced below market and needing repairs have the potential to energize the affordable home market when the right financing tools are available. The 203k loan can be used for such improvements as repairs, adding square footage, making room updates, new carpeting, handicap access or accommodations, better energy efficiency – whatever is needed to get the house in the desired shape for ownership. Realtor Christic Henry of Kingdom First Realty said Saturday’s program – the first seminar and open house event of its type – will get prospective buyers engaged and educated about the buy-and-renovate purchase option. “Our goal at this junc-

ture is to get 50 people in the room, 50 people to raise their hand and say yes,” Henry said of the opportunity. She noted that more than half of the area’s housing inventory was built before 1990. Those homes are likely candidates for being modernized in one way or another. Distressed properties, including short sales and homes taken back by their lenders, represent another part of the market. Many have been sitting vacant when they could have new owners in them. “That is really what this is all about – getting them out of trusts and getting them out of inventories for the prospective homeowners who need an affordable option,” Henry said. Ron Byrom, the national renovation sales manager for University Lending Group, agreed. Foreclosures often need work done, which is why they usually don’t qualify for traditional financing. “The nice thing about these (203k) products is it lets the owner occupants get in there and get into these properties,” Byrom said.

A renovation mortgage allows a buyer to roll extra financing into a single loan that includes the purchase price and money for the desired fix-up work on the home. The consumer is best advised to have a good team assembled to help navigate the process, including a lender who is familiar with the renovation loan product and a Realtor who knows the market. “And it’s never too early to starting looking for a good contractor,” Byrom said.

Neighbors oppose planned pot farm

Residents cite safety, home values among major concerns By Lisa Pemberton Associated Press

OLYMPIA, Wash. — Green is everywhere in the Skookumchuck Valley, from the lush pastures grazed by cattle and horses to the forested hills that surround the rural community of mostly hobby farms just outside of Tenino. But a group of residents have joined together to battle a different type of green from sprouting up in their neighborhood: a proposed commercial marijuana farm. “I don’t care if someone grows a few plants; I don’t even care if they smoke it,” said Phil Forbing, who lives next door to the would-be pot farm in the 6000 block of 199th Avenue Southeast. “But I don’t want a commercial business next to me in a residential area.” So far, about 20 people have joined the effort to block the farm that’s been proposed by Olympia-based Silica Phoenix LLC. It’s one of the first not-in-mybackyard (NIMBY) cases in the state since Initiative 502, approved by voters in November 2012, ushered the way for statelicensed production, processing and retail sales of recreational marijuana.

Some governments, including Pierce County and several of its cities, have banned new recreational marijuana enterprises within their jurisdictions. The Washington State Liquor Control Board has scheduled a lottery next week to select marijuana retail licenses around the state. Meantime, officials have approved about 40 licenses for growers and processors, according to Brian Smith, spokesman for the Liquor Control Board. “What we’re finding is that a lot of people are either slow to pay their fee, or they’re not ready yet,” he said. According to the control board’s online database, which is updated weekly, none of the applicants in Thurston County has received a state license. A company on Skokomish Valley Road in Mason County has received a production license, and an enterprise on Valentine Avenue in Pacific in Pierce County

has received licenses to grow and process marijuana. Thurston County commissioners eased into the law by passing a one-year interim ordinance that included zoning regulations on where state-licensed pot could be grown, processed and sold. County manager Cliff Moore said it hasn’t been an easy task to implement the new law. Officials said they’ve only approved a handful of permits for growing and processing so far. “This is a new world order,” Moore told commissioners during a recent meeting. Several Skookumchuck Valley residents voiced their concerns at a recent Thurston County Commission meeting, urging officials to deny a special-use permit that’s been submitted for the nearly 10-acre property. They’ve also contacted officials at the Liquor Control Board.

Resident Shelly Forest said they have numerous concerns, including the commercial look of the farm, the environmental impact of possible chemicals and groundwater pollution, potential smell of pot plants and personal safety of nearby residents. She also doesn’t like the idea of security cameras on the property, or increased traffic that a business will bring onto their street. “It’s absurd that we should have to put up with that,” Forest said. “It should be in a light industrial area.” Forbing said he’s worried home values will plummet in the neighborhood once the operation is up and running. “Who’s going to want to buy my property?” said Forbing, who purchased his home on a 5acre lot in 2006. “Nobody with kids is ever going to want to buy it.” Retired school bus driver Lynda Johnson-Townsend has lived in the area her entire life — in fact, her great-grandparents homesteaded nearby in 1873. She said she’s outraged by the proposed pot farm on her street and doesn’t think county officials are taking her concerns seriously. “I was told that it was no different than growing hay,” Johnson-Townsend said. He said he expected the neighbors to have some curiosity about the farm, where 8-foot wooden privacy fences and the skeleton of a hoop greenhouse has been constructed. “I was a little surprised about the way they went about expressing their concerns,” Swartz said. “We’ve never talked to the people who are complaining.” He said he’d like to get together with the neighbors to talk about their concerns, and try to resolve issues. Now that pot has been legalized, there’s going to be a natural transition for people’s attitudes, he said. “We’re in an ideological transition,” Swartz said. The company’s business model is carbon-friendly and green, he said. They plan to hire local workers, support community fundraisers and be a good neighbor, Swartz said. “We’re growing plants,” he added. “It just so happens, they’re called marijuana.” Swartz compares the effort to the craft brew industry, which he says emphasizes quality and a connection to community. “Our plan is to do chocolate products and other types of marijuana products,” Swartz said. “We are not purely capitalists. Yes, there is some financial incentive, but it’s about quality of life and sustainability of a lifestyle where we want to do something good.”

Joby Birr, an attorney representing Choate Construction Co., which is the general contractor for the building, said Thursday the company was granted a foreclosure judgment with a lien this month. “By virtue of Florida law, we’re able to foreclose on the lien, which is what we’re doing,” Birr said. “You can see it (the

building) has just got all studs and there are no windows.” The foreclosure and lien ruling this month are a result of ongoing litigation between the original Berkman Plaza ownership and the construction company. A year ago, arbitration resulted in the foreclosure ruling going in favor of Choate, which is based in Georgia, after it was ruled Berkman owed the construction

company about $12.4 million. Birr said there will be an online public auction beginning at 11 a.m. April 29. The city’s website, coj.net, will be used to conduct the auction, he said. Birr said as part of a legal settlement the lien stipulates that Choate is owed about $10.2 million in value for the property. He added if no one makes a bid that is satisfactory to Choate, the construction

company will maintain ownership of the property. “The way it works, someone can come in and if the bid is high enough they can purchase the property. I don’t know if that’s going to happen or not,” Birr said. “The number has to be ($10.2 million) or higher. Otherwise, it’s going to go to my client.” Birr, a partner at the Jacksonville law firm of

Jimerson & Cobb, said beyond the auction he did not know what Choate had planned for the property if the company retains ownership. The Berkman Plaza II project has been mired in difficulty beyond the finances since construction on the building halted seven years ago. That’s when a worker was killed while concrete was being poured in the parking garage.

Flowering Chinese fringetrees appear to be covered in snow Showy blooms add to landscape By Norman Winter McClatchy-Tribune News Service

The Chinese fringetrees have been on the spectacular side the last week or so, and they will be the same in your garden as they have here in Savannah. Botanically speaking they are known as Chionanthus retusus, with Chionanthus meaning snow flower. Snow flower is very appropriate and – like our native Grancy greybeard, Chionanthus virginicus, they make a dramatic statement in the landscape. Though they are native to China, this week I was quick to point out to a business delegation from Korea that this outstanding tree and several others in our garden were also native to their country. The Chinese fringetree is cold hardy from zones 5 to 9 and much of the country will see the glistening white flowers in May and June as warm weather moves north. The native or white fringetree’s flowers open before leaves, while the Chinese fringetree blooms after leaf emergence. The trees are the perfect size for the urban landscape, reaching 15 to 20 feet tall with an equal spread over time. The showy flowers offer a delightful fragrance and partner well with other springtime bloomers. At the Coastal Georgia Botanical Gardens we have ours in close proximity to a 55,000-gallon water feature that is ever so picturesque. The companions are the almost iridescent blooms of the loropetalum or Chinese fringe flower and hollies that serve as a great green backdrop. A screen of

dark green screen whether conifers or hollies really show off the white blossoms. In the fall the Chinese fringetree offers a good source of yellow along with purple olive-sized fruit. As the fruit matures it becomes a prized source of food for both the American robin and cedar waxwing – one morning the fruit is there and by afternoon it will be picked clean, which is joyous to observe. Nursery production has always been a little challenging for the native species, giving way to its Chinese cousin. I assure you that you will be making an outstanding choice. When you find yours it does pay to plant it right. Choose a site with full sun to partial shade. The soil should be moist and fertile, but very well drained. Dig your planting hole about twice as wide as the root ball but no deeper. You do not want the tree planted too deep or sinking. The top of the root ball should be even with the soil surface. Fringetrees don't like prolonged dry periods so I have really become accustomed to forming about a 4-inch berm outside the root ball area at

the time of planting. This allows you to usually add about 5 gallons of water that will be directed to the most important zone while the tree is getting established. After a year the berm can be removed. Trees can be male or female. The male trees have showier blossoms while the female tree produces olive-like blue fruit relished by birds. Unfortunately, you most likely will not have a choice at the garden center. There is also a wonderful selection called China Snow that is smaller and bears the showy fruit. Showy white blossoms, fruit for birds and a small but statuesque structure makes this an ideal plant for your landscape. If you could use a small tree, then shop your local garden center this spring and see if they might have the Chinese fringetee.

KISSIMMEE — Tupperware is making a name for itself beyond plastic food containers as it builds a major retail center near its headquarters and looks toward developing land it owns near one of Osceola County’s proposed SunRail stops. The Orlando-based company broke ground Wednesday on the Crosslands, a 427,000-squarefoot retail center along Osceola Parkway and Orange Blossom Trail in Osceola County. One of Central Florida’s biggest retail projects in recent years, the center already boasts such tenants as Marshalls and HomeGoods, Hobby Lobby, PetSmart, Academy Sports + Outdoors and Starbucks. Tupperware once owned about 1,300 acres of land hugging the border of Orange and Osceo-

la counties, property it purchased more than 50 years ago. Its headquarters takes up 125 acres, and the Crosslands is its 20th real-estate deal aimed at filling in the rest. Even as it builds the 68-acre Crosslands, Tupperware will soon turn its attention to another opportunity involving SunRail. Like Florida Hospital in Orlando, Tupperware finds itself in the enviable

position of owning lots of land close to a proposed SunRail station. Although the train system isn’t slated to reach Osceola County until at least 2016, Tupperware already is looking at what it can do with the 150 acres of undeveloped land it owns next to that station, which would be built on land that Tupperware donated to the state. “We would like to see compatible uses. We would like to see Fortune

500 companies with regional headquarters or national headquarters,” said Thomas Roehlk, executive vice president and chief legal officer for Tupperware Brands Corp. “We’d like to see a vibrant area here.” When Tupperware first came to Central Florida in the 1950s, its headquarters was so remote that the company was forced to provide meal service for its employees because there was no

place nearby to go for lunch. In the decades since, roads have developed and stores have popped up around the headquarters, many on Tupperware’s land. In 2003, the company teamed with O’Connor Capital Partners – the same company it is joining forces with to build the Crosslands – to develop the Loop, a 440,000square-foot shopping center with such businesses as Kohl’s, Old Navy and Regal Cinemas. Back when Tupperware made its acquisition in 1953, buying large swaths of land was “a pretty common occurrence,” said Joshua Harris, director of the Dr. P. Phillips Institute for Research and Education in Real Estate at the University of Central Florida. In addition to its being attractively priced, companies saw future value in the land. For Tupperware, its current developments are a chance to unlock that value from an asset on the books for a long time. “Certainly, a large corporate headquarters and corporate operations is going to generate excess demand for other services,” Harris said. “Housing, retail, as well as other office build-

ings for suppliers and just other businesses that want to locate in the area.” The most famous example of companies buying up land was the Walt Disney Co., which bought the 27,400-acre Disney World tract secretly from dozens of owners in the mid-1960s. Disney himself sought to provide a buffer for his Magic Kingdom theme park, and the purchase provided enough land for three additional theme parks plus thousands of hotel rooms. Parts of the property are still being developed today. It wasn’t until the 1980s that the current model emerged, with real estate investment companies focused on owning land, and corporations focused on their main business operations, Harris said. With the latest project, Tupperware has developed more than 50 percent of its buildable land. And with the completion of the Crosslands, it will have been responsible for about 1.5 million square feet of retail development. Going forward, the company has government approval to build more than 2,500 residential units, with 566 units already built or under contract. It is entitled to build about 1.8 million square feet of office development in Osceola County, and an additional 950,000 square feet of commercial development in Orange, Roehlk said. That’s a lot for a company that has remained somewhat of an oasis, as Hunter’s Creek developed to its north and Kissimmee to its south. “In the midst of the other development, we have been pretty much undeveloped,” Roehlk said. “Now we are just starting to realize the potential of the area.”

WASHINGTON — U.S. homebuilders’ confidence in the housing market rose modestly in April but remained at low levels for the third straight month, constrained by tight credit for homebuyers and a shortage of workers and available land. Question: My wife and I owned a home in Broward County from 1995 to 2002, when we sold it to a young couple. We completed the deal at a title agency that has since closed. The home now is in foreclosure. The lender found that our sale deed had been improperly re-

corded in 2002 and has contacted my wife and me to sign a corrected deed so that the foreclosure process can continue. Is this common, and is there any risk for us to sign? – Ira Answer: This kind of thing doesn’t happen all the time, but it’s not unheard of, either. It’s probably best if you sign – but only after you determine

this isn't a scam. The process of foreclosure involves more than just taking the property back from the borrower. The lender also needs to make sure that any other ownership and title issues are resolved so that it can sell the property to recoup the money. When the bank files the foreclosure action, it also will sue all other parties

who have stakes in the home – such as judgment holders, recent spouses, condominium associations – to clear out their interests and take clean title back. With something like this, the lender will make a claim against its title insurance policy, and the insurer’s attorneys will work to clear up the problem. When you sold the

property, you signed a warranty deed to the buyers. The “warranty” means that you promised to do what is necessary to assist in cleaning up any errors or problems with the transfer. It would be simpler for you to cooperate rather than have the lender sue you over a property you no longer own. But call the lender or check with

your attorney to make sure it’s legitimate.

LOS ANGELES — Rustic Canyon’s sylvan beauty and funky charm cast its spell on Jill Soffer a dozen years ago. She liked the neighborhood’s relaxed environment and abundance of sycamore trees and purchased a home there in 2002. “There’s all this green around. It’s not too manicured,” Soffer said appreciatively. “People are easygoing, everything is a little overgrown, and the creek in the middle of everything is a little shaggy. You can hear the frogs at night.” She planned to renovate her 1920s three-bedroom house, but hadn’t yet when she met and then in 2008 married Greg Adler, who had two young sons. Now something definitely had to be done. They wanted a home big enough for a family of four, plus visiting relatives and the businesses they run from home. Adler builds homes in the Palisades, and Soffer designs, renovates and builds high-end Westside homes. They loved her Rustic Canyon location, but struggled with how to expand the house – which already had been added on to over the years. Then they heard that next-door neighbors planned to retire and move. So Soffer and Adler made an offer on the adjacent property, which had a small house in back, and doubled their lot size to 12,000 square feet. They decided to start over, taking down the old houses and building two new structures on their enlarged property: a main house in front, where they would live and Adler would have his office, and a second building in back. That one would be constructed in the footprint of the former neighbors’ old home and would house Soffer’s offices, a rec room and two upstairs bedrooms for guests. “I’m from the East Coast, and I’ve kept up with my huge fam-

ily and my old friends. It was important for me to have space for them to come and visit,” Soffer said. Each of them had other items on their wish lists as well. Soffer wanted to preserve the trees on the property, including a century-old sycamore in front and an oak and a sycamore in back. “The trees are why I bought the lot in the first place,” she said. She also wanted their home to be built as sustainably designed as possible. Adler wanted plenty of outdoor recreational space for himself and his boys, Jacob and Gabriel (today, ages 17 and 13, respectively), including a basketball court for pickup games. They got all that and more. Working with L.A. architect Peter Kim, Soffer and Adler built a home and guesthouse that seamlessly connect to the outdoors through expansive sliding-glass walls and windows. A courtyard and landscaping by FormLA and Russ Cletta Design Studio link the two buildings and extend the family’s living space. Here, the barbecue and outdoor seating area get a lot of use, as do the basketball court and 25-meter lap pool. A turtle pond provides another water element and frequent amusement. Upstairs, a balcony off the boys’ bedrooms houses a pingpong table. An exercise room has its own balcony as well. The buildings are wrapped in gray-brown reclaimed wood siding with a touch of green from petrified lichen, which helps them blend in with the landscape. “The little bit of green makes the house go away,” Soffer said. In the main house, reclaimed wood ceilings reinforce the indoor-outdoor connection. To echo that palette in the great room, Soffer chose organiclooking patterns and neutral colors for upholstery, rugs, tile and other surfaces. The exception is a pair of See CANYON » 19G

chandeliers of colorful handblown glass from Bourgeois Boheme that hang over the dining table. “I chose them to be the only jewel colors in a room full of neutrals,” Soffer said. “Because of the room’s big glass walls, the chandeliers are visible from the street at night. Neighbors comment on their beauty. It’s like year-round Christmas.” Bold color is used more generously in the guesthouse and Soffer’s office, with green, turquoise and pink walls and textiles offsetting an otherwise white palette. A pair of colorful go-go boot artworks by Adler add whimsy in a hallway. Here, as elsewhere in their home, a rotating gallery of family photos and memorabilia line the walls. “I made the guest rooms playful because people come and stay for a short time,” Soffer said. Whimsy also makes an appearance in the powder room of the main house. Soffer wanted a sink in the shape of a wave and worked with two architecture students who had created a Corian sink they called the Soft Swell. Together they designed one for the house, and Jill had it lighted so it glows. She was serious, though, when it came to sustainability. She and her husband installed solar hot water and photovoltaic panels on the roofs to heat the pool, the home and its water and provide electricity. The landscaping features droughttolerant and native plants. LED light fixtures, no-VOC (volatile organic compound) paint and recycled countertops and flooring were used throughout the house. These and other features earned the main house a Leadership in Energy and Environmental Design, or LEED, silver certification from the U.S. Green Building Council. And the trees? The master bedroom upstairs opens to a view of the 100-year-old sycamore, which was preserved, along with the others, with the help of arborist Lisa Smith. They even added more. “This house is really about the trees,” Soffer says.

TAMPA — Federal banking regulators are suing the officers of the failed Superior Bank of Tampa, claiming they broke their own internal rules and made many improper loans that helped doom the bank. The Federal Deposit Insurance Corp. filed the suit in the U.S. District Court for the Middle District of Florida because that agency ultimately had to take over the bank. The FDIC is now trying to recover at least $44 million in damages due to what it claims are “highly speculative and poorly underwritten commercial real estate loans” that “ignored the risks.” The suit lists loans for projects stretching from Tallahassee to Panama City to Tampa. Two loans included in the suit financed projects in the Tampa area. The first was a loan made July 7, 2008, for $8 million, plus a $400,000 term loan to construct a 20,000-square-foot conference center and corporate offices for the Mainsail Conference Center. The FDIC claims that loan contained “insufficient equity” from the borrower, no personal guarantees and “inadequate financial documentation.” That conference center was completed in 2009. Officials with Mainsail issued a statement, saying, “Like so many other banks and businesses, Superior was struggling in the downturn and, we assume, elected to sell the conference center note at a discount in order to raise immediate capital.” The FDIC also listed a $3 million line of credit and $12 million loan made on Nov. 26, 2008, for Taipan Property II LLC, which went to complete student housing near the University of South

Florida. The project, the FDIC claims, was initially funded by another bank, which ceased funding “about halfway through” after the borrower changed the purpose of the project. The “prevailing economic environment” amid the steepest part of the economic crisis “greatly increased” the chances the loan would fail. The federal court docket does not list any response yet from the defendants. The two highest-ranking officers listed in the suit were CEO and board chair C. Stanley Bailey and president and director C. Marvin Scott. Neither could be reached for comment. The FDIC sold the assets of Superior Bank in the spring of 2011 to Birmingham-based Cadence Bank. The FDIC counts this present action as a “Professional Liability” suit, where the FDIC is the receiver of a bank that’s being liquidated. “You can kind of think of it as a Chapter 7,” said FDIC spokesman David Barr. The FDIC files such suits when “they are both meritorious and cost-effective,” according to FDIC guidelines. Before that step, the FDIC conducts an investigation that can take 18 months, and FDIC staff try to make a settlement with potential defendants. If that fails, the FDIC files a lawsuit in federal court. From Jan. 1, 2009, through April 10, 2014, the FDIC authorized suits against 136 failed institutions and 1,102 individual directors and officers. Of that, 21 were settled and one went to trial, with a jury verdict for the FDIC. On top of that, the FDIC filed dozens of suits for other bank and loan problems, including 69 residential mortgage malpractice suits that are pending. From 1986 through 2012, the FDIC and the former Resolution Trust Corp. spent $1.9 billion on claims and collected $6.8 billion.
