Ex-dad seeks probe on P17b port project

DAVAO City––Former Davao City councilor Peter Lavina has written the Office of the Ombudsman to look into the proposal of the Department of Transportation and Communication to undertake a P17-billion expansion of the Sasa port through public-private partnership scheme. Lavina, in a letter dated Monday, May 18, asked Ombudsman Conchita Carpio Morales to examine the price of the proposed Sasa Port in Davao City. The former councilor said he was one of those pushing for the expansion of the port during his term at the 15th Council. The item has been discussed several times at the current city council, with local officials saying they were not aware of the exact details of the project. During the city council’s regular session last week, port manager Leonilo Miole told the councilors he did not know the full details of the expansion project, and that the idea

came from the national office of the Philippine Ports Authority. The City Planning and Development Office, for its part, said it could not comment on the issue as all the ideas for the expansion came from the PPA. In an interview Monday, CPDO head Marcelino Escalada said the city was not privy to the details of the port expansion project as well. Lavina told reporters at Monday’s edition of the Kapehan sa SM that he will “closely monitor” the issue until the awarding of the project. “We are not against the modernization at Sasa port, but this PPP stinks!” Lavina

said. Ultimately, the burden will be passed on us the taxpayers, port users and consumers.” L av i n a and s e ve r a l councilors have publicly questioned the project cost, which was initially pegged at P4 billion in 2013 and later priced at P17 billion. The local PPA office last week promised it would invite its national office to a meeting with the city council. In an interview Tuesday, PPP specialist Alberto Agra said the minimum courtesy for projects like the Sasa modernization plan would be to involve all stakeholders even as early as the study phase. --MindaNews

2 moderate quakes jolt Davao area

At least two mild earthquakes shook the province of Davao Occidental on Thursday morning, according to the Philippine Institute of Volcanology and Seismology (Phivolcs). In its bulletin, Phivolcs said the first quake with a magnitude of 4.2 occurred at 9:07 a.m. with its epicenter traced 46 kilometers southeast of Jose Abad Santos in Davao Occidental. The quake, which was tectonic in origin, had a depth of 135 kilometers. The second quake with a magnitude 3.0 occurred around 10:07 a.m. with epicenter traced some 47 kilometers southeast of Jose Abad Santos in Davao Occidental. DAVAO City––The Davao City Chamber of Commerce and Industry, Inc. (DCCCII) opposed the 17-billion Sasa Port modernization project under the government’s Private-Public Partnership (PPP) program. DCCCII president Antonio T. Dela Cruz said the hike of the proposed cost of the project is “absurd and alarming”. “Coming from the original figure of 4 billion, it has now ballooned to P17 billion. A thorough explanation has to be made, and a consultation with the business sector and stakeholders is a must,” Dela Cruz said. The original study which was conducted by the Philippine Ports Authority (PPA) in 2013 came up with an estimated cost of P4 billion. However, the government tapped Development Bank of the Philippines (DBP) and the International Finance Corp. (IFC) of the World Bank (WB) to act as their transaction advisors for the international competitive public bidding. New name won’t cure BBL: Miriam SENATOR Miriam Defensor Santiago on Thursday said that changing the name of the proposed Bangsamoro Basic Law (BBL) will not make it any less objectionable unless Congress also revamps the bill to address numerous “constitutional infirmities.” Santiago, chair of the Senate committee on constitutional amendments and revision of codes, was commenting on the House of Representatives’ approval of its amended version of the bill now called draft “Basic Law of the Bangsamoro Autonomous Region.” “The words ‘basic law’ are attached to the name. ‘Basic law,’ in legal construction, is a synonym for ‘constitutional law’ and ‘organic law,’” the senator said, citing her committee report on the BBL draft, pending as Senate Bill No. 2408. Santiago added that the name itself showed that the BBL is intended to have the same effect as the “constitution” or “constitutional law” of the Bangsamoro territory, in the same manner that the 1987 Constitution is supreme in the territory of the Republic of the Philippines. “It goes without saying that two different constitutional instruments cannot have legal effect at the same time and in the same territory. The proposed BBL must be consistent with the provisions of the Constitution of the Philippines,” she said. The Santiago report is based on two public hearings on the draft BBL, where resource persons included former Supreme Court Chief Justice Artemio Panganiban; Associate Justices Florentino Feliciano and Vicente Mendoza; and

former UP law dean Merlin Magallona. Aside from Santiago, senators who signed the report include committee vice chair Sonny Angara, and members Jinggoy Estrada, Bongbong Marcos, Koko Pimentel, Tito Sotto, and Cynthia Villar. Senators Lito Lapid and Ralph Recto said they will sign the report Monday. The 27-page document is one of three committee reports that will form the Senate’s position on the BBL effort. The two others will come from the committee on local government, the primary committee, and the committee on peace, unification, and reconciliation. Copies of Santiago’s committee report on the draft BBL were released to the media as the ad hoc committee of the House of Representatives approved its version of the bill. Malacañang hopes to pass the proposed BBL before Congress adjourns sine die on June 10. Constitutional amendment “The committee on constitutional amendments appreciates the brilliant efforts of the hardworking men and women who put the BBL together. However, in its present state, the BBL raises many insidious doubts on constitutionality,” Santiago said. She urged her colleagues not to approve the BBL with haste, stressing that the Senate and the House acting only by themselves cannot approve the proposed BBL in its present form. “It has to be promulgated by nothing less than an amendment to the Constitution,” she added.

Santiago also said that a constitutional amendment should apply the method prescribed by the Constitution itself--constitutional convention, constituent assembly, or people’s initiative--with revisions subject to ratification by the national electorate in a plebiscite. Quoting U.S. Chief Justice John Marshall, she said: “The people made the Constitution and the people can unmake it-- But the supreme and irresistible power to make or unmake resides only in the whole body of the people, not any subdivision of them.” She nonetheless warned that insisting on changing the Constitution instead of amending the proposed BBL is “constitutional impiety,” and recommended in her committee report that the Senate version of the BBL substantially be revised. “Instead of implying a transfer of sovereignty from the national government to the Bangsamoro Government, the BBL should observe the principle of subsidiarity as a way to allocate decision-making power,” the senator said in her first recommendation. Santiago explained that in law, subsidiarity is the principle that a central authority’s function should be subsidiary, performing only tasks that cannot be performed effectively at a mere local level. Her second recommendation is for the proposed BBL to provide a minimal threshold of competencies in order to ensure that the national sovereignty of the Philippines remains intact, and is not limited nor shared. House version Santiago said that the

amendments the House ad hoc committee introduced in its version of the BBL draft failed to reconcile the bill with the Constitution, specifically on issues of sovereignty, autonomy, the creation of a sub-state, and territorial integrity. She questioned the enumeration of powers in the BBL draft. The House panel retained three types: Reserved powers reside only on the national government; concurrent powers are shared; while exclusive powers rest solely on the Bangsamoro government. “The concept of ‘concurrent powers’ and ‘exclusive powers’ tear asunder the supreme authority possessed by the sovereignty of the people. These will make the Bangsamoro government co-equal with the national government, and thus a subs-state,” the senator said. Santiago particularly opposed the extensive taxing and revenue raising pow-

The provision granting the Bangsamoro exclusive powers and use of natural resources found in the area also drew Santiago’s criticism. “Under constitutional language, nothing of value may be exclusively allocated to any territorial part of the

Philippine archipelago,” she said. The senator argued that although the BBL purports to be an exercise in local autonomy, “it bursts its bounds and turns into a part-sovereign state or a sub-state. The power of paper Paper still matters, as I could learn several years from then fellow Philippine Daily Inquirer staff writer Phyllis Korkki. Yes, paper still matters. The frequent whirring of printers in offices - despite the Internet, Microsoft Word, social media (I love Facebook and Twitter), scanners, smart phones applications and many much more - attest to that. I am very much old fashioned in many things. I was still typing on an old manual typewriter, when my colleagues in different publishing houses used already electric units. I loved my antique typewriter. I love it till today. Yes, it’s still here in my office in Davao City. I can’t use it anymore, because no more ribbons are available in the Philippines. It’s okay. My electric typewriter is also here. Just beside the manual unite. Those were the days, my love... . It has been sometimes at the end of the 1990’s. I worked as coordinating editor in an international publishing house in Berlin with branches in Amsterdam and New York. I still used

one of those wonderful electric type writers - and tried to avoid vehemently a personal computer. Already during that time I needed to hold paper in my hands. Paper, says the productivity expert David Allen, is “in your face”. I strongly agree with David. He said, “Its physical presence can be a goal to completing tasks, whereas computer files can easily be hidden and thus forgotten. I am also returning to paper planners for this very reason. Please, don’t smile at me, my dear readers! David Allen, the author of “Getting Things Done”, does much of his writing on a computer. So I do meanwhile. But, there are still times when writing with a fountain pen on a notepad. It allows “us” to get “our” heads in the right place. When I tried to learn more from David Allen, I really got surprised, that we have many things in common. Old fashioned or not? I don’t care. Here are some facts: Paper print outs serve an important function. For long texts, a print out can allow a reader to better

understand relationships between sections and writings. Paper handouts are still a presence at meetings partly because they are useful for taking notes. Reading a long document on paper rather than on a computer screen helps people “better understand the geography of the argument contained within, “said Richard H.R. I also strongly agree with Sellen, saying, that using more than one computer screen can be helpful for

all this cognitive juggling. But when workers are going back and forth between points in a longer document, it can be more efficient to read on paper. How about “e-reading a book”? A novel, a drama, whatever? What do you prefer, my dear reader? You wanna know my opinion? I am sure, you can imagine. Yes guys, I still need a book in my hands for my leisure reading. I need to feel the book as well as I need to smell a fresh-printed newspaper. Environment savers might start jelling at me now, though I am one of them. So, where is the edge and borderline? Paper can be indeed a luscious and beautiful thing - the way we savor fine food and wine, as Steve Leveen, co-founder and CEO of Levenger, said. People complain that writing by hand is slow (yes, I am really!), BUT that can be good for thinking and creating! Here we are again! Yes, it matters still: in defense of the power of paper! A visiting Harvard political scientist and book author invited here to speak in an investment summit was quoted by the Inquirer as saying that “the long legacy and enduring presence of ‘extractive’ political and economic institutions in the Philippines as reflected by patronage politics has been one of the key constraints to the country’s growth.” The observation is timely now that almost all of the citizens in this country are pre-occupied with politics the 2016 presidential elections being just in the horizon. In yesterday’s column I mentioned that the cultic type of politics adhered to in this country is blindsiding the great majority of the populace from properly vetting the presidential aspirants who among them is best qualified to lead the country out of the rotten state it is mired in. In the Philippines, more often than not, voters vote for a candidate not on the merits of his or her qualifications and ability to lead the country from the bondage of poverty towards fullness and abundance of life but

on what James Robinson, the Harvard-based political scientist, described as “highly clientelistic politics based on exchange of private goods for political support.” While the Philippines, according to Robinson in the Inquirer story, operates as a vibrant democracy, “it’s also a democracy where competition is not about public goods.” Robinson further observed that “the quality of democracy in the country was being hampered by the lack of political competition, resulting in vote-buying during elections, dynastic control and political patronage.” Robinson’s observations,

undeniably, finds truism in Philippine politics. In fact, what he said is what is ailing the country’s politics. And sadly up to this point Filipinos still have to grow toward political maturity. What exists here is some type of political cultism where voters vote for their chosen candidate solely based on the largesse the politician can shower his or her political worshippers. Take for example the arguments put forth by adherents of Davao City Mayor Rodrigo Duterte. They want him to replace President Aquino because of the iron-fist way he managed that southern Philippines city ridding it with hoodlums. If this is not political retrogression, I don’t know what is. But since his supporters worship him as if he is god who can’t commit any wrong, they root for him regardless of his track record of human rights violations in achieving his objectives. By the way, it is not totally true that Duterte had succeeded in freeing his city from any form of criminality. Criminality still exists in Davao City. All that Duterte

did so far is try his best in eliminating criminals from his city through summary executions, a matter he has not denied though he also has not admitted directly. The issue in Davao City is not Duterte’s ability to supposedly bring peace and order in his turf. It is the manner by which he made “peace and order” the hallmark of his administration. Local government heads should understand that in pursuing their avowed political objectives, peace and order in the case of Duterte, they should not run roughshod with the rule of law. Criminality can never be stamped out by employing legal short cuts such as summary executions of suspected criminals. Chiefs of local government units should understand that 80 to 90 percent of crimes against properties, and to a certain degree against persons, are committed as a result of economic deprivation commonly known as poverty. Cops kill suspected kidnapper

AMBOANGA City––Policemen have killed a suspected Abu Sayyaf gunman who may be involved in the spate of kidnappings in Malaysia’s oil-rich state of Sabah.

The gunman, who was initially identified as Muktadil, was fatally shot during a firefight late Wednesday afternoon in Jolo town in Sulu province following a police raid on his hideout. Muktadil was tr ying to escape from pursuing policemen when shot dead during a running gun battle. No policemen or civilians were killed or

injured in the fighting. Authorities were still trying to verify whether the slain rebel was among those that recently kidnapped Thien Nyuk Fun, 50, the manager of Ocean King Seafood Restaurant in Sabah’s Sandakan town; and customer Bernard Ghen Ted Fen, 39. Malaysian policemen said four gunmen raided the restaurant on the eve-

ning of May 14 and seized the duo. No individual or group claimed responsibility for the abductions, but authorities in Sabah have linked two siblings Nilson Muktadil, who is his 30s; and Badong, alias Adzmil Muktadil, in his 40s, to the latest abductions. The Muktadil brothers are natives of Southern Philippines and were also tagged as behind the kidnapping of Chinese tourist Gao Huayun, 29, and Filipino worker Marcy Dayawan, 40, in Sabah in April last year. EXPLORING the vocational track of K to 12 curriculum can be interesting. According to a survey, 70 percent of junior high school students in Cagayan de Oro want to pursue the vocational track. They are also aware that they cannot proceed immediately to college once they graduate from senior high except when they enroll in a vocational course. If they choose to enroll in what we call as a mainstream course, then they have to undergo a so-called bridging program of about one semester. Yet the call for a technical vocation is quite appealing in this country where the minimum wage is way below other

countries. Foreign countries are needing the technical skills of Filipinos abroad, more so that we are able to relatively speak English well over our other Asian neighbors. The vocational track consists of agriculture-fishery, home economics, information and communications technology, and industrial arts. Other tracks that a junior high school student may choose once he or she reaches Grade 11 will be academic; sports; arts and design. These are for students from well-off schools who arguably and understandably don’t have the facilities for a vocational track.

Learning is a crucial process where in order to be successful, appreciation should be there. It has been a long time concern of teachers on how to encourage learning appreciation among school children and attend regular classes. Lot of strategies has been done already but they still failed. Most students are still fond of making absences and some are habitual absentee. In our modern era where modern technology is at hand and our kids are surrounded by cellphones, computers, ipad and other modern gadgets, we need to consider our classroom settings. It is high time to create a wholesome classroom atmosphere where kids will be encouraged to go back to attend their classes.

First, teachers need to teach all his pupils the importance of values and relationships, like to care for each other in the class and allow them to understand the importance of loving and accepting the members of the class. Pupils can easily adopt to the environment if there is acceptance and affirmation in the group. Peace will also prevail in the class thus, quarreling will be avoided. Creating a positive atmosphere will also help to attract kids to come to school daily. The creation of a wholesome classroom environment is a challenge among educators, but truth be told, it starts with teacher. Handling a group of people armed with positive outlook and hope will result to something wholesome atmosphere.

Principals are busy people. It is important that they will take time to get to know the new teachers in their school and establish working relationships with them. F or example, by welcoming new teachers to the school, by maintaining an open-door policy, by being available for individual conferences, and attending to new teachers’ real and perceiving needs. The key is to facilitate a professional relationship between the novice and principal, as well as among peers all throughout the system. By doing so, he has to opens the door to deeper and more substantive conversations, as noted by one of the principal said: I’ll ask about their families. I’ll ask them about their kids. I develop a strong relationship with them. They know that I care about them as people. That relationship takes us a long way. It really opens the door for me to talk to them about superior

performance”. Thus, establishing a strong working relationships is particularly important when concerns arise about a new teacher’s performance. As one principal said: “When you have a comfortable relationship with a person, you can coach that person. There were several times that our pupils went to school without having breakfast, sometimes it result to poor performance in the class due to their stomach growling for food. In terms of school supplies, they can’t buy the required number of supplies needed for three reasons: (1) they have no fare to go to the city, (2) they have no money to buy, (3)the money they earned in cropping is enough only to buy for their food. Due to these problems, we asked help from different stakeholders to help us support these kids’ ultimate needs. CDO BLOGGERS visited

the school and interviewed the teachers as well as the School In-charge about the situation of our pupils and helped us seek help from private companies/stakeholders. Luckily, CDO bloggers, Four Pillars Paint Centre & General Merchandise and Palle Family heard our kids’ cries for these needs and gave their unwavering time and support by providing school supplies, bags and feeding program to our pupils. We are very much thankful for the help of these kindhearted people to our beloved pupils in Cadayonan Primary School. The Department of Social Welfare and Development will assess thousands of poor households for their inclusion to the database of the Listahanan – a system that identifies who and where the poor are in the country. On a recent “Talakayan” held by the Philippine Information Agency, the DSWD announced that about 793,989 households will be assessed in Northern Mindanao alone under its second round assessment. Atty. Araceli F. Solamillo, Regional Director of the DSWD said that the Listahanan database is currently being utilized by the majority of local government units in the region, congressional districts and even civil society groups, and non-government organizations, and that the database is their basis in identifying their beneficiaries for their social protection programs and social services.

In the first round of assessment in 2009 in the region, DSWD was able to identify 338,749 households as poor based on certain variables used during the household enumeration and validation. Most of these households under the Listahanan were able to avail various social protection programs from the national government, local government units, and other social service providers. The DSWD’s Pantawid Pamilyang Pilipino Program, the Social Pension, and other major anti-poverty programs also used Listahanan to identify qualified beneficiaries. A total of 2,505 field workers comprising of Area Coordinators, Area Supervisors, Enumerators, Encoders and Verfiiers will be hired and trained in preparation for the said assessment. Moreno, who was congressman of the first congressional district of Misamis Oriental from 1998 to 2004 said that the ARMM was destined to fail. “It was destined to fail. Why? Because it was passed under the president who succeeded the president under whose term the peace agreement was signed,” he said, referring to President Corazon Aquino and President Fidel Ramos. The ARMM was first created on August 1, 1989 through Republic Act No. 6734 (otherwise known as the Organic Act) in pursuance with a constitutional mandate to provide for an autonomous area in Muslim Mindanao. A plebiscite was held in the provinces of Basilan, Cotabato, Davao del Sur, Lanao del Norte, Lanao del Sur, Maguindanao, Palawan, South Cotabato, Sultan Kudarat, Sulu, Tawi-Tawi, Zamboanga del Norte and Zamboanga del Sur; and in the cities of Cotabato, Dapitan, Dipolog, General Santos, Koronadal, Iligan, Marawi, Pagadian, Puerto Princesa and Zamboanga to determine if their residents wished to be part of the ARMM. It will cover government employees today but there is nothing to prevent government from using the ID system on everyone,” Reyes said. Reyes said that the ID system can in the future become a requisite for all transactions with government offices. “And since many people need to transact with government, they have no choice but to acquire the multi-purpose ID. They can be compelled in the future. The administration is just testing the waters now with this limited implementation,” Reyes warned.
