Someone has put a claim in against me for damages, for an accident I know nothing about. It is from early 2010 and has been going on since then. I have been contesting it on the grounds I have not been involved in an incident, however the third party solicitors have issued County Court proceedings against me. My insurance company are saying they are putting in a defence and have provided a barrister. I am really annoyed with this as I know I haven't been in an accident. I could understand if maybe they were claiming I clipped them and I had done it without realising but they are claiming for an accident which I have no knowledge of! I have attended the Magistrate's Court hearing and although I pleaded not guilty I have been found guilty on the grounds that for the time and date of the accident I have no alibi, witness or other evidence to support my whereabouts. The other party has an independent witness who works for the same company and alleges she could recognise my car but not me as a driver. Mag court fined me and gave me 6 points on my licence. I am not working (and not in receipt of any benefits) and this CC claim amounts to 5k! How would I pay a sum like this??? Or would my insurance company pay out if I was found to be at fault ??? I used old vehicles, new vehicles, safe vehicles, unsafe vehicles, every kind of car/truck you could imagine and my projected rates are still through the roof. For example, for full coverage with the minimum amounts and highest deductibles, my insurance on a 2010 Mazda 3 would be about $1800-$2300 for 6 months. However, I also got a quote for a 1997 Ford Escort and the same exact coverage is still $1200-$1300. I don't get why my rates are so much higher.
