Race Heats Up for 2013 SLAR Officers The St. Louis Association of REALTORS’® annual election is heating up, with several members of the Association competing for key positions on the 2013 Board of Directors. This year’s election includes a noncontested race for Vice President/ Treasurer, Barb Keathley, The Seller’s Agent, Inc., and a contested race for President Elect. Vying for this position are SLAR members Elizabeth H. Braznell, RE/MAX Results, Barrett P. Upchurch (Barry), Barry Upchurch Realty. Other candidates seeking to

fill key positions on the 2013 Board of Directors include the following individuals. Biographies and photos were submitted by election candidates. During her real estate career she has actively provided board service at the local and state level serving on committees such as Budgeting, Strategic Planning, Equal Opportunity Cultural Diversity, Contracts and Forms and Urban Affairs. As a non-franchise broker, Gail is sensitive to the needs of real estate companies of all sizes. Kimberly Cameron: Kimberly has supported the St. Louis Association of REALTORS® by serving on and chairing committees including Communications, Education, Governmental Affairs, Membership and RPAC. She is in a leadership role for the Missouri Chapter of CRS and is a Missouri Association of REALTORS® State Director serving on two committees. In 2011 & 2012, Kimberly helped organize the free real estate technology training REBarCamp in St Louis. She has also been interviewed in The Residential Specialist (CRS) and Above Magazine (RE/MAX) for her real estate technology expertise. Over the years she has been with both an independent broker and the Prudential and RE/MAX franchises- achieving many sales awards in the process. More important is her volunteer work for local charities such as Susan G. Komen, Friends of Wings and Children’s Miracle Network. With a passion for REALTOR® education, you’ll get her commitment, experience and integrity to help the SLAR Board of Directors. Eric Friedman: President, Friedman Group, Ltd. a REALTOR® since 1988. Goals: a stronger REALTOR® organization, REALTOR® Party here and nationally and serving our members. Eric has served the St. Louis Association of REALTORS® as trustee on the Political Action Committee, and as past member of; the Professional Standards committee, Commercial Division Board, CCIM Board, as a co-founder and Chairman of the CIE and he co authored at $15,000 NAR Grant that SLAR received. Eric serves MAR on the Board of Directors, and a past Chair of the Economic Development Council and the Technology Committee. On the national level Eric serves as a Federal Political Coordinator working on Federal Legislation and previously on an Affordable Housing PAG, and co chaired an FPC taskforce. Eric is a founder of the Missouri Historic Tax Coalition and the St. Louis Transit Alliance, helping to build the economy of our region and state. Sandy Hancock: REALTORS® are the driving force behind real estate ownership. We deal with a multitude of issues and entities that continuously impact our ability to sell. The Board of Directors is responsible for representing our members in so many different areas and ways, so that we can continue to help our clients buy and sell property. My background includes selling residential & investment property and managing a real estate company. I have served on both the Contracts & Forms and Finance Committees for many years. In 2012, I was pleased to serve as President of the MARIS Board of Directors. The issues that we are facing in our industry require leadership and ingenuity. We must be financially responsible and look for new ways to provide our members the services they need. I will work on behalf of all our members and appreciate your support.

Gregory Haug: I am licensed as a Broker since 1990 and serve as member of the Governmental Affairs Committee and as vice chairman of the Arbitration Committee. I am 45 years old, married and have two children. I attend the Capital Conferences in Jefferson City to lobby for bills that supporting our mission as REALTORS®. I was elected to the Webster Groves City Council (1998-2002) and oversaw a $15M municipal budget along with legislative duties. I hold an associate in applied science degree in real estate from St. Louis Community College. I am attending Columbia College with 30 hours remaining on a bachelor degree in criminal justice. Since 2003, I serve as a municipal police officer recently awarded the “Chief’s Commendation for Valor” in reference to saving a man from burning car and successfully providing CPR. If elected, I’ll continue to embrace the REALTOR®’S Code of Ethics as my guide. Karl Hawkins serves on the Ethics and Professional Standards and Legal Action Committees, previously serving on the Grievance and Homeless Committees and is a practicing attorney. He attended Case Western Reserve University, Cleveland, Ohio (JD, MBA ‘02), and Webster University (BBA, MA ‘99) now focusing in the areas of real estate: representing REALTORS®, buyers, and sellers; and elder law: estate planning, probate administration, guardianships, and conservatorships. With his background in real estate and law Karl believes given the opportunity he has much to contribute to the real estate community. He also serves as Treasurer of the Scholarship Foundation of St. Louis which awards scholarships and grants to undergraduate students pursuing higher education awarding them in excess of $3 million in 2012. Mr. Hawkins is a member of the Missouri Bar and is admitted to practice in the Eastern District of Missouri. Tom Kennedy, An “old rule” Broker–Sales licensee since 2005, my previous (Prudential Alliance, REALTORS®) and current (Realty Trust Company) Broker Managers encouraged me to get involved in SLAR service suggesting that I would be a “natural”. Serving this year on the Member Services Committee, I am eligible now and encouraged to serve as a REALTOR® Director on the SLAR Board of Directors. With 7+ years of experience as Broker Salesperson and recent re-classification to Broker Associate and with 25+ years of additional experience in business, notably, including 4 years as Assistant to the Governing Board of a large St Louis-based health care system, I believe that my professional experience and perspective that governance service equals mission-focused policy approval and oversight and not micro-management intervention will serve the members of the St Louis Association of REALTORS® well. REALTOR® ASSOCIATE DIRECTOR (one position – 3 year term) ROBERT FREDERICK - I have actively served on the Governmental Affairs Committee for 5 plus years. With 10 years of real estate experience (10 as a landlord and 6 as a REALTOR®) I bring a practical perspective to our profession. My previous experience as a housing inspector has provided me with a unique understanding of how local governmental policies and ordinances impact our incomes and ability to serve our customers.

Open House Safety If you’re holding an open house, previewing the property increases your familiarity with the home, the area, enabling a higher level of service to potential buyers. But that same familiarity provides an opportunity to devise and implement a safety plan, which increases safety for you, your clients, and people attending the showing. These safety tips are primarily for holding an open house, but you may find them helpful for any showing appointment.

Knock on doors of the houses on either side and across the street from the property and introduce yourself, identify your car, and let them know when you’ll be showing the property. When you hold an open house, perform a pre-inspection on the property to eliminate any surprises. • Check your cell phone reception. • Verify operation of the lockbox. • Determine where you’ll park. Select a place where you won’t get blocked in. • Look for any potentially dangerous animals. • Walk the perimeter of the house. • Notice the type of fence. Is there a gate? Is it locked? Are there holes in the fence? • Look at the shrubs. Do they provide a hiding place for someone? • Be familiar with the garage door operation. • Look for anything that seems amiss.

Don’t forget the basics If you’re showing a home in the evening, consider outside and street lighting when selecting your parking location. Also, be sure to tell several people where you’ll be (e.g., broker, spouse, friend, another agent).

Meet the neighbors Take time before the open house to meet the neighbors. They’ll be curious about a house for sale on their

For example, if you and a buyer approach a home via a dark walkway and he suggests that you lead the way, you can remark, “Hey, take a look at the new garage. According to the owners, they had it renovated last month.” While he’s checking out the garage, you can negotiate the walkway, unlock the lockbox, and open the front door. By the time he returns or again focuses his attention on you, you’re standing in the home’s doorway and facing him.

Don’t let your focus on a potential sale or a hurried schedule distract you from being safe. Always be aware of your surroundings and develop a plan, just in case something goes wrong.

Do you know where your personal information is going? By Dawn M. Kennedy, SLAR CEO

As a REALTOR®, a public presence is pretty much required. However, protecting your personal information can mean the difference between success or getting scammed. It is important to periodically check your privacy settings on Facebook. As Facebook makes changes to its external features it will often make internal changes as well. This means more of your information may be being released than you are aware of. Facebook makes the majority of its money through advertising but that advertising revenue includes indirectly selling your personal information. According to MSN Money Magazine (2012), Facebook uses the information it gathers about you to create advertising revenue, "but even more important, the fact that it can target ads with "relevance," based on all the personal information users decide to share. Perhaps more interesting, Facebook can target ads with "social context" -- which means highlighting users’ friends connections with a brand or business. And people are much more likely to respond favorably to a message if they know a friend has endorsed the brand or just "checked in" at a store". Although Facebook discloses its use of your information others may not. Reviewing your privacy settings is not difficult however Facebook has updated this feature. Here are some of the basics: On your home page when you login to Facebook click the arrow on the upper right next to the word "home". A drop down box will appear with selections, choose "privacy settings" by clicking on it. You may also want to edit your basic info to make sure you are not sharing too much with strangers. Simply select the audience you want to share this information with. The icons to the left indicate who you are sharing your personal information with and you can customize this as well. In the

example the person is sharing basic info with all her friends except friends in her Castle Age group.

Facebook now has an inline audience selector, within each post you can control who may view the post and you can even revoke view privileges for the post after you post it. The audience selector is next to each post you make; it’s not on a separate settings page. The tool remembers the audience you shared with the last time you posted something and uses the same audience when you share again unless you change it. From the Facebook help pages (2012) the following icon diagram may be useful in determining who can view a post: The audience selector lets you choose a specific audience, every time you share. Your options include: "Public: When you share something with Public that means anyone on the internet has permission to see it. You should only use this setting for information that you’re comfortable making publicly available. The audience for these posts could include people who are not your friends on Facebook, and people who are not in your school or work networks. Friends of Friends: This option is available for minors only as the maximum audience they can share with. It allows minors to share with friends and their friends. Friends (+ friends of anyone tagged): This option lets you post stuff to your friends on Facebook. If anyone else is tagged in a post, then the audience expands to also include the tagged person and their friends.

Only Me: This option allows you to post stuff to your timeline that is visible only to you. Posts with the audience of Only Me will appear in your news feed but not your friends’ news feeds. If you tag someone in an Only Me post, they will be able to see the post. Custom: When you choose Custom, you can selectively share something with specific people, or hide it from specific people. You can also share with specific friend lists if you’ve set them up, such as Family or Best Friends, or hide posts from your Co-Workers list. Custom also provides the option to share with groups or networks belong to. Or you can make content completely private to Only Me, meaning only you can see the post."

From around the industry…. First off, I would like to thank Dawn Kennedy and the St. Louis Association of REALTORS® for inviting me, as Chairman of the St. Louis Industry Forum, to share some of the issues, concerns, and useful information brought to our forum by its members, with our REALTOR® community. The St. Louis Industry Forum is a forum that has been hosted by the St. Louis Association of REALTORS® for more than 20 years and meets bi-monthly. The forum is made up of representatives of professional and trade associations that are engaged in some aspect of the real estate industry in St. Louis. Currently there are about 17 professional associations that are part of the forum. The forum was chaired for 15 years by Greg Vatterott, and then, in 2007 Greg retired and I was elected.

This month’s "hot" topics from the forum include: 1. The "Mortgage Foreclosure Intervention Code", proposed to the St. Louis County Council (bill #174) by Hazel Erby which would impose fees and additional requirements

on lenders before they would be allowed to proceed with a foreclosure. Cathy Vogt and the MBA has been very active in fighting this bill as has SLAR. The concerns raised at the forum about this bill and why it would be a negative blow to the real estate industry include the addition of more regulation to an already over-regulated industry which could result in lenders increasing the cost of loans in St. Louis County to offset the additional costs they will include as a result. 2. Changes to the HUD1 by the Consumer Financial Protection Bureau as a result of the Dodd-Frank Act. Wendy Cromer of the Missouri Land Title Association, said her association is very concerned about the changes to the HUD1 which would include organizing the data on the form alphabetically rather than in the numbered sections as is a standard presently. Among other issues is the fact that this will result of costly changes to software and systems in the industry.

Legislative Report REALTOR® Safety Month-The Sovereign Citizen and other False Deed Claims Be on the look-out for schemes which involve mysterious individuals claiming to have a deed to one of your listings. Typically the fraudsters seek out vacant property. They may call and request that you meet them at the property to remove your sign and turn over the house keys to them, citing a deed which shows them to be the new owner as a sovereign citizen authorized by a fictitious group. Or they may bypass you altogether and list the house for rent on craigslist or other online marketplace. They will then collect first and last month’s rent and a security deposit from an unsuspecting tenant, never to be heard from again. Once the tenant is in place with a signed lease, it becomes a civil matter, resulting in many headaches for the property’s rightful owner. There are other variations on the theme, but if you are faced with a situation such as this, always remember, SAFETY FIRST: • Never meet a stranger alone at a property. • Involve your broker if you encounter any strange requests or situations involving your listings/buyers/ tenants. • Don’t be afraid to involve the police. Chances are you aren’t the only person who’s been faced with this situation.

Webster Groves Rejects Vacant Building Registration - Decides on Bi-annual Safety Inspections Instead At the urging of SLAR, Webster Groves council members voted down final passage of Commercial Vacant Building Registration in their city. Instead, the council chose the route of bi-annual health and safety inspections of vacant commercial property, citing concerns with long-vacant properties as safety hazards to adjacent businesses. SLAR, supported by research from Association Counsel Steve Murphy and NAR, along with the Missouri Growth Association, individual Commercial REALTORS® and business owners, raised strong objections to the original bill, initially proposed in December, 2011. Through letters and testimony at several council meetings, SLAR was able to convince the council that registration of

vacant buildings and forced marketing of those buildings by the city were not business-friendly actions, nor were they likely to produce the desired results of putting long-vacant buildings back into productive use. The current proposal will be up for final passage on September 4 and will require owners of vacant commercial buildings to allow the city to inspect the interior of the building if it has been vacant for at least 365 days. The owner will then be responsible for repairing any health or safety violations. Once the building passes inspection, the owner will receive a Certificate of LifeSafety, valid for two years. The ordinance will include several exemptions, including a one-year reprieve for property that is being actively marketed for sale or lease. While SLAR did not specifically support the periodic inspection bill, the most egregious portions of the registration proposal are completely missing from the inspection ordinance as a result of our efforts.

St. Louis County Passes Foreclosure Mediation On August 28, the St. Louis County Council passed a measure which will require mortgage servicers to offer supervised mediation to any homeowner facing foreclosure. Working with the Missouri Bankers Association, the Missouri Mortgage Bankers Association, the Missouri Land Title Association and the Home Builders

Legislative Report continued from page 23 Association of St. Louis, SLAR worked to convince the Council that imposing additional lending regulations in St. Louis County will have a detrimental effect on future home mortgage lending in the County. This ordinance increases risk to lenders. Increased risk = increased loan costs to consumers. Whether in the form of higher application fees, higher interest rates or more stringent lending standards, SLAR’s opinion is that fees and fines imposed on lenders by the county will be passed along to consumers, resulting in a smaller buyer pool, and hurting the recovery of the housing market. In summary, servicers will be required to send a Notice of Mediation along with any Intent to Foreclose letter. At that time, lenders would pay $150 for a mediator to contact the homeowner 3 times in the 30 days following the Notice. If the homeowner chooses mediation, the lender would then be required to pay an additional $350 for the mediation itself, which must take place within 60 of the original Intent to Foreclose. If the lender ignores

the ordinance and forecloses without offering mediation, the County will fine the lender $1000. The entire ordinance is available here.

Law & Ethics Protect Your Online Business Identity Protecting your identity is more than just securing your personal information; your business has an identity too. The REALTOR® Code of Ethics helps the member through providing a means to protect the online business identity. Article 12 has been updated several times in the last few years to reflect the rapidly changing Internet technologies, in 2001, 2008 and most recently in 2011. It is likely that it will change again as technology continues to evolve. This is the benefit of our Code of Ethics, it is a living document. The REALTOR® Code of Ethics Case interpretations explain how Article 12 protects your online business identity. From the 2012 Code of Ethics and Arbitration Manual:

Case #12-17: Use of Deceptive Domain Name/URL (“Uniform Resource Locator”) (Adopted May, 2001.) REALTOR® X, a principal broker in the firm XYZ, was technologically savvy and constantly looking for ways to use the Internet to promote his firm and drive additional traffic to his website. Being an early adapter to the Internet, he had registered, but not used, domain names that incorporated or played on the names of many of his competitors and their firms, including ABC, REALTORS®. REALTOR® X and his information technology staff concluded that one way to drive traffic to the firm’s website would be to take advantage of the search engines commonly used by potential buyers and sellers. They realized that when potential buyers or sellers searched on key words like “real estate” or “REALTORS®” or on similar words, lists of domain names would appear, and that when consumers searched the Internet for ABC, REALTORS®, one of the domain names that might appear would be REALTOR® X’s domain name, abcREALTORS.com. REALTOR® X decided to take advantage of the domain names that he had previously registered, and

pointed several that used, in various ways, the names of his competitors, including “abcREALTORs.com,” to his site. In a matter of days, REALTOR® X learned that he had been charged with a violation of Article 12 of the Code of Ethics by REALTOR® A, the owner of ABC, REALTORS® , alleging that his (REALTOR® X’s) use of the domain name “abcREALTORS.com” presented a false picture to potential buyers and sellers and others on the Internet. At the hearing, REALTOR® X defended himself indicating that, in his opinion, use of a domain name was not advertising or a “representation” to the public but simply a convenient way for Internet users to find relevant websites. Moreover, “When websurfers reach my home page, there is no question that it is my site since I clearly show XYZ’s name and our status as REALTORS®,” he continued. “These complaints are just a lot of sour grapes from dinosaurs who aren’t keeping up and who don’t realize that on the Internet it’s ‘every man for himself.’ ” The Hearing Panel disagreed with REALTOR® X’s justification, indicating that while his use of a domain name that employed another firm’s name might not be precluded by law or regulation, it did not comply with the Code’s higher duty to present a “true picture.” REALTOR® X was found in violation of Article 12, presenting an untrue picture in his representation to the public.
