President’s Message Welcome to our New Association Executive During the past 90 days, our Association has conducted an extensive search to find just the right person to serve as our association’s chief executive. I am pleased to announce that on May 7, Dawn M. Kennedy will take the helm as CEO of the St. Louis Association of Realtors®.

Dawn comes to us with considerable Realtor® Association experience. Since 2007, she has served as the CEO of the Oklahoma City Metropolitan Association of REALTORS® and EVP of the regional MLS. Prior to that, she served as executive director for the Northwoods Association of REALTORS® in Wisconsin. An Illinois native, Dawn holds a Masters from the University of Wisconsin-Platteville and a BS in business administration from Franklin University. She is currently pursuing her PhD in Business and Technology-Organizational Management, and holds the RCE, e-PRO® and Green designations from NAR. Those who’ve worked with Dawn describe her as energetic, forward-looking, tech-savvy and member-focused. She is well-respected by her peers throughout the Realtor® Association network. She will, incidentally, be the first woman to serve as CEO of the St. Louis Association of Realtors® in our 135-year history. I know our members join me in extending to Dawn and her family a warm St. Louis welcome.

New Contingent Info Choice A new selection is being added to the “Contingent Information” field. This field can be found on the screen used to put listings in the Contingent status. The new choice, “Awaiting Signature”,will be used to describe a verbally accepted contract and can be se¬lected when moving a listing to one of the contingent statuses. It can be selected along with other contingencies.
The purpose of the new selection is to facilitate notification be¬tween agents that a contract has been verbally accepted and the listing agent is awaiting delivery of the appropriate documenta¬tion. Legislative Report Judge’s Ruling May Keep “Everything Tax” off the November Ballot A court ruling issued Friday, April 13, makes it unlikely that a proposed overhaul of Missouri’s tax system will be on the November 2012 ballot. A statement from Missourians for Fair Taxation, a coalition headed by the Missouri Association of REALTORS®, said that Cole County Circuit Judge Patricia S. Joyce ordered Missouri State Auditor Tom Schweich to prepare new voter information about the negative financial impact of the proposed “Everything Tax.” In her ruling, Judge Joyce wrote: “In both the Fiscal Notes and the Fiscal Note Summaries, the Auditor is not informing proposed signers and voters of the true fiscal impact of the measure in an unbiased fashion. The negative impact of the Initiative Petitions could be as much as $7.5 billion, a fact which the Fiscal Notes and Fiscal Note summaries do not include. Indeed, the Auditor incorrectly advises that the negative impact will be limited to $3 billion (in the Fiscal Notes) or $1.5 billion (in the Fiscal Note Summaries). These are significant variations. The Fiscal Notes and the Fiscal Note Summaries are therefore insufficient, unfair and prejudicial.” “Judge Joyce’s crystal-clear decision is a complete victory for opponents of the ‘Everything Tax’,” said Chuck Hatfield, attorney for Missourians for Fair Taxation, which successfully challenged the ballot language in court. “Judge Joyce agreed with the arguments of Missourians for Fair Taxation that the language being presented to voters is insufficient, unfair, and likely to deceive petition signers and voters.” Missourians for Fair Taxation (MFT) is a statewide nonpartisan, non-profit coalition established to inform citizens about the devastating effects the “Everything Tax” would have on our hometown neighbors, our state and our economy. The Missouri Association of REALTORS®, whose 18,000 members comprise one of the state’s largest professional trade associations, launched the
coalition after leading the successful 2010 campaign for Amendment 3. Nearly 84 percent of Missouri voters approved Amendment 3 to exempt sales of homes and business properties from the sort of massive sales tax schemes that inspired the “Everything Tax.” MFT has led opposition to the “Everything Tax” in the courts, in budget impact research, in media coverage and in uniting influential statewide coalition partners, including the Missouri Broadcasters Association, the Missouri Budget Project, the Missouri Health Care Association, the Missouri Municipal League, Missouri Outdoor Advertising Association and the Missouri Society of Certified Public Accountants. National Mortgage Settlement and REALTORS®: 5 Quick Takeaways On Monday, March 12, 2012, the federal government released details of the $25 billion national mortgage settlement stemming from improper foreclosures and other deceptive practices in the origination and servicing of mortgages. The agreement with Bank of America, JPMorgan Chase, Wells Fargo, Citigroup, and Ally Financial (formerly GMAC) is designed to provide eligible homeowners

with relief as well as prevent future abuses. Along with billions of dollars of relief for homeowners, the servicers are required to implement across the board servicing standards meant to improve borrower communication and provide servicing consistency among five of the largest servicers. NAR has advocated for many of the servicing standards addressed in the settlement. These standards will help keep families in their homes and, if that is not possible, will assist in streamlining the short sale and other loss mitigation processes. To visit the website dedicated to the settlement, click here. Here are the five initial takeaways from the settlement that will impact real estate transactions: 1. Short Sale Timeline. The settlement contains short sale standards that are similar to the Treasury Department’s Home Affordable Foreclosure Alternative, or HAFA, program. A number of these standards will improve the short sale process including making short sale requirements publicly available, development of co-op programs to evaluate short sales prior to marketing the home, and the implementation of a 30-day response requirement after receipt of all required information and third party consents. 2. No Dual Tracking. As part of the settlement, the five servicers will no longer be able to proceed with a foreclosure sale if a short sale or deed-in-lieu of foreclosure has been approved by all parties (first lien investor, junior lien holder, and mortgage insurer, as applicable) and proof of funds or financing has been provided to the servicer. Servicers will also face strict foreclosure referral guidelines if borrowers have requested a loan modification. 3. Single Point of Contact. NAR has long called on servicers to establish a single point of contact for borrowers. This provision will not only assist in maintaining consistency and coordination of loss mitigation options, but will reduce the amount of time agents and brokers spend discussing individual short sale files with new negotiators. 4. Establishment of a Loan Portal. Though processes have recently improved, many members report that lost documents requiring multiple submissions continue to cause delays. The five servicers have agreed to consolidate information for borrowers by developing online loan portals that will provide borrowers with access to information, eligibility factors for loss mitigation programs, and inform borrowers of required documentation that is missing.

Strong Enforcement Mechanism. The success of a number of well-intentioned programs has been hampered by voluntary servicer participation and a seeming lack of compliance oversight. The five national banks party to the settlement will be required to regularly report compliance to an independent, outside monitor that reports to the state attorneys general. State attorneys general and the U.S. Department of Justice can seek redress if the banks don’t follow the settlement terms.
SLAR Brings International Walkability Expert Dan Burden to St. Louis The St. Louis Association of REALTORS® (SLAR) along with the National Association of REALTORS® (NAR) recently partnered with the St. Louis Federal Reserve Bank on an insightful, informative program, “Livability and Jobs: Exploring Innovation 2012”. The return to St. Louis of internationally renowned walkability expert Dan Burden was sponsored by SLAR and Housing and Community Solutions Inc., who received a Smart Growth Grant from NAR, which will allow Mr. Burden, (who is executive director of the Walkable and Livable Communities Institute in Port Townsend, WA), to continue his work in walkability on a regional level. Along with Mr. Burden, the conference featured two other nationally known experts on the topic of livable communities: Robert McNulty, president and CEO, Partners for Livable Communities, and Andre Pettigrew, executive director, Climate Prosperity Project, both out of Washington, D.C. The conference, which was part of the St. Louis Fed’s “Exploring Innovation in Community Development Week,” focused on the growing importance of livabillty - the sum of factors that make up a community’s quality of life - in crucial areas such as job creation and economic competitiveness. A panel discussion was part of the event and two of the local experts who participated were 2011 SLAR President Nate Johnson and SLAR Commercial Division member Eric Friedman, President, Housing and Community Solutions, St. Louis & Friedman Group, Ltd. Participate in a Walkability Workshop, June 28-29 As part of the $15,000 NAR Smart Growth Grant received by SLAR and Housing and Community Solutions, Dan Burden will be returning to St. Louis June 28-29, 2012, in order to conduct walkability workshops in the City of St. Louis and University City. The event will include a walking audit of two neighborhoods where residents, community leaders, government officials and other stakeholders will actually walk through the neighborhoods surveying how friendly the neighborhood is to pedestrians, bikers, etc. Then, Mr. Burden will conduct workshops with elected officials and city staff to discuss what improvements can be made, usually with minimal investment. Dan Burden first visited the 26th Ward of St. Louis in May, 2011, through EPA’s Sustainable Building Blocks Technical Assistance Award, which was won by Housing and Community Solutions, Inc. Eric Friedman, REALTOR® and President of H&CS, applied for the award after attending the New Partners for Smart Growth Conference, which is sponsored by the National Association of REALTORS®, in February, 2011. Urban Affairs Visits the 14th Ward On April 5, 2012, the Urban Affairs Forum enjoyed a great breakfast meeting at the Taft St. Restaurant and Bar in Alderwoman Carol Howard’s 14th Ward. Topics discussed included development opportunities in the ward, issues with problem properties and navigating the permitting process in the city. Eric Friedman also gave an update on the walkability and smart growth program that SLAR is working on in conjunction with NAR. In addition, Mr. Sadic Kukic, owner of the Taft St. Restaurant told his story of how he became involved in the 14th Ward and in building a business there. RPAC Trivia Night Full of “March Madness”!
Oklahoma City Metropolitan Association of REALTORS, ® is already an RPAC Major Investor and a Cardinal fan! She also proved herself to be a worthy opponent in Trivia!
Oh Baby! There were plenty of diaper dandies, windex men and tall trees at the 2012 RPAC Trivia Night March Madness! On March 30, over 200 RPAC Fans filled the SLAR classrooms for an evening of Final Four fun. Members showed their school spirit with tables representing Mizzou, Kentucky, Kansas, and others. Larry Bird even made an appearance! The competition was tough, but when the bracket was completed, Carolyn Mantia’s team came away with the Best Decorated Table prize for the second year in a row with their “Rock Chalk This, Mr. Jayhawk” themed table, all members being dressed in Mizzou attire, of course. Barb Keathley, dressed as a SLU Billikens Fan/Cheerleader, also enjoyed a big win as she walked away with the Best Dressed prize. Also winning back-to-back championships was the Carole Baras Team, who came in with a score of 98/100, celebrating their “One Shining Moment” with $25 gift cards for each member of their team. The runner up this year was the Dielmann Sotheby’s team, led by Andy Dielmann. Two teams, who may need to be part of the play-in round next year, tied for last place - WCR and Keller Williams Southwest. They were rewarded with boxes of Ding Dongs! Excellent categories and questions devised by Trivia Master and SLAR member Marc Levinson kept the evening fun and the members on their toes.

Missouri Real Estate Commission (MREC) and St. Louis Association of REALTORS (SLAR) Continuing Education Rules and Regulations Students must sign the course sign-in sheet located at the registration table. If a student is not signed-in he/she is not considered present for the class. Students must be signed-in for attendance to be considered valid for CE purposes. Students must be signed–in and seated in the classroom when the class begins. Students arriving late will not be allowed to enter the classroom and must pay for another course. Traffic conditions will NOT exempt students from this rule Students must submit written notice to the Education Department at least 24 hours in advance of a scheduled class to transfer to another class at no additional charge or receive a refund. Continuing education requirements mandate 100% attendance during Continuing Education classes. Even the loss of 1 minute of class time will result in loss of C.E. credit! No exceptions. There will be one (1) ten (10) minute break each hour. This is the only time students may leave the classroom. All business and personal issues must be handled during break times. Receiving or making phone calls or text messaging will only be permitted during break time. Cell phones must be silenced and put away during class. Continuing Education certificates must be picked up immediately at the end of class at the registration table (certificates may be mailed within 5 business days to walk-ins). Students should file certificates in a safe place, as they may be requested by the MREC. The cost of a certificate reprint is $10.00. Anyone sending a substitute to a class will be turned over to the Missouri Real Estate Commission as a violation of the Missouri Real Estate License Law for whatever action the commission deems necessary. Students may not engage in work, outside reading material, or any non-course related activities during class. Students found to be doing this will be warned to discontinue or be removed from the classroom. If a student disruptive or does not follow the CE Rules and Regulations, they will be removed from the classroom and no continuing education credit or refund will be issued. Note: For your comfort, please bring a jacket or sweater as the classroom temperature may vary.

Every 4 years all REALTORS® are required to complete Code of Ethics Training! Code of Ethics Training is due by December 31st, 2012 Ours Ethics courses will satisfy the NAR (National Association of REALTORS®) requirement and they will also satisfy 3 hours of Missouri Elective Continuing Education credit This requirement is completely separate of the Missouri Real Estate Commission (MREC) Continuing Education requirements. The MREC does not mandate Ethics. Finally for those that need the Ethics course - SLAR offers courses that will satisfy 3 hours of elective credit AND also satisfy the NAR requirement.
