Baseline Survey Findings

The European Union funded baseline survey in 15 counties in Kenya was conducted by Partners in Literacy (PALM) and IDAY in 2015 with an aim of contributing to ending violence against child domestic workers through education. Key Findings from the survey Most of the child domestic workers (84.5%) are between 14-17 years. - 48.8% of all domestic workers are between ages 18-25. - 76.1% still earn less than the gazetted minimum wage of Ksh. 10,954 per month. - Majority (69.9%) reported that they did not know where to report mistreatment. - 32 % of all domestic workers complained of long working hours. - 86% would like to go back to school or training.

- Kenya legislation has domesticated most of the international conventions on child labour.

The authorities in charge of enforcement rarely apply the legislation possibly because of inadequate social and political commitment.

- Constitution of Kenya 2010 gurantees children right to education.

Recommendations

- The Children Act 2001 guarantees children protection from exploitation.

- Kenya ratifies the ILO Convention 189 on decent work for domestic workers.

- Sexual Act 2007 prohibits child sexual exploitation & pornography.

- Education and training needs for young domestic workers be addressed urgently.

- Basic Education Act 2013 makes criminal any labour activity that prevents school attendance for children.

- Professional training in domestic work is a viable option for the youth.

- National Child Policy (Draft) protects children from all forms of labour.

- Reporting, rescue and rehabilitation systems for child domestic workers be strengthened.

- The employment Act 2007 sets the minimum age for employment at 16 years.

- All stakeholders target areas with many children in domestic work for intervention.

- Counter-Trafficking in Persons Act 2010: forbids child labour, detention and sexual exploitation.
