In order to participate in bidding, each attendee/bidder must agree to the rules and conditions present before the silent and live auctions. By completing your registration for the event, you are stating that you do agree to the rules and conditions. All bids and sales are final and subject to the terms and conditions stipulated by the donor. No refunds or exchanges on auction items are permitted. All items have been donated to the French-American School of New York and are sold by the school and not the donor. All auction items and service dates and times are to be arranged at the mutual convenience of donor and buyer if stipulated. Restaurant donations do not include tax, gratuity, or liquor, unless specifically stated. The French-American School of New York warrants neither the quality nor the value of items and services auctioned. Descriptions of items have been made with every reasonable effort to be accurate, but all items are sold “as is” and “where is” and without warranty or representation of any kind to the correctness of the description, genuineness, authenticity, condition or quality of fitness for any purpose. Dollar values are estimates provided by the donor and are not warranted by the French-American School of New York for tax purposes or fair market value. Each person bidding assumes all risks and hazards related to the auction and items obtained at the auction. Each bidder agrees to hold harmless from any liability arising indirectly from the French America School of New York, elected and appointed officials, members and employees, the auctioneer, the auction company and its agents and employees , sponsors/donors, and/or volunteers connected to the auction.By participating in this auction, each bidder recognizes that the French-American School of New York, the donor of the property or services, or anyone assisting in the auction, shall not be liable for any occurrence resulting from the use of auctioned items and services sold. The French American School of New York does not warrant auction items to be free from defect in material or workmanship and expressly disclaims the same. The French American School of New York assumes no liability for any claims, damages, and/or losses resulting from possession or use of auctioned items. The amount paid by a successful bidder that may be deductible for tax purposes is limited to the excess of that amount over the fair market value of the package. The French-American School of New York is not permitted, by law, to place a value on auction items. The purchaser will be liable for damage to vacation homes and/or property.

Payment for auction items must be made in full by credit card, cash, check, or electronic fund transfer. All bidders must provide a credit card number at registration to obtain a bidding number. All purchases will be charged to this credit card at the close of the Gala. Credit/Debit card payments will be processed in US dollars. If you wish to pay by check or cash, please arrange this method of payment at the checkout table before leaving the Gala. A bid is a legal contract to purchase an item. No lot will be sold for less than the minimum bid. Minimum bid increments should be made in accordance with the automated auction software system used. The highest bidder for any item becomes the purchaser, at the full amount of the successful bid. No bids will be accepted after the close of the auction. The auction winner must pick up, or arrange for pickup of items won in the silent and live auctions by June 30, 2022. Any items unclaimed by June 30, 2022 become the property of the French-American School of New York and no refund will be given. Shipping/handling of winner’s items/packages is not included in the bid price. The French-American School of New York reserves the right to attach fees for the shipment/delivery of items not picked up by auction winners. The French-American School of New York reserves the right to withdraw any item at any time before the actual sale of the auction item(s). Limitations and expiration dates on certificates, vouchers, and other offers of goods and services are stipulated by the donor. Unless otherwise stated, all auction items and services must be used no later than the expiration date specified. Some items are subject to limitations/restrictions listed in the catalogue and/or on the gift certificates. Hotel, theater, and restaurant items are subject to space availability and may be subject to “blackout” dates. In case of discrepancy, neither the French-American School of New York, nor the donor, is obligated to make amendments or changes to the dates stipulated on the prize. If no time limit is specified in the items description, the item is valid for use for one year from the date of the Gala. LIVE AUCTION ONLY: The highest bidder acknowledged by the auctioneer shall be the purchaser. The auctioneer shall have sole and final authority to re-offer and resell an article in the event of a dispute.
