Return to New Zealand: Travels on the South Island by Gene Southard
Are there more curves on the South Island of New Zealand than on the North Island? I decided to do an unofficial survey this year. I packed my suitcase and jumped on a plane for a return trip. My BMW F650GS has been in storage in Auckland at my friend’s (Henry) place. I planned a four-day layover in Los Angeles to visit my niece and her husband. Well, the visit was really a chance to ride in their new Tesla that had arrived since my last visit. This was my first ride in a fully autonomous automobile. Traveling down the LA freeway, which is scary enough with hands on the wheel or feet on the pedals, felt unsafe at first. This electric automobile
makes my electric Zero motorcycle look very basic. In NZ, my friend Dan traveled with me on part of my trip. We had planned on meeting up in Auckland but a large snow storm had Dan stranded in O’Hare and he was running a couple of days behind me. Henry picked me up at the airport and had the Beemer ready to go. I had forgotten how challenging it is to fit all the gear for a two-month trip in my saddlebags and tankbag. My route to the South Island took me along the West coast of the North Island with a stop to visit friends that I made last year. The first stop was Thundercross Valley MX
Park to visit James and Mandy. That four-day stay was spent getting the BMW safety inspected, called Warranty of Fitness in NZ, and purchasing two months worth of registration. In NZ, you can purchase your registration by the month. I wish you could do that in the US. Although the front tire had passed inspection, it was looking a little worn so a new tire was in order. Traveling back roads, the next stop was Kaphia and a visit with Gary at Forest View Campground. Gary’s marriage had ended last year

Fault Lines: Comparative Negligence Litigating Contested Liability Motorcycle Crashes by Jason Waechter, Esq. I have, perhaps, litigated more motorcycle injury and wrongful death accident cases than any other individual attorney in the state of Michigan. In my experience, defense attorneys will do just about anything to point the finger at the motorcycle victim, hoping to escape or reduce the likelihood of their client having to pay fair compensation, if any at all. There is a type of defense behind this logic, which is based on a legal doctrine called comparative negligence. When this type of defense is used, a jury would need to assign a percentage of fault (negligence), as it relates to the drivers involved in the crash. In much of my practice, that would typically mean the driver of the car and the rider of the motorcycle. For every percent of negligence placed on the motorcyclist, the corresponding amount is subtracted from the damages awarded. In other words, the more they can fault the motorcyclist, the less they are required to pay.

We have found that many believe most motorcyclists to be behind the eight ball from the start. Some even feel that, just by riding a motorcycle, getting injured in a crash “comes with the territory”. It is important to note, skipping the helmet is a matter that brings consistently strong feedback from the laypeople we have encountered: the consensus is that it is not smart, and would cause them to assign comparative negligence, if there was any injury involving the motorcyclist’s head.

A common crash scenario occurs at an intersection when the defendant driver (in a car) turns left, directly in front of a motorcyclist coming from the opposite direction who has the right-ofway. to focus on that, and they will typically try almost anything to make it appear that the motorcyclist was speeding. I have also seen three separate cases where the defendant driver has pulled to the right side of the road, with their passenger tires over the white fog-line on the right. In each case, the motorcyclist did what he thought was reasonable — he started the pass. Unfortunately, in each of these three cases, after moving to the right and off the road a little bit, the car whipped left, making a left turn or U-turn. Here too, defense tried to blame the motorcyclist. Each of the car drivers claimed to have had their left turn signal on. One of my questions to them was, “Why on God’s green earth would any motorcyclist pass you on the left, when you had your left blinker on indicating you would be turning into him?”
Setting an Example The people that sit as jurors are just like everyone else, they have biases, prejudices and opinions. We all do. It’s part of what makes us human. Unfortunately, most laypeople’s biases held towards motorcyclists lean more toward negative. One thing we can do to combat these assumptions is to be able to say the motorcyclist is a safe and experienced rider. Take a motorcycle safety class and practice by taking a riding skills class. Be sure to have a motorcycle endorsement on your driver’s license, always wear the appropriate safety gear, and do what you can to make your motorcycle more visible (bright colors, bright lights, etc). If you take the initiative and obtain solid riding experience, it will be easier for your attorney to argue that you are a safe and experienced motorcycle rider. The plaintiff rests.

Continued from page 6 - New Zealand so this year he was shopping for a mail-order bride. There aren’t a lot of available women in rural NZ. Dan and I met up at the next stop—the hostel in Te Kuiti. We then rode a short distance to visit Nigel and Helen at the Beez Neez Hostel in Upper Atimura on Hwy 1. Rain followed us to National Park Village but the skies cleared on the following day’s ride to Bulls. A detour at Raetihi gave us 50km of curves to Upokongo along the Whanganui River with a stop at the St Joseph Nunnery. One of the best rides I have done on the North Island. We had received an invitation to visit the Thomson Motorcycle Museum just outside of Bulls. Peter and his wife are second generation caretakers of 150 unrestored motorcycles from the 20s to the 70s. Over tea and scones, Peter talked about his many years collecting vintage motorcycles. I was in awe of his extensive library of books and literature on vintage machinery. He is the go-to guy in NZ for finding what your vintage machine should look like. I could do a complete story on this out-of-the-way museum. We had a three-day layover at an old US Marine barracks just outside Wellington to let thypoon Gita pass. The break gave us time to visit the Southward Auto and Motorcycle Museum. This museum houses some of the most historical machines from NZ’s motoring history.
The three-hour ride to the South Island on the Bluebridge Ferry was on a calm Cook Staight. I had traveled by ferry across the Straight of Gibraldor so I knew what to expect. Our first taste of South Island roads did not disappoint. The trip to the Blue Moon Hostel in Havelock not only was full of curves but many scenic views of the Malbrough Sound. These views of the Sound were surpassed by our next day’s ride to Kenepuru Head. This ride was on a road clinging to the cliffs overlooking Kennpuru Sound. Stunning views at every turn but the large amount of rainfall that NZ has received had washed out several of the roads so significant road construction projects were underway. I took a rest day while Dan headed South with the goal of getting to Invercargill by way of the Molesworth Station Trail. This road bypasses the road closure on Hwy 1 caused by the earthquake last year. This trail is 200km of gravel and has no gas or lodging. My next ride took me to Cable Bay, a small resort just outside Nelson. The first day’s ride out of Cable Bay had me traveling on Ronga Road to French Pass and back. So many curves, the sides of my tires were dramatically depleted. A visit to Nelson would not be complete without a visit to Queen’s Garden and The Founder’s Heritage Park.

The Himalayan is positioned as a dual-sport motorcycle designed for adventure. The 411cc air-cooled, singlecylinder, four-stroke, fuel-injected engine produces 24.5 horsepower at 6,500 rpms and 32 Nm of torque at 4,250 rpms. It has electric start and uses a five-speed transmission. The 41mm telescopic fork front suspension offers 7.87 inches of travel while the rear monoshock has 7.08 inches of travel which should be sufficient to absorb all but the biggest bumps and jumps. Ground clearance is 8.66 inches to help clear minor logs. The seat height is 31.5 inches, low enough for even the shorter inseamed dual-sport riders. Stopping power is provided by a two-piston floating caliper squeezing a single 300mm disc up front and a singe-piston floating caliper squeezing a 240mm disc in the rear. The fuel tank capacity is slightly more than three gallons; insufficient for longdistance, remote adventure travel. Base MSRP is $4,499. Riders interested in doing some light dual-sport / adventure travel might want to consider the Himalayan. The motorcycle is inexpensive enough to provide a taste of adventure travel without the huge entry fee. Robert Pandya, long-time rider and veteran of the industry including time as the marketing and communications guy at Polaris / Victory / Indian, recently put together a panel of industry veterans and experts to define the causes of the sales decline and develop an action plan for interrupting the slide and attracting new riders to motorcycling. While some might quibble about their analysis and solutions, it’s a fascinating read and evidence that people are taking the problems seriously. Mr. Pandya subsequently launched www.MotoGiveAShift.com as a vehicle for disseminating the report produced by that panel. Included on the website are additional blogs featuring interesting thinking / writing, podcasts and other information and links are available for free. The panel’s next effort is to drill down into the five topics outlined by that first meeting and produce a cumulative report. Continued from page 9 - New Zealand Exploring this restored village from the 19th and 20th centuries took the whole day. Nigel and Jo from Cable Bay Campground suggested a route to the next stop of Tapawera. This route took me along the Moutere Highway then through the Neudorf wine region before arriving at my destination on the Motueka Valley Highway. A large mud slide along the highway had washed away one of the houses. In taking the long way to Murchison, I traveled though the Golden Downs Forest on the Korere Tophouse Road which gave scenic views of the forest. A side trip down the Gowan Valley Road led to a small hostel for trekkers and mountain bikers on the Braeburn Track where I met Louise. I told her I did not have a place to stay in Westport on the West Coast. She gave me the keys to her vacant house and let me stay three days. People in NZ are amazing. I took a day trip out of Westport and headed north along the coastal Route 67. A twisty mountain climb to the Dennison Coal mine historical site and

then another climb to the largest operational coal mine in NZ — the Stockton mine. Just off the road to Stockton, I wandered through Millerton and at the end of a very twisty dead end road, I found a park bench with a panoramic view of the coast. Excellent place for my lunch. My trip will continue next month as I go where the white line takes me.

House Bill 5675 Call to Cap 3P Damages; Tie Bar to HB 5517 by Dondi Vesprini A brief legal lesson is necessary for this month’s article. Michigan is a No-Fault insurance state. This means that if a person is injured in an accident involving a motor vehicle, said person has two distinct types of claims they may advance as applicable to their situation. The first type of claim is a claim for No-Fault benefits which includes unlimited medical expenses, medical mileage, payment for assistance rendered to the injured person for personal care (attendant care) and also three years worth of wage loss and payment for assistance with household chores. The second type of claim is a claim for noneconomic or “pain and suffering” damages against the negligent person that caused the accident. Such damages include pain and suffering, emotional damages, compensation for any residual disfigurement or scarring, and a claim for compensation for the effect that the injury has on one’s lifestyle, among other items. This type of claim is commonly referred to as a “third party” claim. Last month, I wrote about House Bills 5517 – 5523 which were introduced in Lansing on February 6, 2018. As I advised, this package of bills would effectively repeal an injured person’s ability to claim any no-fault benefits if injured in an accident involving a motor vehicle. (i.e., medical expenses, medical mileage, attendant care, wage loss, household chores, etc.) As of the writing of this article, these bills were still pending for consideration in Lansing. As I discussed in the last article, if these bills were to pass, it will leave everyone to their own financial resources regarding paying medical bills and obtaining necessary attendant care and/or replacement services. It can be expected that if these bills pass, health insurance premiums will skyrocket and many injured persons will be forced to apply for Medicaid/ Medicare. Also, without any wage-loss benefits, injured persons who are out of work for a significant period without the financial capabilities to go without an income for an extended period will be forced to file for bankruptcy. As if this blatant attack on one’s right to no-

Continued from page 10 Indian Motorcycle is looking for everyday wrenchers, home builders and amateur customizers who tinker in the garage for the passion, not the pay. Motorcycle industry professionals, such as a mechanic or salesperson, are welcomed to submit.
From March 15-30, amateur builders can submit to be one of three chosen participates. From April 3-13, the top submissions will be showcased online and available for fan voting. Indian Motorcycle will arm each amateur builder with a new 2018 stock Indian Scout Bobber and provide a build budget of $10,000. Participants will design and create their own take on the strippeddown, 100 horsepower cruiser. The three custom Scout Bobbers will be unveiled in July, followed by a fan vote. The winner will be announced at the Sturgis Motorcycle Rally and will receive a $10,000 grand prize along with a feature spread in Hot Bike magazine. To enter, wrenchers can visit IndianMotorcycle.com and submit 500 words explaining their build plans and why they’re deserving to be one of three
participants. Submissions should include a sketch or digital design rendering of their customized Scout Bobber concept, along with descriptions and imagery of previous builds. Those submitting are asked to include any references who can reinforce their talent and justify their skills. Video submissions are also welcomed.

Motorcycle adventurer Rene Cormier recently visited BMW Motorcycles of Grand Rapids to put on a presentation about his travels. We had a great time with Rene talking about of his adventures traveling the world. When you do it on a budget of $25 a day, camping and dining with locals becomes an every day experience. It took him five years to make it around the world including a year off in the middle to go back to Canada and make some more money to finish the trip. His did this all on a BMW F650GS Dakar powered by a single-cylinder engine. Even though Rene’s a big guy, he said it was the perfect size bike for the trip. The GS got great fuel economy and was light enough for him to maneuver the roads he traveled. Used parts were a good option for saving money during the trip. Rene turned into a pretty good mechanic out of need rather than a desire to be one.

He told the audience that Africa was the best continent for camping. The ease of finding places to stay and the beauty of the landscape and diversity of animals were spectacular. It took him four months to make it from Capetown to Yemen. Rene traveled through areas of the Middle East that most of us would consider hostile. Any American would feel unwelcome crossing the borders into those countries. He published a book on his travels called The University of Gravel Roads that’s available at BMW Motorcycles of Grand Rapids or through Amazon. He also offers guided tours of the places he’s visited on his travels. More information about these tours are available at www.renedian.com. Be warned: these tours are not intended for novice riders. In fact, Rene and his people will pre-qualify any rider interested in taking a tour. If you don’t have the skills, they won’t take you. Approximately 80 people attended Rene’s presentation. He’s a character to say the least. He entertained and educated for two hours. If you ever get the chance to talk with him or see his seminar at an International Motorcycle Show, I would highly recommend it.

Attempt to Break Land Speed Record by a Surprising Rider Lake Gairdner, South Australia - In one of the more interesting stories we’ve read lately, Australian Ben Felten will be attempting to break the motorcycle land speed record aboard a Kawasaki ZX-10 at the dry salt lake bed of Lake Gairdner in South Australia during the second week of March 2018. Felten owns the current record of 156.25 mph. That might not seem like a high bar for most motorcyclists but Felten was blinded by Retinitis Pigmentosa in his late 20s. In order to make it safely straight down the track, MotoGP racer Kevin Magee will follow Felten down the track on a separate motorcycle and help guide him using radio communications. Bike Comparison by Franz “The Preacher” Hoffer I am in the enviable position of doing an in-depth article and test comparing a 2011 Road Glide Ultra to a 2017 Road Glide Ultra. “Big deal,” you might say. “Who cares?” you might wonder. “ What about the 2018 models?” you might ask. Well, taking into account that there are no major differences between the 2017 and the 2018 models, that argument holds no water. The comparison or test is more from the stand point of advances and changes made in the last 7 years. I purchased a 2011 Road Glide Ultra in April of 2011. It carried a sticker price or $24,450 compared to my 2001 Electra Glide Standard that carried a sticker of $15,000. But once I got on that ‘11 Road Glide, I couldn’t believe the advances from the ‘01 Electra Glide in terms of power, rideability, acceleration, handling, stability, comfort, and overall appearance. It was also making the jump to a six-speed transmission, sixgallon gas tank, and ABS braking system. The only thing that didn’t impress me was the ABS on the ‘11. Even Harley-Davidson admits it was a sub-standard system. This past January, I was spending an inordinate amount of time at my favorite Harley dealer, Wolverine Harley-Davidson. It’s a special place to me, a place where the employees are my friends and we’re on a first name basis. I can stop in to see George de la Nuez, the Dealer Operator/ Manager/Co-Owner, without making an appointment and we’ve had some fantastic conversations about a lot of things, not just motorcycles. The same holds true for Carla Carlson who is in charge of Marketing, Events, the Riding Academy and is George’s right hand. It’s a home away from home for me. So I spotted this really cool

looking 2017 Mysterious Red Sunglo/Velocity Red Sunglow Road Glide Ultra on the floor. Every time I returned to the store, it was calling to me. And calling to me. I finally gave in, answered the call, and traded in my ‘11 Road Glide Ultra. The sticker on the 2017 Road Glide Ultra was right around $28,000; quite a jump from the sticker on the 11, but the two motorcycles are as different as can be. The models share the name and the fixed frame fairing, but that’s about it. Let’s start with the power plant. The air-
2011 Road Glide cooled Twin Cam 103 is a good engine, but the Milwaukee 8 107 on the 2017 model is better. It far out performs its predecessor and the liquid 2017 Road Glide cooling allows for better performance and increased comfort. From 0 to 60, you can add two to three bikes lengths in increased acceleration. The low end torque is massive on the Milwaukee 8 compared to the TC 103; 114 ft/lbs at 3,250rpm for the ‘17 compared to 102 ft/lbs at 3,500rpm for the ‘11. Seat height is about the same at 29.1 vs 29.0 inches, but the ‘17 feels lower and the seat is much more comfortable. You also don’t get the excessive heat buildup on those long rides. My ‘11 would almost

singe the insides of my thighs even with heat deflectors while the ‘17 runs much cooler, thanks in part to liquid cooling and moving the catalytic converter back farther in the exhaust system. Front and rear tires are the same. The ABS system on the ‘17 far outperforms the ABS system on the ‘11. In addition, the front and rear brakes are linked; if you actuate one the other automatically kicks in on high stress stops. Linked brakes are great for you and me, but not so great for competition riders. Both have six-speed trannsmissions and six- gallon gas tanks and both come in at a fuel economy of around 43 mpg. Wheel base on the ‘11 was 63.5” while on the ‘17 it’s 64”; that 1/2” makes a big difference. Curb weight on the ‘11 was 888 lbs vs 929 lbs on the ‘17 but, with the increased power of the 114, you don’t even notice the additional 40lbs. We finally got some good weather here in Michigan, By good weather, I mean an unusual couple of February days where the temps got into the high 50’s. I was able to give the ‘17 a good road test. Then it snowed 6” on the 3rd day and the high temp was 28 degrees F. On that first ride, I noticed the improved acceleration right away. The suspension is greatly improved and cornering is stable and sturdy. I really leaned into a couple turns at a pretty high rate of speed; higher than I would have on my ‘11 and it was no problem. I have to get used the higher handle bars, but that won’t be a big deal. W ith the higher handle bars the mirrors are also up higher and you get much better visibility behind the motorcycle. It shifts nice and easy but still has that characteristic Harley “clunk”. I did notice that I could feel the shift in the clutch, kind of a slight nudge when the gear kicks in. Vibration is much less than the ‘11 and, as I indicated earlier, the heat buildup is much less. The controls are easy to access and the instrumentation is attractive and visible even in bright sunlight. I like the cruise control being on the left (on the ‘11 it was on the right plus you had to engage it with a separate switch) and being actuated from the hand-grip. The infotainment system will take me a while to master, but I absolutely loved the GPS system on this motor; visible and easy to manipulate. Harley-Davidson has hit a home run with its current lineup of big touring motorcycles. I can’t wait to get on the road for a long trip. My buddy Jimbo and I have already reserved our rooms for Sturgis. All in all, it’s a great motorcycle that offers some extraordinary engineering, styling, and design. See you on the road.
