Silliman University President Dr. Betty CernolMcCann was Wednesday’s guest speaker during the 121st Philippine Independence Day celebration in front of the Presidencia ( old City Hall) and whose keynote address centered on the theme: “Tapang ng Bayan, Malasakit sa Mamayan.” (SU-PIO) Think how much the country, and each barangay in it, has changed over this period. Each of us remembers in our own families those whose lives were sacrificed to secure our independence against colonizers who would try to take these islands and exploit them for their own narrow purposes. My father and mother, I’m proud to say, were part of the Filipino resistance in Leyte, and helped clear the way for the return of President Osmena after the Battle of Leyte Gulf. I’m sure each of you has your own remembrances. But do our lives today actually honor the sacrifices they made for us?

The conditions are different, and our responses may vary. We may not face the threat of an invasion by an expanding Empire seeking to impose its rule through military occupation. The challenges we face are far more subtle and harder to deal with. opefully this is not only in the Philippines, or only in Manila. The culture of corruption in this country has sunk so deep into our society so much so that even in the matter of health care, we have this report in the north that dead patients were recorded to have undergone kidney dialysis …and false claims were paid by PhilHealth not knowing that the patient was already long dead. As a result the Phil Health has filed 28 counts of administrative charges against a private dialysis center in Quezon city who made such false claim. Stakeholders are now arrested and indicted. his may sound disheartening but, our education industry has long become, as it had always been, a virtual diploma mill because unlike in other countries, our situation is that we are producing more diplomas than jobs. Schools and classes will go full blast this week and in August and this is the sad situation year in and year out. What then is the use of the biggest budget of government for education when after college, our graduates either go jobless or leave for abroad because in our country there is hardly any vacancy, unless one goes to private business, and to add, unless one has connections. Working on one’s merits is not the name of the game here. Most graduates do not qualify for present jobs available. This is the biggest mis-match of the century. Worst of all, our “bonus pater familia” culture will not mind sheltering our graduates at home until kingdom come, be they get married or stay single. Proof: of six thousand jobs offered in many job fairs, only a few hundreds are hired. Always, and Why? Because our graduates do not qualify. Why? Because the system of education in this country cannot produce graduates that could qualify and start a job-career. Most of all, there is not enough training in school

that could match the need of industries after graduation.. But in fairness to our colleges and universities, they do their best in offering quality and relevant courses. But the big question is : why are only a handfull hired during job fairs which are offering thousands of new jobs. Why? Are the kind of courses offered wrong? Or do graduates simply lack enough training and preparation for the jobs? In the fact, because of this very sad predicament of unqualified graduates for jobs, we see the very urgent need for our education department to sit down with industries and see HOW college graduates will qualify and be trained so they can get jobs after college. In Singapore, we interviewed students who say that government evaluates their skills and grades, and tell them what course they may or should take so they can work after graduation. The students are looking forward to an assigned job after college. They feel secure. But not in the Philippines, our graduates are very insecure. So we know the problem. Society , both government and industries must agree on how they can prepare jobs and seriously train our graduating seniors so as not to produce jobless graduates year after year. When will we ever see the day when diplomas and jobs will match each other?

Phil Health is shouldering kidney dialysis for each qualified member for 90 sessions and pays P2,600 per session to the dialysis center or a whooping P234,000 for the entire session. Virtually free of charge for patients. The bad news is, nobody is telling Phil Health in this case, exactly whether the patient has already died, or has dis-continued the dialysis. So long as the claim papers are in order, Phil Health innocently pays the bill. This is estafa plain and simple. Moreover, this operation is not possible without the connivance of both the dialysis company or hospital and Phil Health people , at the expense of the government agency, which is funded by taxpayers money . He calls this the “Thucydides Trap”. First, it was Greece vs. Sparta; then, Germany vs. Great Britain and now we have China vs. the USA. He theorized that in three major instances, the powder keg was/will be lit -not by the main actors- but by a secondary agent provocateur. An example was the assassination in a small country like Austria that triggered World War I and it could be North Korea’s bellicose ways in our contemporary times. One can also think of Japan’s attack on Pearl Harbor that ignited World War II in a great way. In 1934, the Red Army went on a strategic retreat covering 12,000 miles to avoid direct confrontation with the then superior Nationalist Army. They famously label this as “The Long March”.After rebuilding for 15 years, the Red Army eventually defeated the Nationalist Army in 1949 and established the People’s Republic of China. In a recent “Asian Review” article, it was pointed out that China could do a strategic retreat in the smoldering “trade war” with the USA but with minds focused on her eventual target of dislodging America as an economic and technology superpower by 2035.A total of about 15 years from today. The confidence of a Donald Trump in the current trade showdown with China is his knowledge that more than America, China is more dependent on the import and export trade. Therefore, the blistering trade war could fracture the sinews of the Chinese economy more than America’s. The prospective Chinese strategic retreat in the trade war could be the moral equivalent of the:” one step backward, two steps forward” being propagated by the famous Chinese military strategist author Sun Tsu in his book “The Art of War”. “Asia Review” uses the Chinese phrase “ tan tan da da” of “talk talk strike strike” as apropos to the situation- which is a duplicitous stance of giving in to trade concessions but -simultaneously-forever mindful of locating openings to destabilize the enemy onwards to 2035. China cannot forever smile away the current effects of the debilitating trade war of new sky-high tariffs which had driven thousands of companies, in the words of Jaan Prime Minister Shinzo Abe in Tokyo recently “from China into no-tariffed nations.” This resulted, allegedly, into the loss of thousands of jobs in the “manufacturing, e-commerce and foreign companies” in the Mainland. Fearful of dissent of unemployed folks, the State Council has been strictly given instructions to find ways to get these dislodged Chinese back into employment. (Are the hundreds of thousands of Chinese in RP part of this exodus?.)

The USA had lowered the boom on many tech-based Chinese companies including the huge Huawei Company that was tagged as a potential “Eye Spy” for China anywhere their products are found in the world. The immediate relief that the world can relish is the settlement of the current USChina trade war with the Americans winning more concessions and their tariffs to generally be restructured southwards both ways as results therefrom. But as the saying goes “one swallow does not a summer make” and this “loss of face” of China for blinking in the current trade war should not be mistaken as the end of the War. It is just one of the small battles taking place in a long war of attrition of 15 years. The battles raging in the fields of technology, financial engineering, arms race and military build-up, the space program, the nuclear agenda, food security and cultural -social influence upon the rest of the globe are very much still up on China’s sleeves. The writings on the wall are clear enough, though- that the American Century will soon give way to the Chinese Century and a New World Order will emerge. The Harvard professor, however, has been proposing to as many leaders willing to lessen, that rather than be subsumed in the “Thucydides Trap” where usurpations of dominance resulted in wars, that China and America, instead, develop a new world community where sharing of powers can still be possible between the First and the Second biggest nations. Wouldn’t that be a Utopia in our generation? But it can be done if one can just assess judiciously about the futility of wars when taken as the only resort of competing interests. And the soundness of the wisdom of looking at the world as the One Homeplace of Fellow Human Beings rather than be parceled merely to be divided and conquered by the strongest to the detriment of the weak. e need to have a law in Dumaguete that bans the use of plastic bags for shopping. The truth is the businesses like this because they get to sell a reusable bag, at a profit, for the customers that forget to bring their shopping bags. Although there is some experiments to melt down and use the plastic bags for energy, for the most part the thin plastic bags are not recyclable, and dangerous to the environment. If you burn them you pollute the air. Or they will kill the fish. Or if you bury them they will pollute any-

ast Wednesday, June 12, 2019, Filipinos celebrated the country’s 121st Independence Day in various historical areas by parades and by programs and gun salutes. On June 12 th 1898, we were finally free after having been colonized by the Spaniards for 300 years. The fervour of our revolutionary past spent fighting our colonizers is forever remembered as we sing the lyrics of our National Anthem, “Ang mamatay nang dahil sa iyo.” We salute the patriotism of our heroes, especially the Katipuneros such as Andres Bonifacio, General Antonio Luna, Gregorio Del Pilar, Apolinario Mabini and others. Despite having limited weapons, resources and military skills, they bravely fought against the might of the Spaniards. In the end, the Treaty of Paris was signed on Dec. 10, 1898, which brought to an end the Spanish-American War.

Every good and perfect gift comes from the Father of Lights. In James 1:17, it also says that God does not change like shifting shadows. He is the same yesterday, today and forever! Hallelujah for such a gracious, loving Heavenly Father who is a giver at the very center of His heart! In Matthew 7:7-11, Jesus encourages us to keep on asking, seeking and knocking because God is a good Father and delights to give good gifts to His children. Like any healthy father/child relationship, it breaks the Father's heart if we only seek Him for the things He gives us. The gifts He gives are really only the icing on the cake. The most amazing thing that we can ever receive from God is the gift of Himself! It humbles me to think of this promise. To think how kind and loving, and generous our Heavenly Father is. It just makes me want to run to Him again and again and thank Him for being so good to me!

Unfortunately when we made the Valencia- Dumaguete road better, perhaps we made it more dangerous because people are going very fast. The corner of Hibbart and Rovira roads continues to be dangerous. The city needs to remove walls and other things that block visibility on our street corners.

TIJING, and may be served with writs, notices and processes of this Honorable Court at the address of its counsel indicated below. 2. Defendant KEVIN GOODWIN is an American Citizen, of legal age, whose last known address is Lot 81, Tierra Alta Residential Resort, Palinpinon, Valencia, Negros Oriental, where he may be served with summons, writs and notices of this Honorable Court. 3. Defendant ROLEN DELOSO is a Filipino citizen, of legal age, whose last known address is Lot 81, Tierra Alta Residential Resort, Palinpinon, Valencia, Negros Oriental. II. JURISDICTION OF THE REGIONAL TRIAL COURT 4. Section 18 (8) of B.P. Blg. 129 as amended by R.A. No. 7691 provides that Regional Trial Courts shall exercise exclusive original jurisdiction: “(8) In all other cases in which the demand, exclusive of interest, damages of whatever kind, attorney’s fees, litigation expenses, and costs or the value of the property in controversy exceeds three hundred thousand pesos (P300,000.00) outside Metro Manila…” 5. Plaintiff contends that this instant case is under the jurisdiction of the Regional Trial Court, considering the fact that the same is for collection of a sum of money wherein the value of the demand is in the amount of Two Million Seven Hundred Ninety Six Thousand and Four Hundred Eighty Three (Php 2,796,483.00) Pesos. The aforementioned amount will be quantified hereinafter. 6. Section 408 (e) of the Local Government Code further strengthened by Administrative Circular No. 14-932 [2] mandates that all disputes are subject to Barangay conciliation pursuant to the Revised Katarungang Pambarangay Law before filing a complaint except for: “(e) disputes involving parties who actually reside in barangays of different cities or municipalities, except where such barangay units adjoin each other and the parties thereto agree to submit their differences to amicable settlement by an appropriate Lupon…” 7. Considering the fact that the plaintiff is a sole proprietorship and its place of businesses is in the City of Dumaguete and that Mr. Goldwin is a resident of Palinpinon, Valencia, Negros Oriental, it is concluded that the barangays where both parties are situated are of different geographical location and are likewise not adjoining each other. Hence, barangay conciliation proceedings are not required as a condition precedent for the filing of this instant case. III. ALLEGATIONS COMMON TO ALL CAUSES OF ACTION 8. Defendants Kevin Goodwin and Rolen Deloso are of public knowledge common-law husband and wife; 9. Defendant Deloso owns a parcel of land known as Lot 81 situated in Tierra Alta Residential Resort, Palinpinon, Valencia, Negros Oriental; 10. On December 5, 2014, THE PARTIES (Plaintiff and Defendant Kevin Goodwin) entered into a contract whereby the plaintiff was engaged by the defendant Goodwin to design and construct a one (1) unit two (2) storey residential building located at Lot 81, for the sum of Nine Million Three Hundred Twenty One Thousand Six Hundred Ten (Php 9,321,610.00). This fact is evidenced by the aforementioned contract, a copy of which is hereto attached as ANNEX “A” TO “A-4”, 11. Article IV of the same contract provides for the terms of payment which the defendant Goodwin is obliged to comply with, to wit: ARTICLE IV TERMS OF PAYMENT 4.1 Down payment: The FIRST PARTY shall pay to the SECOND PARTY the advance payment of 50% equivalent to FOUR MILLION SIX HUNDRED SIXTY THOUSAND EIGHT HUNDRED FIVE & 00/100 PESOS (Php 4,660,805.00) upon signing of this contract; 4.2 Progress payment: Payment for progress billings shall be done in the following manner: 2nd Payment – pay 20% of the contract amount upon reaching 50% of the physical work accomplishment 3rd Payment – pay 20% of the contract amount upon reaching 70% of the physical work accomplishment Final Payment- pay 10% of the contract amount upon completion, turn-over and acceptance of the project. 12. Additionally, Article V of the same contract provides for the terms as to the Commencement and Completion of the construction works, to wit: ARTICLE V COMMENCEMENT AND COMPLETION OF WORK 5.1 It is agreed that the construction of the PROJECT shall commenced within ten days from the date of the release of the Downpayment covered under Article 4.1 and should be completed within a period of THREE HUNDRED THIRTY (330) calendar days; 13. To add, paragraph 6.2 Article VI3 of the contract states that the management of the project in total shall be the responsibility of the plaintiff; 14. Worthy of note is paragraph 7.1 Article VII of the contract which defines the contractor’s obligations and liabilities, as follows: ARTICLE VII OWNER’S OBLIGATION & LIABILITIES 7.1 The SECOND PARTY works on the property, without interference from any party except authorized government agencies; 15. Prior to the execution of the contract, 4 on September 22, 2014, plaintiff provided the defendant Goodwin a detailed document which laid out proposed material specifications and schedule of finishes for the construction works which was thereafter accepted by the defendant. Among other matters, paragraph F in item number 17.0 of the same document contains a proviso which states: F. Major work revision and items not stipulated in this proposal entails additional cost and time, depending on the complexity of the detail. As proof thereof, the document is hereto attached as ANNEX “B” TO “B-5.” 16. After the perfection of the contract and defendant Goodwin’s downpayment of the amount provided by paragraph 4.1 of Article IV under the contract and the acquisition of the necessary permits from the proper government authorities, the construction works began on Lot 81. As proof that the permits were accordingly acquired, attached hereto as ANNEX “C” to “C-3” are copies of several permits issued by the government such as: Building Permit, Certificate of Zoning Clearance, Plumbing Permit, and Electrical Permit; 17. Correspondingly, a Certificate of Occupancy was issued by the Office of the Building Official after the completion of the construction, submission of an application for certificate of occupancy, and the issuance of a certification of final electrical inspection. As proof thereof, copies of the aforementioned documents are hereto attached as ANNEX “D” to “D-3”, 18. To the plaintiff’s surprise on September 9, 2016, defendant Goodwin sent a letter to the plaintiff through Mr. Luisito Tijing, falsely alleging that there were irregularities in the construction of the residential building. In addition, he stated that there were several violations of applicable Philippine statutes and that there was an agreement to use Class “A” materials in accordance with western standards. A copy of the letter is hereto attached as ANNEX “E”; 19. In response, the plaintiff sent a reply on September 12, 2016 and rebutted the allegations made by defendant Goodwin, stating that the methods applied to the project is based on generally accepted Philippine engineering standards in contrary to western standards. The letter added that the delay was attributable to the defendant himself, since he applied changes in the interiors and architectural finishes which in effect deviated from the original plan. As proof thereof, a copy of the aforementioned letter is hereto attached as ANNE “F” to “F-1”; 20. Despite the fact of delay from the defendant Goodwin’s interference with the construction works, the construction was already 70% completed as of January 2017. Pursuant to the contract, the plaintiff send defendant Goodwin a letter on January 9, 2017, requesting for the release of 90% partial billing as initially agreed upon. However, to no avail. A copy of the same letter dated January 9, 2017 is hereto attached as ANNEX “G”; 21. As of July 26, 2017, the full payment for the construction works had already become long overdue. This fact constrained the plaintiff to send another letter requesting for full payment, a copy of which is hereto attached as ANNEX “H”; 22. On August 10, 2017, defendant Goodwin sent plaintiff a letter asking what amount the plaintiff is claiming as per contract and the breakdown of the accounts payable. A copy of the letter is hereto attached as ANNEX “I”; 23. Plaintiff PHILSOUTH thereafter replied to defendant Goodwin’s letter on August 16, 2017 and laid out a breakdown of the long overdue account he has with the plaintiff through a Statement of Account. As proof thereof, attached hereto as ANNEX “J” to “J-1” copies of the letter dated August 16, 2017 and the Statement of Account; 24. The Statement of Account5 shows that as of August 15, 2017, the defendant Goodwin had an outstanding balance of PHP 2,796,483.00 payable to the plaintiff; 25. In a letter dated August 24, 2017, defendant Goodwin once again alleged that the plaintiff breached Article V, Section 5.1 of the contract by not completing the construction within the stipulated 330 days. Plaintiff replied in a letter through counsel on October 11, 2017 and once again clarified to the former that the delay was due to his interferences in revising the original plan of the construction. The aforementioned letters are hereto attached as ANNEX “K” to “K-1” and ANNEX “L” to “L-2” respectively; 26. Defendant Goodwin sent another series of letters hereto attached as ANNEX “M” to “M-1” and ANNEX “N” to “N-2” pushing forward his erroneous contention that the contract was breached with proposal for settlement in exaggerated figures; 27. To finally set things straight, the plaintiff sent a letter on January 27, 2018 to the defendant Goodwin laying out the terms pursuant to the contract dated December 5, 2014 and stood firm on the stand that on its part there were no breaches committed in constructing the residential building. It was he who cause maneuvers and scheming which resulted to the deviation from the contact. A copy of the letter is hereto attached as ANNEX “O”; 28. It has only been recently discovered by that the defendants moved out from the residential building situated in the Lot 81 premises, leaving no personal belongings behind. They never returned since then, Plaintiff exerted efforts in locating the defendants. However, to no avail. This fact leads to the conclusion that both defendants intent to leave the Philippines in fraud of the plaintiff; IV. CAUSES OF ACTION 29. The foregoing statements are hereby repleaded by reference: 30. Article 1159 of the New Civil Code finds significant application over this case. It states: “Obligations arising from contracts have the force of law between the parties and should be complied with in good faith…” 31. Paragraph 4.2 of Article IV6 as stipulated in the contract clearly and unequivocally states the mandatory nature by which the defendant is obligated to pay the plaintiff in given periods of development [of construction] certain percentages of the contract amount until such time full payment is made; 32. The exchange of letters essentially show that the defendant Goodwin refused to pay the amount he was obliged to pay, for the reason that there was an alleged breach of a condition stated in Article 5.1 of the Contract in that the construction should be completed within a period of 330 calendar days. As consistently stated in the replies made by the plaintiff, the delay was attributable to defendant Goodwin’s interference with the construction works. The act of defendant in interfering with the construction is a breach of paragraph 7.1 Article VII of the

same contract; 33. In lieu of the foregoing, it is contented that the plaintiff has a legal and valid right to the payment by the defendant Goodwin of the amount of PHP 2,796,483.00, said amount being an obligation voluntarily entered by Defendant in the aforementioned contract; 34. Defendant Deloso is impleaded as a party defendant in this case because of her capacity as the landowner and the common law wife of defendant Goodwin. She has also been a signatory to the permits issued in favor of defendant Goodwin; 35. Therefore, it is important to state that the defendant Goodwin has no valid and justifiable reason not to pay the foregoing amount, which refusal constitutes a violation of the terms and covenants of the subject contract marked and attached as ANNEX “A” to “A-4”, V. SECOND CAUSE OF ACTION 36. The foregoing allegations are hereby repleaded by reference. 37. Paragraph 9.2 Article IX of the contract has provided for terms pertaining to liquidated damages which the defendant may be held liable to pay should he fail to fulfill any condition of the contract. It states: “ARTICLE IX. LIQUIDATED DAMAGES 9.2 In the same manner, should the FIRST PARTY fail to fulfill any condition of the contract which is incumbent upon him, he shall be liable to pay 1/10 of 1% of total amount due for each day of delay as liquidated damages…” 38. Applying the foregoing provision to the fact that the defendant Goodwin failed to comply with Article 5.1 of the contract, plaintiff contends that he should be liable for liquidated damages; VI THIRD CAUSE OF ACTION 39. The foregoing allegations are hereby repleaded by reference. 40. To protect Plaintiff’s interest, the latter was constrained to engage the services of counsel and paid attorney’s fees in the amount of Fifty Thousand Pesos [Php 50,000.00,] including expenses of litigation and other costs of suit. As proof hereof, a copy of the acknowledgement receipt relating to attorney’s fees is hereto attached as Annex “P”. The Defendants, therefore, must be made to reimburse said expense and costs. VII FOURTH CAUSE OF ACTION 41. The foregoing allegations are hereby repleaded by reference. 42. By reason of the unlawful acts committed by the defendants which subjected the plaintiff’s representative Mr. Louie Tijing to sleepless nights, mental anguish, and public ridicule, plaintiff is entitled and should be compensated to moral damages amounting to One Million Pesos [Php 1,000,000.00] VIII ALLEGATIONS IN SUPPORT OF THE GRANT OF THE PRAYER FOR A WRIT OF PRELIMINARY ATTACHMENT Plaintiff re-pleads all the foregoing averments by way of reference and insofar as they are relevant and material to its application for a Writ of Preliminary Attachment: 43. A sufficient cause of action exists against the defendants; 44. This action for Collection of Sum of Money and Damages is one instituted against defendants Goodwin and Deloso which arose from a contract; 45. In addition, the writ of preliminary attachment is sought for the reason that the defendants have the clear intent to leave the country to defraud the plaintiff as creditor. This fact is manifested when the defendants have removed all their personal belongings from the residential building standing on Lot 81 and left their residential abode and their return uncertain; 46. It is prayed that a writ of preliminary attachment be issued over the residential building standing on Lot 81 in Tierra Alta Residential Resort, Palinpinon, Valencia, and all other real and personal properties under the name of defendants; 47. The plaintiff is ready and willing to post a bond to be fixed by this Honorable Court, executed to the defendants, to answer for all costs which may be adjudged to the latter, and all damages which defendants may sustain by reason of the attachment prayed for, if the court shall finally adjudge that the plaintiffs are not entitled thereto; 48. In support of the foregoing allegations, the plaintiff through counsel have hereto attached their Affidavit of Merit, marked as Annex “Q” to “Q-1”; PRAYER WHEREFORE, premises considered, the Plaintiff most respectfully prays of this Honorable Court that after due proceedings, judgment be rendered as follows: a. The application for a Writ of Preliminary Attachment over the residential building standing on Lot 81 in Tierra Alta Residential Resort, Palinpinon, Valencia, and all other real and personal properties under the name of defendants be GRANTED pursuant to Rule 57 of the Rules of Court; b. resident Rodrigo Roa Duterte on June 10 made a surprise inspection at the Ninoy Aquino In ternational Airport-Terminal 2 after hearing reports about flight delays and cancellations. President Duterte talked to airline and NAIA officials regarding the cancellations and delays to know whether there are flight diversions and if affected passengers are given incentives to ease their inconvenience. A Philippine Airlines manager and a NAIA-Terminal 2 airport duty manager briefed the President on the flight woes and explained actions being undertaken to normalize the situation.
