From the Oklahoma Dental Foundation the heart of the dental community – charitable care.

Through the past few years, your Oklahoma Dental Foundation has been engaged in a very direct effort to address “access-to-care” problems in the state. We know, from myriad reports, that this is an issue affecting thousands of our neighbors throughout the state. As we have come to learn, “access-tocare” means different things to different people. For some, it defines a situation when there is no dentist available within a reasonable geographic area. For others, the problem stems from the cost of acquiring treatment in a state that ranks 44th in the nation for the number of households (approximately 543,000 Oklahomans) living in poverty. Still more find that lack of education is a barrier keeping them from accessing available dental care. It has been astounding to see children living in areas where SoonerCare providers are available but who do not receive consistent (or any) treatment, with a major reason being that caregivers do not understand the important role of good oral health in the lives of their charges. While this is not an exhaustive list of reasons for “access-to-care” issues, it certainly shines a light on some of the contributing factors. Interestingly, the response from Oklahoma dentistry has been one of immense generosity. The drive to help overcome these barriers to care is one which comes straight from

MobileSmiles Oklahoma and Oklahoma Mission of Mercy (OkMOM) are laserfocused on providing direct dental care to as many of those in need as possible, regardless of circumstances. This impulse to help, to make lives better, is one we need to continue to develop and support through our charitable contributions and volunteer actions. It is through these avenues that we come into contact with people who are unlikely ever to see a dentist (at least until there is some major associated health crisis). Yet, there is another side of our charitable nature that the ODF is thinking about, working on, and trying to find solutions for. Our desire to help those in dental need comes from the expectation that the charitable work we do will provide assistance to those we help to better themselves. None of us wants to find ourselves in situations (whether it be in your dental office, at OkMOM, in a charitable clinic, or on board MobileSmiles) where we are promoting irresponsible lifestyles or creating dependency on the good will of those providing charitable care. We come away from those situations feeling used and more on-guard the next time we are asked to provide care. We want to see those we help use our gift to make an effort to become self-reliant. When that doesn’t happen, our inclination to help is sorely tested. The ODF is engaged with a number of local and state organizations to work on the recognition that poverty programs and the methods we use to reach out to those in need are in a place where systemic change is necessary. We are

There are more sources of help, care and concern within the non-profit and church communities of Oklahoma than in any amount of money the state can direct to help solve these problems. The desire of Oklahoma dentists -- who got behind the idea of charitable care and diverse delivery methods years ago -- was far ahead of the curve in trying to bring change to Oklahoma. Now, we hope to help advance your foresight in charitable care in such a way that we are providing long-term help that lifts our patients, and our state, into a better life situation. In the early weeks of May 2015, Oklahoma was hit by a strong sequence of storms that brought tornadoes, hail, flooding and, subsequently, damage to many homes and businesses. To date, the RDGP has awarded a total of $13,738 to dental professionals in the state to help alleviate the financial burden that comes with repairs from storms like these.

CE in the Ozarks at Big Cedar Lodge August 21-23, 2015

The first ODA trip to Big Cedar Lodge near Branson, MO. yielded 27 dental professionals who registered for the CE courses. Attendees enjoyed Saturday’s course presented by Dr. M. Edmund Braly on drug-related necrosis of the jaws and Medicaid audits. Dr. Robert Herman presented Sunday morning on the importance of early orthodontic evaluation and planning.

The weekend schedule provided a lot of free time for families to enjoy all of the amenities that Big Cedar Lodge has to offer such as golfing, swimming and other water activities, a first-class spa, horseback riding and hiking, and so much more.

Dr. Edmund Braly wore a suit and tie for his Saturday presentation. So, a new ODA tradition was started at the ODA’s first CE weekend trip - cutting the tie of the speaker who dresses too formal. New Dentist Parties

On September 10, Tulsa County Dental Society members gathered at the home of Drs. Ben and Eugenia Johnson for the annual Tulsa County New Dentist Party to celebrate the Component’s newest members. Members get together every year in welcoming the newest dentists to their local society with drinks, dinner and camaraderie.

On September 17, Oklahoma County Dental Society held its own New Dentist Party at the home of Dr. Edward Harroz III, OCDS President. New dentists got to mingle, catch up and meet OCDS Board Members. These events serve as one of many opportunities for members to network with colleagues in their area. ODA Mentorship Program

Many ODA members are finding this to be true while participating in this year’s ODA Mentorship Program. The ODA kicked off the 2015 Mentorship Program with a Meet & Greet on September 11 with hors d’oeuvres, drinks and conversation. Many mentees and mentors met for the first time and will continue to communicate through email, phone and in-person conversations, sharing their wisdom and experiences with the next generation of organized dentistry. The program was started in 2014 to help connect third-year dental students with established ODA members for advice on

specializing, minimizing student debt, opening a practice, and much more. Each relationship differs; some are meeting once a month for lunch, others are opting for weekly phone calls. Helpful Information from the ADA

Your ThirdParty Payer Contract: Most Favored Nation Clauses The ADA often hears from members reporting that a third-party payer with whom they participate is requesting a sizable refund. The reason – the payer found that the doctor did not give the same discounts to the payer’s beneficiaries that he/she gave to other patients (some without a dental benefit plan). Can the payer ask for such a refund? How can payers access information on discounts provided to non-subscribers in a practice? Such situations are triggered by a very frequently used clause in the contract between a dentist and a thirdparty payer. It’s called a “Favored Nation Clause.”

ADA Announces Exclusive Student Loan Refinancing Offer with DRB

Through this clause, the dentist agrees not to charge higher fees to the patients covered under this plan than he/she would to other patients. An accompanying clause also stipulates that the dentist agrees to utilization reviews/ audits by the payer and further agrees to provide de-identified information on charges to other patients in the practice. Together, these clauses allow the payer to conduct audits, seek payment records for patients not covered by the payer, compare charges, and recoup monies from the practice. The ADA has been made aware of situations when this clause has been triggered, and substantial refunds demanded, even in cases where the dentist offered a discount or “special” to attract new patients to the practice. This can also be a problem when dentists participate in multiple plans. For example, if a fee specified for a particular procedure under one plan exceeds the fee the dentist would charge a patient from another plan, the dentist is contractually bound to charge the first patient the lower fee.

ODA Partners with OSDH to Enhance Tobacco Cessation Services

The Center for the Advancement of Wellness is a division within the Oklahoma State Department of Health (OSDH) committed to obesity reduction and tobacco use prevention through outcome-driven technical assistance via training, information and consultation. The Tobacco Use Prevention Department provides technical assistance and consultation services specific to evidencebased practices related to tobacco control programs. The Center for Disease Control and Prevention (CDC) Quitline Enhancement Grant has been awarded to

the State of Oklahoma, and has provided the Center the opportunity to enhance tobacco cessation services throughout the State. This funding also provides the opportunity to develop partnerships with established organizations having direct access to individuals that use tobacco products. The Oklahoma Dental Association (ODA) and the Center have entered into a collaborative partnership through which the ODA and the Center will provide training, consultation and ongoing technical assistance regarding tobacco

cessation services to ODA members. The partnership will ensure increased access and reach among current tobacco users by providing opportunities for ODA members to attend trainings and receive technical assistance specific to tobacco cessation interventions. The information presented will be founded on evidencebased practices as outlined in Treating Tobacco Use and Dependence Clinical Practice Guideline, 20081. Trainings will be provided for the following evidencebased practices: The Oklahoma Tobacco Helpline, Motivational Interviewing (MI), pharmacotherapy, the 5 A’s or 2 A’s and 1 R (full or abbreviated intervention strategies, respectively), systems change and policy development. In addition to trainings, the partnership will work with dental providers to incorporate health systems changes to integrate interventions into routine care. This collaboration will provide opportunities and enhanced methods to help improve the health and well-being of patients by intervening with those who use tobacco and by making evidencebased tobacco dependence treatment the standard of care. 1. 2015 Champions of Health Since 2004, the Champions of Health has been recognizing outstanding Oklahoma organizations and individuals who are making a positive impact on the health of our state through innovative programs. An Opportunity to Serve By Christopher Goelz, DS4, OU College of Dentistry I will remember that there is art to dentistry as well as science, and that warmth, sympathy and understanding may outweigh the surgeon’s knife or the chemist’s drug.

(from the Hippocratic Oath for Dentistry) As a senior (finally!), I can say with confidence that dental school has been a rewarding (albeit taxing) experience that can demand so much of its students that we can easily forget the noble aspirations that brought us to this profession. Last year, as I paced the hall outside of the preclinic lab, a teacher approached me and asked whether or not I still loved dentistry. Tragically, my answer at that moment was, “I think so.” Fortunately for me, I stayed the course and have since found many of the fulfilling moments I looked forward to when I first began my journey as a dental student. Among the best of these defining experiences has been the Sooner Stand Down event held at the Homeless Alliance in downtown Oklahoma City. While work at the school is slow and methodical, filled with double-checks and triple-checks, my time with our beloved veterans was a fast-paced flurry of introductions, diagnoses, treatments, and goodbyes. The staff on the MobileSmiles Unit was fantastic, working quickly to prepare the chair for the next patient as fellow doctor-to-be Alison Seamans (DS4) and I documented our work. By the time the day was done, we had treated many men and women for whom I have the utmost love and respect. I knew that these servants of our country and vanguards of our freedoms were special people and it was my honor to serve them in return. One man in particular turned to me and thanked me with a quavering voice and tear-rimmed eyes. He was a man in his late 50s who had broken off an upper central incisor 24 journal | November/December 2015

before entering the military in his early 20s. I had just handed him a mirror so he could see the straight, whole tooth we had built for him. I found myself thanking him in return. It was a quiet, beautiful moment, one that I will carry with me for a long time to come. Indeed, I will remember the Sooner Stand Down as a watershed moment in my career and in my life as a servant to others. It was this desire to serve that led me to, and through, the rigors and stresses of dental school. I referred to this need to help and heal during my admissions interview, and it was upon this foundation that I rested when hard times beat me down. The Stand Down event gave me the opportunity to see fruit borne of the labors of dental education, and it is more than incentive enough to carry me through both good times and bad. By the end of the day almost 300 veterans had received medical and dental care, food, clothing, shelter, and other services in an event that can only be described as our attempt to show adequate gratitude for the much greater service these veterans rendered without thought of

reward or recognition. To be able to perform this service for our veterans was a humbling and fulfilling experience; the feeling I left with is why I started this journey in dentistry and I hope to carry this feeling as I move forward. Christopher Goelz is a senior at the OU College of Dentistry. Native to Purcell, Christopher has lived in Texas, Mexico, Idaho, and Utah, but Oklahoma is his home. He is married to Lacey Goelz and they are the parents of four energetic boys: Coleman (8), Dominic (6), Romney (3), and Tank (he’s a dog). They live in Moore and Christopher is currently trying to decide whether to be a General Practitioner or specialize in Pediatric Dentistry.

LEGISLATIVE LOOP Legislative Session Overview & Political Update

The Prescription for Improving Oklahoma’s Health By Senator AJ Griffin, District 20 Oklahoma has so much going for it. We’re ranked in the top five states for best economic climate. We’re one of the top two states for workforce development. For the third year in a row, we’ve exceeded our state goal to produce more college and CareerTech graduates. These achievements ultimately will create more jobs and a better quality of life for Oklahomans. Such successes are the result of long-term planning, a commitment to achievable goals, and exploring new models for accomplishing those goals, including public and private partnerships. We need to apply those same approaches to improve our state’s health. Our high rates of obesity, diabetes, cancer, heart disease and other illnesses shorten lives, devastate families and drain billions from our economy.

An ounce of prevention is indeed worth a pound of cure, but with limited resources, we must seek innovative solutions to expand access to preventative health care and more efficient delivery systems. It’s certainly doable. The recent expansion of Insure Oklahoma - a program partially funded through our state’s tobacco tax - is helping more of Oklahoma’s businesses offer insurance coverage to employees. A partnership between OSU’s Center for Health Sciences and Mercy Health will sustain the Center’s mission to train physicians and care for the medically underserved in northeastern Oklahoma. I want to make more of these initiatives a priority in the 2016 legislative session. Improving the health of Oklahoma is critical to our overall efforts to help this state, our communities, and our citizens fulfill their greatest potential.

Edmond Ministries of Jesus Dental Clinic Dr. Kathy DeHart volunteers her time at the Edmond Ministries of Jesus with Sarah Martin, a volunteer dental assistant.

Patients at the Edmond Ministries of Jesus clinic experience a unique approach to their care. The integrated medical and dental clinic does not do a normal triage, but rather focuses on a guided self-evaluation of spiritual, emotional, relational and physical health. This reflects the clinic’s mission of bringing healing to the person in spirit, soul and body, in accordance with the passage in Luke 4:18-19. This type of healing is imbued in the Ministries’ medical/dental clinic, counseling center, recovery program, social services and caring support groups. The Ministries of Jesus, as a whole, blesses many lives – averaging 4,800 hours of one-on-one professional counseling, and helping hundreds of people find relief for their hurts, habits and hang-ups from various forms of addiction. The clinic has several thousand active medical charts of the patients it serves. The dental portion of the clinic provides onsite dental care as well as referral to offsite dentists for specific procedures. In its provision of routine cleanings, oral

hygiene education, restorative dentistry, oral surgery and dentures, the clinic recognizes that dentistry is an integral part of a patient’s overall care, especially for the co-morbidities of diabetes and heart disease. The goal is to treat all dental needs identified at the patient’s initial screening visit as well as to provide ongoing preventative care.

Ministries of Jesus was founded in 2001 and the dental clinic was established in 2009. The clinic is made up primarily of volunteers with many of the dentists and hygienists donating their time and services on a monthly basis. The clinic provides five volunteer dentists for general treatment and offsite dentists are available for procedures such as root canals and complete and partial dentures.

Patients truly make Ministries of Jesus their medical and dental home. The dentists make patients feel like they are cared for and part of a private clinic. They get to know the patients on a personal and spiritual level while providing care for them.

ADCF Appoints John Gladden to Foundation Board of Directors John Gladden, president and CEO of Delta Dental of Oklahoma and chairman of the Delta Dental of Oklahoma Oral Health Foundation has been appointed to the America’s Dentists Care Foundation Board of Directors. The America’s Dentists Care Foundation/ Missions of Mercy (A-MOM) was founded in 2008 as a not-for-profit corporation to address the need for quality equipment and its availability for Mission of Mercy events that benefit the less fortunate by providing them free dental care. Child Abuse in the Dental Setting By Kristin J. Woods, BS and Ryan Brown, MD When one considers who is most likely to note child abuse, dentists are probably not high on the list. Yet, given the many ways such maltreatment can be manifested, dentists can serve a critical role in the assessment and reporting of child abuse cases. The following article provides some insight into the broad spectrum of child abuse: its epidemiology and various types, how it may present in the dental office, and what you should do if you suspect that abuse has occurred. The Problem Before we can talk about abuse, we must first define it. The federal government’s Child Abuse Prevention and Treatment Act (CAPTA) defines child maltreatment as, at a minimum, “any recent act or failure to act on the part of a parent or caretaker which results in death, serious physical or emotional harm, sexual abuse or exploitation; or an act or failure to act which presents an imminent risk of serious harm.”1 In 2013, more than 3.5 million calls (involving over 6.4 million children) were placed to child protection services in the United States. After investigation, nearly 750,000 children were considered abused. In Oklahoma, there were 11,575 victims of child abuse in 2013.2

Types of Abuse To better understand child abuse statistics, it is important to consider the various types of abuse that can be manifested. In 2013, neglect was found in 79.5% of abuse cases nationally; other forms of abuse noted were physical (18.0%), sexual (9.0%), and psychological (8.7%). In Oklahoma, these figures were: neglect (68.2%); physical abuse (36.8%); sexual abuse - (5.5%); and psychological maltreatment (23.5%).2 The fact that the sum of Oklahoma’s abuse statistics exceeds 100% means that some children are exposed to multiple forms of abuse at the same time. As noted, neglect is the number one form of abuse. The same is true for dental neglect, which is defined by the American Academy of Pediatric Dentistry as “the willful failure of the parent or guardian to seek and follow through with treatment necessary to ensure a level of oral health essential for adequate function and freedom from pain and infection.”3 Dentists and their staff must differentiate between a caregiver’s lack of knowledge or awareness of the need for a child’s dental care and someone who has been previously given recommendations about a

child’s dental care needs, but failed to act. It is also prudent to consider a family’s ability to access recommended dental care resources. The availability of dental care, combined with the decision by the caregiver not to seek that care, should be considered grounds for a report of dental neglect to child protective services. It is important to consider manifestations of dental neglect during assessment of the oral cavity.4 Neglect exists on a continuum with multiple forms (early childhood caries, rampant caries, dental abscesses, facial cellulitis, gingivitis and periodontal disease and other conditions) possibly being present simultaneously. Physical abuse is what the general public envisions when child maltreatment is discussed. Physical abuse should be considered as a possible etiology in children with any type to trauma to the body. In the dental office, injuries to and affecting the lips, gingiva, tongue, palate, and teeth may be indications of physical abuse and should raise concern.5-7 Non-accidental oral injuries are usually due to blunt force trauma, but penetrating injuries inflicted with objects and thermal or chemical burns are also seen. Oral injury can


be easily missed by the general medical practitioner, unless he/she carefully inspects all perioral and intraoral areas, as well as the pharynx.3-4 Injuries to the head, face, and neck are common in children subjected to physical abuse; some studies report that nearly 50% of all physical abuse involves those regions.3-6 Facial bruising, particularly of the cheeks, ears, and sides of the face, should raise concern of possible physical abuse.7-8 Careful evaluation of the reported mechanism of injury and developmental assessment of the child can help in the determination of the plausibility of accidental injury as an explanation for the findings. Bruising or laceration of the lips is the most common abusive injury to the mouth.5 Mucosal lacerations, dental trauma, tongue injury, and gingival lesions can also serve as reminders of past physical abuse. Injuries observed in abused children showed 59% with facial injuries, but only 11% had recorded intraoral injuries, even though facial injury involving cheeks, nose, or lips overlying the mouth is common.4 Frequency distribution of mouth injuries include the lips (54%), oral mucosa (15%), teeth (12%), gingiva (12%), and tongue (7%).4 Dentists should be observant for manifestations of sexually transmitted infections in the oral cavity. As an example, palatal petechiae have been documented in forced fellatio. However, negative findings in a sexual abuse case do not necessarily mean that sexual abuse did not occur. Past history is of utmost importance. If child sexual abuse/ assault is a concern, it should be reported to the child abuse hotline and all efforts made for a forensic interview and exam. Reporting Child Abuse and Neglect In Oklahoma, Child Protective Services (through the Oklahoma Department of Human Services) is charged with identification, treatment and prevention of child maltreatment. CPS relies on individuals and institutions reporting possible abuse and neglect to accomplish this goal. Since anyone can report potential abuse, there are many different types of sources from which CPS can receive a report. A source is defined as the person or persons who notified a CPS

agency of alleged child maltreatment. Sources are grouped as professional, non-professional and unclassified. Professional sources (including medical professionals such as dentists) encounter the child as part of their occupation and account for 61.6% of all reports. Nonprofessional sources are individuals who do not have an occupation-based relationship with the child; they include neighbors, friends, or relatives. Unclassified sources include anonymous tips of unknown origin.2 State laws vary regarding reporting possible child abuse or neglect, but nearly every state (including Oklahoma) has a law mandating that certain professionals (medical, educational, law enforcement, etc.) and institutions (schools, hospitals, etc.) inform a CPS agency of suspected child abuse and neglect.1 Oklahoma further holds all individuals legally responsible to report suspected child abuse/neglect to a CPS agency.9 Further, Oklahoma law provides immunity for reporters of child maltreatment so that any person who in good faith and exercising due care reports suspected child abuse or neglect will have immunity from any liability that may be incurred from either the initial report or participation in the investigative process.9 To report suspected child abuse, the DHS Abuse and Neglect Hotline (1-800-522-3511) can be accessed 24 hours a day, seven days a week. What the Recent Changes to the Oklahoma Prescription Monitoring Program Mean to Oklahoma Dentists By M. Edmund Braly, DDS, ODA President-elect The most recent legislative session brought about several changes to the laws which govern the practice of dentistry in Oklahoma. Most ODA members are aware of the changes to the Dental Practice Act, as there was considerable and valuable grassroots input into that process over the last two years. However, another law was also passed which will have a huge impact on dental practices beginning November 1, 2015. During the last session, a bill modifying the Oklahoma Anti-Drug Diversion Act and its Prescription Monitoring Program (PMP) was passed after considerable debate involving all interested parties including, but not limited to, the ODA, the Governor’s Office, the Oklahoma Bureau of Narcotics and Dangerous Drugs (OBNDD), law enforcement departments, mental health advocates, the various professional boards listed below (a. through i.) and many other parties. Most dentists are aware of the previously voluntary Prescription Reporting Program (PRP) program and the associated website. The website is a repository of information about all prescriptions filled in Oklahoma, and required information about filled prescriptions to be forwarded to the OBNDDC in a computer format within five minutes of delivering the prescription to a patient or, for mail order pharmacies, within 24 hours of mailing the prescription to the patient. Access to the data in the OBNDD website had been limited mostly to prescribing providers, and accessing the information in the OBNDD website was voluntary. The Passage of the national

Affordable Care Act had far-reaching consequences, including this most recent change to the Oklahoma law concerning PRP rules. This article will summarize the details of these changes. It is incumbent upon any dentist who prescribes controlled substances to take care to follow the new rules, as failure to follow them could result in the loss of a license to practice. First, the new law modifies the previously voluntary program in eight ways: 1. It expands access to repository information to more people, specifically, national, state, county, and municipal law enforcement (“peace officers” and investigative agents of OSBNDDC), multicounty grand juries, additional office staff of prescribers, the Oklahoma Health Department, representatives of the Prescription Monitoring Programs in other states, and the following Oklahoma Boards:

a. Board of Podiatric Medical Examiners b. Board of Dentistry c. State Board of Pharmacy d. State Board of Medical Licensure and Supervision e. State Board of Osteopathic Examiners f. State Board of Veterinary Medical Examiners g. Oklahoma Health Care Authority h. Department of Mental Health and Substance Abuse Services i. Board of Examiners in Optometry j. Board of Nursing k. Office of the Chief Medical Examiner l. State Board of Health 2. It permits prescribers’ access to certain information on the website for certain purposes, namely, to be aware of the patient’s prescription


history for dangerous drugs. 3. It requires registrants (prescribers) or staff to access and review website data prior to prescribing certain drugs. 4. It requires prescribers to note in the patient’s record that the website data had been accessed prior to writing certain prescriptions. 5. It provides exceptions to these rules, specifically for those prescriptions written for Hospice and Nursing Home patients. 6. It directs enforcement of this law to certain state agencies. 7. It requires the Director of the OBNDDC to provide a monthly list of agencies listed above (in a. through j.) of “the top twenty prescribers of controlled dangerous substances within their respective areas of jurisdiction.” 8. It provides an effective date, specifically, Nov. 1, 2015, and to be enforced until at least Oct. 31, 2020, i.e., for the next five years. How will this new law affect our dental practices? Let’s review the above eight provisions: First, the data “repository” is a website that contains information on all prescriptions written for controlled dangerous substances in Oklahoma. It is designed to reduce prescription fraud, prescription drug abuse and “doctor shopping.” All dentists will be required to check the website data on a patient prior to writing any prescription for Opioids (including the synthetics), Benzodiazepines and/or Soma. The dentist must check the website prior to writing for the specified medications on every new patient and on every patient of record, for whom the website has not been checked within the last 180 days. Of note is the list of reasons a dentist could lose the ability to access the website and the license to practice. They include but are not limited to: 1. having falsified an application to OBNDD;

2. having been found guilty, pled guilty, or pled nolo contendere to a misdemeanor relating to any substance defined in this law as a controlled dangerous substance or to any felony under the laws of any state or the United States; 3. having one’s federal registration retired, suspended or revoked; 4. having failed to maintain effective controls against the diversion of controlled dangerous substances to unauthorized persons or entities; 5. having prescribed or administered a controlled dangerous substance from schedules other than those specified in the dentist’s state or federal registration; 6. having a restriction, suspension, revocation, limitation, condition, or probation placed on the dentist’s professional license or certificate or practice as a result of a proceeding pursuant to the general statutes; 7. having abused, within the past five years, or excessively used drugs or controlled dangerous substances; 8. having prescribed, sold, administered, or ordered any controlled substance for an immediate family member, himself or herself (shall not apply to a medical emergency when no other doctor is available to respond to the emergency); 9. having possessed, used, prescribed, dispensed or administered drugs or controlled dangerous substances for other than legitimate medical purposes or for purposes outside the normal course of his or her professional practice; 10. h aving been “under the influence of alcohol or another intoxicating substance…to such degree…as to be impaired during the performance of his or her job”; and/or 11. h aving violated any federal law relating to any controlled substances.

Dentists have long been well aware of most of the requirements above, but should pay careful attention to #8, prescribing for family members. It is probably not lost on the reader that each month, the Board of Dentistry will receive a list of the “top 20” dental prescribers of dangerous and controlled substances. Should the OBNDDC determine that a dentist is prescribing outside the limitations of his or her license, the Board of Dentistry will be notified in writing. This notification shall serve as a complaint to initiate an investigation by the Board of Dentistry, which shall have exclusive jurisdiction to take action against a dentist for this violation. There is a silver lining: A dentist “shall not be liable to any person for any claim of damages as a result of accessing or failing to access the information in the central repository and no lawsuit may be predicated thereon.” Transgressions will be dealt with by the Board of Dentistry, but not by a civil suit. As per the original law, no provider or staff members may access information about a person not under their care, and they may not make information about their patients known to others. The new law does require that the dentist “note in the patient record” that the PMP website was accessed prior to writing the affected prescriptions. It also allows the dentist to let the patient know that the information is known to the dentist, but it does not require this. Also, the dentist may include the information printed from the website in the patient’s record, but is not required to. The law makes no recommendations about what the dentist should do with the information gleaned from the website. It only requires that the dentist note in the record that the information has been seen. The website, of course, records each query, and who accessed the website. The law also allows that information will be pulled from the website any time there is a fatal and/or nonfatal overdose of prescription drugs. Care Enough to Provide an Exceptional Patient Experience By Debra Engelhardt-Nash In dentistry, “care” is a verb, not a noun. We care about our patients and care about people. And the way we care directly impacts the patient’s experience which, in turn, directly impacts case acceptance and patient retention. Providing exceptional care is a process of purposeful actions that require thought, effort, engagement by the entire dental team, and ongoing monitoring and evaluation. In a thriving and busy practice, there never seems to be enough time in the day. Unfortunately, this busy-ness may cause the team to focus on getting things done instead of oncaring for patients. If our tone and communications with patients seem rushed and distracted, they may feel unimportant to the practice. Take a breath and then a few minutes to purposefully communicate with patients, especially during the following touch points: 1. The telephone introduction. Over the phone, patients have no idea what your day has been like or if you are busy or not. They cannot see your body language or the seven things sitting on your desk waiting to be done. So, if you are distracted and focused on getting off the phone to attend to something else, they may interpret your words and tone negatively. It only takes a few moments to be warm and welcoming before you get down to the business of gathering insurance information and scheduling appointments. 2. The in-practice greeting. When patients comes into the practice, 38 journal | November/December 2015

they should be greeted by name with an attitude that projects an understanding that they have choices and the team appreciates that they have chosen your office. 3. The patient/doctor introduction. Take the time to respectfully introduce new patients to the doctor. “Mrs. Jones, I’d like to introduce you to Dr. Smith. As I mentioned, Dr. Smith has been doing amazing dentistry for more than 15 years. Dr. Smith, this is our new patient, Mrs. Jones. Mrs. Jones was referred to our practice by her friend, and our long-time patient, Mrs. Brown.” 4. The treatment and financial conversation. Patients should always be introduced to ideal dentistry. They may choose to phase their treatment, but they need to know you care for their oral health and want what’s best for them. Patients should also be introduced to all payment options if they have an out-of-pocket expense. If you accept financing through a credit card like CareCredit, let them know and then let them choose what’s best for them. 5. The post-appointment follow-up call. A personal follow-up telephone call to the patient is a great way to demonstrate how much your team cares. Many practices routinely call the patient after a hygiene or restorative appointment. But the best opportunity to make an impact on the patient relationship is by calling after the new patient examination and consultation. A new patient may have questions or concerns and when the office calls to provide additional information or just to let the patient know they are available, that patient’s expectations are exceeded. Caring Requires Consistency I recently walked into the gift shop of a high-end hotel to buy a bottle of water. After waiting at the cash register for a few moments, I walked to the back of the shop to find someone to ring me up. What I found was the hotel employee ranting to herself about how much she disliked her

job. Was she having a bad moment? Yes. But her words and attitude significantly and negatively impacted my perception of the hotel and my overall satisfaction. A patient’s experience in a dental practice can be impacted similarly if their interaction with just one team member is negative. Caring is a team effort. People tend to pick up and absorb the emotions around them. When your team is consistently warm, engaging, excited and appreciative, patients will tend to be the same. When one team member is having a “bad day,” they can easily “infect” other team members and patients as well. So be diligent in caring enough to help each other have positive interactions with patients. You’ll be surprised how infectious good moods can be, too. One final note: “The OBNDDC shall provide adequate means and procedures allowing access to central repository information for registrants lacking direct computer access.” That process is not currently known to this author. For those dentists who do not have internet access in their offices, it is important that they contact the OBNDDC and learn this process. One suspects the non-internet process will involve a fax machine. The Bottom Line •

A dentist who is not already familiar with the PMP website should become so as soon as possible.

The dentist may register to access data, and/or may assign certain administrative or clinical staff to also be registered to access the website (each employee will have their own registration number).

The law goes into effect November 1, 2015.

The medications involved are Opioids (including synthetics), Benzodiazepines, and Soma (a central acting muscle relaxant that affects barbiturate receptor sites).

No patient should receive a prescription for any of these medications unless the dentist has checked the data on that patient from the PMP website within the last 180 days.

The Board of Dentistry has jurisdiction for violations of this law.
