A Word from the President I can’t believe that we are already headed into April and the first three months of 2015 are complete. Our NCASP Board has been extremely busy planning for more exciting events for us. Here are some updates. Thanks for all of those members and guests who were able to join us in Charlotte for our Regional Event in January. The topic was NC Labor Laws: Hiring, Testing & Termination. Big thanks to Teague Campbell for hosting a great event for us. Thanks to Jill White for hosting our event in March at the Greensboro Country Club. The topic covered The EEOCs Strategic Enforcement Plan. Be sure to watch your inbox for details for more upcoming Regional Events soon! We are in full swing for the planning of our annual Spring Training Conference event at Wrightsville Beach in May. Cheryl Neely, our Conference Chair, and our Conference Committee have been busy putting together another outstanding event for our members. Our Friday keynote speaker, Danny Cahill, will be sure to deliver an outstanding presentation for you and your colleagues. Our Spring Training event will also include a full day for Certification on Thursday and we have already locked in our trainer to travel to Wrightsville Beach for us. Certification is so important in our industry and we are pleased to be able to offer our members this opportunity. We are also planning an Owner Manager “Inside the Recruiters’ Studio” Thursday afternoon that you will surely not want to miss. If you have not purchased your tickets and made your reservations, please do so as soon as you can. The dates again are May 14, 15, 16 so make your plans TODAY to join us. We need to look ahead and plan for our future as well and our future is in our leadership. If you would like to impact our industry in a positive way, consider joining our Board of Directors. Presented by Alan Gilbert, Director of Strategic Partnerships Essential StaffCARE an IAG Solution Alan has recently been promoted to Director of Strategic Partnerships for Essential StaffCARE, because Alan’s work experience allows him to have a unique perspective on our partnership relationships. Alan has shown great talent in articulating and explaining highly complicated ACA concepts to large groups of people. This has made him a go-to talent for hosting and conducting informational webinars for our partnership client bases. For these reasons, along with his passion for excellence, made Alan the perfect choice for his new role. As a former Business Development Executive, Alan has been responsible for the marketing of our limited medical benefits plan to staffing companies in the eastern region of the US, and maintaining our staffing association relationships in several state chapters as well. Before joining the ESC Team, Alan Gilbert was a District Sales Manager, for TALX Corp. a leading provider of HR, payroll, and tax consulting services. In this role, he was responsible for the sales of corporation tax consulting services to employers with greater than 5000 employees in the Eastern region of the US and developing existing customer relationships. Prior to TALX, Gilbert served as Corporate Sales Manager at ADP Inc., a provider of HR and payroll solutions. At ADP Gilbert managed business development for Pre-Employment Services, which included background checks, applicant tracking and tax credit and incentive services. Gilbert also spent several years in the 1990’s in the staffing industry working as an Area Manager for Olsten Staffing. With more than twenty years of experience in the professional services field, Gilbert has an extensive background in HR workforce solutions and Payroll services. He holds a double major in Business Administration and Insurance & Economic Securities from the University of South Carolina and is a South Carolina licensed Life and Health agent.

Creating Connections... Building Opportunities Together Finally the thrill of March Madness is behind us and it is time to get down to some serious industry training! It is also the time we are all ready for the winter season to be over and it lets us look forward to the upcoming time we will all be at the 2015 NCASP Conference in Wrightsville Beach. It allows us to look forward to sunny days, the smell of the ocean and the chance to add a few more tools into our recruiting box by getting the great training from industry experts. This year our conference theme is “Creating Connections – Building Opportunities Together”. There is no better industry that I know of that relies on these terms then the executive recruiting and staffing industry. Our building of connections helps us meet & match candidates to companies, vendors to buyers and helps to build long term opportunities with everyone we touch. It’s a simple theme but holds so much potential in how we grow our desk, office, company and our relationships. It’s such a great time in our industry and we are all busier than ever and I know it seems like there is no way you can take the time away from the business or office. What might you miss or what client needs might suffer if you’re away. Well the answer is none. This conference will give you the chance to learn real up-to-date information that can

help you find those hard to find candidates, help close that skill gap challenge you might be facing in your market and overall just rejuvenate you as to why this is such a great industry and remind you it can be fun & lucrative. Our 2015 conference committee has created several days of education, networking and fun. We do all of this in a non-competitive environment while supporting our industry. Who better understands the challenges of what we do then each other. So I ask each of you to round up your recruiting & staffing peers and ask them to attend this event as well. NAPS to Conduct Certification Immersion Class at NCASP 2015 Conference

The National Association of Personnel Services (NAPS) and the North Carolina Association of Staffing Professionals (NCASP) are pleased to announce that a Certification Immersion Class (CIC) will be held May 14, 2015 as a part of the annual NCASP conference at the Holiday Inn Resort in Wrightsville Beach, NC. The class is the training route that nearly 1,400 search and staffing professionals have taken to achieve their industry credential(s). Participants should prepare for the CIC by conducting a thorough reading and study of the NAPS Certified Personnel Consultant (CPC) Legal Manual or the Certified Temporary Staffing-Specialist (CTS) Legal Manual in the time leading up to May 2015 class. Each manual represents an overview of the numerous laws that govern the work of search and staffing professionals as they interact with individuals in their various employment transitions. The CIC will be taught by Dr. Frank Burtnett, NAPS Certification and Education Consultant, who is the author of the certification examinations. He will focus on “critical knowledge points” reflected in the manual and the key subjects included in the certification examination, including a review of the NAPS ethical standards and certification program rules. After the CIC, participants will take a paper/pencil version of the CPC or CTS certification examination. Date: Thursday, May 14, 2015 Location: Holiday Inn Resort, 1706 N. Lumina Avenue, Wrightsville Beach, NC Schedule: The CIC will begin promptly at 9:00am. The instruction typically runs to midday and is followed a half-hour lunch break and the two hour paper and pencil version of the certification examination.

If you look deep into the words and message of a true case study. It’s simple. It says you are a professional. An expert. You saved me time. You made me money. Because of you I have documented stats to show you what you did whether it be place a high level candidate, build a new website, create a video spot, etc. worked and it was an investment of my time and money well spent with your organization to do one thing - improve the sales and profits of my company. A recommendation, especially on LinkedIn has become a melting pot of false hopes, embellished success and a friends club to say, thank you for showing me a good time. I appreciate you buying me dinner. And I had a good time. When you take the time to understand the difference, you can see each for what they are. The first, a real testimonial of how you impacted an organization with your product or service in a specific documented way usually attached are stats, percentages, and real results. The second, more of a pat on the back for showing me a good time. I prefer the first method.

2015 NCASP Charity Our NCASP Conference Committee has selected the USO as our 2015 Charity which is a very worthy cause aiding our military as they travel around the world ensuring our freedom.

ABOUT THE USO OF NORTH CAROLINA The USO was established in 1941 to meet a United States presidential request for civilian support of the military. While the world’s first USO facility was opened that year in Fayetteville, North Carolina, the Jacksonville center opened in 1942 and has never shut its doors. It is the oldest continuously operating USO center in the world. It was from these roots that the USO of North Carolina was born. Today, we operate centers in Jacksonville/Camp Lejeune, Raleigh-Durham International Airport, Charlotte Douglas International Airport, Fort Bragg/Fayetteville Airport and a Mobile Center. Our mission is that heritage of service to the brave men and women of the Armed Forces who make sacrifices every day for our free and democratic nation. Our purpose is to serve and support America’s military and their families. Unless you have experienced it, it is almost impossible to describe the anxiety and challenges our military heroes and their families endure. Our most hardened warriors and their loved ones desperately need civilian support in order to stay connected to the society they selflessly serve. Our programs and services are designed to meet evolving troop and family needs and to support military leadership. They range from transition assistance and deployment care packages to airport USO Welcome Centers and our Food Pantry program. Our new critical direct service programs are addressing emerging needs for our troops and their families – needs that we must address so that they can adjust to their new normal. Even in the most tragic of circumstances, we are there in the form of our volunteer-led Honors and Family Support Teams for fallen heroes and their loved ones. As we have for 73 years, the USO of North Carolina continues to be here to serve. The USO of North Carolina provided over 575,000 services to active-duty men and women and their families and retirees in 2013. Our twenty-four employees and 750 volunteers spent 87 cents of every dollar we took in on USO programs and services that directly impacted our Armed Service members and their families. We build partnerships that create impact for our troops and for our partners. As Congress continues to make budget cuts and reallocate military funding, the USO must be there to provide the crucial programs and services our Armed Forces so rightly deserve. We invite you to explore the many ways we can work together and be there for our military every step of the way.

Operations Manager with Carolina Staffing Resources since 2012 What are your primary job responsibilities? Oversee the operations of the firm, client development along with staff training & leadership. In which industries and functions do you specialize? Our firm places in the Office & Manufacturing arena while also meeting clients Direct Hire needs. Which aspects of your job get you revved up? After 24 years in the industry I still get my adrenaline going with making the right placements with clients and connecting the right candidate to their future career. What’s one of your favorite recruiting/staffing stories? (something funny or poignant or just plain interesting) If you spend enough time in this industry you will find something funny every day! Which aspects of your job would you outsource if you could? So much of what we do is relationship building with clients and candidates so there is very little room to outsource things. Great relationships go a long way… Tell me about your professional life before joining your current company. I have been in the industry for over 24 years and started my career with Man Power. Along the way I have also worked in the Health Care Industry.

Why did you leave that industry for the recruiting/ staffing business? This industry allowed me to help those in need, earn a great living and expand my personal growth. How did your pre-staffing/recruiting life help prepare you for your current career? I have always been very customer service driven and love the human services side of life. Has your NCASP membership benefited you thus far? If so, how? Our membership and involvement in NCASP has helped us grow our business, created new friendships and provide great learning opportunities along the way. Why did you join the NCASP BOD? My owner Cheryl wanted me to continue the volunteerism of our company to this industry and our State organization. We firmly believe in what NCASP can do and provide for industry professionals like ourselves. Anything else you’d like to add about your personal or professional life? I may live in a big city now but I grew up in the Asheville area. We were a musical family growing up and I still till this day like to sing & hum a good tune. I have three sons, two dogs and two cats. I am blessed that my Mother is still here with me and I look forward to meeting & making new friendships along the rest of my journey.

U.S. Supreme Court Rules That Time Spent In Mandatory Security Screening at the End of a Workday Is Not Compensable The United States Supreme Court issued an interesting decision in December 2014 on whether employees who are required to undergo security screening after their work was done should be paid for that time. The Supreme Court found in favor of the employer, and concluded that workers did not have to be paid for that that time because the screening was a non-compensable “postliminary” activity under the Portal-to-Portal Act. In Integrity Staffing Solutions, Inc. v. Busk, the employer was a company that provided staff to work in warehouses for the online giant, Amazon. A group of workers filed a class action in 2010 against the staffing company seeking unpaid wages under the FLSA. According to their complaint, workers were required to pass a security screening at the end of the day in order to deter theft of product from the warehouse. The workers alleged that it could take workers up to 25 minutes to compete the screening process, for which they were not paid. Because the screening was allegedly necessary and for the employer’s benefit, the workers claimed they should have been compensated for the time. Initially, the federal district court dismissed the workers’ case for failing to state a viable legal claim. The district court ruled that the security screening was

a non-compensable “postliminary” activity under the Portal-to-Portal Act because it was not an “integral and indispensable part” of the warehouse duties the workers were hired to perform. The U.S. Court of Appeals for the Ninth Circuit disagreed and reversed, holding that the screening was a postliminary activity, but was compensable because it was necessary to the warehouse work and for the benefit of the employer. The employer successfully petitioned the U.S. Supreme Court to hear the case. In a unanimous opinion written by Justice Thomas, the Supreme Court reversed. The Court started with the proposition that the Portal-to Portal Act makes noncompensable “activities which are preliminary to or postliminary to said principal activity or activities” of a worker’s job. Citing its long-standing interpretation of the Act, the Court stated that “the term ‘prin¬cipal activity or activities’ [embraces] all activities which are an ‘integral and indispensable part of the prin¬cipal activities.’” The Court held that under the Portal-to-Portal Act, employers were not required to pay workers for postliminary activities that were not integral to the workers’ warehouse duties. The security screenings at issue here are noncompensa¬ble, postliminary activities. To begin with, the screenings were not the “principal activity or activities which [the] employee is employed to perform.” 29 U. S. C. §254(a)(1). Integrity Staffing did not employ its workers to undergo security screenings, but to retrieve products from ware¬house shelves and package those products for shipment to Amazon customers. The security screenings also were not “integral and indispensable” to the employees’ duties as warehouse workers. As explained above, an activity is not integral and indispensable to an employee’s principal activities unless it is an intrinsic element of those activities and one with which the employee cannot dispense if he is to per¬form those activities. The screenings were not an intrinsic element of retrieving products from warehouse shelves or packaging them for shipment. And Integrity Staffing could have eliminated the screenings altogether without impairing the employees’ ability to complete their work. As savvy HR professionals and in-house counsel know, this case does not create a blanket rule that renders noncompensable every activity after a worker leaves his or her work station. Each situation is different and will generally require a detailed analysis of the particular facts. Indeed, in this case, it took about half a decade in the federal courts to come to a final answer. The case is a relatively straightforward read, and contains a good history and discussion of the Portal-toPortal Act. For those who are interested, the Supreme Court’s decision can be found here.

Tips and Tricks for Marketing Contract Staffing It doesn’t take a marketing wizard to promote contract staffing services. In fact, as the popularity of contracting continues to grow, sometimes all it takes is letting existing clients know that you can place contractors. If you want to take your contract staffing services to the next level, though, you may want to try some of these proven marketing techniques that have helped recruiters establish and grow the contract staffing portion of their businesses: 1. Use existing marketing vehicles An easy way to get contract staffing job orders is to mention contracting in places where you are already promoting your direct hire services. These include your email signature file, business cards, standard fee schedule, newsletters or brochures, and automated “on hold” phone message. 2. Your website Perhaps your most important marketing vehicle is your website. Be sure to include information about your contract staffing services on your website so companies and candidates searching the Internet for recruiters who place contractors will find you. Many recruiters have TWO contract staffing pages – one for clients/employers and

another for candidates. 3. Social Media Social media offers plenty of ways to spread your contract staffing message even further.

• LinkedIn – Mention contract

staffing on both your personal and company profiles. Join LinkedIn Groups in your niche or start your own and share useful (not selfpromotional) information.

• Twitter – Think beyond job

postings and post relevant, useful information. Make your posts easier to find by using hashtags. Hashtagify.me can help you find hashtags for certain industries.

• Facebook –Facebook’s algorithm

keeps making it harder to get seen without paid advertising. Your information will have to be super-useful and maybe even a little bit entertaining to get organic rankings. Even if you don’t have luck with your posts, though, you may be able to find candidates in Facebook’s vast database by using their “Open Graph” search.

• Google+ – We don’t recommend spending a ton of time on G+ unless you are courting

technology and marketing professionals because they are the main ones using the site. However, it is good to have a presence there. Posting links to your blog may give you a boost in search engine results.

• Pinterest – While probably not be

the best way to reach clients, you may find it helpful to source and market to candidates, particularly creatives such as Graphic Artists and Web Designers who often share work on Pinterest. Find them by searching for terms such as “resume,” “cv,” and “portfolio.”

4. Blogging Search engines like blogs because their content is updated regularly. They also help you position yourself as an expert and give you something relevant to post on your social media networks. Some of these marketing ideas may work better for some firms than others, but they have all been proven to be successful by recruiters who have added contract staffing to their direct hire business. Give them a try to see what works best for your recruiting or staffing firm.

Seven Tips to Make the Move to Cloud UC Staffing agencies are rapidly embracing the cloud for flexibility, mobility and scalability, and unified communications (UC) is no exception. Infonetics Research predicts that the market for hosted UC and PBX services will grow by double digits to $12 billion by 2018. You can prepare for your move to cloud UC by following these seven tips: 1. Migrate to a cloud solution on your terms, at your own pace. Moving to the cloud doesn’t have to be all or nothing. If you’re invested in an on-premises UC solution, you may prefer a hybrid environment that lets you migrate to the cloud in steps. You can begin by moving your remote or branch offices to the cloud while leaving corporate headquarters with an on-site IP PBX. You can also start by moving specific services, such as mobility, to the cloud and keep your IP phones dialed into your on-premises server. 2. Review the network architecture for reliability, availability and business continuity. Are the core and distribution routers redundant with no single point of failure? Is the data center committed to 100-percent uptime? How is the backup data center configured and how are redundancy and failover built into the architecture across regions? Make sure your provider has a fail-safe plan for keeping your communications up and running so you can have the peace of mind to concentrate on your business. 3. Test for security and compliance. A multi-tenant model can leave gaps for protecting data. Talk to your cloud provider about how they are maintaining compliance, especially if you are in an industry that must follow HIPAA, Sarbanes-Oxley/Dodd-Frank or PCI requirements. Review the provider’s certifications and compliance with data center standards. It’s important to watch: Customer Proprietary Network Information, ISO 270012013, HIPAA/HITECH and PCI-DSS. 4. Compare cloud-based apps to existing apps. Define what applications your organization needs and compare that to what is available from the cloud UC provider. Cloud providers may support only a sub-section of apps found on the on-premises platform. Are you looking for mobile? Do you need web conferencing? Identify the apps used most within your organization and create a wish list of UC apps that can improve collaboration and communications and make sure the provider can support your short and long-term plans. 5. Adjust hardware and software budgets for reoccurring monthly fees. Cloud services eliminate capital investments and operations maintenance costs and replace them with monthly fees. Your line item costs will have big changes. Consider how the lower monthly fee will impact your budget and free up your capital. 6. Reassign departmental resources to other IT projects. Staff currently assigned to your communication systems will have more time on their hands. Move them to another high-profile project that leverages their problem-solving and expertise. IT and IP skills are in big demand so keep their valuable know-how on your team by immersing them in other interesting projects. 7. Prepare to leverage business intelligence. Cloud-based services collect data about your organization’s communications that can help you make decisions for increasing revenue, managing costs, staffing more efficiently and identifying new opportunities. Understanding who is making calls, the number of calls, call duration, where the calls are originating from and more can help you understand the health of your business and the productivity of each team member. Business intelligence is incredibly underused within most organizations. Harnessing this data and learning how to understand its value can give you an incredible edge over your competitors.
