As Federal Communications Commission Chairwoman Jessica Rosenworcel left the Sunnyoaks Fire Station in Campbell Monday, where she’d held a roundtable discussion with emergency and tech industry officials, the solar eclipse was traversing North America and she was in high spirits.

Here at the McCormack Training Center, she was just blocks from the global headquarter of Netflix, a company that recently weighed-in with support for her push to restore net neutrality.

“First of all, it’s beautiful,” she told the Los Gatan, looking around her at the area once known as the Valley of the Heart’s Delight, the birthplace of so many of the firms she regulates. “It’s tremendous to speak to the Santa Clara County Fire Department about just how to use technology to keep us safe. Here in Silicon Valley they’re taking advantage of those technologies like nobody else—and it’s terrific to see.”

Alex Rossmeissl, of Los Gatos, made the Fall 2023 Dean's List at the University of Puget Sound for achieving at least a 3.7 grade-point average, completing all of their enrolled courses without withdrawals, and having no incomplete grades.

GIRL SCOUTS TOUR CAMPBELL HERITAGE THEATRE

Friends of the Heritage Theatre Board Member Nandini Acharya spearheaded an effort to bring girls from local Girl Scout troops, along with parents and siblings, on a ‘behind the scenes’ interactive tour of the Heritage Theatre.

And on Saturday, March 2nd, a group of community volunteers invited local young people to experience the historic cultural institution in Campbell.

Theatre staff guided the scouts on a private tour of the venue to experience what it’s like to be one of the professional artists and technicians who make the theater come alive. The youth had an opportunity to speak through micro-

phones on stage, view the scene from up in the stage manager’s booth, check out lighting operations, see how sets are raised and lowered from the rigging system (called “the fly”), gaze into the same mirrors performers use to prepare and even hang out backstage in the green room.

The Campbell Heritage Theatre was built in 1938 and used as the auditorium for Campbell Union High School. When the high school closed in 1980, the City of Campbell took it over. The theater remained “dark” for more than 20 years before being restored and reopened on February 14, 2004.

Recount request submitted in 16th District race for Congress

The three-way 16th District race for Congress is now in doubt, since paperwork to initiate a recount has officially been filed.

Elections officials told the Los Gatan Monday that formal documents had been submitted to double-check ballots in the contest, which featured an historic tie for second.

In the race, former San Jose mayor Sam Liccardo got the most votes, with Assemblymember Evan Low and Supervisor Joe Simitian literally tying for the runner-up spot (they each received 30,249 votes).

Michael Borja, a spokesperson for the Santa Clara County Registrar of Voters, said that Pacifica resident Dan Stegink submitted the official paperwork to set a retabulation in motion, though the process still needed to be “finalized” for the machinery to kick into gear.

Stegink, a software developer and environmental advocate, said a tie made about as much sense to him as finding a bucket sitting in a parking lot with $1,000 inside, and pointed out there were a number of ballots with signature problems that weren’t included.

“Let’s have full transparency and take a look,” he said in a telephone conversation.

Borja said elections officials had not found another example of a tie in a congressional race in the county.

According to State law: “If only one candidate receives the highest number of votes cast but there is a tie vote among two or more candidates receiving the second highest number of votes cast, each of those second-place candidates shall be a candidate at the ensuing general election along with the candidate receiving the highest number of votes cast, regardless of whether there are more candidates at the general election than prescribed by this article."

One final signature recorded in the final hour of ballot counting in San Mateo County erased Low's one-vote lead.

Liccardo led his two top opponents by 4.5 percentage points, but approximately 60% of the district's registered voters stayed home in the March 5

vote. The presidential election turnout is likely to be more than twice the primary vote. With a comfortable 8,240-vote lead for the top spot on the November ballot, he has already begun piling up new endorsements and campaign cash.

Jim Irizarry, assistant chief elections officer for San Mateo County, said they’d received an official recount request at 12:55pm Monday.

“We’re just moving the process along,” he said. "When we have a request that comes in, the requestor really has a lot of latitude to determine how the process works."

In order for a recount to be valid, every precinct must be recounted, he added.

"Every election is a complex process,” he said. "We don’t do too many recounts."

In San Mateo County, a hand count costs around $84-85,000 total, while a machine count costs around $10,000 per day (but can be completed much more quickly).

Irizarry said San Mateo County requires a minimum deposit of around $5,000, adding a start date of April 15th is looking likely.

Beyond the typical issues with challenged ballots, Irizarry said there were "no irregularities” with the election.

Santa Clara County officials noted their recount fee is $320,000 for a 10-day hand count, or $84,000 for a machine count.

Stegink said he’s hoping the Boards of Supervisors in both counties will chip in, though he says he’s happy to pay part of the cost.

“I’m not going to pay $200,000 for it, but I’d be willing to submit a

LOCALS SAY ADUS OFFER SOLUTIONS

wanted to keep our daughter close and to have options. And then that knock at the door.”

A couple years ago, a member of the Monte Sereno City Council arrived at their doorstep with a pitch about adding an accessory dwelling unit (ADU) to their property. He explained 225 ADU permits will be issued at a 50% off the regular fee, which normally ranges from $9,000-10,000. Installing an ADU was a relatively new concept for Kong and Lee.

But they’d recently been learning that a first floor addition would involve a costly and inconvenient process.

And the couple had begun wondering if an ADU might make sense.

After all, it would be a complete independent living space at ground-level.

So, when this Council member informed them about the permit discount, it seemed like the perfect solution.

“It was providence,” Kong said. “This looked like a feasible option for us.”

As it turns out, the City also sees permitting for additional ADUs a perfect solution.

The City hopes pursuing this strategy will allow it to meet the State mandate for increased affordable housing.

Monte Sereno was supposed to have a substantially compliant Housing Element by Jan. 31, last year.

It still has not been able to achieve certification from the Department of Housing and Community Development, more than a year later.

The community has been trying to meet its Regional Housing Needs Assessment responsibilities entirely with ADUs.

The State has pushed back, asking for additional proof that Monte Sereno can fulfill its mandate solely with the carriage houses.

On Feb 21, the City submitted its fourth Draft 6th Cycle Housing Element for review and hopes to hear back later this month.

The ‘Build’

The knock on Kong’s and Lee’s front door kicked-off their ADU journey.

“As this is a relatively new idea, much research was needed.” Kong said. “We wanted a company that was based close to us.”

They decided on Abodu, primarily because of the turnkey approach and the fact there was a showroom just up

the peninsula in Redwood City.

Kong and Lee had originally thought to place their ADU in the unused front yard. However with the location of the powerlines and the necessary setbacks, the rear yard was the location decided upon.

Then, it was time to head to the showroom to pick out their preferred ADU model.

“At first we wanted the two-bedroom,” Kong said, and Lee agreed.

Lee understood that “if it was not feasible we would be refunded the feasibility fee.”

Kong added that “after seeing the model in Redwood City, we signed up.”

The assessment determined

they did, indeed, have room for the two-bedroom ADU, though it would cover most of the yard.

So, in July 2023, they selected the 500-square-foot one-bedroom, instead.

“We committed to Abodu with a contract at this point,” Kong said. “We were invited to a party to introduce a newly designed-unit that is close to 1,000 sq ft. This ADU is to be made of two sections, and will be not so narrow, as current units are, the two sections will be assembled onsite.”

This caused the couple to wonder if they’d made the right choice.

So, they discussed it with their daughter.

“It’s bigger than the dorm room that I have been living in for the past four years,” she said, upon considering the smaller model.

“We, along with our daughter, felt the

one-bedroom was perfect,” Kong said.

The ADU comes with electric wiring and ready for hook-up to water and sewer connections.

There are also many add-on possibilities: a handicap bathroom, solar power, upgraded fixtures etc.

“Customization would add potentially $30,000,” Lee said. “We also looked at ordering a handicapped bathroom and this would have been at least $5,000.”

They did, however, go for the optional external gutters.

Kong and Lee knew that Abodu would be working with the City on utility permits, and as soon as these were granted, construction would start.

Abodu submitted these plans— at the discounted rate—and pulled all permits.

from a concrete truck on the street through a pipe to the rear of the house. The couple noted Abodu even notified the neighbors of the dates of any construction activity that might inconvenience them.

The unit was carefully placed on its foundation, though it would take several more weeks, they were told, to complete finishing work.

Their ADU is scheduled to be livable by April 26.

“That is the goal that Abodu helped us to reach,” Lee said, noting they’re “overall very satisfied. We expected to be more involved with interfacing with the City.”

Safety was a concern, and many felt we are not quite there yet.

If other people are interested, do not have your heart set on size and location. In the end, we settled on the one-bedroom to maintain more of our yard. We fluctuated between the one- and the two-bedroom.”

The couple says Abodu was quite flexible with their decision-making process.

Unfortunately, a bit of their front yard, which was their entry point for the crane to get onto the site, was disrupted from the machine’s counter-balance.

This damaged part of the front lawn and some plants.

But they’d been prepared for this possibility, so it wasn’t such a big deal.

In fact, they even had their gardener turn off the sprinkler system ahead of the big day.

Tom Berchem of Abodu says they recommend placing ADUs at least 10 feet from the primary residence.

“California has statewide ADU regulations and local municipalities have to also follow those guidelines,” he told the Los Gatan. “In other words, there's not much cities can do to prevent homeowners from adding an ADU to their property.”

SOLDIERS VICTORIOUS AT NATIONALS

Los Gatos fourth-grade team finishes 22-1

Three teams from the Los Gatos National Junior Basketball (NJB) program won national championships last month to cap the 2023-2024 winter season.

Within the NJB’s top division, All Net, the Los Gatos fourth- and

eighth-grade boys team captured titles. Los Gatos’ eighth-grade boys divisional team also won its respective national tournament. All of the championship games were played on March 10 at the Map Sports Facility in Garden Grove.

Nathan Sanders, who doubles as a Los Gatos chapter NJB board member and co-coach of the fourthgrade All Net team along with Mason Powell, praised the players’ parents

for their unwavering commitment and support.

The All Net fourth-grade boys team defeated Newport Mesa Blue 37-28 in the final amid raucous fan support.

“It was pretty impressive because we traveled pretty heavy (to Garden Grove),” Sanders said. “All of the parents came and some of the players had extended family from the LA area. Even some of the Newport coaches said the same thing about our

fan support, because we literally had three times as many fans as they did. And they’re literally 15 minutes away from the facility.”

The All Net fourth-grade team also known as the Los Gatos Soldiers includes Aziz Khouzam, Sean Garcia, Parker Fanoe, Allen Xiang Hao, Liam McDonald, Solomon Petros, Greyson Wells, Hunter Sanders, Milo Pruett, Vonn Marshall and Ronnie Fairley.

CHAMPIONS The Los Gatos All Net fourth-grade boys team defeated Newport Mesa Blue 37-28 in the championship game of the NJB National Tournament in Garden Grove on March 10.

Incidentally, the Soldiers lost their first game of the season before running the table, finishing 22-1. They went 14-1 in the regular season, 4-0 to win the Silicon Valley Sectional Tournament and 4-0 in capturing the National Tournament.

The Soldiers played Newport twice at Nationals, once in pool play a 4240 decision and again in the championship contest, a 37-28 victory. Even though the pool play result was numerically closer, Sanders said the title contest was equally competitive.

Los Gatos was up by six points with 45 seconds remaining when Garcia drained a 3-pointer to give the team some breathing space.

“They (Newport) were up for a little while in the first half, so it was close,” Sanders said. “Both games were close with those guys. In the first game, we were up by five points with 14 seconds to go when one of their kids threw up a prayer and banked in a corner 3-point shot. But then we brought the ball up the court and closed out the game.”

Sanders said the backcourt of Marshall and Garcia was instrumental in the team’s success. Marshall manned point guard duties, Garcia played shooting guard and both ended up being the team’s top two scorers.

“Vonn is a good ball handler, passer, 3-point shooter, moves well off the ball and spends a lot of time developing his skills,” Sanders said. “And Sean is a good 3-point shooter, takes the ball aggressively to the basket and finishes with contact. He’s crafty scoring around the rim.”

The team hurt opponents both on the perimeter and on the inside, with Fairley and Khouzam controlling the paint area.

“Those guys were our biggest post players and dominated in rebounding,” Sanders said.

Marshall, Khouzam, Garcia and Hunter Sanders the coach’s son have been on the same team the last couple of years, resulting in cohesive play.

“That’s why we have good chemistry, because the boys have a lot of experience playing together,” Nathan Sanders said.

The Los Gatos All Net eighth-grade team coached by Jack Beibel and Cristo Ortega proved clutch in Nationals, defeating a Centennial Hills squad that it had lost to in pool play one day earlier. Los Gatos’ 48-45 victory in the championship game came just hours after a 45-40 win over Lemoore in the semifinals.

Barbara Van Schewick, professor with the Stanford Law School, described net neutrality as “we the people” getting the choice about what to do online.

“We get to decide what sites we visit, what apps we want to use, what videos to watch, and the companies we pay to get online don’t get to interfere with

online or block websites,” she said. “It’s vitally important that every one of us can go where we want, do what we want online, without our broadband provider making choices for us.”

She characterized net neutrality as “court tested” and “wildly popular” amongst consumers and businesses.

“But today we were able to talk about what it means for public safety,” she said. “Because when our firefighters are going to dangerous environments, they want to know that they have an internet that they can count on.”

Verizon told the Los Gatan it is committed to an open internet.

“We do not prioritize traffic in a way that harms competition or consumers, and we offer transparency in what we do,” a spokesperson said. “That commitment was put in place several years ago and remains in place today.”

The company also said it maintains strong support for public safety agencies.

“For three decades we've worked hand-in-hand with public safety agencies and first responders on the front lines delivering mission critical communications where and when they're needed,” the spokesperson said.

Earlier this year, Netflix argued Americans should have the freedom to access the websites of their choice without any interference from carriers.

“ISPs should not be permitted to block or throttle such access or engage in paid prioritization, and should be required to be transparent about their network management practices,” reads the Jan. 17 submission signed by Thomas Volmer, head of global content delivery policy and Diana Oo, head of US federal affairs. “Netflix members depend on a well-functioning, content-agnostic Internet for unfettered access to our TV shows, movies, and games.”

Cheryl Scimone, a 59-year-old resident of Los Gatos’ North 40 neighborhood said while she wasn’t familiar with the term “net neutrality,” she could see why it could be seen as important.

The FCC is seeking the ability to force companies to address internet outages and beef-up consumer protections. A vote has been scheduled for April 25.

By Tuesday around 3pm, Stegink said he’d spoken to Santa Clara County, but had not yet heard from San Mateo County.

Stegink said he interprets State law to say that the counties must pay for a recount if there is a tie and the new tally reveals the first delivered an incorrect total.

"The goal here is to put together a recount request that I can pay for part of and the county realizes that, Oh we’re not going to recover on this,” he said. “Statistically, mathematically, this is an impossible event."

He denied launching a recount at the behest of Liccardo.

"I’m not part of the Sam Liccardo campaign,” he said. "I haven’t taken a dime from him or endorsed him."

In fact, he said, he initially put down both Low and Simitian when indicating which candidate he was filing on behalf of and which candidate’s total he’d like to see changed.

However, he told the Los Gatan, he designated Low, in the case he had to select one.

“I picked Evan Low alphabetically,” he said.

Stegink says he will ask for a machine recount, because it’s cheaper.

"I do believe that a machine count would not reflect the hand count total that they’ve come up with,” he said. "It’s cheaper. It’s a minimum risk argument."

When asked about his motivation, he said he wants the local member of Congress to be elected by a majority, in part to prevent the Republican Party from being able to throw their weight behind a particular candidate.

"I am a progressive at heart,” he said.

Stegink confirmed that as long as the counties agree to his interpretation of the refund rules, he's willing to front the money to get the ball rolling on the recount.

"If there’s not a chance that I can recover the funding for this…then there’s no benefit for me,” he said, adding, "I can guarantee that a recount will take place.”
