As publisher of LUMBERMEN’S Equipment Digest I rarely use these pages for sharing my opinion. We strive to keep this publication true to its goal of “Bringing Buyer and Seller Together”. But on occasion there comes a situation that prompts me to break my silence. The issue of False Patent Marking is just such a circumstance. Just moments prior to writing this, I was happily ignorant of the threat posed upon the free world by the dangers of False Patent Marking. In a recent conversation with longtime advertiser, Tony Pawlosky of Saw Paw, the manufacturers of the one piece Saw-Claw. This 20 year-old invention combines a high quality carbide saw bit with a one-piece shank to improve performance and reduce costs. I was unaware that Tony had been in “LAWYER HELL” for the past several months. Noticing that his website was down for revision I inquired as to whether the internet design division of CC Enterprises could be of service. That’s when I found out WHY it was down. As I stated, Tony patented his idea over 20 years ago. He was granted 17 years of protection. Being like the rest of the world Tony went about his business making customers happy and selling his product – until a suit was filed against him in US Federal Court. This suit, he found, was part of one of the worst abuses of the US Justice System that I’ve ever heard of. It is called a qui tam action (from the Latin phrase meaning “he who brings a case on behalf of our lord the King, as well as for himself”) and is part of the False Claims Act, 31 U.S.C 3729. This statute was first passed in 1863 to prevent “false or fraudulent claims to the United States”. Basically the law, as I understand it, was intended to stop misuse of patent claims and patent pending claims, the key here being that, the person filing the suit NEED NOT HAVE BEEN PERSONALLY harmed by the defendant’s incorrect or improper patent claim. The problem becomes completely disengaged from reality (unless you’re a lawyer looking to extort a few easy bucks) when this outdated statutes is used to put forth a “non-pertinent or expired patent claim” on a product constitutes a false or fraudulent claim under 35 U.S.C 292. In other words if you mark a product as “patented” or “patent pending” where no patent has been issued, applied for or if a patent has expired that would be actionable ONLY if done “for the purpose of deceiving the public”. Problem is that most companies, large and small, get a patent to protect their intellectual property, but are unaware that once the term of that protection has expired, they are no longer allowed to mark it as patented – go figure! So, as was the case for Tony, a lawyer found that he had exceeded his patented protection period and doing his civic duty to...
