Today’s trends include condo living Today, the experience of going with a newly built home is very different from that of the past. One of the trends we are seeing is that many of Regina’s newly built homes tend to be of the multiunit variety rather than the single, detached home. Just a few years ago, 60 per cent of new homes were single-detached and 40 per cent multiunit. However, today it is the other way around, as more and more consumers are deciding to go with condo living. Chances are, if you are looking to move into a newly built home, many of you will be considering a condominium. We are living in an era of customization. With customization, you have choice over how your newly built home will look and feel, and the end result is a home that is truly your own. But, do these same advantages apply when purchasing a newly built condominium? “The answer is a resounding yes,” said Stu Niebergall, president and CEO of the Regina & Region Home Builders’ Association (RRHBA). “When one thinks of a newly built home, being able to design your own home and having choices regarding its features and finishes is a large attraction to many buyers. When purchasing a newly built condo, many of these advantages still apply”. When it comes to the interior of the unit, customization is the name of the game, although the options will vary with each builder and depend on the target market of the particular condo development. Options for customizing your condo frequently deal with

features and finishes rather than design, and normally include a choice of floor coverings, cabinetry, countertops and back splashes. Paint colour, light fixtures and hardware are other areas where you can make your mark to personalize your newly built condo. Some builders offer options for trims and mouldings around doors and windows, baseboards, and ceilings. The same applies for granite countertops and tile or hardwood floors, although these would likely be considered upgrades, depending on the target market of the development. Many builders will include the assistance of a designer to help in choosing the right combinations that best suit your taste and lifestyle. “There are many advantages to starting fresh and going with a truly new condo,” Niebergall said. For starters, today’s home builders offer designs that are highly functional, with efficient use of space, and new condos stress spaciousness rather than square footage. An open layout or great room — a large informal space for living, working, eating and relaxing — is a popular feature in today’s newly built condos. Also, watch for well-appointed, organized workspaces. Today’s condos are generally designed with plenty of built-in storage and conveniences that include ample closet space, drawers, cupboards and shelves, and linen closets. Look for other conveniences such as laundry rooms on the main or second floors, built-in pantries and attached garages with direct access to

mudrooms off the kitchens. Niebergall said that home building designs, materials, techniques and systems have advanced significantly over the last number of years, creating more energy efficiency. Generally, energy-efficient, double-glazed windows are the standard, with an upgrade to triple-pane windows. Thanks to the great advances in the construction and sealing of windows and doors, today’s new condos are light and bright, with less worry about heat loss in the winter and overheating in the summer. “In addition, energy-efficient mechanical systems are designed to be more environmentally friendly while saving you money on your energy bills,” Niebergall said. When condos are attached in groups, fewer exterior walls also add to their energy efficiency. Appliances manufactured today are also significantly more efficient than those of even a decade ago. Brand name products are another great advantage of going with a newly built condo, offering solid value in terms of quality, performance, warranty and after-sales service. The types of brand name products will vary with each builder and depend on the target market of the particular condo development. Purchasing a new home is one of the largest investments many of us will ever make, and therefore it demands many special considerations. When purchasing a newly built condo, there are additional items to take into account in discussions with your builder

regarding the common elements, condo fees, bylaws, etc. As such, choosing the right builder is just as important as choosing the right condo. “You will want to ensure that you are dealing with a reputable and qualified professional, who provides after-sales service and warranty,” Niebergall said. The place to start is with the RRHBA. All builder members must be members of a third-party new home warranty program that provides protection to consumers. At a minimum, it generally includes deposit insurance and protection against defects in work and materials, as well as major structural defects. When you are dealing with an RRHBA member, you are dealing with a builder who has agreed to abide by the Code of Ethics and who has met the association’s qualifying criteria. Perfect perennials By Carol Todd For L-P Specialty Products

Annuals may provide a quick bright splash of colour, but perennials are perfect for the long-term enjoyment of your yard. Perennials are those plants that return to Carol Todd our garden year after year, unlike annuals that will not survive our cold winters and therefore last only one summer. While perennials may cost more, they don’t need to be replaced each year, saving you money in the long run. One of the great things about perennials is that many of them can be divided to form new plants for other areas of your yard — or to share with family, friends and neighbours. Most older perennials will benefit from division. The method and timing of dividing perennials can vary from plant to plant, so check a reputable source, like Lois Hole’s Perennial Favourites, for details on your favourite perennials, including how to divide and replant them. Regina and area are considered to be in Zone 2, according to the Agriculture and Agri-Food Canada 2000 plant hardiness guidelines. The zones are just guidelines, however, and many Zone 3, or even higher rated, plants may grow well in southern Saskatchewan. There are also numerous factors, such as wind protection, location and elevation; that can result in “microclimates” that may make growing conditions in your yard different from your neighbour’s. Choose plants rated Zone 2 or 3 to be more certain they will overwinter here, but take a chance on higher rated ones to see what happens — you just never know! Native prairie plants are the hardiest — most garden centres label the plants as such, or you can contact the Native Plant Society of Saskatchewan for more information. Be careful, though, many

native plants, such as Achillea millefolium (common yarrow) may take over your garden or even, like Lythrum salicaria (purple loosetrife), are considered invasive by the Province and shouldn’t be grown at all. Planning your garden In addition to considering the micro-climate of your yard, the other factors to take into account with perennials are growing conditions, height, colour and blooming period. Colour selection is generally a matter of personal preference, with a nod to blending in the colours with your house’s paint scheme. You’ll want to place the taller perennials toward the back of your flower bed (or in the middle of a circular bed), medium-height plants next and, finally, short plants for the front of the bed. A note here on raised flower beds — while they are very attractive, it is highly unlikely that perennials will survive the winter in them as their roots will be beset by the cold from three sides. Choose perennials that have constant, or varied, blooming times to ensure your yard blooms all summer and fall, not just in one big blast of blooms with nothing but green the rest of the time. The tags that come with most plants usually provide that information, along with the optimum growing conditions for that plant. It is a good idea to put plants with the same growing requirements in the same area to ensure they have the right conditions and to make it easier to give them the proper care.

Planting It’s not too late to plant perennials in late summer or even fall, and many perennial bulbs, like lilies and even garlic, actually prefer fall planting. The ground is much warmer in late summer, which contributes to strong root development. Warmer soil is also drier, easier to work and provides better drainage. The cooler day-time temperatures in late summer and early fall are also less stressful on new plantings than the heat earlier in the year. The difference between day and night temperatures that time of year also signals the plants themselves to begin preparing for winter. Gardeners can help encourage plants get ready for winter dormancy by not fertilizing past the middle of August and by cutting back on watering. Late summer and fall are also good times to pick up some deals on perennials, as most garden centres have their products on sale to eliminate having to carry stock over the winter. Check the plants carefully, though — they can be root bound, where the roots have outgrown the pot. Buy only healthy-looking perennials with good new growth at the base, not those

with the most flowers. When planting, gently untangle the roots and add some bone meal or other fertilizer with a high phosphorus content to encourage root development. Some people think it’s necessary to pull all the annuals and cut down all the perennials in the fall. And, that’s fine if you want a perfectly clean-looking yard. But, the snow covers up most of those ragged plant tops, and leaving them standing over the winter helps trap the snow, providing another layer of insulation for your perennials. Pull your annuals if you wish and cut off any seed heads from the perennials, but otherwise leave them standing over the winter. Except for lilies and peonies, where leaving the stalks standing can contribute to disease. In the spring, just take the whipper-snipper and cut them all down and carefully rake out the beds with a lawn rake. It’s fast and easy, and better for the plants. So, head down to your favourite garden centre for a plethora of pretty, perfect perennials and enjoy some happy gardening! (Carol Todd is a Regina area horticulturalist)

Increased protection for condo buyers What to keep in mind when buying a condo “Talk to people that are in the existing building — owners that are there, if you can,” said Gerry Cairns, president of the Canadian Condominium Institute (CCI) South Saskatchewan Chapter. “Read the estoppel. Talk to your lawyer about the estoppel. You have to get that — it’s one of the conditions — and that should tell all. Don’t be scared to ask. I think it’s very important that you review the package with the lawyer — the lawyer should review the package with the buyer.”

incomplete property. “The amount [of the bond] can change as situations change,” said Cairns. Condo owners now have more power in dealing with the conduct of the board or condominium associations, ensuring that they perform their duties. “Associations have to have better governance,” said Cairns. “The biggest thing is that, to make changes in bylaws or have a special resolution, you need at least twothirds of the vote from all owners, not just the majority that show up at the AGM, and I think that’s important for owners. It makes it a little more difficult on boards, but at least you know you have the majority agreeing and approving — it’ll make them work a little harder to get everybody out at the meetings.” Not all of the regulation modifications are aimed at assisting condo owners, however. They also assist condo board members in carrying out their responsibilities in collecting fees from owners. Cairns said, “Boards can now recover some of their costs a little easier. If there are some arrears in fees, now there’s a maximum interest rate that can be charged, and then they can go through the courts to collect. The only resolution they used to have when there was a delinquent account was to go through small claims.” Legislation changes are also in effect regarding condo insurance, but they affect only bare land condominiums, where each dwelling is entirely contained on one unit of land and the building and land are the responsibility of the individual unit owner. Typically, bare land condominiums are single-detached homes, duplexes or townhouses. Under the amended legislation, bare land condominium owners are responsible for insuring components of the interior of the home, such as walls, ceilings and flooring, such as carpet, hardwood or linoleum, while condominium associations are responsible for insuring the external components of the building, including any plumbing and electrical connections up to the unit. “They never had to have building insurance on bare land before, and now it’s up to the condominium association to make sure that happens,” said Cairns. “Before, bare land condo associations could determine whether or not they would obtain insurance as a corporation. There was always some confusion, not only in how it was set up, but who was responsible for

Formed in 1982, CCI represents all participants in the condominium community. This September, the South Saskatchewan Chapter is offering seminars on changes to the Saskatchewan Condominium Property Act. On Sept. 2, general changes to regulations will be the topic of discussion and on Sept. 16, the changes to the legislation as they relate to bare land developments will be discussed. “It will be just a general conversation — a round table discussion — on bare lands, which is really needed in Saskatchewan to make people more aware about what’s happening,” said Gerry Cairns, president of the CCI South Saskatchewan Chapter. what, so it’s a lot simpler now — there’s some clarity of insurance obligations between the unit owner and the corporation.” However, any upgrades to condominiums, whether or not they are bare land developments, are not insured by the condominium association. To ascertain what was included in the basic condominium, each condo must have a standard unit description. “If there was a total destruction or a good part of destruction by fire or flood, it would only be insured by the condominium association to the actual standard that was originally built, not the upgrades,” said Cairns. The description of the standard condo is included in the estoppel, a certificate issued by the condominium corporation to give potential condominium purchasers information about the specific condo unit and the association that manages it. This allows potential buyers to make educated decisions about their purchases. Further changes to the regulations will not take effect until April 1, 2015, which will allow associations to plan for the additional costs that may ensue. Corporations managing 50 units or more must have their financial statements audited by a chartered accountant or a CMA every year. Corporations of 12 to 50 units must have statements audited unless a minimum of 80 per cent of owners take part in a vote and 100 per cent of those who vote consent to have them merely reviewed. Condominium corporations of fewer than 12 units are not required to have financial statements audited, but they must be reviewed and consent must be given by 80 per cent of the owners. Consent must be obtained on an annual basis for all of the above.

A further amendment states that, beginning on April 1, 2015, condo associations must complete a reserve fund study to determine what major expenses might be imminent every five years instead of every ten years. Cairns is pleased with the amended legislation. “There’s a lot more protection for the potential purchaser. I think the condo conversion and bonding of developers makes a major difference for purchasers, and disclosure statement that associations and developers have to give help everybody. The estoppel form has changed significantly. Part of the disclosure in the estoppel is defined a lot better for the purchaser. You have to disclose a little more detailed information – the insurance, the reserve fund, the status of the actual unit, if there are any moneys owing, or what potential things might be or what has been struck out from the reserve fund that they are trying to cover some other way. So, just general disclosure has been upped, which is great,” he said.

Saskatchewan’s real estate market is changing: the province’s rapid growth and the resulting escalation in prices have necessitated a more diverse selection of housing choices. In the not-too-distant past, 60 per cent of new homes were single-detached and 40 per cent were in multiunit developments; now the numbers are reversed, and many of these new multiunit developments are condominiums. The provincial government became aware of that trend and recognized the need for a review and revision of Saskatchewan’s Condominium Property Act, which regulates condominium sales and management. Gerry Cairns, president of Canadian Condominium Institute (CCI) South Saskatchewan Chapter, believes the changes are very positive and will result in more protection for condo purchasers and a clearer understanding of what is required of condo developers and the boards that manage the day-to-day operations of the properties. “I think we have enough consumer protection now; I think we have all the basics covered,” he said. “There was a lot of consultation with condo owners, board members, professionals like insurance [providers] and property managers.” Along with adjustments in Saskatchewan’s real estate market that are being advanced by a strong economy, the province’s rental market now has a very low vacancy rate. Concerns regarding this have been addressed through the legislation changes by limiting of conditions under which condo conversions can be undertaken. “There’s a restriction put in place that you can’t convert existing rental properties unless the vacancy rate exceeds 2.5 per cent. That’s to protect the rental market,” said Cairns. The City of Regina already has tighter restrictions in place and reconsiders and approves applications for condominium conversion only when both the Regina Census Metropolitan Area Vacancy Rate and the Zone Vacancy Rate (according to the Canada Mortgage and Housing Corporation’s rental market surveys) are three per cent or more. In areas where condo conversions may be undertaken, legislation is now in place that will protect buyers from facing unforeseen expenses. Previously, residents of newly converted properties may have found themselves facing costly maintenance and repairs once they moved in. Now, buyers will know more about the property they are purchasing and what expenses they can expect to incur in the coming years, and there will be funds in place to cover some of those expenses. “There would have to be a reserve fund study [on any properties converted to condominiums], which would show exactly what’s required to keep it up to snuff. They have to do a projection of longevity of components,” said Cairns. “Say that the heating and ventilation has to be changed — they are more aware of what they can expect when they buy. There’s a lot more in the disclosure package. That was never there before, so that’s a very positive addition for potential buyers.” In addition to the disclosure, it is now mandatory to provide a reserve fund to cover the predicted expenses. Another problem being addressed by the legislation protects condo buyers from delinquent developers. Under the previous legislation, if all of the components of the common property of the community were not completed by the developer, the responsibility for completing the work fell upon the condo owners. With the amended legislation, developers must provide a bond to cover any
