What about a Condo? One of the concerns we hear about moving to a condo is the enormous monthly condo fees! And it is true that a condo lifestyle is exactly that, it is a lifestyle and it may not be the most “cost effective” lifestyle you can have, however, if you consider that you don’t have to shovel the snow or cut grass or if you like to travel, just lock the door and go, someone is always around the property, and usually most general maintenance items are done for you. Often parking is underground if you have a car. It is important to note that some buildings have different inclusions, rules and work differently and it is important that you know and understand what you can expect. There are documents referred to as a “Status Certificate” that you will want to review with your lawyer or your Realtor before you make a firm commitment when purchasing. These documents include the financial health of the Condo Corporation, as well as rules, bylaws, and any special items that are going to affect your enjoyment.

Warning: I have heard too often from families that they bought a condo for dad, or mom only to find out that it did NOT solve the problem of isolation. Generally, a condo is not a social environment, unless the resident themselves are outgoing and make a point of making friends within the complex. Condo fees Can vary depending on the amenities of the building, how well the building has been operated, age and if utilities are included in the fees or if they are paid separately. What is probate? What if there is no Will? Probate is the process our legal system uses to approve a person’s last Will after his or her death and to confirm the appointment of the person(s) named as Executor(s) in the Will. If a person dies without a will then he or she has died “intestate”. Since there is no Will to give authority to an Executor, a Court application must be made to give a person legal authority to administer the estate and distribute the deceased person’s property. As part of the application process, the beneficiaries of the estate, which will be determined by law since there is no Will, will need to be notified of your application to the Court and a majority of these beneficiaries will need to consent to your application. The application is almost identical to the probate process with a Will but the document produced at the end of the process is called a Certificate of Appointment of Estate Trustee without a Will. All the same fees as are required to be paid in the probate application with a Will must be paid before this appointment is finalized. Conditions can also be imposed by the Court when granting the appointment, such as a financial accounting during the administration of the estate.
