DESCRIPTION: Injured Worker Advocate Dina Padilla Challenges Corruption at FAC/CA Insurance Department Injured worker advocate Dina Padilla attended a meeting of the California Fraud Assessment Commission FAC in Sacramento on 9/9/2009 and challenged the Commission which is under the Department of Insurance for a conflict of interest. The chair of the commission William Zachry is also a Vice President of Safeway Inc. Risk Management and has done damage control for the insurance industry. Steve Poizner, who is the California Insurance Commissioner has also personally been presented with evidence of fraud by insurance companies and employers and has also refused to prosecute. As a result of deregulation of workers compensation which which Zachry and Poizner supported injured workers are forced to go onto SSI and other government agencies in a cost shifting scam with the tax payers picking up the costs of getting injured on the job. www.workersmemorialday.org - Dina Padilla can be reached at dinaJpadilla@gmail.com Transcription

DINA PADILLA: ..before, it happened to me by Kaiser, along with hundreds of others, and it’s still happening by Kaiser.... while other self insured employers that funds this commission.... This commission to me is to help perpetuate fraud and corruption. I’m not going to say this isn’t a a personal issue, because this affects many people. I’d like to know Mr Zachary how you get funded..... to do your job here? Does Safeway pay for it, does the state of California pay for it?

they save Ok, they give everybody else money, but they’re not giving it to the injured worker. But, I have to..... I’m going to read two little things and then I’ll be off. DINA PADILLA: [reading from the Risk & Insurance pmsionline article, “5 States of a Claims Adjustor’s Job written by Bill Zachary] (WILLIAM (Bill) ZACHRY words): • “When the employee is an unskilled worker with a relatively high paying job-say, a union job with great benefits--when the employee has spent decades with the employer (and all of his friends work there), or when the employee particularly enjoyed the job, the loss can be even more devastating.”

Who pays you to be on this commission? Who pays these commissioners here? Will you tell me that? CA Fraud Assessment ATTORNEY: The comp attorney is suppose to be relevant to the presentation...

PADILLA: Now, this came under the guise that the insurance claim adjustor’s should counsel them under the five stages of grief; (reading from the Risk & Insurance pmsionline article, “5 States of a Claims Adjustor’s Job written by Bill Zachary]

DINA PADILLA: Well, the reason I ask... the reason I’m asking ok... is because there’s being money spent to go after injured workers. And I’m going to read something. This was from PMSI and Drug Spend.... This was from Bill Zachary

• “denial, anger, negotiation, depression... acceptance.”

CA Fraud Assessment ATTORNEY: Could you please just show the relevance to the....

PADILLA: The other thing is; [reading from the Risk & Insurance pmsionline article, “5 States of a Claims Adjustor’s Job written by Bill Zachary]

DINA PADILLA: The relevance is...

(WILLIAM (Bill) ZACHRY words): • “Another interesting phenomenon in workers' compensation is that the injured worker can take on a new identity--that of an "injured worker."

CA Fraud Assessment ATTORNEY: presentation by the fraud and.... [INAUDIBLE] DINA PADILLA: ... when you have a negative conditions of an injured worker, and insurance companies litigate claims.... ok?

PADILLA: [Hmmmm] [reading from the Risk & Insurance pmsionline article, “5 States of a Claims Adjustor’s Job written by Bill Zachary]

CA Fraud Assessment ATTORNEY: [INAUDIBLE]

(WILLIAM (Bill) ZACHRY words): • “As an injured worker, it now becomes his job to maximize the benefits and work the system rather than to return to work.”

DINA PADILLA: Most of them are 30 percent, that’s about 300,000 people per year that don’t get their claims done. That’s a lot of money..... that self insured companies that fund this commission,

PADILLA: You know, this is to me perhaps... when I first

read this I... this was done 9/8/ of this year, 9/8/09. This... oh no, I’m sorry this was done last month. This was printed off last night for me.

When I first read it... it’s repugnant Mr Zachary, it’s despicable, because you know what? This is by you. You wrote this. This is done by you.

NOTE: William M Zachry gave the above business card to Steve Zeltzer, Dina Padilla and Sandi Trend after the 9/9/2009 meeting of the California Department of Insurance, Workers” Compensation Fraud Commission. DINA PADILLA: That’s why I’m asking, what kind of money do you get that put’s you here in this position that you can sit there and say these horrible things about people that get sick? We’ve got people

that are getting sick down there at Downey, we’ve got people that got sick in the biotech industry. You know, it got started with repetitive stress injuries back in the early 1990’s ..

CA Fraud Assessment ATTORNEY: Your time is up and I just want to say that I don’t see the relevance to your statement as they pertain to the

DINA PADILLA: I’d like to put this stuff into the minutes because none of this stuff that I have to say gets in... gets said or done.

CA Fraud Assessment ATTORNEY: Ok, your time is done

presentation by the fraud division on it’s budget request, but your time is up nonethe-less. You were given... your three minutes.

DINA PADILLA: ... Ok, for today it is.

DINA PADILLA: Ok... CA Fraud Assessment ATTORNEY: ... your three minutes ... DINA PADILLA: Ok, I just want to enter in ... CA Fraud ATTORNEY: [INAUDIBLE]
