The Court’s order, to the surprise of most, was to disconnect the electricity supply to the tenant. TPN Registered Credit Bureau weighs in on the judgment. The case in question is that of Anva Properties CC and one of its tenants. Anva, the landlord, owns a building in Cape Town, and pays the City of Cape Town directly for the electricity supply to the building. The landlord then recovers the costs relating to the supply of electricity from its tenants, at a pro-rata amount. The tenant in question had not paid its electricity bill in months, and as such the landlord was essentially subsidising the tenant’s business. The problem the landlord faced was that if it did not keep up to date with the full electricity account, the City of Cape Town would disconnect the supply to the entire building, thereby prejudicing the rights of the other pay-

When prospective franchisees consider investing in an estate agency franchise in their area they are often deterred by the fear that it will take them years to establish themselves. In reality, says Wayne Albutt, Western Cape regional sales manager for the Rawson Property Group, a really good franchisee can be up and running and doing far more than just recovering his overheads within six months – but on average may take up to three years to be fully established, highly competitive and possibly the market leader. “When a new franchisee blames a lack of sales on the fact that he is new to his district, he is, in my experience, often fudging the simple truth that he is not operating as efficiently

as he should,” says Albutt. However, he says, all his experience in the Rawson Property Group goes to show that a competent franchisee (and his team) can become widely accepted and recognised in a very short time period. Tax deductions on rental properties This week, the Property Poser panel considers a query from a landlord about which expenses can be deducted from rental income. According to Schalk van der Merwe from Rawson Properties in Somerset West, Cape Town, there are two main provisions of the Income Tax Act that deal with such deductions. “These two provisions are useful in attempting to clarify which expenses can indeed be deducted.” Van der Merwe says the so-called “general deduction” provides for “expenditure and losses actually incurred in the production of the income, provided such expenditure and losses are not of a capital nature”. “This would include expenses such as rates and levies, advertising, agent's commission and rent collection fees, the interest on the loan raised to purchase the property as well as insurance, security expenses, water and electricity.” Van der Merwe says another section of the Act refers to expenditure actually incurred in repairing a property occupied for the purpose of trade. “This includes expenditure incurred on treatment against attack by beetles of any timber forming part of such property.” The reference to “for the purpose of trade” does not mean that the property is to be used for commercial purposes, says Van der Merwe. “In this instance, the renting out of the property constitutes a commercial activity as would be the case in a buy-to-rent scenario.” Grant Hill of Miller Bosman Le Roux Attorneys in Somerset West says a repair is different from an improvement or renewal and the guidelines laid down in the 70-year-old case of CIR v African Products Manufacturing Co still stand. “A repair is a restoration by either a renewal or replacement of a subsidiary party of the whole; the materials used need not be the same as the

• Grant Hill and Schalk van der Merwe original material.” Hill says it follows then that renewal is a reconstruction of the entirety or substantially the entirety, whereas improvement is the creation of a better asset. “When an asset is improved the result is a better asset that possibly has an improved income-earning capacity.” However, the distinction between “repair” and “improvement” is sometimes vague, says Hill. “For an asset to be repaired, there must be damage or deterioration to a part of the original asset or structure and the intention of the taxpayer must be to restore the asset or structure to its original condition.” Hill says some examples of such deductible costs include the costs of scraping off old paint and stripping woodwork, filling cracks in walls and repainting walls. “The cost of installing a sprinkler system will be of a capital nature, but should any part of an existing sprinkler system be repaired or replaced when it becomes faulty, such costs will be deductible expenses in terms of this provision.” From these examples it is clear that no expenditure of a capital nature is allowed under the general deductions, says Hill. “It is not excluded under the provision relating to repairs but it does follow that whatever repairs you are not able to deduct under that provision will not be deductible under general deductions either.”

Tips for creating an emergency fund While it is not possible to predict the future and what may or may not happen, it is always a good idea to have a contingency plan in place to ensure that you are prepared for the unexpected. This is according to Adrian Goslett, regional director and CEO of RE/MAX of Southern Africa, who says that it is particularly important for homeowners to have a plan in place and funds put aside for a rainy day, considering the long term nature of homeownership. “Owning a home is a long-term commitment, which means that the homeowner needs to have a plan of action should their financial situation change in anyway. Life can sometimes throw you some unexpected turns, so it is important to ensure that there are funds in place to be able to weather the storm and keep your head well above the water,” says Goslett. He notes that an important question that every homeowner should ask is: if they lost their job tomorrow, would they be in a financial position to afford their home? “Unfortunately these things can become a reality and preparing as much as possible for these hurdles will put homeowners in a far better position for the future,” adds Goslett. According to Goslett, there are three simple steps that homeowners can take to start creating an emergency fund to use as a financial cushion in tough times. He notes that while the idea of saving in an emergency fund can seem like a daunting task, the thought of not having one is far more unnerving. An emergency fund can help homeowners financially manage any event, regardless of whether it is something as serious as losing their job or something like a burst geyser that requires urgent replacement. The number of dependents a homeowner has will also influence the amount that should be saved, as will plans to expand the family. Choose an account Account selection is an important aspect when looking to build an emergency fund as certain accounts will yield a higher interest rate than others. However, when looking at a higher-interest-yield account, it is good to consider accessibility. “There is little point to having an emergency fund if the finances cannot be accessed quickly during an emergency. Often higher interest accounts have a longer waiting period before the money can be unlocked and used. Ideally the money should be easily accessible and in a low-risk account,” says Goslett. Set up an automatic monthly deposit The easiest way to build up an emergency fund is by arranging a direct deposit system that transfers the selected saving amount into the emergency fund account each month. “The best time for this to happen would be as soon as the salary is paid into the account – if you don’t see it, you don’t spend it. Automating the savings will also take the need to be disciplined out of the equation and will ensure that a certain amount is set aside each and every month,” says Goslett. An emergency fund for homeowners is crucial to assist them ward off financial crisis without being forced into debt. “An emergency fund is one of the best tools for homeowners to build onto their financial security and independence,” Goslett concludes.

Young owners revitalise old Stellenbosch suburb As years pass, some suburbs wax and wane, while others simply reinvent themselves. Such is the small residential area of La Colline in Stellenbosch in the heart of the Cape Winelands. Excluding a handful of secure complexes and sectional title blocks, La Colline comprises only 75 residential properties in total, all full title semi-detached homes built mainly around the 1940s, and with no vacant stands available. Louise Varga, Pam Golding Properties’ (PGP) area manager in Stellenbosch, says situated on a small hill with mountain views all round, this suburb, which has been generally regarded as being on the wrong side of town, is fast becoming a hip and happening location. She says elevated in more ways than one, the area is undergoing a revival and transformation as a new generation of younger buyers and investors move in, many with young families. These buyers see the charm and potential of this suburb and are investing in homes they are then modernising and enhancing, helping breathe vibrant new life into the area while improving the value of their properties, she says. Varga says such is their confidence in La Colline, some have even acquired two properties, while others are investing further capital in expanding and upgrading their homes. It’s exciting to see such a turnaround take place, with the best of the old and new features of the properties combining to create a trendy, character-filled residential area,

she says. PGP agent in the area, Lizanne Fourie, says there is already a strong sense of community in the suburb. She says residents look out for one another while their children play together in one of the small parks in the area. Homeowners are a like-minded mix of young people breaking the area out of its former mould with renovations and refurbishments, including extensions that will create good capital growth in the long run, she says. “Hairdressers, actors, estate agents, musicians, event organisers, professors and architects are just some of those buying into the area. They realise this makes sense, particularly as a first-time or investment acquisition.” Overlooking Stellenbosch and the university campus, which is only 1,5 km away, La Colline is conveniently situated close to main feeder routes such as the R44 to Paarl and Somerset West, Hellshoogte Pass to Franschhoek and Ryneveld, Street which leads through to Dorp Street in the centre of Stellenbosch. Fourie says stands vary from 300 m² to 900 m² in size, averaging around 450 m² to 550 m². She says there are two types of homes; single level or double storey, and all are semi-detached. In their original form, without extensions or addons, all these properties would cover a surface of 105 m² to 110 m² and comprise three bedrooms and one or two bathrooms. If you’ve seen one, you’ve seen them all, as the layout of the properties are all exactly the same for a single level, and the same for a double

La Colline was built in 1948 by the National Housing Commission as part of an economical housing scheme. Since then, most of the area has been privatised. With Stellenbosch expanding in all directions and traffic becoming an issue, Fourie says it is inevitable that the first-time buyer or investor will buy into and ultimately uplift an area this close to the CBD, especially considering the low prices and potential capital growth and return on investment over the longer term. “The homes in La Colline are affordable when compared to the rest of Stellenbosch. A three-bedroom, two-bathroom single or double sto-

rey home that hasn’t been renovated can sell for anything between R1,1 million and R1,58 million, depending on stand size and state of the property.” Just below the La Colline hill is a suburb called Kromrivier, comprising another 72 full title properties, where last year a property sold for R2,54 million. Both developers and investors are showing an interest in Kromrivier, where homes are average single storey properties, she says. At present, Fourie says there is a renovated five-bedroom property on the market for R2,6 million, with a potential rental yield of R237 000 per annum if the owner leases all five bedrooms at R3 950 per room. She says currently, one would be fortunate to find a home for R1,2 mil-

lion, however, there have been one or two sales in the past two years under R1,2 million. Buyers are investing between R300 000 and R600 000 minimum, adding rooms to the property or building flatlets for extra income. With the original shape of the properties being rectangular blocks, owners are breaking away by adding rooms to the front or back and thereby changing the “box” appearance of the original semi-detached, she says. Modern perimeter walls with attractive gates are being built, while care and pride in ownership is evident in the attractive gardens and sidewalks in front of the properties. “The last five properties I sold in La Colline since 2013 were all acquired by buyers in the 27 to 35 year age group, all of whom undertook to improve or change the homes either for themselves or in order to achieve better rental income.” Fourie says a home can be leased for R7 500 to R11 500 per month for a three-bedroom, two-bathroom property, and from R3 500 to R4 000 per month for a separate bachelor flatlet with bathroom and kitchenette. She says over and above this, they are also seeing parents acquiring properties for their children to use while attending university in Stellenbosch. While there are wellmaintained properties, there are few on the market, she says. She says currently on the market is a beautifully renovated three-bedroom, two-bathroom home with a rental income of R11 500 per month, available for purchase at R1,69 million.

However, property investors should weighup the pros and cons very carefully before they decide to go into this market, and make sure they work with a managing agent who really understands it, he says. “Of course everyone who buys an investment property wants to make the best possible returns, and by letting short-term at a daily, weekly or monthly rate, owners stand to make considerably more money than if they rent long-term. “What is more, short-term letting makes it easier for landlords to raise the rent to cope with any increases in interest rates or sectional title levies,” he says. “However, investors need to look beyond these numbers and take other factors into account, such as the consistency of short-term demand in the area where the property is located, and what competition they might face from hospitality establishments in the same area – or even local homeowners with a room or two to let.” Harris says additional positives associated with short-term letting include: ) Better condition. Short-term tenants generally won’t be moving furniture in and out, painting the walls or changing the carpets, so the property should need less heavy-

duty maintenance. ) Tax advantages. If you let your property short-term, you may well have more advertising, cleaning and management costs to deduct from your rental income. However, you will need to seek professional financial advice in this regard. ) Flexibility. Toyota’s surprising turbo-diesel Corolla FRANS LE ROUX Most South Africans have fond memories of Toyota’s evergreen family sedan, the Corolla. Weather you drove to the beach in the back of your grandfather’s brown Corolla, shared your first kiss at varsity or bought one recently as a family transporter Corolla is as much a part of our national heritage as braaing and rugby are. Withits11thversion,thetriedand tested Corolla has grown in size and stature to what is an accomplished medium-size sedan. Crucially for Toyota, they’ve managed to keep the price down and still offer an affordable and versatile vehicle. This brings me to the Corolla I test drove recently, the mighty impressive 1.4 turbo-diesel Prestige. I’ve got to be honest, when Wesbank revealed the list of SA Car of the Year finalists for 2015, I was sceptical as to what the Corolla was doing in the lineup. Surely, when surrounded by brilliant Subaru’s, Porsches and BMW’s, the humble Corolla is out of its depth. That is until I spent an entire weekend driving the diesel Corolla around the Western Cape. From a looks perspective, my friends and family shared mixed feelings. The previous generation Corolla had smoother lines and tended to be a bit dull. Designers in Japan sharpened their pencils and went for a more daring and edgy look. At the front they’ve used the same grille as you’ll find on the Auris. Angular headlights and the large emblem complete the look. At the rear, however, things are more subdued. Proportionally, they’ve stretched it in the right directions. Lowered by 5 mm, lengthened by 75 mm and widened by 15 mm, the Corolla has more of a

Step inside, and you’re welcomed to a much improved interior. It’s been years since the latest Corolla upgrade, and these days, even budget city cars have wonderful ergonomically designed cabins. ThislatestCorollaisnoexception, and the look and feel of the interior is a step in the right direction. Comfortable black leather seats (in some models), a modern leather-clad multifunction steering wheel and a infotainment system with all the bells and whistles. The multimedia screenisprettyeasytolivewith,and

is the same as one would find in the Fortuner and Hilux. Bluetooth connectivity, preloadable satellite navigation and a great aircon unit, are some of the cabin highlights. Interior space is ample. The wheelbase has been extended by 100 mm which gives rear-seat passengers massive leg room, while headroom is never a problem. The boot too, is pretty enormous at 452 L, and can swallow a weekend getaways luggage with some ease. Driving the Corolla is simply a pleasure. No harsh ride or bumpy suspension setup, the Corolla com-

forts you with relaxed driving. The cabin is well insulated and sufficient sound deadening helps keep everything quiet. Do not expect a sporty drive or something you can thrash around your nearest mountain pass. The star of the show, the unprecedented trump card, is however the smallturbocharged dieselmillfitted to this Corolla. At just 1 400 cc in capacity, power figures are nothing special. With 66 kW/205 Nm, the traffic-light racing is the last place you will find the Corolla. However, pair those figures with a slick-shift-

ing 6-speed manual gearbox, and things start to look more promising. When you pull away from a stop street or traffic light, the first two gears are short and needs to be shifted quickly. Once you’ve reached cruising speed, this Corolla comes into its own. The torque spread is useful when passing or cruising while the Toyota hates using fuel. Never in three days of testing did the Corolla use more than 17 km/F. That’s on average, with my best figures of 21 km/F returned while cruising at 95 km/h on a flat stretch of highway. Theoretically, with the 55 F tank filled, you can drive a 1 000 km before refuelling. These figures are mightily impressive if you consider that the diesel-Corolla retails for around R250 000. Main rivals in this category include the likes of the Volkswagen Jetta, Ford Focus and Chevrolet Cruze. Only the Jetta offers a dieselvariant, so I will be focusing on the German specifically. The Jetta has a slightly bigger 1.6 F turbo diesel engine, while it does have more power, its price-tag is much higher. The fancy-pants German is R40 000 dearer, without selecting any of the yummy extras. (Choose one extra, and the difference of R50 000 is easily reached.) There is no denying then, the Corolla is an exceptionally good value offering. If youoptforthe1.4Esteemmodel,you can save even more money. The latest Corolla then is worthy of all its praise. It stood proud in a spectacular SA Car of the Year lineup, and it is sure to sell even better than its predecessor. Don’t be fooled by the tiny diesel engine or the car’s large body – Toyota did their homework and delivered a car that’s certainly worth the gossip around braais and rugby matches.

Chevrolet Cruze further enhanced for 2015 QUICKPIC Chevrolet has enhanced the Chevrolet Cruze hatchback and sedan range for 2015, adding a 1.4 turbo model with a six speed automatic transmission for the first time in South Africa. Now with a line-up of four sedan and two hatchback models, Chevrolet has given the Cruze a new face and rear styling for an elegant and classy look. The interior remains unchanged, with LS models now receiving Chevrolet’s MyLink infotainment system as standard. “The 2015 Cruze offers great ride and handling, fuel efficient powertrains, styling, and the well-integrated Chevrolet MyLink infotainment system. The 2015 Chevrolet Cruze is a tangible demonstration of our “Find New Roads” vision which puts the customer at the forefront of everything we do through innovation, pioneering ideas and technology,” said Tim Hendon, Chevrolet Brand Manager at General Motors South Africa (GMSA). First introduced in 2013 the turbocharged 1.4 ECOTEC petrol engine now benefits from the addition of an automatic transmission

to complement the existing six-speed manual. The turbocharged 1.4T LS generates 200 Nm of torque for a smoother ride and instantaneous power delivery under all road conditions. Power remains at 103 kW between 4 900 and 6 000 rpm. Combined fuel consumption is 6,8F/100 km, with corresponding CO² emissions of 157 g/km. The 1.4 turbo auto has the highest top speed of all the models in the range topping off at 204 km/h with a 0 to 100 km/h acceleration time of 10.4 seconds. The 1.4 turbo models matted to the manual transmission are fitted with stop/start technology for additional fuel economy and lower emissions. Combined fuel consumption for the manual is 5,8 l/100 km, with CO² emissions measured at 135 g/km. This model accelerates from 0 to 100 km/h 9,3 seconds and has a top speed of 195 km/h. Three models in the range are fitted with Chevrolet’s naturally aspirated 1.6 litre petrol engine. Performance figures for this engine are 86 kW of power @ 6 200 rpm, 155 Nm of torque at 4 000 rpm. Combined fuel consumption is 6,7 l/100km with 158 g/km CO² emissions. 0 to 100 km/h is 12,8 seconds and a top speed of 185 km/h for the 1.6 hatch and 190 km/h for the 1.6 sedan.

All-new Mustang sprints 0-100 km/h in less than 5 seconds QUICKPIC Ford Motor Company today announced that the all-new Ford Mustang will deliver 0-100 km/h (0-62 mph) acceleration in under 5 seconds – making it the fastest accelerating high-volume Ford model ever offered in Europe. New Audi A6 and A7 Sportback improved power QUICKPIC Audi’s new A6Audi has thoroughly updated the Audi A6 range with new engines, transmissions, headlights, and a new infotainment system that makes the Sedan more efficient, more powerful, more attractive and more sophisticated than ever. The design of the Audi A6 epitomises precision and sporty elegance. It was carefully honed as part of the model refresh, with changes made to the Singleframe grille, the headlights, air inlets, bumpers, side sills, rear lights and tailpipes. Audi optionally offers headlights with LED technology or Matrix LED technology, combined with dynamic turn signals. Due to its intelligent composite construction concept, the body is extremely rigid and safe. Numerous components of aluminium and hot-shaped steel form the backbone of a systematic lightweight construction concept. Kom sê hallo vir die hersiene Lexus ES QUICKPIC Die Lexus ES, die topverkoper sedan in die indrukwekkende Lexus-stal, is ’n goeie definisie van wat alles in ’n weeldesedan moontlik is. Dit is met die onthulling van Lexus se opwindende nuwe 2016-ES by die Shangai-Motorskou duidelik dat hierdie neiging sal voortduur. Die 2016-ES het ’n opwindende, meer sportiewe houding wat beklemtoon word deur ’n elegante dog progressiewe buitekant-stilering, ’n gevorderde en weelderige binneruim sowel as die nuwe veiligheidstelsel wat die Lexus Safety System+ genoem word. “Ons konsep vir die ontwikkeling was om die ES tot die volgende vlak op die gebied van luukse weelde te neem,’” het die ES se hoofingenieur, Toshio Asahi, gesê. “Die Lexus ES is bekend vir sy vernuwende buitekant-stilering en luukse binne-ontwerp. Ons wou daarop voortbou en hom selfs nog meer elegant maak, terwyl ons die motor ook van die jongste tegnologie wat Lexus kan bied, toegerus het. Die ES pronk met Lexus se nuwe veiligheidstelsel wat die Lexus Safety System+ genoem word. Dié stelsel kombineer toonaangewende vernuwende veiligheidstegnologie in ’n netwerk in ’n enkele pakket. Dit behels onder meer die botsvoorkomingstelsel (PCS), wat ander voertuie en voetgangers in sekere omstandighede kan bespeur, sowel as die gebruik van millimeter-golflengte radar en ’n kamera in die neus om die noodremhulp (BA) aktiveer. Die stelsel het ook ’n baandwaal-waarskuwing (LDA) wat ’n kamera gebruik om die sigbare strepe tussen bane dop te hou en die bestuurder deur middel van ’n alarm en vibrasie aan die stuurwiel te waarsku wanneer die motor sonder bedoeling uit sy baan begin dwaal. Die outomatiese hoëstraalkoplig (AHB) bespeur die kopligte van aankomende verkeer en die stertligte van ’n motor voor die ES, en verstel dan die hoë en dompelstrale outomaties om die beste sig in die donker te bewerkstellig. Die radar-spoedbeheer gebruik millimetergolflengte radar om die spoed van verkeer voor die ES te bepaal en pas die spoed van die spoedbeheer outomaties aan ten einde ’n voorafbepaalde volgafstand te handhaaf. Die stelsel gebruik ook millimeter-golflengte radar en ’n kamera om te bepaal wanneer ander verkeer van bane verwissel sodat die ES soepel kan versnel of rem. * Die volledige Suid-Afrikaanse spesifikasieen toerustinglys sal nader aan die amptelike bekendstelling in die tweede helfte van die jaar aangekondig word.
