Rhonda Cooper named 2010 Citizen of the Year

Mother Nature’s cold shoulder? Folks from across the Copper Corridor - from Superior to SaddleBrooke - woke Sunday morning to a confectioner’s sugar dusting of white snow. It was cold and wet ... but it was sure pretty! Some kids headed out for some snowman making while photographers from the Miner-Sun-Basin headed out for some photos. We took photos in Kearny of Teapot Mountain and in Superior of Picket Post; downtown Superior and some wonderful photos of Devil’s Canyon; San Manuel got some snow and the Galiuro Mountains were just glistening with all the snow left on those peaks. Mail-in election planned for Hayden mayoral race By Taylor Sheaffer Ritter Everyone’s on high alert and on their best behavior as mayoral elections in Hayden loom. The mayoral election in Hayden is by mail only this year with a good selection of candidates: besides the incumbent current Mayor Monica Badillo, Town Council Member Rhonda Cooper is also running, along with Hayden town citizen Jose Vasquez. In a statement, Mayor Badillo explained that she is running for re-election because she is looking forward to completing some of the projects that she has started while in term, such as the Waste Water Treatment

Project. This project is currently a multi-million dollar project that she believes is very important to the community of Hayden. Like this project, there are several developments Mayor Badillo has begun that she feels she is very close to achieving results on, projects which she has been working hard for. She understands that people have not seen a lot of change, yet she would like to emphasize that it often takes time to do things correctly and she understands the importance of doing something right the first time. Mayor Badillo explained that the waste water treatment project has taken a

lot of everyone’s time, energy, money and effort; because of this she is anxious to see it through. The other two candidates could not be reached for a comment. Since it is a mail-in only election, it is extremely important that all mail-in ballots are returned to Gila County by March 8. Please do not throw away your ballots, there will be no polling, it is strictly a mail-in only election. The Annual Copper Basin Citizen of the Year banquet and annual Copper Basin Chamber of Commerce business meeting was held Monday night at Trendz Restaurant. Angela Hillian Ramirez presented Reflections of 2010 and looking Ahead to 2011 with Bill Loehr serving as Master of Ceremonies. Introduction of past COYs was made reiterating their accomplishments for the year that they were nominated. The 2002 COY, Rose Bradford, read the nomination letter which appeared in last week’s Copper Basin News. For her dedication to her community especially the youth, Bill Loehr, 2009 COY, presented Rhonda Cooper with a plaque. More than 200,000 ponytails have been donated to Pantene Beautiful Lengths since the program began in 2006. This week, your local reporter, Lana Jones, added one more to the total. Beautiful Lengths, working with HairUWeave, creates wigs from the donated ponytails. The wigs are then given to cancer patients through American Cancer Society wig banks. Each wig takes at least six ponytails and three to four months to create. As of last summer, Pantene and HairUWeave had donated 6,300 wigs to the American Cancer Society. Florence Copper Project holds open house to explain planned mine By Lana Jones The Florence Copper Project held an open house on Feb. 24 at the Florence Gardens Clubhouse. The open house officially ran from 6 to 8 p.m. although the public was touring the posters and speaking with company representatives even before 6 p.m. rolled around. A total of 74 people attended the open house. Florence Copper Project is Curis Resources (Arizona) Ltd.’s main project. The Arizona company is a wholly owned subsidiary of Curis Resources Ltd. of Canada. Curis is affiliated with Hunter

Dickinson Inc. (HDI). The Project is located near Florence, south of Poston Butte, between Hunt Highway and the Gila River. The property was previously owned by BHP. Low copper prices caused BHP to delay the project and then sell the property to Merrill Ranch Investments in 2000. HDI acquired the property in 2009. plans to use a mining process called ISCR (in-situ copper recovery). In ISCR, an acid solution is pumped into the ore body using injection wells. The copper solution is then pumped out through recovery wells and processed. The copper is then recovered from the solution at a solvent extraction/electrowinning (SX/EW) plant. ISCR was one of the mining processes used at the San Manuel Mine. Water use is a common concern associated with ISCR mining. Curis Resources See Copper, Page 4

CSBG dollars pay for Community Action Programs that are the federal government’s only comprehensive approach to address the needs of vulnerable citizens and help struggling Arizonans access services to achieve economic stability. CAP agencies are locallymanaged agencies governed by boards of directors with equal representation from the private sector, low-income individuals and elected officials. Community Action Human Resources Agency (CAHRA) is a non-profit organization with 501 c 3 status that has provided services for thirty years in Pinal County. Community Action Human Resources Agency’s Board of Directors includes representatives from a major utility company, city councils, business, the Pinal County Sheriff’s Office, the Arizona Department of Public Safety, local schools, behavioral health and a retired CAP Agency staff member. During the last fiscal year from July 2009 to June 2010, 2,461 households including 8,854 duplicated individuals received

services and support through Community Action Programs offered by CAHRA. Statewide during Fiscal Year 2010, 156,327 unduplicated individuals (53,900) families were served across Arizona. Nationwide, 1065 CAP agencies provided critical support for employment, education and housing to nearly 21 million Americans. In Superior during the last fiscal year, residents were assisted with $33,080 to prevent homelessness, moving families from the street to affordable housing, preventing loss of utilities and meeting nonfinancial needs for car repairs, vehicle licensing, registration and insurance to help households improve their self-sufficiency. CAHRA also enrolled 36 families with children ages 0 to 5 years in the First Things First funded emergency food box program. These families received fresh meat and a food certificate to purchase fresh produce, dairy products and other items important to health growth. The total value of the certificates came to $12,834 paid to local grocers. Families also received diapers while supplies lasted. Sixteen households in Superior and Kearny received

weatherization and home repair services valued at$68,763 while 9 households were enrolled in the Home Alone Safe Alone and received an Emergency Alert Pendent. Four households in Superior and Kearny received foreclosure mitigation counseling services to help them retain ownership of the family home. CAHRA staff in partnership with the owners of the Arboretum Apartments are weatherizing the units and making them energy efficient. CAHRA provides urgently needed basic services along with effective, managed programs for individuals and families to gain economic stability, said Jayme Valenzuela, CAHRA Board Member. “CSBG funds in Pinal County have allowed us to identify and implement effective local solutions to complex needs, create jobs and raise significant additional non-federal resources that have made a tremendous difference in our County. Every CSBG dollar invested in Arizona has been used to leverage more than $16.50 in other resources. Valenzuela strongly encouraged all Pinal County residents, whether they are involved with the Community Action Program or accessing services

and programs to reach out to the Congressional delegation and to the White House to urge decision makers in Washington, D. C. to reconsider the depth of the cuts because of the “all too real impact on human lives those cuts will cause”. “We recognize that cuts are necessary across the board, but there must be level of reason and consideration for how these incredibly severe cuts will take their toll on individuals and families who can least afford another challenge or crisis in their lives,” Valenzuela pointed out that of the 2,461 households assisted county-wide, 1,193 households are either working or searching for employment while relying on unemployment benefits to sustain their household. He also stressed that 1,832 households have incomes below the 100% of poverty level. In Superior of the 87 households helped, 24 were working or receiving unemployment benefits, but 70 households were at or below the Federal Poverty Level. Valenzuela also pointed out that of all the households CAHRA worked with, 10 households or about 11% were receiving welfare, dispelling the old myth about “welfare mothers”. Valenzuela pointed out that statistics also showed that the 60% of households assisted were seniors or persons with disabilities living on fixed income and that many of the Agency’s programs including non-crisis energy assistance and weatherization are the only way these households can be secure.

Kearny Police Report According to state law, there are two methods by which police may arrest suspected offenders. The suspect may be physically taken into the department and booked into jail, or the arresting officer may write a citation and release the suspect to appear in court later. All suspects are presumed innocent until proven guilty in a court of law. Only criminal citations are listed. All damages are estimates. Feb. 24 A 13-year-old male juvenile was arrested at the Ray Elementary School for possession of a narcotic drug/ drug free zone and possession of drug paraphernalia. Feb. 27 A burglary was reported at the Kearny Golf Course. Other calls included seven ambulance runs; two suspicious person/vehicle/ circumstance reports; two 911 hang-ups; one disturbance report; one threatening/ intimidating report; two agency assists; one criminal trespass report; three information reports; and one domestic disturbance report. Citations written included one for speed and one for no valid drivers license. Verbal warning included three for speed and one for a license plate violation.

Pinal County Sheriff’s Report The Pinal County Sheriff’s Report is taken from the daily logs, based on the information provided by deputies. All persons arrested are presumed innocent until proven guilty in a court of law. Feb. 22 Theft of air conditioning coils was reported in the 5100 block of North Cholla Street, Dudleyville. Feb. 22 Estella Ortiz, 27, Winkelman, was arrested in Hayden on a failure to appear warrant. She was transported and booked into the Pinal County Adult Detention Center in Florence.

‘A Brave Coward’ The Life of Ella Goodrich and the Town of Hayden, 1910

By Rosalind Padilla Dia De Los Pioneros features pioneers of the Copper Basin area from 1846-2011. Georgianna Wood is writing about early settlers in Aravaipa and the next few weeks other families from the Copper Basin will be featured. Comments in parenthesis and italics are my comments relating to those of Ella Goodridge, sometimes pointing out present day locations of items mentioned for the early 1900s. “No train whistle could ever have sounded more eerie than it did a hot September evening in 1910. We were backing our way into the Santa Fe Depot in Phoenix, Arizona.” So begins the memoirs of Ella Bush Goodridge in a document she titled “A Brave Coward,” dedicated to her grandchildren. This book of memoirs was given to me by her grandsons Dick and Bob Goodridge to use for part of the theme of Pioneer Days. I find it a privilege to do so because I knew this stately woman who lived on Utah Street in the 1960s as did several other fine Senior Citizens of their day. Each Christmas I would take plates of Christmas Cookies to each one of these great neighbors of mine and visit for a while before heading for New Mexico for Christmas vacation. I loved their stories and little did I know then that I would be writing any of their stories. Ella includes so much of interest but I will condense this to her life in Hayden. In her memoirs Ella mentions some people by their first names only and I can only guess who they might be since people possessing those names are long gone but were the Senior Citizens in the ‘60s. Ella had been diagnosed with consumption and her doctor said “Go west, young lady, go west.” She was born in a small summer resort town, French Lick, Indiana, July 14, 1889. Living in the resort town she met several people who were instrumental in helping her get to the ‘inferno” called Phoenix. Her ticket said Phoenix but she then had to board the Arizona Eastern train to travel another 100 miles to a new mining town just being developed. The route from Indiana included stops in Newton, Kansas, Albuquerque, Winslow, Ashfork and Prescott. For a girl coming from the rolling plains of Indiana that was an experience almost an adventure. She had never seen mountains before, houses seemed to hang off the mountains and as they descended down, down, down it got hotter and hotter and dustierno air cooled trains in those days. Arriving in Phoenix in the late evening she went from the train depot up Central Avenue to the Adams Hotel passing adobe huts where Mexican families were sitting outside to get relief from the September heat. She was in total disbelief that hotel room doors were wide open as people slept—outside her window, men were sleeping on the porch roof. She shut and locked her window, shoved a dresser in front of her keyless door spending her first night in Arizona encased in a hot room. When she woke up to the sound of roosters, barking dogs and wagons she walked down Central Avenue to the Southern Pacific depot to board the little train to this new little town of Hayden. Ella then did something (1910) she wouldn’t do today (1969) she went into a little eating house next to the railroad tracks, wearing a big hat with bright red poppies tacked across the crown, a fashionable military blue cape on her arms and carrying her overnight bag. She climbed on a stool to order breakfast. As she looked around she realized she was the only woman as the men stopped talking, straightened up in their chairs, buttoned their collars and ate with some manners. As she ate, another woman entered. She had no hat, no overnight bag, wore a bright orchid dress cut way too low. She had freckles, red hair was pleasingly plump. Ella was five foot seven and weighed 119 pounds. The two women conversed, the other gal was going to Winkelman which Ella found out was a few miles further down the dirt road from Hayden. The train ride from Phoenix to Hayden included a stop in Florence to let a sheriff and a prisoner off at the penitentiary. The lady in orchid had been pacing up and down the aisle of the train trying to sit by Ella and when she got the chance to do so she told all about the

red light district in Winkelman and really was into the story when the conductor broke up the conversation. The train stopped for water (probably Kelvin-Ray Junction maybe even Cochran) and the conductor called Ella aside and told her to stay away from that woman and why. Ella was met at the Hayden depot by Bob Jones, soon to be Arizona’s next governor. He had the only car in town. The new depot was a bright yellow and had just replaced an old abandoned train coach which was on the siding. The train which composed of one passenger car and baggage coach made its way to Winkelman then back to Hayden and on to Phoenix. Sometimes this Doodle Bug as it was called would go to Christmas where a stage coach and driver, Welo Mungaray, wound their way up the rocky road to Christmas (the railroad tracks to Christmas are now Highway 77). Ella states that before the days of the mill and smelter and Arizona Eastern lines, ranchers and citizens of Winkelman would drive up the river by horse and buggy spending two or three days camping out before reaching Tucson. In a real emergency they would go to Kelvin over the mountain to an old stage coach center (probably Dripping Springs) and then to Globe. The Bar Flagg cattle ranch now owned by Brian Tatum (1969) is in this spot. There was a bar and a few rooms which provided a spot for a weary traveler. The coach horses were changed here. The train lovingly called the Doodle Bug was cast aside like an old shoe, trips discontinued, now 50 years later (1969) the depot is gone and the express office moved to Hayden Junction. Now back to Ella’s arrival in Hayden—As Ella departed from the depot with Bob Jones they drove up the dirt Road (now Velasco Ave) to the top of the hill, the lodge hall was to the right (now demolished) they used as the general office for the superintendent and pay master. The men’s dormitory was behind it. In 1910 Frank Poe was the pay master. There was a large house that was once the Superintendent’s home, then a boarding house and now a private home. There were a few family houses but most were tent houses. At the corner of Fifth and Hayden Avenue was McIntyre’s Mercantile. The bank had opened just a few days before her arrival. The Winkelman Bank was torn down and remnants of the old vault were still in place in 1969. Next to the bank was a saltbox of a building that served as a Post Office approximately 12X15 feet. The cracks in the floor were so wide that you had to be careful not to drop precious letters on the floor. When the Post Office was moved across the street letters were found under the floor. This new Post Office was the little building next to the Hayden Primary School (now a Union Hall) and was attached to what

was the McIntyre Mercantile then Polly Simpson’s store in 1969. (Polly was later on the Kearny Town Council and is Jerry Cross’s mother). The postal clerks were kept busy handling mail for 700 construction workers as well as writing money orders for the women who were always ordering from the mail order houses. These two postal clerks started the Odd Fellows Lodge in December 1912. They had their first lodge meeting in the old warehouse that was on the hill by the powerhouse. A café, a meat market and the Gus Hirchfields Saloon opened for business in December. The first barbershop was just about where the soda fountain was in the drugstore. The rest of the drugstore building was finished in 1912. The area where the

drugstore, the Lee Peobles Market (Hayden Grocery now demolished) and the swimming pool are now was a forest of small tents. Each tent was large enough for one man with a cot, a little table with a tin basin and a small mirror that was all they had. Later these small tents were torn away and little three room cottages were built. When the mill was completed the men brought their families and lived there. Two small buildings on

Utah Ave served as school houses and are now homes. The old barn like theatre stood right beside the little Catholic Church across from Ella’s current home (it was a green two story home on Utah1969). After this grand tour of Hayden in 1910 we go back to Ella’s arrival in Hayden. That day when Ella got off the train and made her way to the boarding house (which in 1969 was the hospital and currently a residence) they passed two tent houses on Hospital Hill one was the home of Dr. Wiley, the first doctor in Hayden

who rode his horse around this new camp. The other was a drugstore and doctor’s office. There was one cot at one end for emergencies. Claude Himbaugh a young 19 year old from Seymore Indiana was in charge of labeling the medicines mostly quinine and herbs. There was a lifetime of living for this young eastern girl and in the first three months of her life in Hayden she took care of three children of the boarding house matron, Katherine Regan. Writing, drawing contests open for H-W students By Taylor Sheaffer Ritter There are some of the cool new events taking place within the school district of HaydenWinkelman. Being spearheaded by Superintendent Jeff Gregorich, the Hayden-Winkelman School District will be hosting an

informational meeting on the WeTip’s Crime Reporting Program that will be soon be active in the Hayden-Winkelman Community on Monday, March 7, at 7 p.m. in the Hayden High School lobby. All parents and community members that would like to put an end to crime and

drug abuse in our schools and community must attend. Please come learn about the program and give your input into what the community is experiencing. WeTip’s is sponsored by the Gila County Sheriff Department, Hayden Police Department, Town of Hayden, Town of Winkelman,

She fled into the Hogan when Ella took out a camera to take the lovely girls picture. Another escapade with these young kids was to find the Pete Winkelman ranch house which they never did find. Mrs. Winkelman was a loner who wore a man’s hat and man’s shirt. At other times she would wear an old gunny sack with holes cutout for arms and neck. The town of Winkelman was named for Pete who died at the ranch and was buried there. The tailings have since covered the spot the ranch was on. Kennecott wanted the property and she would not give an inch. One day they realized no one had seen her. Slim Gilmore, the tall good looking sheriff went looking for her and found her under a tree with her horse and dogs standing nearby. Ella had searched the Winkelman cemetery for the grave site but never found it. Ella arrived in Hayden on a Sunday and immediately asked where the Church was. Those listening were amazed. There were no protestant churches as no one was interested in Christian living, most of whom had a church of their choice but had shed their religion like a duck sheds water. Hayden seemed to be one grand lark, like a busy anthill. There were people from every state of the union and every walk of life. During the early years the garbage man was a Harvard graduate. People came seeking their fortune, for health reasons, an unhappy marriage or looking for a new way of life. Having been richly endowed with a religious background Ella came well equipped to carry the torch. She and Joe Brown put their heads together and the Community Methodist Church was born. For many years the Church standing on the corner just opposite the Bank was made up of almost every denomination including Mormons, and Catholics. A minister came from Higley on the train to conduct Church services.

Curis estimates that if the same land were used for farming alfalfa it would use between 1700 and 2600 acrefeet of water. The estimate is higher than University of Arizona (UA) Cooperative Extension estimates of water use for alfalfa in Pinal County. Based on UA estimates, 216 acres of alfalfa would use 1400 acre-feet of water. Wheat or cotton, two other common Pinal County crops, would use about 570 or 1000 acre-feet of water. The UA estimates are over 10 years old, though, and based on the county as a whole. They may not accurately represent current water use by farmers near Florence. County and stationed at Ray. He was killed in a shoot out at the Saloon of Dick Remington (or Pennington) in Sonoratown. I have included parts of the

Georgie Digs By Georgie Wood (ggannwood@yahoo.com) Before the road was built from Lawrence White’s Basin homestead south of Aravaipa Creek to our upper range in 1948, the best way to get up there was by riding horseback through White Wash Canyon or Bear Springs Canyon whose mouths were close to our Panorama Ranch homesite. When things had to be done “on Top”, the work days began very early and often ended after dark, and the cattle to be sold were also trailed down those canyons to our homesite. In 1947, our steers brought 20 cents a pound, and in 1951 they brought from 35 to 37 cents a pound! It helped to have our own cattle scale in 1951, because truckers could load our cattle at our homesite, and some buyers had their own trucks. No more driving the cattle to the railroad! I was informed that some of the earlier cattle inspectors in our area were George Acton, Sr., who was also a Gila County Deputy; Holland Bass from Kelvin; “Doc” Deaver; Fred Pascoe of Hayden, who was also a Gila County Deputy; and in the 1950’s Jake Upshaw, youngest brother to Fred Upshaw, who was also a Gila County Deputy. Many of the San Pedro Valley’s farmers and ranchers belonged to the Winkelman Soil Conservation District and the Winkelman-Mammoth Farm Bureau. In 1956, Chairman of this Farm Bureau was Buster Naegle, who had the property across the San Pedro River from Dudleyville known as the old Finch farm; Vice-Chairman was Dillard Shartzer who lived south of the mouth of Aravaipa Creek, and before running cattle only he had previously run more Angora goats than anyone in the area when using the country north of Winkelman along the Gila River and on the Mineral Strip; Morris Wilkins from Kelvin was first alternate; Cliff Wood (my husband) was second alternate; and third was Jim Ragsdale who had become the owner of the Severo Zapata property along the San Pedro River at some period after Severo’s tragic death in 1936. The Wood family had thought much of Severo Zapata who they had bought grain and barley from at his farm. I was

told that one day as Severo was disking his field, the disk had become clogged, and when Severo was down trying to unclog it, the animals that were hitched to the disk started to pull it and the disk ran over Severo, cutting him badly; also, that after having surgery, Severo developed complications due to gauze that had been left inside of him during the surgery. At the age of 60 years, Severo was buried at the Mammoth Cemetery. In 1957, a newspaper article stated that Catalina Council, Boy Scouts Of America, hoped to lease 1200 acres of grazing land upstream in Aravaipa Canyon; that they wanted campsites and picnic areas, and hoped to build pistol and rifle ranges, biking trails, and swimming facilities. A copy of their May 1957 application to the Department of The Interior Land Office stated they wanted to buy a section of land, that it was estimated that in excess of 200,000 people (200,000!) could be served by the recreational area, and that a usable road was within one and one-half miles of the land applied for. That “usable road” had to have been the road that started on our property close to our homesite and ended on Ed Coleman’s Trails End Ranch just upstream of us. Ed Coleman was very much against this happening, as he firmly believed, as we did, in no development in that area. It didn’t happen, but the 1960s were to bring some surprising changes. Those changes, with other stories, are included in my yet-unpublished manuscript “A Creekside Story”, and I haven’t been able to resist sharing some of those stories, although shortened, with the faithful “Georgie Digs” readers who comment to me so favorably. Drew married Georgiana “Ann” Stuart/Stewart in New York. Georgiana was born in Edinburgh (Glasgow), Scotland, on 19 June 1835. She was educated in the lessor school in the University of Edinburgh. It is conjectured that Georgiana was of the Stuarts of Lennox (It is also possible that she was from the Stuart of Bute or Alpin.) Her departure from Scotland is unknown and her point of arrival is unknown. Sometime between the death of Laura Pease Drew, William’s first wife and the birth of George in 1858, Georgiana and William were married. According to Cora, they were married in New York City. Amend the Town of Kearny Municipal Code Article 13-2 Section 13-2-2 to insert the definitions of medical marijuana, “medical marijuana dispensary,” “medical marijuana dispensary off-site cultivation location” and “medical marijuana food establishment, medical marijuana qualifying patient,” and renumber subsequent subsections as follows: Articles 13-2 Definitions Section 13-2-2 Definitions Medical Marijuana: Means of all parts of the genus cannabis whether grown or not, and the seed of such plants that may be administered to treat or alleviate a qualifying patients debilitating medical condition or symptoms associated with the patients debilitating medical condition. Medical Marijuana Dispensary: A not-for-profit entity approved by the Arizona Department of Health Services (ADHS) as defined in A.R.S. § 362801(11), that acquires, possesses, cultivates, manufactures, delivers, transfers, transports, stores, supplies, sells or dispenses marijuana or related supplies and educational materials to cardholders. Medical Marijuana Dispensary Off-site Cultivation Location: Additional locations where marijuana is cultivated or stored by a medical marijuana dispensary as defined in A.R.S. § 36-2804(B)(1)(b)(ii) Medical Marijuana Food Establishment (Infusion or Manufacturing): A place that supplies one dispensary with edible food products which are infused with medical marijuana. Medical Marijuana Qualifying Patient: a person who has a debilitation medical condition as defined in A.R.S. §362801.13. Section 2. Amend the Town of Kearny Municipal Code Article 13-18, Section 13-18-2 as follows; Section 13-18-2: Conditional uses. U. Medical Marijuana Dispensary: A medical marijuana dispensary is permitted as a conditional use subject to the conditions as set out in the Town of Kearny Municipal Code Article 13-8. V. Medical Marijuana Off-Site Dispensary Cultivation Location. A medical marijuana off-site cultivation location is permitted as a conditional use subject to the following conditions as set out in the Town of Kearny Municipal Code Article 13-8 W. Medical Marijuana Food Establishment. A medical marijuana food establishment is permitted as a conditional use subject to the conditions set out in the Town of Kearny Municipal Code Article 13-8. The name, address and date of birth of each principal officer and board member of the nonprofit medical marijuana dispensary and the name, address and date of birth of each medical marijuana dispensary agent. d. A copy of the operating procedures adopted in compliance with A.R.S. § 36-2804(B)(1)(c). e. A notarized certification that none of the principal officers or board members has been convicted of one of the following offenses: i. A violent crime as defined in A.R.S. § 13-901.03(B) that was classified as a felony in the jurisdiction where the person was convicted. ii. A violation of state or federal controlled substance law that was classified as a felony in the jurisdiction where the person

Three children were born in Midland, Dane, Wisconsin: George Harrison (9 September 1858), Darwin, and Florence. The family moved onto the Montana Territory sometime during 1864-1865. Permitted Location: A medical marijuana dispensary is only permitted in the C-1 Commercial and C-2 Light Commercial Zoning Districts zone with a conditional use permit. 4. Community Impacts: The Town Council may or may not approve a medical marijuana dispensary at a site if substantial evidence is presented that locating the dispensary at the proposed site will negatively impact neighboring property values or if substantial evidence is presented that shows that locating the dispensary at the proposed site will created an unreasonable risk to the health safety or general welfare in the area. 5. Development Standards. a. A medical marijuana dispensary must be located in a permanent building and may not be located in a trailer, cargo container or motor vehicle. b. A medical marijuana dispensary shall be setback a minimum of 1,500 feet from all other medical marijuana dispensaries measured from the parcel boundaries. c. A medical marijuana dispensary shall be set back a minimum of 500 feet from schools, community service agency, activity facility and/ or activity where children may be enrolled, measured from the parcel boundaries. d. A medical marijuana dispensary shall be set back a minimum of 500 feet from a childcare center, measured from the parcel boundaries. e. A medical marijuana dispensary shall be setback a minimum of 500 feet from a church. f. A medical marijuana dispensary shall be setback a minimum of 500 feet from a residential substance abuse diagnostic and treatment facility or other drug or alcohol rehabilitation facility. g. A medical marijuana dispensary may not have a drive-thru service. h. A medical marijuana dispensary may not have outdoor seating areas. i. the maximum floor area of a medical marijuana dispensary is 2,000 square feet. j. The secure storage area for the medical marijuana stored at the medical marijuana dispensary shall not exceed 400 square feet. k. A medical marijuana dispensary must be located in an individual building bay or unit and cannot be combined with other allowed uses in the C-1 Commercial or C-2 Light Commercial Zoning Districts. l. The permitted hours of operation of a medical marijuana dispensary are between the hours of 8:00 a.m. and 6:00 p.m. daily. 6. Permit Conditions: The Town Council may include any conditions it finds necessary to conserve and promote the public health, safety, convenience and general warfare. The Council must include the following permit conditions for issuance of the conditional use permit for a medical marijuana dispensary: a. An expiration date for the conditional use permit that requires re-application or renewal of the permit after two years or less. b. A requirement that the medical marijuana dispensary meets security requirements adopted by the Arizona Department of Health Services. c. A requirement that the storage facilities for the medical marijuana facilities for the medical marijuana stored or grown at the off-site cultivation location prevent the emission of dust, fumes, vapors or odors into the environment. D. A requirement that the owner secure a certification from the State Fire Marshall or from another acceptable entity responsible for fire safety in the area in which the medical marijuana dispensary is to be located stating that the structure complies with all fire code requirements and supply that certification to the Town of Kearny. e. A prohibition on the medical marijuana dispensary offering a service that provides offsite delivery of the medical marijuana. f. A requirement that the medical marijuana dispensary is prohibited from permitting anyone to consume medical marijuana on the premises. g. A requirement that the medical marijuana dispensary comply with applicable sections of the Town of Kearny Sanitary Code. 7. Fees. The fees for application and hearing is a combination of the existing fees for Conditional Use Permit application filing fee, the site analysis submittal fee and the notice of public hearing fee. Special Conditions for NonDispensary Cultivation. 1. Medical Marijuana Cultivation Location for a Registered Qualifying Patient: a. Allowed as an accessory to a primary residence. b. Must be conducted in a completely enclosed, locked building. c. Must have a legible copy of a valid Medical Marijuana Registry Qualifying Patient Identification Card, the original of which is issued by the State of Arizona, plainly displayed inside the doorway. d. The qualified patient cultivation must be at least 25 miles from a medical marijuana dispensary. 2. Medical Marijuana Cultivation Location for a Registered Designated Caregiver: e. Allowed as an accessory to a primary residence. b. Must be conducted in a completely enclosed, locked building. c. Must have a legible copy of a valid Medical Marijuana Registry Designated Caregive Identification Card, the original of which is issued by the State of Arizona, plainly displayed inside the doorway. d. Must be for qualified patients who live at least 25 miles from a medical marijuana dispensary. Medical Marijuana Dispensary Off-Site Cultivation Location: As long as the Arizona Revised Statutes remain in full force and effect to allow medical marijuana dispensaries, a medical marijuana dispensary off-site cultivation location is permitted as a conditional use subject to the following conditions: 1. Minimum Notification Area: The minimum notification area for a conditional use permit for a medical marijuana dispensary off-site cultivation location is 1000 feet. 2. Supplemental Application. In addition to the application required by Section 13-18-2, an applicant for a conditional use permit for a medical marijuana dispensary off-site cultivation location shall complete and application that includes all of the following information. a. If the application is by an agent for the owner the authorization

and a span of mules, Jane and Lyde, started a small herd of cattle toward California. The first stop of any duration was at Signal, Arizona where the family remained for the summer and winter. Signal is about 65 miles west of present-day Prescott. Around 1874, a major silver mine was found there. The family stayed near an Indian village. A notarized certification that none of the principal officers or board members for the medical marijuana dispensary affiliated with the off-site cultivation location has served as a principal officer or board member for a registered nonprofit medical marijuana dispensary that has had its registration certificate revoked. g. A floor plan showing the location, dimensions of and type of security measures demonstrating that the medical marijuana dispensary off-site cultivation location will be conducted completely within an enclosed locked building and meet the definition of enclosed locked facility contained in A.R.S. § 36-2801(6). 3. Permitted Location: A medical marijuana dispensary off-site cultivation location is only permitted in the C-2 Light Commercial Zoning District and IND-1 Light Industrial Zoning District 4. A medical marijuana dispensary off-site cultivation location must have a legible copy of a valid Medical Marijuana Dispensary Agent Registry Identification Card, the original of which is issued by the State of Arizona, plainly displayed inside the doorway at all times. K. Must have the address of the Medical Marijuana Dispensary that the Offsite Cultivation Location supplies plainly displayed inside of the doorway at all times. 6. Permit Conditions: The Town Council may include any conditions it finds necessary to conserve and promote the public health, safety, convenience and general warfare. The Council must include the following permit conditions for issuance of the special use permit for a medical marijuana dispensary: off-site cultivation location: a. H. Drew that was assaulted by Robert Mason during a quarrel over water rights in June 1879 in the upper San Pedro Valley. As there was another William Drew in the area at the time it may or may not have been our William. The Contention Mine was opened during the spring of 1878. It was about 10 miles north of what was to become the town of Tombstone. Contention City was laid out in the later part of 1879. They planned a smelter and it was started. Mule teams brought in materials. Before the smelter was completed, William passed away on 6 November 1879, of typhoid fever at the age of 60 and was buried in Contention. This is the first in a series about a local pioneer family.

Ray ‘Cats are ready for some action on the diamond By Taylor Sheaffer Ritter The minor lull between sports is finally over for all of you sports fans that go insane for the Bearcats…even the super-chill the area just experienced, snow and all, cannot cool the passion for sports in this town. The people of Kearny and the surrounding area go wild for their sports, chanting and cheering on their kids at every game. The Bearcats (both guys and gals) went up against

the Panthers of Superior on Tuesday, March 1, at 4 p.m. in Superior, thus starting not only the season off, but the fierce rivalry that exists between the teams. At press time, the outcomes of these games were unknown; however, they will be updated online as soon as possible. This season, balls are going to be knocked out of the park, athletes will run their hearts out, trying to steal home, second and third base. Outfielders

will leap for fly balls like their lives depend on it and undoubtedly, fantastic games will be played. Following their games against Superior, the Bearcats will meet with Braves from San Carlos in Ray on Tuesday, March 8, at 2 p.m. for the home game opener. The following game will be played again in Ray against Thatcher on Thursday, March 10, at 4 p.m. Come out and cheer for your guys and gals as they start their season!

(2) (Reserved) (b) Exclusion of certain sales of natural gas to a public utility. Notwithstanding the provision of subsection (a) above, the gross income derived from the sale of natural gas to a public utility for the purpose of generation of power to be transferred by the utility to its ratepayers shall be considered a retail sale of tangible personal property subject to Sections 8A-460 and 8A-465, and not considered gross income taxable under this Section. (c) Resale utility services. Sales of utility services to another provider of the same utility services for the purposes of providing such utility services either to another properly licensed utility provider or directly to such purchaser’s customers or ratepayers shall be exempt and deductible from the cross income subject to the tax imposed by this Section, provided that the purchaser is properly licensed by all applicable taxing jurisdictions to engage or continue in the business of providing utility services, and further provided that the seller maintains proper documentation, in a manner similar to that for sales for resale, of such transactions. (d) (Reserved) (e) The tax imposed by this Section shall not apply to sales of utility services to a qualifying hospital, qualifying community health center or a qualifying health care organization, except when sold for use in activities resulting in gross income from unrelated business income as that term is defines in 26 U.S.C. Section 512. (f) The tax imposed by this Section shall not apply to sales of natural gas or liquefied petroleum gas used to propel a motor vehicle. (g) The tax imposed by this Section shall not apply to: (1) revenues received by a municipally owned utility in the form of fees charged to persons constructing residential, commercial or industrial developments or connecting residential, commercial or industrial developments to a municipal utility system or systems if the fees are segregated and used only for capital expansion, system enlargement or debt service of the utility system or systems. (2) revenues received by any person or persons owing a utility system in the form of reimbursement or contribution compensation for property and equipment installed to provide utility access to, on or across the land of an actual utility customer if the property and equipment become the property of the utility. This exclusion shall not exceed the value of such property and equipment. (h) The tax imposed by this Section shall not apply to sales of alternative fuel as defined in A.R.S. Section 1-215, to a used oil fuel burner who has received a Department of Environmental Quality permit to burn used oil or used fuel under A.R.S. Section 49-426 or section 49-480. Section 4: The Town of Kearny hereby Amends Model Sales Code Reg. 350.2 Record keeping: expenditures by deleting Regulation 350.2(e)(3)(A) and is redesignated as Reserved. Section 5: The Town of Kearny further Amends Ordinance No. 09-178 and adopts Reg.8A-350.2 Record keeping expenditures by deleting Regulation 8A-350.2(e)(3)(A) of the Model Sales Tax Code to the Tax Code of the town of Kearny and Restating Regulation 8A350-2 as follows: Reg. 8A-350.2 Recordkeeping:expenditures. (3) franchise and license fee payments and computations thereto which relate to: (A)(Reserved) (B) telecommunication service. (4) the validity of any claims of proof of exemption, as provided by Regulation. (5) a claimed alternative prior value for reconstruction. Local opens for Wood Hometown Alumni John Manuel Solis, son of Alfonso and the late Margie Douglas Youtsey –Solis, was giving the opportunity to open for “Doo Wop” legend Brenton Wood and his True Player Band on Friday, Feb. 4, in Avondale at the club, Henry Jack’s Place; and, on Saturday, Feb. 5, in Casa Grande at the Holiday Inn, for their preValentine celebration. Wood is best known for his songs “Oogum Boogum”, “Give Me Some Kind of Sign”, “Girl”, “Sitting in the Park”, “Me and You”, to name a few. He

performed to a sold out room, two shows, both evenings, where John and his Solis-101 and Dulce band, opened for Wood. The musical treat of performing with such a legend was as sweet as the candy the band is named for. John is looking forward to working with Wood and his crew, again, in the near future. In the meantime, other shows are being planned, where Solis-101 and Dulce will be the opening band. A thankful John says, “Much love and respect to all of you, and, God bless,” to the members of his group, who made it all possible.

Repaving project on State Route 77 north of Catalina begins March 7 TUCSON - The Arizona Department of Transportation will repave more than three miles of State Route 77 just north of Catalina beginning Monday (March 7). A layer of the existing pavement will be removed and replaced with a new layer of smooth, quiet rubberized asphalt between Eagle Crest Ranch Drive and just east of the Oracle Junction/State Route 79 turnoff. What to expect during construction: • Crews will work daytime hours from dawn until dusk, Monday

through Friday each week. • There will be at least one lane open in each direction of traffic through the project area at all times until the project is completed. • Signage will direct motorists through the work zone. • The project is scheduled to be completed early this summer. While the lane restrictions are in effect, drivers from the communities of SaddleBrooke, SaddleBrooke Ranch, Florence, Oracle, Mammoth, San Manuel, Winkelman, Hayden, Kearny

and Globe should allow extra time for travel to and from Tucson. As always, drivers are reminded to proceed through the work zone with caution, slow down, and be alert for construction equipment and personnel. ADOT works to inform the public about planned highway restrictions, but there is a possibility that unscheduled closures or restrictions may occur. Weather can also affect a project schedule.
