Charges laid in crash that killed teens

Man 27,charged with criminal negligence causing death,flight from police and driving while prohibited

A 27-year-old man has been charged in connection with a crash that killed two young men on the Burnaby-NewWestminster border last summer.

The deaths of Samir Olyad Suleiman Ali, 18, andYabsrat HabtamuYtatek, 17, devastated the Lower Mainland Ethiopian community

Both teens were firstborn sons of large families and were described as leaders in the Ethiopian community

Ytatek, a Burnaby resident, had come to Canada with his family as a refugee via Somalia eight years earlier

He was preparing to enter Grade 12 at Byrne Creek Community School in the fall

Developers push back on $40K parking stall ‘penalty’

Developers aren’t happy with a City of Burnaby proposal that would charge them $40,000 per parking stall they don’t have to build.

They say the cost will either be passed onto homebuyers or effectively shut down a project

The proposal is part of an interim plan to reduce parking requirements within 800 metres of a SkyTrain station

It specifically responds to an 80-storey development in Lougheed that currently has 14 floors of required parking

The proposal would reduce the parking requirement in the development by 45 per cent, from 1,612 residential parking spots (the minimum number currently required by the city’s bylaws) to 879 spots

The project by Pinnacle International at 9850 Austin Rd. and 9858/9898 Gatineau Pl. is direct-

ly across the street from LougheedTown Centre SkyTrain station, a one-minute walk.

City staff and Pinnacle agreed building the current required minimum “would have significant impacts upon housing affordability” and the city’s climate goals, according to a staff report

The proposed policy would reduce the parking minimum from the current requirement of 1.1 parking spots per strata unit to 0.6 spaces per unit.

The interim policy would also require developers to pay $40,000 per stall in lieu of the reduced parking from the current 1.1 spaces per unit.

The money (called payment in lieu) would be funnelled into the city’s active transportation initiatives.

Current city policy charges a payment of $25,000 per commercial and industrial parking stall for up to 35 per cent of

the required parking. But developers aren’t happy about the new payment.

It would mean, for example, Pinnacle would pay $40,000 for each of the 733 parking spots it doesn’t have to build under the new proposed policy. It would cost the developer more than $29 3 million

He added that, along with rising interest rates, the fee for reduced parking would place a “significant financial burden on Pinnacle and will ultimately cause housing pric-

es to go up and not down as suggested in the report ”

Ralph noted all the parking stalls in the development will be equipped with EV chargers, and the developer will offer transit passes, a car share program and an e-bike share program.

“While also costly, these are effective measures and incentives, unlike the $40,000 per stall penalty proposed,” he wrote.

The Pinnacle development, which would include the tallest tower in Western Canada at 259 1 metres/850 feet high, plans for 1,067 commercial parking spaces and a total of 3,374 spaces for bicycles

Canderel, which is developing two towers of condos and rentals at 3965 North Rd. right beside the Pinnacle development, said it is “very concerned” about the policy and asked for the city to remove the parking pay-

ment in lieu.

Senior executives Ryan Jenkins and Bryce Margetts at Canderel said the policy would cost them more than $12 million in “unforeseen additional costs” that would either be passed onto the buyers or cause the development to become “economically unfeasible.”

They said the policy could result in developers choosing to build more parking and “attempt to sell or retain ownership of the additional stalls rather than paying a fee to the city”

The developers agreed that reducing parking minimums is “long overdue.”

Council on June 19 referred the proposal to the July 12 planning and development committee meeting, after press deadline Councillors hoped the proposal would returnfor council approval in August.

“We all are heartbroken,” a neighbour and close friend of the Ali family said at a candlelight vigil for the young men last summer.

Charges have now been

laid against Cory Robert Brown, 27

He was charged on July 4 with two counts of criminal negligence causing death, flight from police and driving while disqualified under the criminal code.

Brown has been charged with dangerous driving at least three times before, according to Court Services Online.

He was sentenced to one

day in jail and a one-year driving ban for dangerous driving and obstructing a police officer in Burnaby in December 2020

He is awaiting sentencing after being found guilty of dangerous driving and fleeing from police in Surrey on May 5, 2022 less than three months before Ytatek and Ali were killed And he was charged with dangerous driving in Burnaby on Aug 28, 2022

B.C. boundary shuffle will help keep election on track

Premier David Eby keeps getting asked if he will call an early election, and he keeps emphatically denying that he has any interest in doing so

The latest question came in the wake of BC United’s dismal showing in two recent byelections Why not take advantage of that party’s rebranding birthing pains and pull the plug now? Eby replied that no one is looking for an early election and that he has bigger priorities on his plate I believe him.

However, there is also another big reason to wait until the actual scheduled election day (which is Oct. 19, 2024) before testing the voters: B C ’s electoral map is in for some major changes, and most benefit Eby’s New Democratic Party

An independent electoral boundaries commission has added six new ridings, bringing to 93 the number of MLAs to be elected

Two of the new ridings are in BC NDP fortresses (Burnaby and the Capital region), while three more are in cities where the NDP holds most ridings already (Vancouver, Surrey and Langley) while just one is in a traditionally strong BC United (née BC Liberal) area (Kelowna)

Given that Elections BC has indicated it will take months to incorporate the changes into its election infrastructure, that would appear to rule out a fall vote if Eby wants to take advantage of the new ridings It is not yet clear whether the changes can even be made by next spring, so waiting until the fall of 2024

seems advantageous to the New Democrats, no matter how many controversies pile up between now and then.

The big increase in seats is reflective of this province’s huge increase in population, particularly in the areas where the new seats are located: MetroVancouver, Vancouver Island and the Okanagan

If this population trend continues, more ridings will likely be established in those regions in the future

The steady increase in the number of our provincial MLAs also poses a challenge that has little to do with politics or policies.

The B C legislature chamber itself is almost overcrowded, and adding six more desks seems problematic. Right now, all the desks and chairs have been removed

for maintenance and the empty room reinforces how small a chamber it really is

One solution floated by veteran NDP Mike Farnworth is to get rid of the desks and bring in benches, as is the case in the U.K.’s House of Commons.The primary role of the desks in the B C chamber is to serve as an opportunity for MLAs to pound their desktops in support of their side of the house, so replacing them would at least make the place less noisy

In any event, after the next election we are soon going to have more MLAs in the chamber For the moment (and things can change quickly in politics), the odds favour most of them sitting on the NDP side of the house

Proposed non-market project can help ease rental crisis

Editor: I am surprised at the opposition shown by homeowners in the Edmonds Town Centre towards the proposed non-market rental building at 7388 Southwynde Ave.

This development has the potential to address the pressing issue of affordable housing in a city plagued by high rents and dwindling purpose-built rental units, yet this development also brings out the NIMBYs

It is crucial to understand the broader context and the urgent need for affordable housing in the city Burnaby currently ranks as the thirdworst city in the country in terms of rental affordability As residents struggle to find suitable housing within their means, purpose-built rental units are being lost over time The proposed non-market rental building, including a child-care facility, offers an opportunity to alleviate this crisis.

The City of Burnaby has taken a proactive

approach by partnering with Metro Vancouver Housing to address the affordable housing shortage. The project intends to provide 122 rental units, with a significant portion offering rents at below-market rates. The City of Burnaby would lease the land at a nominal rate, ensuring the long-term affordability of the housing

As a community, we must recognize the importance of embracing affordable housing initiatives By opposing such developments, we risk perpetuating the housing crisis and denying fellow community members the opportunity to live in safe and stable homes.

I urge homeowners and community members in Edmonds Town Centre to consider the long-term benefits of the proposed non-market rental building. Let us come together and work towards creating an inclusive community that prioritizes the well-being of all its residents By embracing affordable housing initiatives, we can foster a more equitable and prosperous future for Edmonds Town Centre

Man charged with ‘indecent act’ inside women’s washroom

A 48-year-old man has been charged with committing an indecent act inside a women’s washroom at a Burnaby park during the Canada Day long weekend.

Officers were called to Rene Memorial Park near Sperling Avenue and Elwell Street at about 2 p m on July 2 for a report of an indecent act that allegedly happened in a women’s washroom at the park, according to a Burnaby RCMP news release.

Police conducted patrols in the area and arrested the suspect a few blocks away from the scene about

“It is because of the quick thinking and assistance of the public that we were able to locate and arrest this individual,” Burnaby RCMP Cpl Mike Kalanj said in the release. “We want to remind the public that it’s import-

ant to report these types of incidents right away, as this gives us a much better chance of locating suspects and producing more positive outcomes for victims.”

Christopher Johnson, 48, has now been charged with one count of committing an indecent act in public

He has been released on court-ordered conditions, including not going to public parks, swimming areas, daycare centres, playgrounds and school grounds. He is also banned from any community centre where persons under the age of 16 can reasonably be expected to be present

$30K in fines for Airbnb rentals at condo dismissed

A strata that tried to impose $30,000 in fines on an owner whose Burnaby condo was rented out on Airbnb has lost a case in front of the province’s Civil ResolutionTribunal

In September 2021, the strata at the Altus in Brentwood’s Solo District fined Kale Kondra $30,000 for breaking the building’s rules against short-term rentals, according to a June 29 tribunal ruling.

The penalty represented fines of $1,000 a day for 30 days between July 14 and Aug 14, 2021 because Kondra’s condo had been listed on Airbnb at that time, and fob activity and video footage had shown different groups of people living in the unit

But Kondra opposed the fines, saying his exspouse had listed the condo on Airbnb and that a B.C. Supreme Court order had given that exspouse exclusive occupancy of the unit between

April and September 2021

Kondra said his lawyer had even sent the exspouse’s lawyer a letter to get the Airbnb listing taken down, but the exspouse’s conduct was out of his control because of the court order.

Tribunal vice-chair Garth Cambrey ultimately sided with Kondra for two reasons

First, he concluded there was enough evidence to show the exspouse and not Kondra had allowed the Airbnb rentals

Second, Cambrey said the strata has no bylaw explicitly banning Airbnb, and the bylaw against short-term rentals doesn’t apply

The bylaw states no owner shall “rent” a strata lot for a period shorter than one month, but Cambrey pointed out there is a difference between “renting” and “licensing.”

Short-term accommodations, such as vacation rentals, involve licensing arrangements, Cambrey said

“The words ‘rent’ and ‘rental’ do not apply to licences and only apply to tenancies,” states the ruling.

Cambrey dismissed the strata’s claims.

Communitynow Burnaby Pride Week kicks off with flag raising

Just exactly who, what and where is Burnaby’s queer community?

Burnaby Pride organizers still don’t really know, but they’re keen to learn more, according to chair Athena Affan

Now in its sixth year, the organization is presenting another series of summer events starting with a barbecue at Keswick Park last weekend to celebrate localTwo-Spirit, lesbian, gay, bisexual, transgender, queer, intersex, asexual/aromantic, plus (2SLGBTQIA+) residents, but the nature of the community has remained somewhat elusive

When Burnaby Pride threw its first summer street party at Civic Square in 2018, Affan herself was pleasantly surprised.

“I was just like, ‘I didn’t even know that there were any queer people in Burnaby,’” she said in an interview with the NOW “We don’t have any specifically queer spaces.”

Burnaby Pride was started through community organizations, Affan explained, but organizers would like to see it

be more responsive to the needs of the individuals it serves

“In order to do that, we really need to get a sense of who the community is and really do some community engagement so that we’re really offering something that’s meaningful for the queer folks who live and work in Burnaby,” Affan said

‘YOU WANT TO KNOW YOU’RE SUPPORTED’

Meanwhile, the events Burnaby Pride is already putting on every July provide important opportunities for members of the queer community to come together in solidarity and celebration where they live, work and play, according to Affan.

“As a queer person living in Burnaby, you want to know you’re supported; you want to know that you’ve got other community members out there; you want to know your community supports you,” she said

The events also give other Burnaby residents “lowrisk” ways to learn about queer people’s experiences, according to Affan

This year’s offerings kicked off with a Pride

community barbecue last Saturday at Keswick Park near the Lougheed SkyTrain station

On July 17, there will be a Pride flag raising ceremony at Burnaby City Hall at 1 p m to kick off Burnaby PrideWeek

Then, on July 22, the big event, Burnaby Pride Festival, hits Burnaby Civic Square from noon to 6 p.m. (see information below)

A youth Pride movie night on July 28 from 7:30 to 10 p.m. rounds out the

month

The first in-person festival after the pandemic last year drew a big crowd, with about 3,000 people coming through, according to Affan.

“We had a lot of seniors come out to that event last year, which really sur-

prised us, and we’re hoping to see the same this year,” Affan said

‘AVOID AND REPORT’

Burnaby Pride organizers hope anti-trans and anti-SOGI (sexual orientation and gender identity) protests won’t dampen the celebrations, but Affan said Pride organizations across the country have recorded an uptick in antagonism toward the queer and trans communities over the last year

Burnaby Pride has safety plans in place and is asking people not to engage if protesters show up

“Some of the ways that the protesters are engaging these days, is that they might video you,” Affan said “They’re trying to get a negative response to portray the community in a bad light ”

The best way to deal with the situation is to notify a volunteer or Burnaby Pride representative, according to Affan.

“Avoid and report,” she said “We’ll have a safety plan in place so we can address it,” she said.

While it might be tempting to engage, Affan said there are lots of other ways to be an ally of the queer

community without creating a “tough vibe” at events

“On a day like a Pride event, folks just want to relax and focus on the celebration,” she said

BURNABY PRIDE FESTIVAL

This year’s Burnaby Pride Festival runs from noon to 6 p.m. on July 22 at Civic Square outside the Bob Prittie Metrotown library.

The event will feature a diverse lineup of live music, comedy, drag performers, interactive booths, activities and more

The drag segment will run from 5 to 6 p.m. and feature performers Batty Banks, King Fisher and Bongganisa

Musical acts will include Fallen Stars, IAMREBELWILL and Parlour Panther

“We’ve got a lot of new performers this year,” Affan said

Among the new acts is a mother-daughter duo Affan is “really excited about,” but she wouldn’t say much more for fear of spoiling the surprise.

Performances on the main stage will run from 1 to 6 p.m.

Citynow Inventory shortage helps drive Burnaby home-price rise

Home prices continue to rise month-over-month in MetroVancouver, and Burnaby is no exception.

Detached homes and apartment prices have ris-

en across the city, according to a new report by the Real Estate Board of GreaterVancouver (REBGV)

“Despite elevated borrowing costs, there continues to be too little resale in-

ventory available relative to the pool of buyers in MetroVancouver,” said Andrew Lis, REBGV’s director of economics and data analytics, in a news release.

“This is the fundamental reason we continue to

see prices increase month over month across all segments.”

In Burnaby, the estimated price of a typical property (called the benchmark price), ranged from about $1 03 million in North

Burnaby to $1 19 million in East Burnaby South Burnaby saw a benchmark price of $1 12 million last month across all property types.

It’s a one-month increase of between 6 4 per cent (South Burnaby) to 9.1 per cent (East Burnaby) over the last six months

But in the last year, prices have dropped ever so slightly; Burnaby North saw its benchmark of all residential types drop 3.7 per cent from a year ago – but it’s still up 26 8 per cent from three years ago.

And townhome prices in East Burnaby fell slightly, with a benchmark of $863,500 (down 1.3 per cent this month, but up 27 1 per cent from three years ago).

The REBGV is calling on the provincial government to adjust the threshold for the first-time homebuyers’ exemption from the property transfer tax.

The REBGV noted the benchmark price for apartments in the region is now $767,000 while the current threshold for the firsttime buyers’ tax exemption is $525,000.

“This is a simple policy adjustment that could help more first-time buyers afford a home right now,” Lis said

Rise in violence prompts bill to protect first responders

NewWestminster-Burnaby MP Peter Julian pushes for tougher laws against attacks on firefighters and other emergency personnel

The stabbing death of a young police officer in Burnaby and the assault of a firefighter attending a routine call are being cited as examples of why first responders need added protections under the Criminal Code

On June 19, NewWestminster-Burnaby MP Peter Julian tabled Bill C-345 in the House of Commons, legislation aimed at protecting firefighters, paramedics and other first responders. At a July 5 news conference, Julian said firefighters, paramedics and other first responders put their lives on the

line to protect communities across Canada

“Yet, we have seen a striking increase in aggravated assault of firefighters, paramedics and other first responders,” he said “What my legislation does is add firefighters and paramedics under the definition of first responder in Section 2 of the Criminal Code so their safety is being protected ”

Julian said it’s been “disturbing” to see the increase in violence against firefighters and paramedics.

“A recent study in Manitoba actually showed that 50 per cent of all firefighters had at some point,

been kicked or hit or pushed. And we see 75 per cent-figures for paramedics,” he said. “So that is disturbing to see this rise

in violence against firefighters and against paramedics And that is the primary reason why I tabled Bill C-345.”

According to Julian, his private members bill would result in an automatic charge of first degree murder in cases where an assault of an on-duty first responder, firefighter or paramedic leads to their death

“This is very similar to the language in the Criminal Code that exists now for police officers,” he noted. “Secondly, what it does is increased penalties for assaults against firefighters and paramedics. And thirdly, it creates an offense in the Criminal Code of assault against a firefighter or paramedic, assault against a first responder. What this bill does is en-

sure that firefighters and paramedics are protected to the same extent as police officers.”

At a July 5 news conference, NewWestminster and Burnaby fire departments offered their support for the bill and encouraged Canadian MPs to support the bill.

The NewWestminster Firefighters Association, Local 256, the Burnaby Firefighters Association Local 323 and the BC Professional Fire Fighters Association joined New Westminster and Burnaby fire chiefs, including Burnaby chief Chris Bowcock, in supporting the proposed legislation.

What marks a summer day more than a bike ride?

I can remember, as a kid, the hours spent pedalling up and down my family’s driveway with my dad holding onto the back of my bike so I could learn to balance without training wheels

Then, the feeling of weightlessness as if I were taking off when I was pedalling and looked back to realize my dad was no longer holding my bike.

The feeling of surprise probably made me a little unsteady, but this was overshadowed by the success and freedom I felt to be pedalling all on my own.

Learning to ride a bike, especially for kids, becomes a marker of childhood adventure and independence, and it can even spark a lifelong love of cycling as a

sport, a form of play or a form of transportation or all three
