BANDRA GYMKHANA COMMEMORATES 80TH ANNIVERSARY Located in the heart of the Queen of the Suburbs, the Bandra Gymkhana is a hive of activity, both sporting and otherwise - including fine dining. The metamorphosis of the Bandra Gymkhana since its inception in 1935 is the result of eight decades of grit, determination, dedication and the selflessness of its founding fathers and successive committees. As a child, I have fond memories of going to the Gymkhana every Sunday for housie with my parents. It was a ritual that many families in Bandra followed religiously, after Sunday morning mass. But now, it’s the Wednesday & Friday dance social that every Bandraite looks forward to. The Bandra Gymkhana proudly boasts

of five court well-lit asphalt tennis courts, an ultra modern fitness centre, a top-of the line bar, a fine dine speciality restaurant, a refurbished billiard room, card room and well-stocked library, a pine-wood floor badminton court, an amphitheatre space, a rooftop swimming pool and a 4,300+ member club, proud to be ‘Simply the Best’. The “Gym” - as it was abbreviated in the years, has played a vital role in the history of the suburb. Authorities witness People’s Power at DPRC As a ‘show of strength’, the DPRC grounds were packed with more than 800 people, who came to witness what our MLA and the Hon. Co-operation Minister would have to say about the many grievances’; that have arisen due to various discrepancies in respect to the 97th Amendment effected in The Maharashtra Co-op. Societies Act, 1960 - from the year 2013. Many were seething with anger at what was happening in their societies, due to issues of newly amended laws, that are allegedly – ‘just not practical’. The backdrop banner said it all – PEOPLE’S POWER! Present on dais were Shri Subhash Deshmukh - Hon’ble Co-operation Minister, Shri Ashish Shelar - MLA, Smt. Alka Kelkar - Deputy Mayor of Bombay, Shri Pravin Dharekar - MLC, Shri Mahendra Mhaske - District Deputy Registrar, Shri Arif Khan - Divisional Joint Registrar, Mumbai, Shri Ivan Mendonca - Chairperson, The Salsette Catholic CHS, Brenden D’Silva - Chairperson, The Sebastian Homes Co-op. Soc. Ltd., Shyama Kulkarni Co-ordinator, Karen D'Mello & Asif Zakaria - both MC. Surely, the restless crowd sitting in front of them, spoke volumes of how society members feel about these amendments (without any application of mind, in terms of ground realities), that have affected them very badly. Initially, Adv. Rafael D’Souza spoke on the early humble beginnings of Housing Societies Rules & Regulations around the year 1904, by founding fathers with vision – and how it evolved very successfully,

even till today. In fact, the comparatively recent MCSC Act 1960 has taken many clues from the early society laws, with 167 sections. Then, Ernest Fernandes & others spoke on behalf of aggrieved society members. There were spells of rhetoric, as pent up emotions got a platform – to interact directly with people who matter. These vocal outbursts were the frustrations of society members coming to the surface - after being suppressed for years. There was a lot of hate sentiments expressed about the office of the Deputy Registrar. Authorities witnessed people’s power - at close range. Then, MLA Ashish Shelar commented in a balanced manner. He stated that the root cause of this issue was the 97th Amendment. This was followed by Shri Subhash Deshmukh - Hon’ble Co-operation Minister - who spoke at length in Marathi. Since he had to take a flight, the meeting ended without any mention of the letter to be sent by representatives of six societies to the Hon’ble Co-op. Minister. However, Bandra Buzz has got a copy of this important letter, of which the crux of the matter is published in this issue. Interacting with affected society members in the crowd, the general feeling of hate against interference from the Registrar of Societies - could be clearly seen. Bandra Buzz Team

Six societies send a plea to Co-op. Minister Subhash Deshmukh Six large Bandra-based societies have sent a humble plea regarding various discrepancies in respect to the 97th Amendment effected in The Maharashtra Co-op. Societies Act, 1960; from the year 2013 – to the Hon’ble Co-operation Minister Shri Subhash Deshmukh. The points to be considered, mentioned in the letter are: 1. To amend the Co-operative Societies Act and de-link the Housing Sector from Applicability of provisions of Elections, Training & Contributions to the funds of the Government. The reason is that Housing Societies are only service-oriented & exist on mutual concept, while others are stateaided & commerce-related. 2. Income Tax should not be applicable to Housing Societies dividends, as per the present Act. 3. Since no government funds are given to

Housing Societies, they should not be asked to conduct their elections through the State Election Authorities – and made to pay for this, from their limited funds. 4. The amended Act has cast a heavy burden on implementing its own laws, as resources are very limited. They are unable to send their officers to conduct the elections. 5. The training programmes are another burden cast upon Housing Societies. Many societies have been successfully run since 1912 – and do not need inputs from the MCS Act 1960, which had taken vital clues from them. 6. Why has an officer from the Dy. Registrar’s Office to come and be paid to conduct elections, when a Managing Committee Member resigns? The earlier Act clearly provides that a MC member could be coopted in place of the resigned member –

and continue. 7. Many societies have 10 or less members. With the Amendment, the MC should consist of 15 members – which will affect the quorum needed for holding a meeting. Hence, this clause should be deleted with immediate effect. 8. Plot Holder Societies & their Sub-Societies have issues too. There are many Plot Holder Societies registered under the Bombay Co-operative Societies Act, 1912. Their bye-laws were duly approved by the Deputy Registrar appointed under the Act of 1912. Since then, the plot holder societies have been following their bye-laws and running efficiently. Needless to state, that some of the plot holder societies restrict membership to a particular community, religion, etc. Their bye-laws are in accordance with the Fundamental Right, guaranteed under Article 19(1)(c) of the Constitution of India. The right to restrict membership to a particular community, religion, etc. has been upheld by the Supreme Court in the case of the Zoroastrian CHS Ltd. & Anr. v/s District Registrar, Co-operative Societies (Urban) & Ors. Reported in 2005, Supreme Court Cases 632. In view of this, the Government of Maharashtra should direct the Registrar of Coop. Societies to desist from interfering with the bye-laws of CHS, restricting member-

ship to a particular community, religion, sex, etc. – in a secular India, if the restriction is fair and reasonable. In these circumstances, all six societies have appealed to the concerned minister to urgently look into the matter and delete the clauses mentioned, which will affect over 30 million members of CHS in Maharashtra. Detailed documents of this letter can be seen on bandrabuzz.com/chs.html Further, these matters have put a lot of pressure on the Dy. Registrar – who in turn is harassing CHS members. Moreover, the Constitutional 97th Amendment has been struck down by the Gujarat High Court, in view of it not having the requisite mandate for the President to clear the subject Bill. The Six Signatory Societies to this plea, are the Secretaries of: - The Salsette Catholic CHS Ltd. - The Sebastian Homes CS Ltd. - Virendra Sahakari Griha Nirman Ltd. - The Nasik Catholic Sanatoria CS Ltd. - St. Peter’s CHS Ltd. - St. Anthony’s Home CHS Ltd. Bhamla Foundation gives St. Catherine’s Home kids a reason to smile - this Diwali Just seeing the joyful orphans enjoying themselves at Global Fusion, Times Square Mall, Saki Naka, brought tears to my eyes. Their reason to smile was because of the efforts of Bhamla Foundation, who arranged to take the kids from St. Catherine’s Home, next to Mount Mary Basilica, Bandra for a day out of their normal routine. Rangoli designs, diyas, lamps and other decorations added to that Diwali feeling. A candle loses nothing by lighting another candle. So, why not spread joy to the less fortunate? Would you? When other children enjoy with their families, homeless orphans feel lonely and isolated. Remember, this festival of Diwali is about spreading happiness and joy around us. Bhamla Foundation did exactly that. They celebrated Diwali, the festival of light; by touching the lives of

the little children. It was an eco friendly Diwali with Bollywood stars Ranbir Kapoor and Anushka Sharma, who came, played, sang and spoke to these children, who were thrilled to experience such an interaction. Is our H-West ward BMC office communal? In a shocking incident, Mr. Allan Francis Fishery’s house was partially demolished with instructions from BMC Officer Mr. Sunil Tawde. After surreptitiously serving a stop work notice dated 15th October 2016 on 18th October 2016 at 11:45am - within hours (at 2pm), Mr. Tawde and his team with the police entered the premises of a senior citizen Mr. Allan Francis Fishery at 111-A, Bazar Road, Bandra (West). They demolished a slab of the second floor roof, despite Mr. Allan applying for permissions (for details, please visit: bandrabuzz.com/hw-bmc.html) vide letter dated 6th November 2015 and 24th February 2016 to the BMC. In another recent case, there is an order from the city civil court dated 6th May 2016 - for demolishing an illegal structure of ground plus first floor, occupied by Mr. Kambli at Kadeshwari Mandir Road, wherein the whole first floor and partial ground floor had been ordered to be demolished. Despite constant follow up by a senior citizen Mr. Clifford Cardoz, in the public griev-

ances held by the Assistant Municipal Commissioner (AMC) Shri Sharad Ughade - there has been no demolition till date. In both the cases, Christians are being harassed by the BMC H/West ward office. Similarly I have met up with several other cases during the Public Grievance meetings held by the AMC, whereby I have interacted with many Christians who have complained - that either their complaints have not be addressed, or they have been served with illegal notices, only to be harassed. One of the most prominent case of targeting Christians is the Development Plan 2034, which has targeted our heritage churches, crosses and gaothans. Why do India's liberals oppose a liberal idea? The introduction of a Uniform Civil Code (UCC) has been talked about for decades, indeed since Independence. It was part of the BJP’s 2014 manifesto, and the attempt at reform of triple talaq has sent alarm bells ringing among liberal intellectuals and conservative Muslims. The uniform liberal view seems to be that the UCC is an imposition by a right wing Muslim-unfriendly government and that reform of triple talaq is just a way to beat up or subjugate the Muslim community. The “liberals” (I will have the word in quotes until it is established that the “liberals” are actually liberals) claim that there are discriminatory anti-women laws among the majority Hindu community, and that these need to be reformed first, before imposing majority views on the minorities. Let us start with first principles. In a fair, just & ideal world, rights should be human rights, unaffected by sex, or religion. The Indian Constitution came close to defining it in this manner. Article 44 of the Constitution, “Uniform civil code for the citizens” states: “The state shall endeavour to secure for the citizens a uniform civil code throughout the territory of India”. Unfortunately, the Constitution writers inserted this clause in the nonbinding Directive Principles of State Policy

section. The Constituent Assembly debates make up for the lack of appropriate specification in the Constitution. Particularly relevant for today’s debate are the comments of K.M. Munshi, made 68 years earlier. His summary view on the UCC, which he supported, was “This attitude of mind perpetuated under the British rule, that personal law is part of religion, has been fostered by the British and by British courts. We must, therefore, outgrow it.” At the time Munshi made his comments, Hindu law was very anti-women. However, post 2005 and passage of the Hindu Succession (Amendment) Act 2005, men and women have equal rights to inheritance, property etc. Besides some possible capital gains benefits for those filing under HUF (Hindu Undivided Family), there are no differences (that I can surmise though I am willing to be corrected) in the rights of Hindu men and Hindu women. However, this was not the case in 1948 when Munshi said: “I know there are many among Hindus who do not like a uniform civil code, because they take the same view as the honourable Muslim members who spoke last. They feel that the personal law of inheritance, succession etc is really a part of

Stop arguing by deleting negative energy in your tone of voice. Avoid criticizing and telling others what to do. • Any tone of "I'm right; you're wrong," gives an "I'm ok; you're not ok" message. So does irritability, annoyance, sarcasm, contempt or anger. • Criticism, especially when it is spoken with an irritated tone of voice, conveys a “You're Not Ok” message. • Skip the dictating. All of us want to be the captain of our own ship so beware of pressing the "Don't control me!" button. Requests are fine, if they are genuine questions. Demands are not, including subtle comments like "I need you to ..." or "I would like you to ..."

their religion. If that were so, you can never give, for instance, equality to women. But you have already passed a Fundamental Right to that effect & you have an article here which lays down that there should be no discrimination against sex. Look at Hindu Law; you get any amount of discrimination against women; & if that is part of Hindu religion or Hindu religious practice, you cannot pass a single law which would elevate the position of Hindu women to that of men. Therefore, there is no reason why there should not be a civil code throughout the territory of India.” (emphasis added). Not surprisingly, Munshi, a Congressman & governor of Uttar Pradesh during 1952-55, resigned from the Congress & became the vicepresident of the newly formed Swatantra Party. He recognised early on that the Nehruled Congress was no party for liberals. The Muslim community has attacked the suggestion of a UCC as a direct attack on itself. A recent press release, signed by 103 “Muslims & people of Muslim descent” states at the outset that it is “against the instant arbitrary triple talaq as practiced in India & we support the demand of the Muslim women to abolish it.” However, the statement goes on to add that “The present regime & their earlier avatars have used the Uniform Civil Code as a stick to frighten & demonise the Muslim community & polarise opinion. Uniform Civil Code has been always been projected by such regimes & right wing politics as a Hindu vs Muslim tool. The fact of the matter is that many of the personal laws irrespective of which religion they belong to are archaic & anti-women We appeal to all liberal, progressive sections of the Muslims as well as all other citizens to support the struggle of the Muslim women for reform & to expose the nefarious designs of both the present regime as well as of the patriarchal conservative Muslims who are colliding with the retrogressive forces to take the attention away from the most important issues & the failures of the present government on all fronts.” (emphasis added) It is intriguing that the “liberals” have moved from attacking triple talaq and women’s rights to an all-out attack on a “right-wing” government. Let me see if I understand this right. The previous Congress governments went all out for appeasement (remember Shah Bano?) of Muslims to get a few extra votes and irrespective of the fact that they were being blatantly anti-women; the present government, even if it is against triple talaq and pro-women rights is suspect

because it has failed on all fronts? Even “liberals” like Flavia Agnes (interview to Firstpost.com, October 19) have problems with implementing the UCC at this time. In a not too dissimilar statement than the one above, she states “today the faith of Muslim communities in the present rightwing government is at very low ebb. Hence the political climate is not conducive to reforming laws of minorities or for bringing in a Uniform Civil Code”. (emphasis added) When asked about why the UCC should not be implemented, she counters by obfuscation. “When discriminatory practices within Hindu law and cultural practices are discussed they are not framed as ‘Hindu’ but are discussed in general terms as ‘women’s problems.’’’ One such Hindu problem coming in the way of the UCC is “the problem of dowry-related violence & dowry deaths. There is no research conducted as to how many women who are murdered for dowry are Hindus. A research done by our organisation about cases which have reached the Supreme Court and the Bombay High Court revealed that more than 90 per cent were Hindus. Less than 10 per cent were Muslims and others.” Assume for a moment that all 100 per cent of dowry deaths are Hindu. What does that fact have anything to do with the desirability of a UCC? These deaths are illegal; are not sanctioned by law, Hindu or otherwise. If not implemented, it is a law and order problem, not a UCC problem. It is somewhat disappointing to note that whereas a fundamentalist Muslim country like Pakistan has banned triple talaq our “liberals” are arguing that UCC should not be introduced until India has solved all problems related to women — nay, all problems related to womenkind. Masha Allah, “liberals”. Implementation of the UCC will not result in zero dowry deaths, or make zero the practice of bigamy among Hindus, or the practice of “quadrigamy” among Muslims. Further, the UCC will not end violence against women. To ask for a solution to all women-related problems before introducing the UCC is to blatantly argue against the interests of women. Which is why the quotation marks on “liberals” remains.

However the first question that I asked Mr. Kishore Makad, MD of the desi paan boutique is that it is that what inspired him to launch a store exclusively for paan at such a prime location? The outlet in Bandra is their fourth branch, having opened up the first store in the year 2014 in Chembur he seemed at ease with this strategy. Mr. Makad states “Our vision is clear and we are immersed in each and every aspect of the business. With a redefining business plan we are sure that as long as we are able to provide a good experience for our customers we are on the right track. Bandra just got Sassier The Sassy Spoon is a labour of love and a deep-rooted passion for food & the Bandra outlet has always been adored for its scrumptious food & cute dining place. Two months after a sudden shut down to refurbish its interiors and its menu, Bandra’s sassiest gourmet eatery is back with a bang and a lot more sass. All the vintage deco & delicious additions in the menu has made it worth the wait. So what’s new? For starters, they’ve added ‘Bandra’ as a suffix to their name. The new avatar imbibes a more youthful spirit with its warm and chic bar centric ambience. Being true to their oxymoron like nature, the design intend is to blend the essence of a contemporary resto bar. A fresh colour palette of vintage pink with floral art work has been introduced on the walls, along with a cute spectrum of pink ombre on the rope ceiling in the outdoor patio. To give patrons that ‘Sassy experience’, the menu has been completely revamped with several new additions like a warm green apple, smoked scarmoza and fennel soup, which is tangy but creamy, giving it a sassy twist. Hamara Bandra Station, Hamari Shaan Under the auspices of the nation-wide Daan Utsav from October 2-8, Mumbai First and Making A Difference Foundation (M.A.D.) had organised an initiative to spruce up 36 local stations on the Western & Central Railways in Mumbai. Bandra Railway Station was one of them. The Chief Guest at the inauguration of this initiative was Hon’ble Railway Minister Suresh Prabhu and Guest of Honour was Poonam Mahajan, MP for Mumbai North Central on Gandhi Jayanti, October 2 at 9am in the foyer of Bandra West station. Also present on the dais were CM Devendra Fadnavis & our local MLA Adv. Ashish Shelar, who spoke about maintaining this iconic structure – and the importance of keeping it clean. Actor Anil Kapoor gave us his child-

hood experiences of Bandra Station. Bandra Railway Station was centrestage that day. After brief speeches by the dignitaries, NGOs had wonderful road-skits with the theme of Gandhi Jayanti. It was a sight to see young kids dressed as Mahatma Gandhiji, Pandit Nehru and ‘Mother India’ – shouting slogans of Indian nationalism. This was patriotism in action. Then, to add colour and sound to the event, ‘Morya Dhol Tasha Pathak’, comprising of more than 30 youth (boys and girls), gave us a good measure of the ‘Dhol’ beats, that re-vibrated the entire station. Everywhere, high energy was flowing.

The Bandra Gymkhana is the adhesive that binds the community together and keeps us all aware of our roots. As Bandra grows skywards, with high-rise apartment complexes; where no one even knows one’s neighbour, it is all the more vital that the past remains ever-present in our collective memory. HUMBLE BEGINNINGS: The Gymkhana owes its very existence to the benevolence of the late Dr. D. A. D’Monte - a visionary & philanthropist, par excellence. Darryl D'Monte, grandson of Dr. D. A. D’Monte & President of the Bandra Gymkhana said, “If our beloved founders are looking down from heaven, they are sure to marvel at how this institution has transformed itself into being a focal point in the life of Bandra; as much as it was when it was when it was founded in 1935. We have the distinction of being probably the only club in the city, if not

the country, to own the land on which we are located.” Taking us down memory lane, Darryl added, “Its story can be traced to the founding of the Salsette Catholic Cooperative Housing Society in 1918. The society was in need of a recreation centre, so it began negotiations with Dr. Dominic Anaclete D’Monte, whose bust adorns the Pavilion named after him. It required a park and tennis courts, land for which he donated. In 1924, the layout was approved and three years later, four tennis courts came into being. It was thanks to the Chairman of the Salsette Society, D.J. or Dominic Joseph Ferreira, who happened to be Dr. D’Monte’s brother in law; that negotiations were begun to get another plot of land for a club. Dr. D’Monte gifted this plot too, which is where the mock-Tudor Bandra Gym building stands today. Mr. Ferreira drafted the constitution of the Gym, appointed the first Trustees, collected

funds for the Pavilion and the Society leased 5,819 sq. yards to the Bandra Gym Trustees in October 1934. The lease was for 998 years, which is more than several lifetimes. Prior to this lease, the foundation stone was laid in April 1934 and blessed by the Archbishop of Mumbai. The Pavilion was specifically meant to cater to social, cultural and sports activities. The Pavilion was formally opened on 4 May 1935 by the Governor, Lord Brabourne, who said: “I hope that this Pavilion which I am now about to open, will for long contribute to the enjoyment of the East Indians of Bandra.” We can surely assert that this wish has been more than fulfilled, 8 decades later. 80 YEARS CELEBRATIONS: Members were called to attend the momentous three day celebration for the 80th Anniversary held from 20th to 23rd October 2016, which commenced with a mass celebrated by the 'Prince' of the Church, His Eminence Os-

VINTAGE EXHIBITION: To add a dash of cool to the three unique entertainment evenings, a vintage car and bike exhibition was held at The D'Monte Park Recreational Centre organised by the committee along with Nitin Dossa. AT THE HELM: Cornel K Gonsalves, President of Bandra Gymkhana said, “It was a seamless team effort by the managing committee. It managed to pull in a huge crowd. Bandra Gym has now reached a new height.” Brainchild of the 80 year celebration, Trustee & Chairman Roger C.B. Pereira said, “A lot of people have asked me why we are celebrating 80 years. Since usually one celebrates 25, 50, 75 & 100 years. The truth is - I became a trustee just before the gymkhana celebrated its platinum jubilee in 2010. Since I was trav-

elling a lot, during my tenure as the president – and the years from the golden jubilee till the platinum jubilee, I couldn’t connect with the feeling of the celebration. During the platinum jubilee we decided that the gymkhana needed a new branding and we coined the phrase ‘Simply the Best’.” He further added, “To be honest, those three words were really inspirational. We were among the best, but were not the best. We published a book on the history of the gym. Since then my mind has been working on methods to reposition the gymkhana amongst its members primarily, to take the gymkhana to a very different level. So I was pondering over this for the past 5 years and in January we decided to celebrate 80 years of the gymkhana. So, we organised 3 different events. Now, one can really say that the three words that describe the gymkhana ‘Simple the Best’, is a reality.” It was a fitting finale for the three days entertainment and most certainly was a feast for the eyes and senses. The Bandra Gymkhana

now possesses a flag and an anthem, which will be sung at every major event. The catchy anthem was composed by Clinton Cerejo & written by Annabelle Ferro, while the flag was designed by Roger Pereira and Sunil Pawar. The Bandra Gymkhana has played its stellar role in social functions, including weddings, Christmas and New Year celebrations, birthdays, anniversaries, christenings and many other happy occasions. Apart from these memorable social occasions, it was the sports and games in which the gym made its mark. Tennis was similarly a big draw, as it remains to this day. 80 years is more than the lifetime of many people but in the case of the Bandra Gym, it far from showing signs of old age and wear and tear. In fact, it is getting sprightlier by the day. The 80 year celebrations have left the gym with a vestige for the first centenary in 2035 and a melody that “feels like family”. As they say, once you’re a member of the Bandra Gymkhana, no other place is good enough.

In a thrilling final, in the presence of a very large crowd - Celtic struck in the 15th minute of play when Altamesh Sayyed’s defence splitting strike from top of the box beat

Twelve years hence, hockey comes home to Apostolic Carmel High School Over the past few years, the Apostolic Carmel High School has consistently been making headlines in the girls' category of school football. So it was not surprising when their U16 team won the district football tournament organised by the DSO this week & moved to the divisional finals of the competition. However, the big news that's doing the rounds is the school's participation in the inter-school hockey tournament. While it's no big deal to see schools from Bandra dominate the hockey arena be it in the boys or girls category, Apostolic Carmel, a school that's historically been known for its domination of girls' school football, for the first time after twelve long years participated in the MSSA inter-school hockey tournament earlier this month. So what prompted the school to venture into the hockey arena? Most Bandraites may know the answer themselves: If you can play football, you must play hockey too! Coach Cosmos Vaz, who has represented his school hockey team at the state level &

continues to play for various Bandra clubs even today reflected the same, "I was surprised myself when the girls, who are all footballers came to me to put up a hockey team. But what worked for us was the enthusiasm of these girls over the next one week before the start of the tournament.

Our goalkeeper Giselle had just two days to practice with a kit borrowed from a neighbouring school but she did an excellent job under the bar." Giselle's father was initially apprehensive of his daughter playing hockey but once he heard of the tales of his daughter's heroics, he seemed to be much

more encouraging & infact, excited himself. Forming the backbone of the team were Florian Pereira, Gauhar Mithaiwala and Trevina Fernandes, who have all played hockey when they haven't been busy with the football at their feet. Although the team bowed out in the league stage itself, they did so with the same fighting spirit they put on show at every football game. One of the girls' parents Trevor Fernandes, who attends every single game of his daughter, remarks, "When it comes to sports, our school principal has always encouraged the girls to do well. Even though their exams are on, special arrangements have been made so that the girls can attend their exams separately and focus on the game at the moment and this spurs them to perform even better." While the school's hockey team is a first in twelve years, every Bandraite can expect the emergence of another superpower in a sport in which the suburb of Bandra has produced international heroes. Letters to the Editor DEFAMING DY. REGISTRAR KISHORE MANDE? Please refer to the article in your newspaper  by  Haresh  Jairam  dated  5th  October 2016, where Adv Ashish Shelar  answered society related queries at DPRC.  This was an open forum. However, as it was held at DPRC, The Salsette Catholic CHS put restrictions as to who could speak.  This  was  very  unfortunate.  Further  it turned out to be defaming the Deputy Registrar of C.H.S. - Dr. Kishore Mande, just because the Managing committee of Salsette Society did not want to amend their bye laws. It is to be noted that bye-laws of any Society should be endorsed by the Dy. Registrar of CHS. It was a pity to note that this meeting turned out to be platform for defaming Dr. Kishore Mande before the general public. We have courts, anti corruption bureau etc.  -  and  citizens  cannot  take  law  and order in their own hands. One cannot say that Dr. Kishore Mande should be transferred as he is corrupt - without any documentary  proof.  Moreover,  it  was  even more unfortunate for a trustee of AGNI – i.e. Shyama Kulkarni to go a step further and say that Dr. Kishore Mande should be suspended, without any cause of action. This action of the Managing committee of Salsette Society as well as the trustee of AGNI has attracted sec 499/500 of the IPC - that is defaming a Government Servant in Public,  without  any  cause  of  action  and also Damage Claim as it has caused damage to his reputation. Also, sec 120B of IPC - Conspiracy by two or more people. Ashish  Shelar  -  being  an  Advocate, should not have allowed this to happen. There are many witnesses to the event, that indeed a defamatory act was done and who can vouch for Dr. Kishore Mande’s interigity. He is a fearless man and acts as per provisions of the Law.  Leslie Almeida

STOP NOISE POLLUTION In spite of HC order, the State Government continues  to  ignore  monitoring  of  noise levels in the city, which has reached dizzy heights with continuous honking by motorists & bikers. To add to it comes the festival  noise  of  loud  music.  The  State Government in response to HC directive, gives a flimsy excuse that the consignment for decibel meters (to measure noise levels) has yet to arrive from the suppliers & without  which  noise  cannot  be  ascertained. According to newspaper reports, it is  alleged  that  this  has  been  done  purposely  to  delay  the  process  of  securing those instruments, so as not to hurt religious  sentiments  of  people  celebrating Ganeshotsav & Navratri. After all political parties  are  more  interested  in  keeping their vote banks intact & would not like to see it erode. It is their prime object & that comes first than anything else. During this period of festivities there is joy & celebration expressed through dance &  music.  The  blarring  of  music  through loud speakers at a high pitch particularly observed & heard in slum areas & bazaars, is a blatant violation of the law. Numerous calls to the police complaining of such nuisance has gone on deaf ears. The present government  seems  to  be  least  bothered which  goes  to  show  that  our  lawmakers themselves are the law-breakers. In such a situation how can the public expect good & honest governance. It is high time the SC steps in & issues a strongly worded message to the Government, as it is doing so with its arm twisting tactics to make the BCCI toe in line. Only when  such  things  happen  we  will  see some improvement in the culture of conducting festivals. Even if music & dance is a must for celeberation, it should be carried out with much grace & harmony, without disturbing an entire neighbourhood. SHIFTING TO SECOND GEAR Dear Reader, Mid October opens opportunities that are endless – in terms of entertainment, social interaction and business. With blue skies and  sunny  weather,  conditions  are  conducive for ‘action’.  With Diwali around the corner, Bandra has her fair share of festive fervour, with scenes of hectic mid-day and evening crowds at malls and other outlets, where die-hard shoppers shop and shop till they drop.  Yet, there are swirling under currents below the seemingly calm surface. New alignments and re-alignments are interesting scenes in political circles. This time, it looks as if new entries will shake up many old equations. People are fed up with  corrupt  authorities  and  the  games they play – just to grab a quick buck. When most families are watching TV, followed by dinner and then sleep – politics is taking shape, at varied venues, with interesting discussions that overflow to the other side of midnight. Bandra’s burning issues are the focal point of these meetings – and how  to  resolve  them.  Strategies  are  created, with collective brain-storming. If you

observe, BMC is shifting to second gear – with opposing parties claiming, that their efforts have resulted in the ‘Work Under Progress’. What a joke! This  is  prime  time  to  get  your  surroundings spruced up. After all, it is your tax money that pays for BMC work – cleverly  called  ‘MLA  Fund’  or  ‘Corporator’s Fund’. Many active ALM’s are alert to see that the contractors who do the jobs – do it well. Concerned citizen’s watch, when the work is being done. This supervision has  resulted  in  better  work  done.  If  any BMC job has been shoddy – do report with proof.  Bandra  Buzz  will  publish  your grievance – and you will get the credit.
