Local animal lovers will be coughing it up at the Pensacola Humane Society’s (PHS) fourth annual Fur Ball event on March 16. This black-tie soiree at the Pensacola Yacht Club has become one of tthe largest annual fundraisers for the nonprofit facility.

Local animal lovers will be coughing it up at the Pensacola Humane Society’s (PHS) fourth annual Fur Ball event on March 16. This black-tie soiree at the Pensacola Yacht Club has become one of the largest annual fundraisers for the nonprofit facility.

Founded in 1943, the PHS was initially established as a one-person operation committed “to improving the lives of companion animals.” It achieved its no-kill status in 1985. Today, the shelter has more than a dozen employees with support from nearly 200 volunteers.

Fur Ball made its debut in 2019, when the Humane Society was looking to boost revenue by hosting another major fundraising event in addition to their already well-established Barktoberfest and Paws on Palafox events.

event chair, teamed up with Deborah Dunlap, Michelle Sauls, Megan Kennedy and a small committee of local volunteers and board members to organize and host the first Fur Ball event. Since its establishment, the Fur Ball has grown to become the Humane Society’s most popular annual event, with tickets selling out each year.

The inaugural Fur Ball was a huge success, with a packed house and more than $85,000 raised to benefit the PHS. Since then, that number has only increased, with a total of $125,000 raised at last year’s event.

“Fur Ball is a sell-out every year! It’s a glamorous and glitzy evening that will warm your heart,” Lautier said. This year’s Fur Ball will be held on March 16 from 5:30 to 10 pm at the Pensacola Yacht Club located at 1897 Cyprus Street. The evening will include a gourmet dinner, music, cocktails and a series of both live and silent auctions, with the most notable being the popular “Bow Wow Wow Wow Table.” The lavishly decorated table is piled high with wrapped gifts for ten people, which is auctioned off to the highest bidder at the beginning of the evening.

“There are at least $500 worth of gifts at each place setting, making this one of the most popular auctions of the night. It’s what Fur Ball has become known for,” Lautier explained.

In addition to the gifts on the table, auction winners will also gain access to the open bar throughout the evening. The event will also feature a special Yappy Hour, in which Don Your Best for Pensacola Humane Society’s Annual Fur Ball Gala by Morgan

Fur Ball guests will also enjoy a Puppy Parade that will take place inside of the event space, as well as designated time for gala guests to mingle with all of the Humane Society’s adoptable furry friends.

“The Puppy Parade features cats and dogs from PHS, which mingle with the guests during the early part of the evening. The Raise Your

Paw live auction winds up the event festivities,” Lautier said.

Funds raised at the event will directly benefit the Humane Society’s animals staying in foster homes and the shelter. Adoption fees account for only a small portion of the shelter’s annual budget, and, as a registered 501(c) (3) non-profit, PHS relies heavily on grants and donations.

“All event proceeds go directly to helping the animals in our care by providing food, spay and neuter services and medical care. Adoption fees cover only a fraction of the true cost of rescuing homeless animals. PHS relies completely on grants, bequests and in-kind donations from individuals, and it receives no regular city, county, state or federal funding,” Lautier explained. BALLET PENSACOLA PRESENTS THE SLEEPING BEAUTY

Ballet Pensacola announces its production of The Sleeping Beauty sponsored by ServisFirst Bank and Gulf Coast Pelvic Health to be held at The Saenger Theatre this May. Based on the timeless fairy tale, The Sleeping Beauty is one of the world’s most beloved and captivating ballets, featuring incredible music by Tchaikovsky, gorgeous costumes, lavish decor, and of course, beautiful dancing by Ballet Pensacola, Pensacola’s own resident, professional company.

This beloved “storybook ballet” is adapted from Charles Perrault’s fairytale, The Sleeping Beauty which tells the story of the lovely Princess Aurora who is cursed at her birth by an evil Fairy. Protected by the Lilac Fairy, rather than falling ill and dying as Fairy planned, Princess Aurora falls into a slumber of 100 years upon her 16th birthday only to be awoken by a kiss from Prince Desire.

Audiences will be treated to captivating performances with the role of Princess

Aurora being danced by Savannah Crabtree, Hannah Holtsclaw and Amanda Carrick.

Prince Desire will be danced by Juan Arango, Felipe Zapiola and Gabriel Arango. Audrey King and Olivia Bevilacqua will dance the role of The Lilac Fairy. This enchanting adaptation of The Sleeping Beauty is choreographed and directed by Ballet Pensacola’s new Artistic Director, Stéphano Candreva.

Ballet Pensacola’s The Sleeping Beauty takes place on May 3, 4, and 5 at The Saenger Theatre. Tickets range in price from $40 - $75 and can be purchased by calling the Saenger Theatre box office at 850-595-3880.

APPLICATIONS NOW OPEN FOR 2024 SUMMER YOUTH EMPLOYMENT PROGRAM

Applications are now open for the Escambia County Summer Youth Employment Program. Applications are accepted beginning Wednesday, Feb. 28, until Friday, March 22, at 3 p.m. Online applications are available at MyEscambia.com/youthemployment. Physical applications are not available. Incomplete applications or applications submitted after the deadline will not be accepted.

The program is open to Escambia County youth ages 16-24 interested in an opportunity to receive paid work experience this summer. Qualified youth who are accepted into ECSYEP will be able to work up to 30 hours a week, with positions available in various county departments along with the Escambia County School District, Property Appraiser, Tax Collector’s Office and Supervisor of Elections Office. Participants will also receive job readiness training prior to job placement as well as post-employment briefings.

Last summer, over 200 youth participated in the program, working in county departments including Engineering, Public Safety, Escambia County Area Transit, West Florida Public Libraries and more. Limited positions are available.

Requirements for the program are as follows:

• Must submit complete application packet by prescribed deadline. Must be a resident of Escambia County, Fla. at the time of application and for the duration of program participation.

• Must complete up-front job readiness preparatory training classes.

• Must complete post-employment debriefing sessions.

• Must not have any felony convictions.

• If enrolled in school, must submit enrollment verification.

• Must be between the age of 16 years old and 24 years old at the time of enrollment.

• Must show proof of identify (stateissued driver’s license or state ID card).

• Must show proof of address.

• Must meet hiring criteria of the temporary employment agency.

• Must submit completed application with all supporting required documentation to be considered.

WSRE PBS STAFF PROMOTION AND ADDITIONS

PENSACOLA, Fla., February 29, 2024 ― Cheri Bone has been promoted to program operations manager at WSRE PBS, a service of Pensacola State College, after having served as assistant manager for five years and upon the retirement of longtime traffic manager Brent Burton.

Burton first joined WSRE PBS in 1985 and served the station for 25 years altogether, retiring from Pensacola State College on January 5. Originally from Galveston, Texas, and a graduate of the Art Institute of Houston, Bone has worked 22 years in the broadcast operations industry for television networks in Houston, Los Angeles and Pensacola.

Lolly Carlson as donor services manager and Marlee Warner as development coordinator.

A Pensacola native, Carlson is a graduate of the University of West Florida and Columbia University’s Graduate School of Journalism. Her journalism and communications experience includes more than 24 years in trade and consumer publication editorial positions, most recently for New York Life Insurance Company. Carlson also taught for seven years at the Pensacola School of Liberal Arts, her alma mater.

Warner is a graduate of North Greenville University in Tigerville, South Carolina. Her work experience includes regional film, television and theater, and she most recently worked as an administrative assistant for the Pensacola State College Performing Arts Department.

BAPTIST HEART & VASCULAR INSTITUTE HOSTS 9TH ANNUAL CARDIOVASCULAR SYMPOSIUM

PENSACOLA, Fla. (Feb. 27, 2024) – More than 350 health care professionals gathered for Baptist Heart & Vascular Institute’s 9th annual Cardiovascular Symposium on Friday, Feb. 23. The event was held at Sanders Beach-Corinne Jones Resource Center, and speakers included physicians and leaders from Baptist Heart & Vascular Institute and Baptist Health Care as well as Eduardo Sanchez, M.D., M.P.H, FAAFP, chief medical officer for prevention at the American Heart Association.

Each year this day-long symposium is free to the community, and health care professionals, regardless of affiliation, are encouraged to attend.

“We are delighted to continue to provide a free, full-day educational event for health care professionals,” said Rachael Dorval, MBA, BSN, R.N., executive director of heart and vascular services. “We know that this ultimately serves patients and the overall community well, and we look forward to our 10th annual event next year.”

Council on Aging of West Florida is bringing high-flying, intergenerational fun back to Pensacola’s Casino Beach Friday, March 15 through Sunday, March 17 for its third annual kite festival, Gulf Winds Credit Union Kites on the Coast! A kaleidoscope of colorful kites will dance above the white sands and clear seas as the centerpiece of the weekend. This free community event now stretches a full weekend, featuring massive, showstopping kites by Chicago Kite along with stunt kite demonstrations from SkyFX. The weekend will also include food trucks, kids’ activities, and more at the Gulfside Pavilion.

Gulf Winds Credit Union Kites on the Coast promotes fun across all ages with the classic pastime of kite flying over the beautiful setting of Casino Beach. Families can bring a kite to fly, purchase one at the event, or sit back and enjoy the sight of colorful kites soaring above the shoreline. Friday’s event kicks off at 4 pm until 10 pm, with a lighted night fly after sunset, and Saturday’s festivities will begin at 10 am with another lighted night fly, weather permitting. Sunday’s kite flying will be from 10 am until 2 pm.

Through the installation of rescue tubes at strategic locations along the beach, this initiative seeks to provide additional support to beachgoers and first responders in times of need.

In partnership with ECPS, the SRIA has identified five key locations for the installation of rescue tubes:

These rescue tubes, similar to those already in place at Perdido Key and Navarre Beach, serve as crucial safety equipment offering available assistance to individuals in distress while awaiting the arrival of professional help.

The installation of the rescue tubes is scheduled to take place on Friday, March 8, at 9 a.m. Members of Pensacola Rotary, the SRIA and Escambia Public Works will be working together to install the posts and signs along the island.

“We believe that this project will make a significant difference in ensuring the safety of individuals enjoying our beautiful beaches,” said Dave Greenwood, Escambia County Water Safety Chief. “By strategically placing these rescue tubes, we aim to provide an added layer of protection and support for our community.”

As preparations continue for the installation, the SRIA encourages beachgoers and residents to familiarize themselves with the locations of the rescue tubes and adhere to the beach flag warning system, prioritizing water safety at all times.

Pensacola Beach is owned by Escambia County, Fla., and is under the direction of the Santa Rosa Island Authority (SRIA). The SRIA was created by the Florida legislature in 1947 under Chapter 24500. The SRIA does not receive tax support from the taxpayers of the county. It is fully funded from lease fees collected from business and residences on the beach. The SRIA board is made up of six members; five are named by members of the Escambia County Board of Commissioners whose term is the same as the commissioner who appointed them. Registered voters on Pensacola Beach elect the sixth member. The elected member’s term is two years.

CITY SELECTS RUSSELL SWEATT AS FACILITIES AND FLEET MANAGEMENT DIRECTOR

Russell Sweatt has been selected as the first Facilities and Fleet Management Director for the City of Pensacola, responsible for overseeing the newly established Facilities and Fleet Management Department which provides preventative maintenance and repair services to city vehicles, buildings and equipment.

Sweatt recently served as Focus Factory Manager for Overhead Door, where he planned and directed cost effective production activities and managed the flow of materials and labor. While in the role, Sweatt directly managed six supervisors and a team of 400 employees, continuously improving operational performance.

Prior to his position with Overhead Door, Sweatt served as Senior Facilities Maintenance Manager for United Airlines at Denver International Airport. In addition to facility maintenance, he managed a budget of more than $15 million and oversaw the performance of contract services relative to facilities and employee support areas.

The 1st Annual Mitch Madness Charity Basketball Tournament will take place on Saturday, March 30, 2024 at 9:00am at Gulf Breeze High School. Mitch Madness honors the life of Mitchell Delgado who lost his life on December 26, 2023 due to opioid addiction.

Sixteen teams with three players each will compete, bracket-style, in hopes of winning the 1st prize trophy. The goal of the tournament is to give our community much-needed information about the opioid epidemic in a fun-filled, safe environment.

Ahead of the tournament, Dr. Laura Wehry will present the truth about addiction, the stigma surrounding it, and will offer science-based information to educate attendees. There will be food trucks on-site all day, and sports memorabilia raffle tickets available for purchase.

All the proceeds will go to Shatterproof, a national nonprofit organization dedicated to reversing the addiction crisis in the United States. Their goal is to transform addiction treatment, end addiction stigma, educate and empower communities, and advocate for policy changes across the nation.

On December 26, 2023, Mitchell Delgado lost his battle with addiction at the age of 30.

Early in his life, Mitchell evolved with his many interests. By age 10, he was playing Beethoven on the piano and achieved his second-degree Taekwondo black belt. He loved playing with his friends, playing sports of all kinds and Mitchell loved his St. Paul Catholic Church community. Mitchell was confirmed at St. Ann Catholic Church in Gulf Breeze. Even as a child, Mitchell was kind, generous, respectful, and caring...traits he carried into adulthood.

Into his teen years, Mitchell was funny, warm, friendly, and had a ravenous zest for life. He excelled in his schoolwork, receiving many academic accolades and scholarships. Mitchell’s love of sports began early, and he got out of many household chores because practice of some sort was a year-around commitment! He and his friends played football, baseball, basketball, and ran track throughout middle and high school. Mitchell was a fierce competitor and pushed every throw, drive, run or shot to the ultimate limit. His track speed translated to his love of fast sports cars for which he was passionate. His BMW 435I was his pride and joy.

After graduating from Gulf Breeze High School, Mitchell attended Florida State University. His years there are best recalled by his close group of friends from GBHS who attended FSU and UWF. I am sure they have lots of “stories” we have yet to hear (or maybe shouldn’t). Those guys and girls know who they are. Mitchell earned his BA degree in Criminology and Psychology, planning to attend law school. However, his best friend since childhood, Andrew Zambetti, convinced Mitchell that a move to California to sell solar door-to-door would

be the ticket to great riches and success... both passionate goals of Mitch’s. This experience brought new friends and experiences into his life and the lessons learned continued to serve him in his quest to build a solid career. Eventually, Mitchell was hired as a recruiter by CyberCoders and then as a senior recruiter with Jobot, where he was employed at the time of his passing.

Mitchell was a lifelong New Orleans Saints fan who loved nothing more than watching his team, talking sports with his father, uncle, and friends, and predicting the outcome of every game, every season, and buying the latest jersey of new Saints stars. Annual fantasy football with his squad was the highlight of every year. To the core, he was a member of the Who Dat Nation. His IG bio reads “FSU Alum and biggest Saints fan you’ll ever meet.”

The outpouring of love and support from Mitchell’s vast group of friends has been a saving grace for his family. The common thread is that Mitchell was kind, loyal, intelligent, a deep thinker and debater, funny, non-judgmental, smart, fair, honest, spiritual, and a mentor to many. Mitchell had an uncanny ability to relate to most anyone, and was truly interested in people, their lives, their well-being, and their futures, a trait which endeared him to all. Several newer friends have said that Mitchell’s concern, care, mentoring, and advice had changed their lives forever in a positive way that they never thought possible. His legacy will be one of profound impact on all who knew him.

Nothing was more important to Mitchell than his family. We will forever cherish the memories we made with Mitch, including holidays, birthdays, sporting events, travel, the many museums we visited, and just hanging out at the house. Mitchell adored his dogs, actually all dogs and animals. He had a special place in his heart for the many pups in our family over his life. Ellie, Mila, Honey Bun, Chloe, Finley, and our cats Cali and Midnight will miss Mitch and his sweet, gentle love for them.

Mitchell was a seeker of knowledge and truth, was a voracious reader, and could converse on so many topics, including history, politics, self-improvement, fiction, investments, and sports. We discussed his concerns and hopes for others, for family, for the future, spirituality, music, and so much more. He was an old soul at heart.

Unintended opioid addiction due to an accident or injury is a national epidemic and extinguished the bright light that was Mitchell. Mitchell had been clean for nearly six months, but the addiction overtook him when he came home for Christmas. Be kind and understanding to those battling addiction. It’s not their fault. No one wants to be an addict. Seek help and support for loved ones suffering from addiction of any kind.

STATE SEEKS JUDGE’S EXIT FROM ELECTIONS FIGHT

TALLAHASSEE — Saying he “appears to have a closed mind,” the state has asked a federal judge to exit a case about the constitutionality of a 2023 Florida elections law.

Attorneys for Secretary of State Cord Byrd last week filed a motion seeking the recusal of Chief U.S. District Judge Mark Walker, pointing to parts of a ruling he issued Feb. 8 in a separate court battle about a 2021 elections law.

In that ruling, Walker entered a judgment in favor of the state after the 11th U.S. Circuit Court of Appeals overturned an earlier decision in which he found the 2021 law improperly discriminated against Black voters.

But Walker also wrote that the state “has, with surgical precision, repeatedly changed Florida’s election code to target whichever modality of voting Florida’s Black voters were using at the time. That was not this court’s opinion — it is a fact established by the record in these cases (involving the 2021 law). Even so, following the state of Florida’s appeal, this persistent and pernicious practice of targeting the modalities of voting most used by Florida’s Black voters has apparently received the stamp of approval in this (11th) Circuit.”

Three consolidated lawsuits challenging the 2023 law allege that the state has placed improper restrictions on what are known as “third party” voter-registration organizations. Plaintiffs contend that the organizations play an important role in signing up Black and Hispanic voters.

In the motion for recusal, the state’s attorneys cited parts of the Feb. 8 ruling, such as Walker’s description of a “persistent and pernicious practice” related to Black voters.

“Plaintiffs in these consolidated proceedings must prove that the state of Florida intentionally targeted third-party voter registration organizations because Black voters prefer to use them,” the motion said. “But this court (Walker) has seemingly concluded that the state of Florida engages in discrimination against Black voters. On the discriminatory-intent issue, therefore, this court appears to have a closed mind.”

The motion acknowledged that the “bar for recusal is high,” usually involving such things as

comments made by judges to the news media or judges’ relationships.

“But there’s no rule limiting recusal to such instances. The analysis turns on whether a reasonable observer might perceive this court to have a ‘fixed opinion, a closed mind’ on the discriminatory-intent issue,” the motion said, partially quoting a legal precedent.

Walker gave the plaintiffs, which include groups such as the NAACP, the League of Women Voters of Florida and Hispanic Federation, until 5 p.m. Monday to respond to the motion for recusal. Responses had not been posted on court dockets as of Monday morning.

If Walker recuses himself, another judge would take over the case, which is scheduled for trial in April.

The groups and other plaintiffs filed the lawsuits after Gov. Ron DeSantis and the Republican-controlled Legislature last year approved the elections law. The plaintiffs argue, in part, that the law violates First Amendment rights.

In a July ruling, Walker issued a preliminary injunction against two changes in the law. Those changes would prevent non-U.S. citizens from collecting or handling voter-registration applications and make it a felony for voterregistration group workers to keep personal information of voters.

The state has appealed that ruling to the 11th U.S. Circuit Court of Appeals, where it remains pending. While Walker issued a preliminary injunction, that is not a final ruling in the case.

Meanwhile, Walker this month rejected a League of Women Voters challenge to another part of the law that prevents people with certain felony convictions from “collecting or handling” voter-registration applications. Walker ruled the organization did not have legal standing to challenge that part of the law.

Walker, who was appointed to the federal bench by former President Barack Obama, has issued a series of decisions in recent years that have been sharply critical of laws approved by DeSantis and lawmakers. Along with the elections cases, for example, he issued injunctions against a law that restricted the way race-related concepts can be taught at universities and addressed in workplace training — a law that DeSantis dubbed the “Stop WOKE Act.”

SENATE REVAMPS TEEN WORKER BILL

TALLAHASSEE --- A controversial proposal to loosen work restrictions for 16- and 17-year-olds is ready to go to the full Senate after changes Monday night drew at least some labor-union support.

The Senate Rules Committee voted 15-3 to approve the revised bill (HB 49), which addresses issues such as how many hours that 16- and 17-year-old youths can work. The House voted 80-35 on Feb. 1 to pass a more farreaching version.

Rich Templin, a lobbyist for the AFL-CIO, said unions have long been concerned about child labor abuses. But he said the AFL-CIO could support the bill as revised by the Senate.

“When we look at the product as it came over from the House, with truly draconian elimination of labor laws that have been on the books since 1986, this (Senate version of the bill) is an area where we have to break with tradition,” Templin told the committee. “And we support this bill.”

As an example, the bill, as passed by the House, would have eliminated a restriction on 16- and 17-year-olds working more than 30 hours during weeks when school is in session. The Senate version would maintain the 30-hour limit, but it would allow parents or guardians or school superintendents to waive the limit.

“I think if we’re looking to empower parents and also get the school more involved, I think it’s a measured approach,” Senate sponsor Danny Burgess, R-Zephyrhills, said.

But Sen. Shevrin Jones, D-Miami Gardens, questioned if the change would allow 16- and 17-year-old students to get approval from school officials to work more hours when their parents object. Burgess said that issue could be addressed during a rule-making process but is “certainly something to continue to look at.”

The House version of the bill would have removed a restriction on 16- and 17-yearolds working more than eight hours a day when school is scheduled the next day. The

BEHAVIORAL-HEALTH TEACHING HOSPITALS BACKED

TALLAHASSEE — The Florida Senate on Wednesday unanimously passed a plan that would designate at least four behavioralhealth teaching hospitals, as lawmakers look to improve care for people with mental-health and substance-abuse issues.

“This is the next step in really modernizing the whole system of mental health,” Senate Health and Human Services Appropriations Chairwoman Gayle Harrell, R-Stuart, said. “When you look at the problem that we have, not just in the state of Florida but across the country, in the whole mental-health, substanceabuse issues, we have got to address that. It came to the forefront during the (COVID-19) pandemic, certainly, and people began to realize how important mental health and behavioral health is.”

The bill (SB 330), sponsored by Sen. Jim Boyd, R-Bradenton, would designate four behavioral-health teaching hospitals linked to universities. They would be Tampa General Hospital and the University of South Florida; UF Health Shands Hospital in Gainesville and the University of Florida; UF Health Jacksonville and the University of Florida; and Jackson Memorial Hospital in Miami and the University of Miami.

Also, it would allow the state Agency for Health Care Administration to designate four more behavioral-health teaching hospitals over the next two years.

A House version of the bill (HB 1617), sponsored by House Health Care Appropriations Chairman Sam Garrison, R-Fleming Island, has moved through committees and is positioned to go to the full House. The Senate made changes Wednesday to its bill, with Boyd indicating the Senate and House have tried to work out differences.

The Senate bill would provide $100 million a year over the next three years to the behavioral-health teaching hospitals, with

additional money provided for such things as residency positions for psychiatrists.

For example, the bill during the upcoming 2024-2025 fiscal year would provide $6 million for 10 residency positions at each of the four designated teaching hospitals through what is known as the state’s “Slots for Doctors Program.” It would provide another $6 million for residency slots if additional teaching hospitals are designated.

Also, it would provide $5 million for a newly created Florida Center for Behavioral Health Workforce at the Louis de la Parte Florida Mental Health Institute at the University of South Florida. The teaching hospitals would work with the center about behavioral-health workforce issues.

In addition, the bill would require teaching hospitals to take steps such as working with the universities on programs for students in colleges of medicine, nursing, psychology, social work and public health “related to the entire continuum of behavioral health care, including, at a minimum, screening, therapeutic and supportive services, community outpatient care, crisis stabilization, short-term residential treatment and long-term care,” the bill said.

“This (bill) is groundbreaking in terms of mental health and teaching hospitals in the state of Florida,” Sen. Darryl Rouson, a St. Petersburg Democrat who has long worked on behavioralhealth issues, said Wednesday.

The bill has been linked to a broader effort by Senate President Kathleen Passidomo, R-Naples, to increase the number of doctors in the state and expand access to health care. The Senate and House have passed a plan that Passidomo’ calls the “Live Healthy” proposal, which is ready to go to Gov. Ron DeSantis.

While Passidomo’s plan would address a broad swath of health-care issues — from increasing medical-residency slots to trying to provide care outside emergency rooms for patients with non-emergency conditions — the Boyd and Garrison bills are more narrowly focused on behavioral health.

The Senate changes also would keep work hours for 16- and 17-year-olds from 6:30 a.m. to 11 p.m. when school is scheduled the next day. The House bill moved the allowable start of the workday to 6 a.m.

Also, while the House version would have led to teen workers getting breaks and meal periods on par with people 18 and older, the Senate changes would require 16- and 17-yearolds working eight hours or more in a day to get 30-minute meal breaks after four continuous hours of work.

“This is in no way, shape or form a repeal of current Florida law. It’s merely updating it, I believe, to reflect sort of the world we live in today,” Burgess said. “I don’t believe there’s going to be any increase in child-labor violations due to the measured adjustments to the left and right in this law.”

If the full Senate passes the revised bill, the issue would then have to return to the House. If the House doesn’t accept the Senate changes, the two chambers would have to try to negotiate a final bill.

As the proposal moved through legislative committees, Democrats and some groups argued that easing current restrictions would hinder students’ education. They also argued the intent of the bill was to use minors to address labor shortages, including shortages related to a lack of immigrant workers.

Alexis Tsoukalas, a policy analyst with the Florida Policy Institute, said Monday existing “guardrails,” which include allowing 16- and 17-year old to work more than 30 hours a week during the summer, need to remain in place.

“We know from reputable studies that extending teens’ work hours can make even the safest job hazardous to their education and well-being,” Tsoukalas said.

The Senate version would match the House in exempting 16- and 17-year-old students who are homeschooled or in virtual-instruction programs from restrictions.

TALLAHASSEE — Pointing to permits in “regulatory limbo,” the Florida Department of Environmental Protection on Monday asked a judge for a partial stay of a ruling in a legal battle about a 2020 decision that shifted permitting authority from the federal government to the state for projects that affect wetlands.

U.S. District Judge Randolph Moss on Feb. 15 ruled that federal officials did not follow required steps before transferring the authority to the state. Moss issued an order vacating the approval of the shift.

Lawyers for the state said in a 21-page filing Monday that the ruling could affect more than 1,000 permit applications that are “now in regulatory limbo with no clear timeline or expectation for a permit decision. This includes pending permit applications for roads and bridges, hospital construction projects, school buildings and facilities, affordable housing, military base projects, power grid reliability projects (including construction of new power generation facilities and transmission lines), and various projects necessary to improve water quality in the Everglades, just to name a handful of examples.”

The filing sought a limited stay of the ruling to keep the “bulk” of Florida’s program in place until a new plan can be put in place or until further court rulings. As an example, the Department of Environmental Protection suggested the state continue handling permits that would not affect endangered species.

The U.S. Environmental Protection Agency approved the transfer of the permitting authority to the state in December 2020, about a month before former President Donald Trump’s administration ended. Florida became the third state, after Michigan and New Jersey, to receive the permitting authority, which is usually held by the U.S. Army Corps of Engineers.

The Center for Biological Diversity, Defenders of Wildlife, the Sierra Club, the Conservancy of Southwest Florida, the Florida Wildlife Federation, Miami Waterkeeper and St. Johns Riverkeeper filed the lawsuit in January 2021 against the federal government. The state later intervened.

But while the state filed a motion Monday for a limited stay of Moss’ ruling, U.S. Department of Justice lawyers said in a separate filing that federal officials don’t think such a stay would work.

“As a practical matter, it is unclear how, or even if, Florida and the (Army) Corps could divide permitting responsibilities for projects in state-assumed waters depending on whether those projects ‘may affect’ listed species,” the Justice Department lawyers wrote. “Under such an arrangement, would applicants apply to Florida or the Corps in the first instance? Who would then determine impacts on ESA-listed (Endangered Species Act-listed) species? And what would happen if Florida and the Corps disagreed on that determination? The time needed to answer these, and many other difficult questions could exceed the uncertain duration of a limited stay and would consume considerable agency resources that might otherwise go toward processing permit applications in the meantime.”

In his Feb. 15 ruling, Moss found that actions by the EPA and the U.S. Fish and Wildlife Service in approving the shift violated the Endangered Species Act.

The ruling focused, in part, on whether the U.S. Fish and Wildlife Service properly prepared a biological opinion and what is known as an “incidental take statement” as part of the process of approving the transfer. Incidental takes are situations in which threatened or endangered species could be killed or harmed as a result of what are allowed activities.

Moss said a biological opinion and incidental take statement did not comply with the Endangered Species Act and another law known as the Administrative Procedure Act. He wrote that because the biological opinion and incidental take statement that the Fish and Wildlife Service “issued in this case were facially and legally flawed, the EPA unreasonably relied on those documents in approving Florida’s assumption application.”

While the federal government Monday opposed a partial stay, it said in a footnote that the U.S. solicitor general has not decided whether to appeal Moss’ ruling.
