Husband and 'hitman' found guilty in Surrey mother's murder -CBC NewsA jury has found Baljinder Singh Bahia guilty of first degree murder for planning the death of his wife and using a "hitman" to carry out the deed. The judge sentenced both men to life with no eligibility for parole for 25 years and called the crime one of "cold, enormous cruelty." The family of the victim, Amanpreet Kaur Bahia, reacted in tears after the sentencing Saturday. They say there is no real justice, only sorrow, in this case. "She was very hard working, she was so innocent. And how her life was gone, and how it impacted everybody's life around her, it's very sad. It was very sad to see how she was murdered," said Perminder Chohan, the victim's uncle. The body of the young mother of three was found inside her Newton home in Surrey in 2007. Baljinder Singh Bahia and the man he hired to carry out the brutal slaying, Eduard Baranec, heard the verdicts in B.C. Supreme Court in New

Westminster on Saturday. Baranec was also found guilty of first degree murder. Third person, Tanpreet Athwal, is also charged with first degree murder in the case, but has not gone to trial. The court heard that Athwal and Bahia were suspected of having an affair and allegedly schemed to kill Bahia's wife. The victim's brother, Jugraj Kahlon, came from India to hear the verdict today, but says there is no real justice in a case like this. "We are satisfied that justice has been

done, but for us it is not a game to win or lose. We are losing from the very first day. And today we also lose. First we lost our sister and now we are thinking about their kids. They're going to not have their mother. They're going to not have their father," he said. "We are satisfied that justice has been done but we are not happy. We can't be happy. It is only a satisfaction that the person who did this, they have to pay. But this is the satisfaction — maybe now she will be rest in peace." Undercover sting This came after an undercover police investigation which started in Saskatchewan. The court heard that the police sting was underway on an unrelated case when Baranec disclosed information about the Surrey mother's murder and his connection to a realtor named Tanpreet Athwal. Investigators set up a series of scenarios during which an officer posed as a member of a fictitious criminal organization and Baranec proceeded to

brag about Ontario murders he claimed to have committed, which ended up to be non-existent. The Crown presented evidence, including audio recordings, to prove that Baranec was paid $15,000 to carry out Amanpreet Kaur Bahia's murder. Eventually, an undercover officer met with Baljinder Singh Bahia. By then, police suspected he plotted to kill his wife and hired Baranec as a contract killer. Baranec's lawyer, Matthew Nathanson, told the court his client confessed to crimes in "enormous detail" to make himself look like a "tough, experienced criminal." He believed he was talking to a crime boss and wanted acceptance into the criminal organization, the court heard. But he made mistakes, his lawyer pointed out. Baranec claimed to have stabbed Bahia in the chest and made a single cut to her throat. In fact, she was stabbed in the back and her throat was slit several times, according to a medical expert's testimony.

Crown seeks 12-18 months in jail for drunk driver -By Andrew Fleming A Surrey man who caused a horrific accident while drunk behind the wheel was in Surrey Provincial Court on Wednesday (Oct. 5) for a sentencing hearing after pleading guilty to several charges. Crown Counsel Kim Wendel told the court blood samples taken after his arrest indicate Christopher Malloy, 52, was between three to five times above the legal limit for driving when he clipped a car from behind while driving west on Fraser Highway in January 2015. Instead of stopping, he stepped on the gas and blew through a red light at the intersection of 152 Street at a speed witnesses estimate at around 150 km/h, more than double the speed limit of 60 km/h, Wendel said. Domestic incident-related charges against former Winnipeg Jet stayed BY THE CANADIAN PRESS WINNIPEG – Assault charges have been stayed against a former National Hockey League star and Winnipeg city councillor. Manitoba’s justice department says in a statement that the Crown has entered a stay of proceedings against Thomas Steen. Steen was charged in May 2014 with two counts of assault and one count of uttering threats after what police said was a domestic incident at a restaurant. Steen was a member of Winnipeg city council at the time, and lost a bid for re-election later that year. Steen, who is 56, played for 14 years with the Winnipeg Jets before

retiring from hockey in 1995. But he is scheduled to play alongside other former Jets in an alumni game against former members of the Edmonton Oilers on Oct. 22. The game takes place one day before the outdoor Heritage Classic between the current Jets and Oilers.

The justice department gave no explanation for the stay against Steen. “Following a review of all the circumstances, the Crown determined that a stay of proceedings was the appropriate course of action,” said the department’s statement Thursday. Steen took a short leave of absence from council after his arrest, citing a “personal and private issue.” He also removed himself from the Winnipeg Police Board — a civilian group that oversees the city’s police force. Prior to his time on council, Steen ran for the Conservative party in the 2008 federal election. He finished a close second to New Democrat Jim Maloway.

Malloy, wearing a polo shirt and denim pants, offered a brief apology to his victims. “I can never say or do anything to repair it,” said Malloy in a choked voice while facing the judge. “I just want to apologize to everyone.” While Malloy has no criminal record, his driving history shows numerous infractions dating back to 1987. He has received a total of six 24hour driving prohibitions in the last eight years as well as a 90-day driving ban for refusing a roadside breathalyzer test in 2014. The court heard several victim impact statements from the Aujla family and their supporters describing the financial and emotional devastation the incident has caused them. Aujla, a former longshoreman and the family’s sole bread-winner, said he doesn’t think a sentence of 12 to 18 months is nearly enough and didn’t accept the offered apology for ruining his life. “If he was really sorry, he could’ve at least turned around and looked at us,” said Aujla outside the courtroom after the proceeding was over. “What does a person have to do to get 10 years?” Judge Sudeyko is scheduled to deliver a sentence Oct. 26.

Court considers admissibility of police opinion in high driver trials OTTAWA, ON. (NEWS 1130) – There’s an argument whether the opinion of a police officer should count as “expert evidence” if someone is on trial accused of driving while high. Beginning today, the Supreme Court of Canada will look into that in what will likely be a precedent setting case. If you end up defending yourself in court on drunk driving charges, an officer’s roadside assessment does qualify as expert evidence. However, the rules aren’t so clear when it comes to the issue of impaired driving involving marijuana, as we see in a case involving Ottawa man Carson Bingley. “The court will rule on whether or not this evidence is admissible and what the procedure will be for that evidence to be part of a criminal trial,” explains NEWS 1130 Legal Analyst Michael Shapray. While breathalyzers aid police in drunk driving cases, no such device is approved for determining whether a person is high. This comes ahead of federal plans to legalize recreational marijuana by the spring of 2017, as pledged during the last election.

Vancouver home prices may have seen 'final hurrah,' Royal LePage says

-By Canadian Press House prices in Greater Vancouver grew 30.6 per cent year-over-year in the third quarter of the year, says Royal LePage, marking what may have been the real estate market's "final hurrah." The real estate agency says the average house price in the region soared to $1.19 million in the three-month period that ended Sept. 30, up from $914,705 during the same quarter last year. The average price of a home in Greater Toronto rose to $693,154 over the third quarter, up 13.6 per cent compared to last year, when the average home price was $610,308. Royal LePage says its national house price composite — a figure based on 53 of the country's largest real estate markets — showed that the average price of a home climbed 12 per cent from a year ago to $545,414 in the third quarter.CEO Phil Soper says he expects that price growth in Vancouver will slow or even reverse in the months ahead as the effects of recent federal and provincial government rule changes begin to be felt. Calgary man who played role in $23M Concrete Equities fraud won't see jail The Calgary man who played a part in a $23-million investment scheme won’t serve time behind bars for his role in the fraud. Provincial court Judge Joanne Durant on Wednesday agreed with a joint Crown and defence submission to hand Varun (Vinny) Aurora a conditional sentence for his participation in a fraud run by Concrete Equities Inc. (CEI). Durant said during the first six months of Aurora’s sentence of two years less a day, he will be under house arrest. He’ll have to abide by a nightly curfew for the following 14 months and must perform 240 hours of community service, the judge ruled. Aurora pleaded guilty last week to fraud over $5,000 in a scheme focused on Mexican real estate investments. One of those scammed was his own father, who lost the largest amount — $901,000 — in the fraud run by CEI that roped in 1,200 investors. Durant said there were several mitigating factors which justified sparing Aurora jail time,

primarily the fact he pleaded guilty and his role in the fraud was limited. But she also noted his part in the scheme left many victims in its wake. She said statements provided by nearly 100 victims to the court spoke of “betrayal, anger, embarrassment, violation (and) shame. “And in one case suicidal thoughts,” Durant said. “Some have lost their homes.” Durant said that unlike so many other fraud cases, however, Aurora didn’t benefit financially for his part in the scam. The plot, which began in 2007, sold investor units in a Mexican development known as the El Golfo project, whose purchase price Concrete Equities greatly inflated for investors. nThe company, said Crown prosecutor Steven Johnston at last week’s sentencing hearing, “purchased it for less and just pocketed the

money.” “It was an advanced hucksters’ scheme that sold people real estate that absolutely didn’t exist.” Some of the investors’ cash was also moved into other investments not known to them, while the supposed ringleader, David Nelson Humeniuk, allegedly pocketed $1 million. While Aurora‘s role was more supportive than leading, he signed off on offering memos and was “willfully blind” to the scam, said an agreed statement of facts. It also stated “to the extent that money which was raised for the El Golfo project was being transferred or lent to other CEI businesses, Mr. Aurora was an officer and should have known about those transactions.” Durant noted that since the losses exceeded $1-million, Aurora would be looking at an automatic penitentiary term today because of changes in the legislation made after the crime was committed. -Calgary Herald

U.S. lumber trade faces uncertain future By Tom Fletcher - BC Local News Negotiations for a new deal to regulate Canadian lumber exports to the U.S. are continuing as the protection of the latest softwood lumber agreement expires this week. As of Thursday, the U.S. industry is free to launch new unfair trade actions against Canada, although new tariffs can't be imposed until six months after a formal complaint is filed. With most U.S. lumber exports coming from B.C., the temporary period of free trade may be the calm before the storm for the B.C. industry.

The Canadian and U.S. governments issued a joint statement Wednesday promising to continue talks towards a "durable and equitable solution for North American softwood lumber producers, downstream industries and consumers." That solution may have to wait until after the U.S. election in November, with a campaign marked by anti-trade rhetoric from Republican presidential candidate Donald Trump and Democrat Hillary Clinton. Whatever the solution, it will not be free trade in lumber. Prime Minister Justin

Trudeau and U.S. President Barack Obama agreed in June that a new agreement would be "designed to maintain Canadian exports at or below an agreed-upon U.S. market share to be negotiated." The U.S. industry has long maintained that B.C. lumber is subsidized by an artificially low price paid for Crown land timber.

Competitive aviation policy made in B.C. Air travel inspires endless opportunities for businesses to connect with new prospects and seek out untapped markets. Air travel is essential to the growth of the tourism industry and bolsters our ability to trade Canadian products. Canada has the resources and talent to be a powerhouse in the global economy, and aviation competitiveness is the key to ensuring our future success in the international arena. At the recent Canadian Chamber of Commerce annual general meeting, chambers across the country unanimously supported a made-in-B. C. policy calling on Ottawa to lower taxes and fees and improve air access in order to make the aviation industry more competitive. We tapped into the powerful network behind the B.C. chamber, partnering with the Greater Vancouver Board of Trade, the Richmond Chamber of Commerce, Prince George Chamber of Commerce and Whistler Chamber of Commerce, and asked the question: how do we achieve a stronger, more robust air travel network that can support the growth of our trade, tourism and transportation sectors? After conducting intensive on-the-ground research we narrowed our focus to three primary targets: greater international competition, an increased capacity for the free movement of labour and goods, and mutually beneficial liberalized air access achieved through reciprocal agreements with other jurisdictions. Our goal is to solidify Canada’s position as a global hub for aviation traffic, a prospect that is hindered by high taxes and fees that continue to drive away business and leisure travellers. To put things into perspective, a $600-round trip flight within Canada is subject to a nearly 30 per cent premium in taxes and fees,

within the United States. With sky-high taxes and fees, our airlines simply can’t compete with cheaper deals south of the border, and that’s hitting our airlines and airports, our tourism providers and our economy. The high cost of travel and the lack of aviation competitiveness is stunting Canada’s ability to attract not only tourists, but also international companies wanting to do business within our borders. Trends are showing that companies are choosing to establish offices in the U.S. to avoid the high-cost of travelling within Canada, specifically the booming technology industry. Without access to affordable and reliable air travel, relationships are not made, business is not done, and ultimately the economy suffers. Liberalizing Canada’s air policy through bilateral agreements would promote increased competition by opening Canada to new international markets. Foreign carriers would have greater access to our skies and Canadian airlines would be able to explore more opportunities in foreign markets. The benefits would be numerous, including more competitive pricing to match international carriers. Canada’s economy is very dependent on trade, and as a country that spans across three oceans, it’s necessary that our air travel network is as vast as our landscape. As we continue to become bigger players in the global market, specifically with potential deals like the Trans-Pacific Partnership, it’s more important than ever for Canada to strengthen the competitiveness of its air industry. Chambers representing small business to big enterprise from every nook and cranny across the country are counting on our federal government to hear their voices by implementing our recommendations. Air travel serves as a vital link between Canada and our rapidly globalizing economy, and we must act now if we want a shot at keeping up. Val Litwin is President and CEO at B.C. Three Toronto police officers face assault charges Ontario’s police watchdog has charged three Toronto police officers with assault following an incident during a 2013 arrest — and two of the officers have been in trouble before. A 46-year-old man was arrested at his home on Feb. 13, 2013, and was taken to a police station in the back of a police cruiser, the Special Investigations Unit said in a media release Tuesday morning. There was “an interaction” between the man and three officers during transportation, the SIU says, and the man was taken to Humber River Regional Hospital to examine what was determined to be a serious injury. The SIU was informed of the incident in August 2015. Const. John Darnell, Const. Piara Dhaliwal, and Const. Adam Morris are facing assault charges. They will appear in court on Nov. 3; all three officers have been suspended with pay, said Const. Meaghan Gray. Dhaliwal was subject to a Professional Standards investigation after an Ontario Court judge found that his testimony and that of his partner to be “deliberately misleading” and added that Dhaliwal’s actions “amounted to an assault.” Dhaliwal and Const. Akin Gul alleged they were assaulted by Abdi Sheik-Qasim while investigating a noise complaint in January 2014.

Sheik-Qasim, then 32, had taken out a cellphone to record the encounter. Within seconds, Dhaliwal knocked the phone out of Sheik-Qasim’s hand; SheikQasim was then arrested and charged with assaulting a police officer and failing to comply with a court order. The phone was seized by the officers at the time, but not returned to him after he was released from detention. However, the phone automatically uploaded video files to the cloud, and the video evidence was used during his trial. “Officer Dhaliwal’s swing of his arm and hand was the very first physical force during the interaction. The accused didn’t grab a hold of the belt of Officer Gul in advance of this action by Officer Dhaliwal,” said Ontario Court Justice Edward Kelly, adding he had doubt it happened at all. “I believe that Officer Dhaliwal’s action amounted to an assault against the accused,” Kelly said in a decision issued Sept. 10, 2015. Sheik-Qasim was

acquitted of both charges. It is not known what result the Professional Standards investigation produced. Meanwhile, Gray confirmed one of the officers, Const. Adam Morris, was arrested back in 2013. Morris was pulled over on Hwy. 400 when he was approached by a York Region police officer, after having several drinks in an industrial parking lot after reporting off duty. York police officers performed a breathalyzer test, which Morris failed. He was taken back to a station, where his gun was seized by police. Morris took two more breath tests, one showing he was exactly at the legal limit and the second showing he was over it. He was released with no criminal charges, and instead received a three-day driving suspension. “The decisions of certain members of the York Regional Police Service not to proceed with criminal charges against Const. Morris should in no way detract from the seriousness of this misconduct,” the prosecutor told the disciplinary hearing in 2013. Morris apologized for his actions and told the hearing it would never happen again. He was docked 18 days pay. There had been complaints from her school as well regarding her mindfulness and inattention,” she added. During the sessions, initially Gina would not talk. As she gradually opened up, the experts got to know that they had relocated due to her father’s transfer. The relocation, new school and environment had taken a toll on her adolescent mind. Assessment showed that she had moderate depression. Her parents felt that she was taking her time to adjust to her new school. Gina, on the other hand felt that no one in new school liked her, and she refrained from opening up. Thus she felt alone, and a sense of inferiority grew inside her. To create a true, full-blooded biopic, filmmakers need a free-hand: MS Dhoni The Untold Story, which claims to give us Mahendra Singh Dhoni Uncut, is much more generous with details from his childhood and his days of struggle than from his blazing tenure as star wicketkeeper-batsman-captain of the Indian cricket team. The result, with the exception of a few interesting bits and pieces, is bland and predictable. The over-long film cherry-picks the details it wants to serve us, skirting all grey areas and controversies: there are no smart nosedigs, only ingratiating bouquets; only hurrahs (the critique is so muted that we can barely hear it), and loud background music which is used to drum up emotion and drama. It begins with promise. Young Mahi is more interested in football, badminton and tennis, and tries to blow off his first coach (Rajesh Sharma) who spots his potential. The entire ‘bachpan’adolescence section, featuring the father (Anupam Kher) who thinks a job will take his son much further than sports, the mother who believes in her son, the sister (Bhumika Chawla) who is a solid support to him, his bunch of loyal friends who just know he can do it, has been crafted with heart and feels authentic. We see Mahi (Sushant Singh Rajput) trying and failing and trying again,

get behind a bright-eyed lad who dreams big, and is willing to work for it. In the way it shows Mahi’s often herculean attempts to become visible to the powers that be (he can smash the ball all across the ground effortlessly, and wicket-keep beautifully too), the film becomes almost copybook in telling us that strokes may come easy but getting invited into privileged sporting enclaves is exceedingly tough. But, and this is the message that comes through loud and clear, that it can be done. You can be a small town boy, and if you have talent and a little bit of luck, you can be unstoppable. Up till here, Mahendra Singh Dhoni’s story, the mostly untold part for most of us, holds us. It tells us that it is right for us to aspire, and that anyone can do it. Then the curse of the second half

strikes, and it goes into an irreversible slide. Two romances arrive in swift succession (Disha Patani, Kiara Advani, both sparkly, both reduced to sidebars). There are songs. There is a stab at the intrigue that governs selection processes at various cricketing bodies, including the mighty BCCI, but it is laughably feeble. The entire focus is on Dhoni who is shown as the sole match-winner from the Indian side. His teammates, which include Indian cricketing greats (Saurav Ganguly, Sachin Tendulkar and others), are seen in flashes, either from the back or in profile. There is no dressing room banter with his team-mates. No scenes, in fact, with other players, except for a couple of stray ones with Yuvraj Singh (Harry Tangri). The quality of cricketing on screen is excellent. Rajput looks right at home with the bat and gloves, as do the other actors on the pitch. You wish there were some more cricketers — all significant contributors to Indian tests and one-day cricket and the glitzy T20 tournaments, during the years Dhoni entered and captained them — in this tale. For cricket is a team sport, right? MS Dhoni makes it seem like a one-man army. This film had potential to present us with the recent Indian cricketing story, warts and all. Sadly it’s more hagiography than biography: the cricketer is reduced to a being singingromancing Bollywood hero rather than a top-flight cricketer, a master strategist, and a captain who led from the front. True champions have that edge that no one else does: on that score, the real-life Dhoni hits it out of the park, every single time.
