Honorable Senator Lummis, The Wyoming Pastors Network represents church leaders from many denominations and non- denominational congregations across our state. We share a common commitment to love and care for every Wyomingite, of every background, age, or persuasion. Our love and care is—and must be—guided by the timeless principles written by God both in the “book of nature,” and in the Bible.

Our particular focus centers on the Manhattan Declaration released in 2009. Crafted by 152 charter signers, it had garnered more than 550,000 signatures by its 10th anniversary—including many of our own. Regarding marriage, it teaches: “In Scripture, the creation of man and woman, and their one-flesh union as husband and wife, is the crowning achievement of God’s creation.” It further observes: “Vast human experience confirms that marriage is the original and most important institution for sustaining the health, education, and welfare of all persons in a society.”

Convicted by this truth, we and many in our spiritual care reached out to you in late July after the House hastily introduced and passed H.R. 8404, “An Act to repeal the Defense of Marriage Act.” This legislation redefined marriage in ways that no society in world history has ever dared. Not only that, but it uses the force of the United States Attorney General, private action, and the federal courts to prosecute any person, group, or institution who would not give “full faith and credit” both to current redefinitions and to whatever new definitions might appear in the future.

Thus, H.R. 8404 violates the First Amendment in multiple ways. The language, “faith and credit,” establishes a belief and creed that is favored by the United States government against the faith and creed of the Bible. Thus, when citizens—whether individuals, private businesses, religious institutions, or corporations—are threatened with “enforcement” of this creed by the U.S. Attorney General and by the “Private Right of Action,” they are being forced to confess what they do not believe. This violates both the Freedom of Speech and the Free Exercise of Religion.

We who are duty bound to “obey God, rather than men” (Acts 5:29) have no choice in the matter. We simply cannot put asunder the institution that God has created from the beginning of the world (Genesis 1:26-27). H.R. 8404 will make outlaws of pious and God-fearing citizens.

Even if the Baldwin amendment adequately protected Free Speech and Free Exercise, it does nothing to address the violation of the Establishment Clause. But it does not even protect free speech and exercise since, in the “Goods and Services” clause, it names only “nonprofit religious organizations” but pointedly omits individuals, small businesses and for-profit corporations from its exemptions.

Thus, despite senator Baldwin’s amendment adopted with the cloture vote, our objections remain. The letter of more than 2,000 “pastors, ministers of the faith, and leaders of religious nonprofit organizations” which you received on September 13, 2022, has not been adequately addressed. We, again, are asking that you reverse course by supporting an amendment that prevents H.R. 8404 from either establishing a new federal creed, or stripping individuals of their rights to confess God’s creed in the public square. Specifically, we plead with you to support Senate Amendment 6483 when it comes to the floor as early as Monday, November 28. In this way you can fulfill your duty as one who is “sent by [God] for the punishment of evildoers, and for the praise of them that do well” (1 Peter 2:14).
