Mr. Sorin MOLDOVAN Vice President National Authority for Sports and Youth Strada Vasile conta n0 16, Sector 2 Bucuresti ROMANIA Subject: Reimbursement - Pre-information letter (Agreement 2003-1823) Dear Mr. Moldovan, According to previous commitments between the Ministry for Youth and Sport and the European Commission, the ministry assures the follow-up of the YOUTH agreements. Based on the final report and the audit report by AS Audit Co of 30 September 2008, we have completed our evaluation of agreement 2003-1823. The details of the analysis are presented in annexes 1 and 2. We hereby notify you the final amount of the grant calculated in accordance with the contractual terms and on the basis of the abovementioned documents. Hence, considering prefinancing already received, you have to reimburse to the Commission 1.091.250,826. We would be grateful if you could return to us as soon as possible and at the latest within 20 calendar days following the despatch of this letter to the address mentioned in the footer, a copy of Annex 1, duly signed. The legal representative of the project beneficiary should take care to precede his signature of the words "read and approved". You are kindly requested to submit any queries or complaints not later than 20 days after the date of dispatch of this letter. After this time such requests will no longer be considered. In the event that you wish to contest our decision, your argument must be accompanied by supporting documents, by the financial report, revised if necessary, and by a list of the documents attached. Each document has to be numbered and its numbering recorded in the list. If there are several documents proving only one declared cost, the addition of the various amounts must be presented. Absence of supporting documents proving declared amounts will lead to the corresponding amounts being declared ineligible. The financial evaluation of the project will be definitively completed on the basis of the documents received.

The Commission undertakes to reply in writing within two months following the date on which the request for information or the complaint is received, giving reasons for its reply. Unless you have reacted within 20 days, the Commission will send you a debit note for the amount due indicating a deadline for the receipt of the payment. Failing payment of the amount indicated on the debit note within the time limit set by the Commission, penalty interest at the rate indicated on the debit note will be added. The Commission reserves the right to recover any amounts through: setting off against amounts of any kind owed to your organisation; or use of any bank guarantee which may exist; or forced recovery.
