Hey all. Recently, a car ran into my legally parked car early in the morning. When I found my car hit, strangely, the other car was still there with their lights on and keys in the ignition. It appeared whomever was driving fled. Fortunately, when the police was called, one of the officers found insurance information for the car that hit mine. We took the make, model, year, and licence plate numbers down on the report. The officers left, however I'm not sure if they are going to attempt to search out the registered owner or not. Guess I could call to see if they are or not. Anyway, I then had the other car towed away and mine towed to a nearby auto body shop. They gave me a preliminary estimate for repairs. I then used the car insurance that was found in the other car, called and filed a claim. The same day the insurance I called had an insurance adjuster/appraiser come look at my car. They considered the damages to notably exceed the first estimate, and considered it 'totaled'. Now, the other car's insurance is attempting to contact the registered owner. They mentioned that if there is difficulty in reaching the owner, the insurance to blame may deny making a reimbursement/compensation payment for my damages. Should I contact the police to see if they've investigated the person? I then later called my own insurance and notified them of what happened in its entirety. Now...if my claim is denied by the at fault person and their insurance, is their any consolation for me? Shall I hire a lawyer and sue in small claims or civil court (for damages/rental car/lawyer fees) since the damages estimated are borderline ~$5,000 +/- 1,000? Could this be a successful alternative if their insurance refuses to help me out? Or should I bite the bullet and go through my own insurance...risking an increased premium for something that was not my fault? Thank you for any advice."

Hi Have a question. My rear bumper was lightly tapped by 17 year old new driver.

Damage is minor and cosmetic at $425. My car is only three years old and in perfect condition. The insured provided me all his insurance information and said to file a claim through his dad's insurance carrier. I called local police department 911 line to report minor collision. Officer responded and insured admitted to police officer that he tapped rear bumper. Police officer looked at my rear bumper and refused to make a police report as he said cannot issue a report unless damage is over $1500. I begged the officer repeatedly to please provide me even an incident report or something official like an affidavit as the teenager admitted to officer that he hit my rear bumper.

Police Officer simply drove off and left me on the side of the road with a stranger. Of course now four weeks later, the insured and his father have simply ignored phone calls, emails and registered mail attempts by his insurance carrier to verify version. (not sure what version would be needed as my black paint is on his front bumper) I called the insured and his dad hung up on me twice. The insurance carrier told me they are denying and closing out the claim due to insured not responding. They said this is totally legal under Illinois State laws. (basically too bad, so sad) By the way this insurance company has unacceptable rating with state insurance board and BBB. I paid a body shop $425 in cash to fix car yesterday. Should I hire an attorney for this?, I purchased a policy online a few months ago within the first few days that i had this insurance I had a storm and damaged my vehicle (minor) with hail damaged I submitted out a claim, appraiser was sent they covered the loss sent a check to me, now i take it to the bodyshop and try to have it fixed but they need a supplement, they contact insurance co. but insurance co, makes many excuses over this they state I dont have full coverage which I do, and it was verfied with them that i do, the next few weeks pass and then I finally get a call from a manager at the insurance company stating that they mistakenly sent me out a check because I made a false claim report, they said that they can tell by my pictures before policy was bought that vehicle had damaged (which is an excuse of denying supplement) and stated the the adjuster overlooked everything point here is that insurance co, cancelled my policy by stating underwriting issues, so now Im without insurance coverage, the manager also stated she reported this to the texas state but mentioned she could not put a stop payment on the check and that I could still use it to fix the car or cashout the check... I am really dissapointed at how all this was handelled, Im thinking about getting an attorney, I already discussed and this issue with the Insurance company and Im basicly told that I lied about the claim and they end my call... Should I wait to get an attorney or should I just get one and go from there? I believe this is bad faith insurance coverage, What should I do? I mean I still have the check it is not cashed out, I cant really do much with this check everyone charges an arm and a leg, can they file insurance fraud charges and if so even though I know I did everything right should I get an attorney?"
