As I write this I feel good, and not because my term is slipping away! I feel good because our staff just planned and executed one of our best Annual Meetings ever. We were treated to an incredibly substantive presentation from Dr. Lawrence Yun, the Chief Economist for the National Association of Realtors. Well attended, the event was a great tribute to our increased emphasis on professional development for our members.

Provided at the meeting was our Annual Report. If you were not at the meeting, make a point to pick up a copy of this year’s report. The staff has worked hard to provide a succinct overview of the many activities of this past year. It is a really well done and their hard work does not go unnoticed. The Leadership Team is off to the National Convention. As you are aware, these are very important opportunities for us to exchange information with our regional counterparts as well as receive briefings from various National Committees on policy concerns which affect our local markets.

WRAR ANNUAL MEETING This year’s Annual Meeting was held on October 28 at the Worcester Technical High School. The budget and Slate of Officers for 2016 were reviewed and approved. Attendees were treated to a wonderful breakfast buffet served by the HS Students. We were honored to have Lawrence Yun, Chief Economist & Senior Vice President of Research at the National Association of REALTORS® as our Keynote Speaker. Dr. Yun reviewed the economic and housing market forecasts for the coming year, both nationally and locally and answered audience questions. Interest was high as Dr. Yun presented the economic outlook to a sold out crowd.

INTEGRATED DISCLOSURE ADDENDUM INTEGRATED DISCLOSURE ADDENDUM - MORTGAGE (To Contract To Purchase / Purchase And Sale Agreement) This Integrated Disclosure Addendum is entered into this ___ day of ________, 20__ and is deemed to amend and supplement a certain agreement between _____________________________ __________________________________ (“SELLER”) and _______________________________ _______________________________ (“BUYER”). Beginning on October 3rd, 2015, the federal Consumer Financial Protection Bureau’s “Closing Disclosure” for mortgage loans is required (the “Integrated Disclosure Rule”). The final Closing Disclosure must be received by the borrower three business days prior to the date of Closing (a/k/a Time For Performance) when a deed to the property is delivered by the seller to the buyer and the purchase price is paid. If, after a buyer receives the Closing Disclosure the annual percentage rate of the buyer’s loan changes by more than one eighth of one percent for a fixed rate loan or changes by more than one quarter of one percent for an adjustable rate loan from the rate that was previously disclosed to the buyer, the loan program is changed, or a prepayment penalty becomes applicable to the mortgage loan then it will become necessary for the Closing to be delayed until at least three business days after a buyer receives a revised Closing Disclosure. To promote compliance with the Integrated Disclosure Rule, the parties agree as follows: 1. BUYER agrees to obtain and provide SELLER the name of the attorney for BUYER’s mortgage lender (“Lender’s Attorney”) as soon as practicable after BUYER receives this information from the Lender, but in any event no less than fourteen business days prior to the scheduled date of closing. 2. No fewer than seven business days in advance of the scheduled closing, SELLER and the BUYER shall provide Lender’s Attorney all information reasonably obtainable by such person needed to calculate the adjustments (such as water, sewer, taxes, oil in tank) specified in the applicable clauses of the Purchase and Sale Agreement or as requested by Lender’s Attorney for the purpose of preparing the Closing Disclosure. 3. The BUYER and SELLER agree that: (a) if necessary to assure full compliance with the Integrated Disclosure Rule; and (b) at the request of Lender’s Attorney, the scheduled date for Closing will be extended up to three business days, or such other time as parties may agree. In such event, BUYER shall promptly give notice to SELLER. 4. No claim, counterclaim or cause of action for any loss or damage resulting from an extension, pursuant to paragraph 3, above, shall be initiated or maintained by SELLER against BUYER or by BUYER against SELLER, unless caused by breach of the terms of this Addendum. 5.

Q. My buyer client recently made an offer on a property, but the seller has not accepted the offer. May the buyer withdraw his offer? A. Generally, the buyer may withdraw the offer prior to the seller’s informing the buyer of the written acceptance. Once the seller informs the buyer of the written acceptance, however, that offer is binding and the buyer typically cannot withdraw without risk of losing his or her deposit, unless the withdrawal is based on an agreed upon contingency. Q. Is there a requirement in Massachusetts that a seller reject an offer in writing? A. No. Although a buyer may request that a written rejection be provided in response to their offer, there is no legal or ethical requirement that the seller do so. Q. Is it true that a consumer who signs an offer to buy a home has three days to change his mind even if a seller has accepted the offer? A. No. M.G.L. c. 93, s. 48 allows a consumer three business days in which to cancel an agreement for the sale or lease of goods or services in excess of $25 which are used primarily for personal, family or household purposes if the contract was signed at a place other than the seller or lessor’s office. For example, if a door-to-door salesperson convinces a consumer to sign a contract to have aluminum siding installed on his house, and the contract is signed at the consumer’s dining room table, the consumer would have three business days in which to rescind or cancel the contract. However, this statute has not been held to apply to real estate transactions since real estate is not a “good.” The reasoning behind the statute is that consumers who sign contracts in their homes are under higher pressure to do so than a person who signs a contract in a business office where he is free to leave.

Q. I am selling my own listing to a customer who has asked me to recommend a home inspector. Is there a rule regarding seller’s agents recommending a home inspector? A. The law prohibits brokers and salespersons who are not working in the capacity of a buyer’s agent from directly recommending a specific home inspection company or home inspector. They may, however, provide a complete list of licensed home inspectors prepared by The Division of Professional Licensure, which can be accessed here: http://license.reg.state.ma.us/public/hi_biz/v_list_hi.asp. It is important to remember that this prohibition against recommending a home inspector shall not apply to agents working for the buyer as a buyer agent. Buyer agents are allowed to recommend a specific home inspector to clients. However, for liability reasons, it is always recommended that the buyer agent provide a list of several inspectors so that the client can choose a home inspector for themselves. Q. As a listing agent, can I make home inspectors’ business cards or other promotional material available? A. The law states that real estate agents (except those representing the buyer) cannot make direct or indirect recommendations on the use of home inspectors to their clients. The promotion of business cards and materials could be seen as indirectly recommending those home inspectors and therefore a violation of the statute.
