The REALTOR® Code of Ethics – Are you Doing Your Part? One of my roles this year as President is having the opportunity to attend the new member orientations and induct and welcome the new REALTOR® members. It has been a great experience seeing the excitement in the new members as they realize the importance of the REALTOR® Code of Ethics and how it distinguishes us from real estate agents who do not pledge to abide by the Code.

It fills me with pride to welcome them to the Association. It also makes me think that maybe we do not keep the Code as sacred as we should, as experiences such as the one that happened to me this week seems to be happening

I met with a man a couple of weeks ago who was thinking of listing his house for sale. He previously had it listed, and it had expired just a few days before our meeting.

WRAR Mission Statement The purpose of the Worcester Regional Association of REALTORS® is to: * Provide members with the resources that enable them to serve the public in an ethical and professional manner * Take an active role regarding issues affecting sellers, buyers, tenants and landlords.

At the end of our meeting, I asked him if he was getting flooded with phone calls and letters since his listing expired. He replied “quite a few, but that’s nothing new. I’ve been getting calls for months.” I explained to him that REALTORS® abide by a Code of Ethics and we do not solicit homes listed by other agents. He scoffed and said “It’s a pretty thin Code of Ethics if you ask me. I can’t tell you how many of those calls I’ve had over the last few months.” These were difficult words to hear. The vast majority of our members take the Code of Ethics seriously, but there are unethical agents who are making these calls stand out to consumers. These agents destroy the perception of professionalism in our industry. These unscrupulous agents are also trying to steal clients from you, or interfere in the contractual relationship you have with your clients for their own gain. Chances are, if they’re calling other’s clients, they’re calling your clients as well. Remember, it is every REALTOR® member’s duty not only to abide by the Code, but to report violations when they occur. continued on page 3

What do you do if a client listed with you tells you they received a call? First, talk to your broker. It’s always best to get their input. In many cases it’s best to contact the offending agent and ask them what happened. In other cases, a grievance should be filed. If you call the Board office, Colleen or another member of the staff will email a grievance form to you. It’s easy to fill out, and there’s no fee to file it. The complaint will be reviewed by our Grievance Committee to determine if an article of the Code of Ethics may have been violated. The complaint then goes to a hearing panel, where evidence is presented by both parties and if the panel determines a violation of the Code has occurred, appropriate action is taken such as fines, education, or suspension as punishment.

PAST PRESIDENTIAL REFLECTIONS What does a Past President do? I never thought about that when I was WRAR President in 2012. I just always knew “they” were there and, yes -- here “we” are! Our Past Presidents possess a wealth of knowledge and are always available to the REALTOR® association. You will find us at events, orientations, meetings, Board of Directors meetings, or via email and telephone. If you need a sounding board, our ears are always available. It’s hard to believe 2 years have almost past since I was president, but how exciting it is to be included among this group of amazing “Past Presidents!” I look back over this time and see such growth and wisdom coming from our association. I can tell you that during my years of travel and meetings at the State level, you can be very proud of what we have accomplished as an association. I believe we are far beyond the rest of the State. Our timing and Strategic Plan were spot on as we blazed our way forward with the help of Finance Committee and the Board of Directors. Congratulations to all the award winners and nominee’s at a spectacular Awards Ceremony. It was such a pleasure for me to be able to present the Natalie Quinlan Distinguished Service Award to Rochelle Jonswold this year. This award was named for a member that stood for ethics, integrity, honor and, above all, RESPECT for their fellow REALTOR® members. At times it seems these are attributes that are hard to find these days. Shouldn’t we all strive to be better REALTOR® members by living by the Golden Rule? COMMITTEE ON GOVERNMENT & LEGISLATIVE AFFAIRS Day on the Hill REALTOR® Day on Beacon Hill is scheduled for Wednesday, June 11, 2014, at 10:00 am at the State House, Great Hall. Pariticpation will give members a chance to meet with their elected officials and discuss legislation currently before the House of Representatives and the Senate. This year efforts will be focused on supporting a bill that would regulate the sale of scrap metal, as well as a bill that would reduce flood insurance costs required for some homeowners. REALTORS® will also continue to oppose the imposition of occupancy taxes on homes in the Commonwealth and a proposal to rewrite the state’s land use laws that would negatively impact private property rights Transportation is provided FREE for WRAR members. National Flood Insurance Program Rules Begin May 1 Effective May 1, 2014, all buyers of older properties (“pre-FIRM”) will see a premium rate reduction under the Homeowner Flood Insurance Affordability Act of 2014. Instead of jumping to “full cost” for flood insurance, buyers will assume the seller’s Oct-2013 rate for a pre-FIRM property. NAR prevailed upon FEMA to implement this provision seven months early. FEMA also extended the rate relief so all pre-FIRM properties (including the second homes and businesses) will begin paying Oct-2013 rates when they purchase or renew their flood insurance after May 1, including:

• ALL buyers of a pre-FIRM property, not just those whose seller has an existing policy;

• ALL recent owners who apply for a new flood insurance policy on a pre-FIRM property; • ALL recent owners who reinstate an old pre-FIRM policy that previously lapsed for any reason; • ALL recent owners who renew a policy on a pre-FIRM property bought or newly insured after the 2012 Biggert-Waters law.

While expediting the rate relief, FEMA must still issue refunds to all those who paid more than their Oct-2013 rate. NAR will continue working with FEMA and Congress to quickly issue these refunds to anyone overcharged for flood insurance under Biggert-Waters.

Q. I have heard that Town Building Inspectors and Assessors have been making visits to homes listed for sale lately. Do homeowners have to let them into their homes? A. No. There is no statute or regulation in Massachusetts that allows for these municipal officials to enter a home without permission. Further, there is no state administrative procedure that requires an assessor or building inspector to be permitted to inspect the interior of a home, whether to evaluate the condition of the interior when valuing the property, or to look for a building code or building permit issue. Additionally, homeowners have a constitutional right to refuse entry under the Fourth Amendment to the United States Constitution. Q. Are there any exceptions to this rule? A. Yes, if a homeowner seeking to challenge the assessed value of the property has applied for abatement. Massachusetts law requires the homeowner to comply with the assessor’s request to enter the home in order to be considered for abatement. Therefore, the homeowner may still refuse entry to the assessor, but that refusal will also provide a basis to deny the application for abatement. Q: What should I do if an assessor asks to enter the home during an open house, when my client is not present? A: As your seller’s agent, you should always follow the lawful instructions of your client. Therefore, you should not allow an assessor into your client’s home without permission, preferably in writing, to do so. The assessor should not enter a home without consent. Consent, however, may be given verbally, in writing, or it may be implied. For example, if a broker is in control of the property and allows the assessor into the home, it is likely that a court would rule that consent was given, even if the broker had never actually received permission from the homeowner.

Q. My seller-client has stated that he does not want to allow the Fire Department into his home to conduct a smoke detector inspection. Does the same rationale apply? A. No. Massachusetts law specifically requires that sellers ensure that the home is properly equipped with appropriate smoke and carbon monoxide detectors. It also authorizes the fire department to ensure that residential properties are in compliance upon the sale or transfer of such structure. Therefore, prior to the sale of the property, the fire department must be allowed to enter the premises for purposes of conducting a smoke detector inspection. Q. Several town officials accompanied representatives from the Fire Department during a smoke detector inspection. Must I also allow those representatives into the home, since they came in at the same time? A. No. If you are present for a smoke detector inspection and are faced with the question of whether to allow entry to a municipal representative other than a representative from the fire department, you should consult with the sellers prior to granting consent. The sellers are within their rights to limit entry to the fire department representative. A REALTOR® should ask for verification of the person’s identity, affiliation with the fire department and, depending upon the seller’s instructions, may refuse entry.
