WRAR Mission Statement The purpose of the Worcester Regional Association of REALTORS® is to: * Provide members with the resources that enable them to serve the public in an ethical and professional manner * Take an active role regarding issues affecting sellers, buyers, tenants and landlords.

President’s Message March is usually the beginning of the busy spring real estate market. Though there’s still a lot of snow on the ground, things are definitely picking up. Thanks to all the REALTORS® and Business Partners who came to our Affiliate Appreciation Night on February 27. Congratulations to Tony Economou & his District 1 Team on a well deserved victory. Dave Samara & I had a great time running the trivia contest. Next time we need to make the questions a little bit harder. There are some great events planned for this month: Our YPN Chapter is hosting a St. Patrick’s Day party on 3/12 at the Perfect Game on Water Street in Worcester. Why not stop by to network and have some green beer? Our Business Builders series continues in March with a Buyer Agency & Compensation class on 3/13. The first class in this series had great reviews and this one should be great. On 3/21 Jody O’Brien will return for another event for Designated REALTORS®. This will be directed toward small offices with 3-10 agents, but the content will be useful to all DR’s. We had excellent evaluations from Jody’s last event, and expect a great turnout for this one. Please register early. There are lots of CEU classes scheduled throughout the month, at both the Auburn location and the Fidelity Bank location in Leominster. We’re getting a group of REALTORS® together to support the Walk for the Homeless in Worcester on 5/18. More info to come. And last, Don’t forget to register for Day on the Hill on 6/11. AFFILIATE APPRECIATION NIGHT WRAR Affiliate Appreciation Night was held on Thursday, February 27. Thank you to all of our members who showed their support to our great team of Affiliate Members. They are the ones who make all the “extras” at our events possible. Did you know that affiliate support is a reason for membership dues remaining steady for seven years running? Appetizers and drinks were followed by Trivia, hosted by WRAR President Dave Stead and Prospect Mortgage Manager Dave Samara. Each member of the winning team won a $25 gift card to a local restaurant. The winning team was made up of Tony Economou, Bruce Varner, Matthew Stewart and Nathan Stewart. Attorney Meghan Roche of the Law Office of Meghan Roche won the raffle basket, which was donated by Kelly Gaumond of Country Bank for Savings. Jim Flynn of First Eastern Mortgage won the door prize.

WRAR SCHOLARSHIP

The Membership Committee of the Worcester Regional Association of REALTORS® is excited to announce the 2014 Scholarship Recognition Program. In the past, through the efforts of our membership, we have granted scholarships to children of REALTORS® and Affiliate members to help further their educational endeavors. Rules & Regulations for Scholarship Awards 1. The Scholarship will be awarded on the basis of scholas�c achievement including transcripts and awards (50%); leadership ability (10%); community involvement (10%) ; and essay (30%). Applica�on must be submi�ed with most recent transcript. 2. The Candidate must: a) be a high school senior or full-�me college student b) maintain a 3.5 GPA or higher 3. At the discre�on of the Selec�on Commi�ee, candidates may be asked to par�cipate in a personal interview. 4. This Scholarship will be awarded a�er the student has received their rst semester grades. He/she will submit their transcript to Lisa Sprague at the Worcester Regional Associa�on of REALTORS® to receive their scholarship award. In the event that a recipient does not use the scholarship within the allo�ed �me, the next highest candidate in order will be awarded the scholarship. If any winner accepts the scholarship and therea�er does not a�end school or does not maintain reasonable a�endance or grades, the award, or balance thereof, shall be returned to the Worcester Regional Associa�on of REALTORS® Scholarship Fund . 5. Scholarships are designated for children or grandchildren of REALTOR® members of the Associa�on; Affiliate members of the Associa�on, or full-�me staff employees of the Associa�on. 6. COMMITTEE ON GOVERNMENT & LEGISLATIVE AFFAIRS State Political Coordinators Day on the Hill The Worcester Regional Association of REALTORS® was excited to welcome MAR President Peter Ruffini at a special local Government Affairs Meeting on February 25, where we launched our new State Political Coordinator initiative. WRAR has been identified as the pilot program as the state is looking to expand their efforts to all the local associations. A State Political Coordinator is a REALTOR® that is dedicated to a Representative or Senator of whom they are a constituent. The purpose of the program is to open of the lines of communication between the local REALTORS® and Legislators regarding issues that affect home ownership. This program has been very successful at the National level. WRAR, with assistance from MAR, has modeled the Federal Program. There are currently 11 State Political Coordinators who have generously contributed their time and talents to launching this program on the local level. State Political Coordinator

When I first meet with a prospective client, I like to ask them a series of questions to better build a relationship, and to establish their wants and needs. Are there any specific questions that I should avoid asking? My office takes Fair Housing laws seriously, and I want to be sure that we are following the laws.

A.

As a real estate agent, it is important to understand the wants and needs of your clients, and quite often, learning this information is the result of well-intended questions and conversation. It is always important, however, to keep Fair Housing laws in mind when speaking with your clients. Specifically, M.G.L. c. 151B Section 4 states, in part, that it shall be unlawful to ...”cause to be made any written or oral inquiry or record concerning the race, color, religious creed, national origin, sex, gender identity, sexual orientation … age, genetic information, ancestry, marital status, veteran status or membership in the armed services, blindness, hearing impairment or other handicap or because such person possesses a trained dog guide as a consequence of blindness or hearing impairment, of the person seeking to rent or lease or buy any such accommodation or land.” A recent case held a broker liable for asking his Venezuelan client the question: “Where are you from?” Although the broker in this case claimed to be making small talk and insisted that his question was non-discriminatory, the statute is clear: an inquiry concerning national origin is a per se violation of the Massachusetts Fair Housing Laws. REALTORS should always be mindful of this section of the law when speaking with clients and prospective clients.

Q.

My Buyer-Client is purchasing a rental property that was built before 1978. There is a family currently renting the home, and one of their children is under 6 years old. The Seller/Landlord has never inspected the property for the presence of lead paint. We have a lead inspection scheduled for next week. If lead paint is found, what must my client do to comply with the lead laws?

A.

If lead paint exists in the home, your client will have to delead the home or bring it under interim control. You should remind your client that it is illegal to evict or refuse to renew the lease of this family because of lead paint. Additionally, the parents cannot waive the rights of their children to live in lead-safe housing or agree to assume to risks of lead exposure.

The Lead Laws provide that new owners have 90 days from the date of taking title to bring the home into compliance. Since there is a signed lease in place, the tenants will have to be relocated for the time that certain deleading work is taking place inside the home, and the landlord is responsible for the reasonable moving costs and temporary housing costs over and above the rent of the home being deleaded. During the time the home is being deleaded, the tenant remains responsible for paying the normal rent they would pay for this period as their share of the cost of temporary housing. The Lead Law states the temporary housing must not cause undue economic or personal hardship to the tenant. You should remind your client that a state tax credit of $1,500 per unit is available to abate the home. Q.

My Landlord-Client has been renting an old Victorian to a couple for the past several years. When they rented the apartment they did not have any children, and chose not to have the property tested for lead. The couple has now informed my client that they are expecting their first child. How can my client be sure to follow the Lead Paint laws?

A.

Since there has not been a transfer of ownership, and the tenant is already living in the unit, there is no “grace” period in the law after a child under 6 moves in. Prior to the birth of a child, the home must be brought into compliance with the Lead Law. On the day the child is born or moves in, the landlord becomes liable for failure to comply. You should also remind your client that it is illegal not to rent or to evict a tenant based on the fact that she is pregnant. For more information on Fair Housing, please visit www.marealtor. com.

Each year our Scholarship Committee reviews all applications, and makes decisions based on factors including academic achievement, school and sports involvement, community activities, work experience and the student’s goals and personal accomplishments. A minimum of two scholarships are awarded each year, with a minimum value of $500 each. We would love to be able to increase these amounts, but are dependent upon the monies available in the fund.
