PRESIDENT’S MESSAGE Happy New Year Everyone! I hope you all had a wonderful holiday season. I think the crazy warm weather kept the real estate market full of activity through December. It is going to be a busy year for CMAR. Yes, our Central Massachusetts Association of REALTORS® name change was approved in November at the NAR National Convention in San Diego. We will be working diligently to promote our new name and, as of January 1st, we launched a contest for a new association logo. Check out www.wrar.org for all rules and submission directions. We encourage REALTORS® and their friends and family to participate. I am so honored to be at the helm this year of such a great association. We have an outstanding Board of Directors and committee chairs to take CMAR to the next level. Our benefits will continue to grow and new programs and education will continue to provide our members with up-to-date information and great resources. CMAR will have the best REALTORS® out there providing excellent service! Lastly, I challenge all of you to participate at the board in the coming year, especially if you haven’t had the chance yet. CMAR LOGO DESIGN CONTEST Central Massachusetts Association of REALTORS® Logo Design Contest The Central Massachusetts Association of REALTORS® (CMAR) is looking for a new logo following our recent name change. Since 1923, our organization has been proudly serving members in Central Massachusetts. Today we are comprised of over 1,500 real estate professionals, who work one-on-one with consumers and are involved in all aspects of residential and commercial real estate. Pursuant to our Mission Statement, we provide essential services and resources that promote home ownership in central Massachusetts. The purpose of the Central Massachusetts Association of REALTORS® is to: • Provide REALTOR® members with the resources that enable them to serve the public in an ethical and professional manner • Take an active role regarding issues affecting sellers, buyers, tenants and landlords. We are in search of a new logo that reects the important, professional work we do right here in the heart of our great Commonwealth.

Q. My client owns a rental property and insists that he has no responsibility for removal of snow except for clearing the sidewalks as required by a municipal ordinance. Is he correct? A. No. The usual rule is that it is the responsibility of the homeowner or landlord to keep means of egress free of snow and ice. The State Sanitary Code provides that, “the owner shall maintain all means of egress at all times in a safe, operable condition and shall keep all exterior stairways, fire escapes, egress balconies and bridges free of snow and ice.” If the residence has its own means of egress, meaning that it is not shared with other occupants, the landlord and tenant can agree to allocate the responsibility of maintaining such egress free of snow and ice to the tenant. Therefore, in situations where there is a single or multi-family home and the occupant has its own exclusive means of egress, be sure to review the lease to determine who is responsible for keeping exclusive means of egress clear of snow. Q: As a property owner, do I have a legal obligation to remove snow and ice from my property?

The Court did not define “reasonable care,” and the duty of the property owner will depend on the specific situation. It is recommended that every property owner should take are to do the following: (1) review insurance policies to be sure that there is adequate coverage; (2) determine whether contractors or others hired to remove snow and ice have insurance; and (3) be vigilant when there is newly fallen snow, melting or freezing. If complete clearing is not possible, warning signs may be appropriate. Clients that have specific questions regarding their duty to clear snow should consult their attorney.

A. Yes. All Massachusetts property owners have a duty to use “reasonable care” for the protection of visitors, and are legally responsible for the removal of snow and ice from their property. In terms of liability, homeowners should be aware of the 2010 SJC ruling of Papadopoulos v. Target Corp. That case expanded the duty of property owners to remove snow and ice from their property and definitively held that Massachusetts property owners have a duty to use “reasonable care” for the protection of visitors, and are legally responsible for the removal of snow and ice from their property. COMMITTEE SERVICE The DR Committee wrapped up a successful year of our networking breakfast series on December 14 with a presentation by Kathy Condon and John Breault from MLS Property Information Network. The session was informative and the participants were reminded about many of the MLS Rules and Regulations including that only AUTHORIZED photos may be submitted to the MLS, as there are lawsuits happening across the country where stock photos have been used. Broker/owners were urged to stay diligent in relating office policies to their agents in relation to MLS rules and regulations so that missteps do not occur. If you missed this session, we plan to hold one annually so you will have a chance in 2016. The DR Task Force is once again being chaired by Leif Rosseland and we will start planning the topics for this year’s sessions in January. If there is a topic you would like to see presented, please reach out to Leif or Colleen at the Association.
