PUBLIC POLICY AND ADVOCACY

WOCN SOCIETY 2023 YEAR IN REVIEW

Advocating for our profession and the patients we serve is the heartbeat of the WOCN Public Policy and Advocacy mission. In 2023, our commitment to driving change through advocacy has resulted in continued success. WOCN is steadfast in its dedication to advancing legislative and regulatory action that underscores the benefits of WOC nurse involvement in areas such as pressure injuries, acute and chronic wounds, ostomy, and continence care. Let’s shine a spotlight on highlights from our 2023 advocacy success:

Implementing Legislative Success

After WOCN had successfully advocated for the inclusion of two important Congressional policy priorities in 2022: The Lymphedema Treatment Act and The Better Wound Care at Home Act. The organization had to pivot to ensure that these legislative victories were implemented during the regulatory phase of policymaking. Starting in January 2024, Medicare will cover compression therapy for the treatment of Lymphedema. The final rule determining coverage set forth that Medicare will cover the following: • Standard and custom-fitted lymphedema compression treatment items for each affected body part, including: ͸ Compression garments, including those for daytime and nighttime, which offer different levels of compression ͸ Compression bandaging systems and supplies provided during the initial decongestion phase and maintenance phases of treatment ͸ Gradient compression wraps with adjustable straps ͸ Necessary accessories for gradient compression garments and wraps, including: • Aids for putting on and taking off (donning and doffing) items for different body parts, like lower limb butlers or foot slippers that help patients put on compression stockings • Fillers • Lining • Padding • Zippers • Medicare will cover these items in the following frequency: ͸ Daytime: 3 garments per affected body part every 6 months ͸ Nighttime: 2 garments per affected body part every 2 years • Medicare will also pay for the following items as needed: ͸ To replace lost, stolen, or irreparably damaged items ͸ If a patient’s condition changes, like a change in limb size • Medicare beneficiaries are eligible for coverage if: ͸ The patient has Medicare Part B coverage (their annual Part B deductible and 20% coinsurance will apply) ͸ The patient has lymphedema (a chronic condition that causes swelling in the body’s tissues) and will use the item to primarily and customarily treat it ͸ An authorized practitioner prescribes the item Passage of the Better Wound Care at Home Act will help smooth the implementation of the Medicare home health benefit for disposable negative pressure wound therapy (NPWT) to remove cumbersome billing and reporting regulations on the home health agencies (HHAs) and nurses. Starting in January 2024, NPWT services will be reported on the standard Medicare Home Health claim. The nursing visits associated with this care will be considered as any other nursing visit and will be reported on the claim and reimbursed under the HIPPS code payment. Thank you to all our members who have taken the time to reach out to their members of Congress and the Centers for Medicare & Medicaid Services to advocate for these bills over the last few years, your advocacy has paid off. Advocating for our profession and our patients is a priority for WOCN and we will continue to push for health policy objectives that achieve those goals.

Advocating for Increased Supplies in State Medicaid Programs

In response to member requests, WOCN has engaged with stakeholders in multiple states to increase the maximum allowable for ostomy supplies in their Medicaid program. Recently, WOCN and UOAA sent a joint letter to the New York Medicaid Administrator expressing concerns about how recent changes in how the state is administering ostomy supplies to beneficiaries are impacting patient access to those supplies. New York responded to our request and has agreed to work with us to ensure beneficiary access to supplies. The state has also agreed to revisit their reimbursement and quantity limits for ostomy supplies and the Society will be sending them our recommendations. Similar efforts are underway in other states across the country to ensure that state Medicaid programs are covering ostomy supplies that meet or exceed Medicare minimums.

WOCN Continues to Push for Coverage of Supplies for Spontaneous Fistula

WOCN continued our conversations with CMS to push for Medicare coverage of supplies for spontaneous fistula. WOCN members expressed growing concern over the lack of access to supplies for patients who have nonsurgical and surgical-related fistula. These groups of patients are falling into a coverage gap that exists in postacute, post-home care with access to supplies. This issue has been noted in patients both pediatric and adult. Our Policy paper on fistula which outlines the plight of our patients will be transformed into an infographic as part of our communication to politics as we pursue efforts to close this coverage gap. WOCN continues to work in collaboration with other stakeholders on working with Congress seeking legislation to change coverage policy so patients have access to these important supplies.

Collaborations. United Voice. Forward Movement.

WOCN continues to seek organizations and coalitions that have a like-minded focus to support our practice and the care of our patients. Over the last year, WOCN has: • Continued a strong relationship with the Alliance of Wound Care Stakeholders and the Access to Care Coalition. These groups actively pursue regulatory concerns that impact supplies for our patients. In 2023, the Alliance persuaded CMS to delay and re-evaluate the problematic CTP provisions in the 2023 Physicians Fee Schedule Final Rule which would have reclassified all cellular and tissue-based products for wounds (CTPs, or skin substitutes) as “supplies incident to a physician service,” and packaging payment into practice expenses. In addition, the Alliance pressed CMS for greater transparency and uniformity in the development and implementation of coverage issues and the use of the Carrier Advisory Committees by meeting twice with CMS senior staff. • Continued our work with Access and Care Coalition including working with CMS and the DME contractors to advocate for a more streamlined process to ensure ostomy patients who exceed the supply limits can access additional supplies with reduced burden. • Worked closely with the United Ostomy Associations of America, Inc. (UOAA). UOAA has initiated an Ostomy Quality Campaign, with the Ostomy and Continent Diversion Patient Bill of Rights being a campaign foundation. WOCN has been an ardent supporter of the Patient Bill of Rights and encourages all WOC nurses to utilize this document in their everyday practice. Work also is underway to try to address the Non-Medical switching of supplies that occurs each day to our patients. • Continued to be an active participant in the Nursing Community located in Washington DC. The Community consists of numerous nursing-based organizations that weigh in on legislative, policy, and regulatory issues. Most recently the WOCN Society and the WOCNCB collaborated in supporting House and Senate legislation on the I CAN ACT which protects the full scope of practice of nursing.
