he Bank of Canada’s recent announcement to hold its interest rate target at one per cent does not come as a surprise. The rate has been holding at that level since September 2010, which is good news if you’re in the market for a mortgage. There are many excellent mortgage products available from banks and brokers that will suit your individual needs, and could well be lower than posted bank rates, which are currently hovering around three per cent for a variable rate. With a pre-approval in hand, you’re protected if rates rise; if they go down, you’ll likely get an even lower rate. A pre-approval can be a win-win situation for shoppers, since it means you don’t have to wait to get financing

approval on a home when you put in an offer. This is an especially good tool to have when markets are hot. Removing the “conditional on financing” clause could mean your offer is accepted first since you already have your financing in place. So when will rates rise? It’s anyone’s guess, but most experts agree it’s unlikely there will be any significant movement until mid 2014 at least. However, we can’t assume that will be the case, and you shouldn’t wait too long to get pre-approved for a mortgage. It can take a few days. Many lenders offer online pre-approvals to make the process faster and easier. Start the spring season off right by taking advantage while you still can.

Indeed, spring is always busy season in the housing market, and this year, despite some recent “cooling” in some areas and housing types, should be no different. Fairer weather and stillfavourable mortgage rates should point to the sales pace continuing in the coming weeks and months. Need proof? and model homes. A combination of factors – including land availability and affordability – is restricting supply of single-detached homes, in particular, at the moment. If you have just bought a new home or business in Ontario, you might know this from paying development charges (DCs). DCs are used by municipalities to pay for new, growth-related infrastructure such as bridges, sewers, libraries and other public services. These charges are paid by new-home buyers within the final purchase price of a new home or business. Did you know that you also pay HST on DCs? Since DCs are part of the final purchase price, that makes them HST applicable. Is it fair that new-home buyers in the GTA are essentially paying a tax on a tax? BILD and the Ontario Home Builders’ Association teamed up for the recent 80-day public consultation over the Development Charges Act. We collaborated on a solutions-oriented set of recommendations on behalf of new-home buyers and industry professionals.

The province, municipalities and development industry rely heavily on new neighbours. They deserve to be treated properly for their role in keeping our economy moving.

One of the recommendations in the submission to the province was that our leaders should change the name of the Development Charges Act to the “New Neighbours Tax Act” to provide clarity to Ontarians about the purpose, intent and cumulative effect that these charges have on families being able to afford a new home or business in Ontario. According to a study by the Altus Group, a Toronto-based global real estate consultant, more than one-fifth of the cost of a new home is made up of government fees and charges, of which DCs make up the most significant portion. In the six municipalities that the study looked at, DCs have increased between 143 and 357 per cent since 2004. We believe new neighbours already do their fair share. They contribute about $1 billion in development charges every year to GTA municipalities. We also think new neighbours deserve accountability, so I’d like to present three solutions that give them what’s deserved. Firstly, each municipality’s DC reserve fund should have a yearly public meeting to inform new neighbours about the infrastructure their payments contributed to. These meetings should cover construction schedules and estimated completion times for all projects that receive DC funds. Ideally, the province would pass a law to make these meetings mandatory. Secondly, to eliminate uncertainty and the burden of an unexpected DC increase, we have also recommended that the province makes it compulsory for municipalities to set up DCs in a transition phase before a new DCs bylaw is introduced. The framework would give new neighbours the information so they can be secure in their finances. Thirdly, as experts of this industry, we feel that our association would be most qualified to assist in the creation of a best practices manual related to DCs in partnership with the province and municipalities so that we can be even more effective at building quality, complete communities. The province, municipalities and development industry rely heavily on new neighbours. They deserve to be treated properly for their role in keeping our economy moving. make this decision a little easier by introducing the Ontario Builder Directory, which replaces the former Licensed Builder Directory. These changes are part of an ongoing process of identifying and providing information that helps consumers who are researching a new home builder. The new directory continues to show a 10-year history for all builders, but the listings will now include builders who are no longer registered. The directory will confirm whether a builder’s registration has expired or whether Tarion has revoked their registration or refused to renew it. This is an important consumer protection tool, particularly in regards to illegal building, as many of our investigations are focused on builders who are no longer registered. Buyers will now be able to quickly and easily confirm that those builders are no longer licensed to build homes in Ontario. The directory shows if a builder has been a Tarion Award of Excellence finalist or winner in the past three years; a breakdown of the types of homes built over a 10-year span into freehold homes and condominium units; and lists the names of officers and directors for each company, providing links to companies that share the same officers and directors. The directory continues to show a 10-year history that includes chargeable conciliations and the number and amounts of certain claims paid by Tarion.

A chargeable conciliation occurs when Tarion conducts a conciliation inspection and determines that one or more outstanding items are covered under the warranty but have not been resolved by the builder. Not all chargeable conciliations result in a claim paid, as builders have an opportunity to make a repair after the inspection. Homes with claims and dollars paid in claims refer to situations where the builder did not resolve a homeowner claim and Tarion stepped in to work directly with the homeowner to resolve the issue. Buyers may want to consider these numbers in comparison to the number of new home possessions in the builder’s profile. When buyers ask for advice on how to choose the right builder, I suggest they start their research by visiting the directory. Buyers need to make sure their builder is licensed, which means they have satisfied Tarion’s licensing criteria and have proven their technical and business competencies. And the directory will give you a good idea of your builder’s past performance. The next step is to ask around. You may want to walk around neighbourhoods where the builder has built, and inquire about these homeowners’ experiences. Speaking to other homeowners will give you a good indication of whether the builder stands behind his construction and is attentive to customers over the long term. Most homeowners are happy to talk about their home and their builder. You can also ask for references in online communities and social media platforms. There are a number of active homerelated sites where homeowners share experiences about everything from décor selections to construction delays and after-sales customer service. If there’s one piece of advice I give most often to buyers who are just starting to think about a new home purchase, it’s research. All too often I hear stories of buyers walking into a model home, being dazzled by the stylish décor and gleaming countertops and signing on the bottom line before researching who built that beautiful home. Your home will most likely be the largest purchase of your life, so you owe it to yourself to take the time to thoroughly research your decision. Amid all the ongoing talk of mortgage rates, market conditions, high levels of household debt and economic uncertainty, good news comes from RBC Economics Research’s latest Housing Trends and Affordability report. After two straight quarters of modest deterioration, housing affordability improved mildly in Canada in the fourth quarter of 2013, thanks primarily to income gains and still-low mortgage rates. “The relative strength in income gains in Canada offset the minor increase in homeownership costs in the final months of 2013, meaning that homes were more affordable for those looking to buy,” says Craig Wright, senior vice-president and chief economist, RBC. The RBC report notes that household incomes outpaced a modest rise in mortgage carrying costs associated with buying a home at market value in the fourth quarter, which contributed to the improvement in affordability. Easing price gains in most markets across the country and marginal increases in mortgage rates kept the rise in mortgage carrying costs subdued. The way RBC’s affordability measures work is, the higher the measure, the more difficult it is to afford a home. For example, an affordability measure of 50 per cent means that homeownership costs, including mortgage payments,

utilities and property taxes, take up 50 per cent of a typical household’s pre-tax income. A decline in the measure represents an improvement in affordability. For the Ontario market, 
homeownership affordability eased by 0.1 percentage points for both bungalows and two-storey homes, and remained flat for condominiums in the fourth quarter of 2013. Owning a single-detached home at market value in the province continues to take a larger share of household income compared to the historical average despite marginal improvements for the first time in a year.
 For the Toronto market, specifically, affordability deterio-

What if your co-purchaser doesn’t qualify as first-time homebuyer? » by ALYSSA RICHARD

If you’re a first-tome homebuyer, you should be aware that there are credit and rebate programs available to you. Depending on where you live, there may be both federal and provincial programs that can help you enter the market and put money back in your pocket. Here’s a look at the programs you may be eligible for, and how they change if you and your co-purchaser don’t both qualify as first-time homebuyers. Federal programs The first program is the First-Time Home Buyers’ Plan (HBP), which allows eligible Canadians to withdraw up to $25,000 from their RRSP tax-free for a down payment. If only one of you is a first-time homebuyer, you can still withdraw this amount, so long as you have not lived in a home owned by the other buyer within the past four years. If both qualify as first-time homebuyers, you can withdraw a combined $50,000. There is also the First-Time Home Buyers’ Tax Credit (HBTC). So long as you can show $5,000 in eligible expenditures (including your land transfer tax), you will receive a $750 rebate with your next income tax return. In order to qualify, however, neither you nor your co-purchaser can have lived in a home that one of you owned in the past four years. Provincial programs In Ontario, qualified buyers may be eligible for the Ontario Land Transfer Tax Refund for First-Time Homebuyers, up to a maximum of $2,000. If one of you has owned a home before, the other can still claim half ($1,000).

In Toronto, qualified first-time buyers are also eligible for a rebate of the Toronto Land Transfer Tax, up to a maximum of $3,725. Again, if one of you has owned a home before, the other can still claim half of this refund ($1,862.50). Elsewhere in the country, both purchasers have to be first-time homebuyers in order to qualify for any provincial programs. Homebuyers in British Columbia and Prince Edward Island can face a hefty property transfer tax. Unfortunately, neither you nor your co-purchaser can claim a rebate of it, if one of you is not a qualified first-time homebuyer. In Saskatchewan, the First-Time Homebuyers’ Tax Credit provides a tax credit of up to $1,100 to first-time homebuyers, so long as neither you nor your co-purchaser have owned and lived in another home in the past four years. Finally, the Nova Scotia First-Time Home Buyers Rebate helps buyers get back 18.75 per cent – to a maximum of $3,000 – of the provincial portion of the HST on new homes. To claim the rebate, neither of you can have owned a home in Canada in the last five years.

Brampton offers

NEW NEIGHBOURS ACCOUNTABILITY AND TRANSPARENCY The Ontario Home Builders’ Association (OHBA) applauds the City of Brampton for taking the first steps in providing greater transparency and accountability to new neighbours. The Capital Project

Finance Review – Status Report supports OHBA’s recommendations for greater fairness and accountability when allocating a New Neighbour Tax for community infrastructure projects. “Brampton has done a service to new neighbours – new-home owners and new employers – by issuing this status report and other municipalities should follow their leadership,” says OHBA CEO Joe Vaccaro. “New neighbours have a right to know where their taxes are being spent on approved community-growth projects. Brampton is heading in the right direction, ensuring that new neighbours are treated with fairness.” The Brampton report identified more than $800 million of approved but unspent capital funds, with 68 per cent generated through the New Neighbours Tax (development-related). The OHBA consultation document noted that new neighbours already pay their fair share to municipal, provincial and federal government for growth-related projects and contributed more than $1.8 billion to municipalities through development charges in 2012. This is an increase of

40 per cent from the previous year and doesn’t include any additional charges municipalities lay on new residents (such as Section 37, Parkland Dedication cash-in-lieu and voluntary charges). The OHBA report stated that municipalities often don’t spend money collected from new residents on projects necessary to supporting growth. “Growth pays for growth, but more often than not, new neighbours are unaware of what they are paying for in their communities,” says OHBA President Eric DenOuden. “We are recommending that the provincial government develop a transparent system that holds municipalities responsible for how these funds are being allocated and hold them accountable if they are mismanaged. OHBA believes that affordability and fairness is the key to the success of this province and new neighbours deserve to understand where their taxes are going. The City of Brampton Report is the first step in creating this system.”

As we progress further from the financial crisis of a few years ago, economic slowdown, stock market and even real estate declines, things are looking brighter for many Canadians. Canada survived the recession; though there are still some challenges, spending is up, stock markets have arguably rebounded and the real estate market has shown longer-term price and sales increases. Many economists predicted real estate price declines, and few expected price increases and such a quick recovery. Homebuyers who were counting on further price declines may have been kicking themselves. How long will this continue, you ask? It’s anyone’s guess. Finance Minister Jim Flaherty has, on occasion, given notice he is concerned about a potential overheating of the real estate market. Borrowers must meet the requirements for a five-year, fixed-rate mortgage, even if they plan to choose a shorter term and lower rate. The maximum amortization period for government-insured mortgages was recently reduced to 25 years from 30. In addition, Canadians can now withdraw in refinancing only 80 per cent of their home’s value, down from 85 per cent, while down payment requirements

remain at five per cent for primary homes and 20 per cent for investment properties. Some experts feel these changes may leave some first-time buyers sitting on the sidelines. However, these issues should not be the primary factors to influence your decision to buy. Some considerations to reconcile before making the plunge include: » How much of a house can you afford to purchase? Get pre-approved by your bank before shopping » How much of a house do you want to afford? The answer is not necessarily to purchase the maximum house you qualify to buy, but what you want to afford » What will your payments be, if interest rates rise (and they definitely will) one, two or three per cent? Ensure you can easily afford the increase » First-time buyers of new homes priced at less than $425,000 will be minimally affected by the HST. Generally, there are no real estate commissions for the purchaser of a home. Legal fees are not usually high for a purchase and are minute in the grand scheme of purchasing a home At the end of the day, a home is a long-term investment, so look beyond the next year or two.

Matthew

Matthew was born in August 2012, three weeks prematurely. At 30 weeks gestation a routine ultrasound showed fluid in his abdomen. Matthew’s mom, Gillian, was transferred to the high risk unit at their local hospital. Their doctor there suspected that Matthew had meconium peritonitis, a rupture of the bowel. This is rarely seen in babies in utero, but is associated with babies who have cystic fibrosis. His parents were tested and learned that they carry the gene for cystic fibrosis. This came as a total surprise to them as there is no CF in their families. At birth, Matthew had a blood test and was confirmed to have CF and presented with the “classic” form – the delta gene. He was transferred to SickKids and had surgery to unblock his bowel on his first day of life. He

had some complications, and spent six weeks at SickKids. Shortly before Christmas, he had a second surgery and was in hospital for three days. Matthew’s condition has already affected his pancreas and although it has not yet affected his lungs, his parents expect that it will as he develops and grows. They do physiotherapy with him daily to keep his lungs as healthy as possible. “It’s the worst feeling watching your child fight to get better,” says Gillian. “But despite his condition, Matthew’s been a happy boy providing us smiles.” Matthew’s parents decided that they want to do everything they can to help advance research. They met Dr. Felix Ratjen, head of respiratory medicine and co-director of the Cystic Fibrosis centre, who spoke to them about CF stem cell research and they readily agreed to allow SickKids to take a sample of Matthew’s skin when he came to have his surgery in December. “You can’t do anything to help other than be there and love them unconditionally. There were really two reasons behind participating in the research study: a little hope and a lot of fear. My optimistic side would say a lot of hope,” says Gillian. Last year, SickKids researcher, Dr. Janet Rossant and her team became the first in the world to use skin cells from patients with CF to produce mature lung cells in a petri dish. Lung cells generated from patients can be used to develop and test drugs that target the genetic mutation underlying the condition. If the drugs work on the lung cells, then later they may also be tried on the patient. Until recently, the only therapies available for patients with CF targeted the symptoms, like infection and digestive disorders, rather than the underlying genetic alteration.

One of the most serious issues facing a homebuyer and it doesn’t matter whether you buy a house, apartment, townhouse, new or resale, is the Agreement of Purchase and Sale or Offer. Over the last few months, I’ve had a number of people bring me their Offer long past the time when they can have a lawyer comment on it, and they were stuck with the terms and extra expense. Let’s review a couple of things. CONDOMINIUMS The Condominium Act provides that you have 10 days from the date you receive the disclosure statement and the date you receive an Agreement of Purchase, executed by the builder, to rescind the deal. This gives you an opportunity to see your lawyer, get suggestions, changes and explanations, and then within the 10 days, return to the sales office and negotiate for those important items that are usually left open. NEW FREEHOLD HOMES, RESALE HOMES AND RESALE CONDOS No

time is allowed after you sign, unless you have ensured that there is a schedule or clause making the transaction conditional for a given period of time on your lawyers review and approval, or other conditions. Here are a number of items, primarily for new homes, to look out for so you have an idea, but recognize this is not a comprehensive list, just a sampling: 01. Hydro and water installation and subdivision charges – get written maximums put in; 02. Development charges and levies – get deleted or written maximums; 56 NEW HOME GUIDE GTA | MAR 22 - APR 5, 2014

03. The vendors lawyers’ Law Society Levy – get it deleted – you pay yours, they can pay theirs; 04. Driveways – they say it is paved, does that mean base and finish coat or only a base coat?; 05. Damage deposits – get a maximum and make sure there is a process for obtaining a refund; 06. Mortgage clauses – a re you stuck with the builder’s mortgage and terms? – is there a clause requiring you to accept the builder’s lawyers undertaking to discharge the mortgage without a discharge statement or direction to pay funds to the lender? – is the builder trying to make you pay to obtain partial discharges of a blanket mortgage; 07. Condos – do you own your parking and storage locker or is it only exclusive use?; 08. Ensure you get a chance to review the status certificate and any reserve fund issues; 09. Survey – who pays? When do you get it? 10. Extensions – how long? Have you selected your option under Tarion for new homes? 11. Title – is there a clause that says you have to accept the builder’s undertaking to give you a deed if one is not available on closing; 12. W hat about home inspection and inspections prior to closing?; 13. Ensure you are getting the appliances and fixtures you think you are. There are many more issues that arise in an Agreement of Purchase and Sale or Offer. This document is the most important in the whole process because it sets the rules for you and the vendor. This becomes critically important when you realize that you need independent legal advice that will properly help you deal with this document. Only a lawyer can do this. Perhaps the most difficult part of writing these articles relates not to the actual writing, but thinking of a topic to address. Bank of Canada MAINTAINS OVERNIGHT

RATE TARGET AT ONE PER CENT The Bank of Canada has once again maintained its target for the overnight rate at one per cent. The

bank rate is correspondingly 1.25 per cent and the deposit rate is 0.75 per cent. Both total CPI and core inflation in Canada are still expected to follow roughly the path outlined in the January Monetary Policy Report, although recent readings were slightly higher than expected. Excess supply in the economy and competition in the retail sector will likely keep inflation well below the two-per-cent target this year. The global economy is evolving largely as anticipated, with growth expected to strengthen in 2014 and 2015. The United States is still expected

to lead the acceleration in advanced economies, although recent data have been softer, largely owing to weather effects. Volatility in global financial markets has increased somewhat, reflecting buoyant market conditions in most advanced economies and increased risk differentiation among emerging markets. More recently, tensions in Ukraine have added to geopolitical uncertainty. In Canada, economic growth in the fourth quarter of 2013 was slightly stronger than the Bank anticipated, and upward revisions earlier in the year further raised the level of GDP. The Bank still expects underlying growth of around 2.5 per cent in 2014, with the current quarter likely to be softer. Exports have been a little stronger than previously thought but continue to under-perform, and overall business investment has yet to pick up. Meanwhile, recent data support the Bank’s expectation of a soft landing in the housing market and stabilizing debt-to-income ratios for households.

The global economy is evolving largely as anticipated, with growth expected to strengthen in 2014 and 2015 On the whole, the fundamental drivers of growth and inflation in Canada continue to strengthen gradually, as anticipated. With inflation expected to be well below target for some time, the downside risks to inflation remain important. At the same time, the risks associated with elevated household imbalances have not materially changed. The Bank judges that the balance of risks remains within the zone for which the current stance of monetary policy is appropriate and therefore has decided to maintain the target for the overnight rate at one per cent. The timing and direction of the next change to the policy rate will depend on how new information influences this balance of risks. The next scheduled date for the overnight target rate announcement is April 16.

We obviously needed to eat, so we got lunch. Should we save the receipt for lunch to put as our expense for the year-end? Does that mean it would be tax deductible?

Answer: Meals and entertainment are tricky expenses, and subjective and confusing in practice. Plus, there are plenty of exceptions. Assuming that someone owns a few properties, and they are out of town a distance of 40 kms and you’re there more than eight hours (in some cases 12), then the meals are more likely deductible. Alternatively, if you are having a meal with a prospective tenant, supplier or accountant, then there are no time or distance restrictions – they are deductible, as there is a clear business purpose. The primary issue in Canada Revenue Agency’s mind is similar to what you indicated in your question. You obviously had to eat, so the CRA is saying “Why should real estate investors get to deduct their meals at work when nobody else does?” Practically speaking, I don’t think it hurts to do this now and again, but this would be an administrative concession from the CRA, as compared to a technical ability to make the deduction.

Tis the season for spring cleaning! But just because they call it “spring cleaning” doesn’t mean you have to do it all in one weekend, or in one season for that matter. It can take a

PLAN BEFORE DE-CLUTTERING Before beginning any de-cluttering project, determine in advance how you will dispose of the items you no longer want. If you have valuable pieces and would like to sell them, decide whether you will do this yourself or hire someone to do it for you. If you would like them to go to charity, which one is it and where is it located? Some charities will pick up, so call them to find out when they will be in your area. It’s not until those boxes and bags leave your home that you will reap the full rewards of de-cluttering. Planning in advance will curb procrastination and ensure full completion of the task.

WHERE TO START? One of the most common questions I get asked when it comes to getting organized is, “Where do I start?” Picking a place to begin can often be the biggest obstacle to de-cluttering, immobilizing us from taking action. Think about what you are making room for. If your goal is to unload some “financial burdens” the logical place to start is the home office where the financial papers are piled. If your goal is to have more romance in your life, it would make sense to start the organizing process in the bedroom.

BEGIN WITH THE “NO BRAINERS” Toss old newspapers, things that are broken or have missing parts and clothing items that are permanently stained or damaged. If you can devote 10 minutes a day to this process (even the busiest person has 10 minutes a day), you’ll be amazed at how much progress you can make in just one week. The important thing is to block out time every single day to do it.

If you can’t quite bring yourself to let go of certain items, even though you aren’t using them, consider packing them in a box and writing a “best before” date on it six months away. Put this date on your calendar as a reminder. If you don’t go into that box again before the expiry date, donate it to charity without opening it again. This provides you with a cooling-off period, making it easier to detach. EMPTY SPACES RESULT IN SMILING FACES When reorganizing a closet, a dresser or a cupboard, empty it out first. It’s motivating to see the space empty and this will give you immediate gratification. You are also likely to sort through the contents more thoroughly. However, when organizing a large area, empty only a section at a time, sort it and then move on to the next section. OVERCOME PROCRASTINATION If you’ve got an unfinished project hanging over your head but can’t seem to motivate yourself to work on it, take a moment to think about what the payoff of completion would be. Write down three benefits you’ll receive by completing that particular project and keep this where you’ll see it throughout the day.

Follow these steps to see if you’ll qualify for a mortgage on your dream home

Calculate the combined monthly before-tax income of you and your spouse. Divide by three. This figure is the monthly payment you can afford to make on your home. Take the total price of the home and subtract the amount of money you expect to make as a down payment. This is the money you will have to borrow.

Refer to the chart on the opposite page. Look down the left column and locate the interest rate you expect to pay. Line this up with the amortization period of your choice. (Most firsttime buyers take the 25-year amortization.)

Add to this your estimated monthly heating costs and monthly property taxes. If this figure is equal to or less than one-third of your gross monthly income (calculated in Step 2), you’ll qualify for a mortgage on your dream home.

Multiply this figure by the amount you need to borrow. Divide by 1,000. » Bear in mind that this is a rough estimate. If you have several other large loans already, you may qualify for less. Also, banks and trust companies vary in their policies. The best way to know what you can afford is to go to the lending institution of your choice andget pre-qualified.
